A settlement between Wm JONES Clerk of this Court and Solomon JOBE Guardian to the minor heirs of A MELSON decreased was this day submitted to the Court which was confirmed by the Court and ordered to be recorded

A settlement between Wm. JONES Clerk of this Court and William THORNTON Guardian to Wm R DUNCAN was this day submitted to the Court which was received by the Court and ordered to be recorded

Washington CARTER et al§ Ex Parte Petition to Sell Slaves
Be it remembered that this cause came on for a further hearing before the worshipful county Court of Wayne County Tennessee on this 5th day of January 1852 upon the report of the Special Commissioner appointed [by – crossed out] at a former term of this Court which said report is in the words and figures following to wit
“The undersigned who was appointed to sell the slaves belonging to the Estate of Robert N MACK deceased (mentioned in the pleadings in this cause) by a decreetal order of your worshipful Court would submit the following Report
That on the first day of January 1852 he proceeded to sell said negroes pursuant to notice previously given as be said decretal order directed when said slaves were struck off and sold to Bennet COLE at the following prices the same being the highest and best bids to wit Lucy [or Levy/] at the price of $700.50 Hannah at the price of $476.50 and Lewis? at the price of 334.50 $1511.50 making in the agregate the sum of fiften hundred and eleven dollars and 50 cents and said Benet COLE executed his bond for the sum payable twelve months after this date thereof with James ARNETT as his security who is deemed good and sufficient All which is Respectfully submitted Jany 5 1852 //s// John McDOUGAL Comm’r”
Which being in no wise excepted to it is considered by the Court that said report be and the same is hereby in all things confirmed all other matters being reserved &c.

This day came John C. BLACKBURN Jesse S. ROSS Solomon JOBE Eli BYNUM James GRANT King PRATER and Elijah WARRINGTON who were appointed a jury of view at the December Term 1851 of this Court to view and mark out a second class road from the Turnpike road at or near the head of Eagle Creek to Carrollville in Wayne County and reported a road found as directed in the order issued from this Court whereupon the petition of Jonathan C ELLIOTT and thirty six others were presented in opposition of said road and proof being also heard by the Court as to the practicality and utility of said Road [It was considered by the Court that it is not practical to establish said Road – crossed out] Whereupon on motion to concur in the report of the Jury of view and establish the Road those who voted in the affirmative are David J JONES Chairman Solomon JOBE & W CARTER 3 those who voted in the negative are W HAYES W M LAFFERTY

A MONTAGUE J. C. G. WILSON J. P. VOORHIES J MONTAGUE & G HERRAN Noes 7 so said motion [road – crossed out] was lost Whereupon on motion it is ordered by the Court that Eli BYNUM John C. BLACKBURN and Solomon JOBE be made parties to this suit whereupon the said Eli BYNUM John C. BLACKBURN and Solomon JOBE pray an appeal to the next term of the Circuit Court of Wayne County Tennessee which is granted them they having entered into bond and security according to law.

A majority of the Justices of the peace of Wayne County present the Court proceeded to Levy a County Tax for said County and on motion of Lay said Tax of ten cents on [the evry – crossed out] each hundred dollars worth of Tax able property and twenty five cents on each Poll and fifty percent on the State Tax for all privileges for said County purposes and [A majority of – crossed out] the Justices aforesaid voting in the affirmative the motion carried and said Tax was Layed

Came William THORNTON Guardian to Wm R DUNCAN minor heir of William DUNCAN Dec’d into Court and renewed his bond in the sum of two thousand dollars with Brinkley HOPSON his security which was approved of by the Court and ordered to be recorded

A majority of the Justices of the peace present the court proceeded to elect a Tax Collector for the present year 1852 Whereupon Thomas H MABRY was duly and lawfully elected

Came William RAY who was this day appointed administrator of the Estate of Stephen S RAY deceased and entered into bond in the sum of two hundred dollars with Albert G CLAY and George E. HUCKABY his securities which was approved of by the Court and ordered to be recorded Whereupon the said Wm RAY took the necessary oath for his qualification

A majority of the Justices present the Court proceeded to elect a Quorum for the present year 1852 and Whereupon David J JONES was duly Elected Chairman of said Court and Abraham MONTAGUE and Lewis B. GANT his associates to hold the Quorum County Courts for the twelve months next ensuing

Came Leonard H GRIMES who was this day appointed Guardian to the minor heirs of Elihu S GRIMES deceased and entered into bond in the sum of one hundred dollars with Bennet HALE and Isaac W ROSS his securities conditioned for the faithful performance of said Guardianship whereupon the said L H GRIMES took the necessary oath for his qualification

Upon the petition of John JACKSON it is ordered by the Court that the Sheriff of Wayne County summons a Jury not to consist of less than five nor more than twelve freeholders and unconnected with the parties therein Concerned to View and mark out a change in the road of second Class leading down forty eight mile Creek so as to leave the old road oposite John JACKSONs Jr field near the rock quarry and intersect the same about one fourth mile below and that they report the same to the April term of this Court Issued Febr 2, 1852

Ordered by the Court that Wm BURRIS be appointed overseer of the road of second Class in the place of Litle CHOAT and that he have the hands in the same bounds to work under his direction Iss. Jan. 8, 1852

Ordered by the Court that John RUTLEDGE be appointed overseer of the road of second Class in the place of Marcus COOK removed and that he have the hands in the same bounds to work under his direction. Iss’d Jan 8, 1852


Upon motion it is ordered by the Court that David MITCHELL and all the hands above him on Mitchells branch be released from working on the Waynesboro and Savannah road and that said hands and all in that bounds work on the road [under – crossed out] from the Turnpike road on Eagle Creek to the Stage road on Hardins Creek under George H REA

Ordered by the Court that John FUSON be appointed overseer of the road of first class in the place of Bethel FUSON and that he have the hands in the same bounds to work under his direction Issued Jan 8, 1852

Ordered by the Court that John H. EAST be appointed overseer of the road of first Class in the place of Isaac MORRIS and that he have the hands in the same bounds to work under his direction Issued Jan 8, 1852

Upon motion it is ordered by the Court that Abraham MONTAGUE and James ANDERSON be appointed County Commissioners for Wayne County to settle with the revenue officers for the year 1852

Ordered by the Court that Wm H HILL be appointed overseer of the road of second Class in the place of Elijah MATHENY and that he have the hands in the same bounds to work under his direction Issued Jan 21, 1852

Came James HOLLIS Administrator of the estate of Thomas GIST deceased and suggested to the Court in writing the Insolvency of said estate alledging that there has been more claims presented against said estate than there are means to pay [the Court – crossed out] and prays the court to make such orders in the case as is required by the laws in such cases It is therefore ordered by the Court that the said James HOLLIS Administrator as aforesaid give notice by advertisement in the Messenger a newspaper published in the town of Lawrenceburg in the State of Tennessee for 3 successive weeks the last of which shall be three months before the first Monday in January 1853 and also at the Courthouse door in the town of Waynesboro in County of Wayne in said state notifying all persons having claims against said estate to appear and file their claims with the Clerk of the County Court of Wayne County Tennessee duly authenticated on or before the first Monday in January 1853 or the same will be forever barred

GANT it is ordered by the Court that the Sheriff of Wayne County summons a Jury of View to consist of not less than five nor more than twelve freeholders & unconnected to the persons concerned to view and mark out so as to change the road of second Class leading up Indian Creek leaving the old road below said GANTs plantation and runn up on the west side of said Creek and intersect the same near the forks of the road above said GANTs plantation and that they report the same to the April term of this court Iss’d Febr 8, 1852

A Settlement between Wm Jones Clerk of this Court and James M RAMSEY Administrator of the estate of John N SHIELDS dec’d was this day submitted to the court which was confirmed by the Court and ordered to be recorded

Upon motion it is ordered by the Court that David J JONES Abraham MONTAGUE & George W BARKER be appointed Commissioners [to super – crossed out] to superintend the Poor house in [said – crossed out] Wayne County for the year 1852 and that David J JONES be appointed Treasurer of said board of Commissioners Whereupon the said D J JONES entered into bond in the sum of one thousand dollars with A MONTAGUE his security which was received by the Court and ordered to be recorded Whereupon the said D J JONES and A MONTAGUE took the necessary oaths for their qualifications

Where as at the july term of this Court the Court made an appropriation to A MONTAGUE an Jonathan MORRIS the sum of two dollars and fifty cents each for their services as Comm’s settlement with the County Trustee the year 1851 And where as it was omitted and not put on the minutes of said Court it there fore ordered by the Court that it appear on the minutes now as for then. Those who voted in the affirmative were D J JONES Chr. The last will and testament of William W GRIMES deceased was this day duley[sic] proven in open Court by the oaths of J C ELLIOTT and George W BROWN both subscribing witnesses there to which was rec’d by the Court and ordered to be recorded And where upon the Court ordered that Leonard H GRIMES the executor there in named have letters without giving bond as directed in said will where upon the said Leonard H GRIMES took the necessary oath for his qualification

Came into Court James H McLEMORE Guardian to Joel McLEMORE and renewed his bond in the sum of two thousand dollars with James C WHITAKER and John WHITAKER his securities which was received by the Court and ordered to be recorded

Be it remembered that this cause coming on for a further hearing this 4th day of August 1851 upon the Report of the Clerk & Master of this Court which is in the words & figures following to wit:
“The undersigned Clerk of the County Court of Wayne County, Tennessee who was directed to sell certain Salves mentioned in the pleading in this cause by a decree of the Worshipful County Court of said County of Wayne at the June Term thereof for the year 1851, begs leave to make the following Report
That after advertising said Salves as directed in said decree he sold said slaves to the highest bidder on a credit of twelve months at the court house door in Waynesboro on the 7th day of July 1851 and Cary W POPE because the purchaser of the Boy Wiley at the price of seven hundred and thirty one dollars & fifty cents And Clayton THARP became the purchaser of the Girl Sibba at the price of Three hundred & fifty dollars who executed their notes with good security for said sums of money respectively and retained a lien on said slaves until said purchase money is paid
All which is respectfully submitted August 4, 1851 //s// William JONES Clerk Which being in no wise excepted to it is considered by the court that said report be and the same is in all things confirmed.

Whereas satisfactory evidence has been exibted[sic] to the Court here that Robert CYPERT Late of said County is dead and was before death a United State pensioner and that he died on the 28th day of January 1851 it is therefore ordered by the Court that the Clerk of this Court Certify accordingly Came James HAGGARD who was at the January term 1851 of said County Court appointed Commissioner to take and make out in writing an accurate and complete list of the number of free white Male inhabitants who are twenty one years old and over and returned his list accordingly the aggregate of which is Thirteen hundred and seventy one verified by his oath which was received by the Court and ordered to be recorded
Upon motion to appropriate to Jesse S. ROSS and W CARTER each the sum of four dollars for their services as commissioners to sell certain lots in Waynesboro Those who voted in the affirmative were D J JONES, Chr. A majority of the Justices of the peace present John SHIPMAN presented in open Court the Scalp of a wolf over four months old and proved the killing of said Wolf in Wayne County by his own oath and said scalp was destroyed by the Sheriff according to an Act of the General assembly in such made & provided Issued to John SHIPMAN July 8, 1851
A majority of the Justices of the peace present William M HORTON presented in open Court the Scalps of five wolves under four months old and proved the killing of them in Wayne County by his own oath and said scalps was destroyed by the Sheriff according to an act of the General assembly in such cases made and provided Isued Aug 4th 1851

Be it remembered that this cause came on this day a further hearing before the Worshipful David I JONES William LAFFERTY W CARTER and others Justices &c. present and presiding upon the report of the Clerk & Master & special commissioner and report of the Surveyor & commissioners which reports being unexcepted to and in all things confirmed and are in the words and figures following to wit

James M RAMSEY et als Exparte§ The undersigned Clerk & Master and special commissioner in this cause would respectfully report to your Worships that in obedience to a decretal order made at your February term 1851 after having given the notice and upon the terms therein mentioned he on the 8th day of March 1851 [after having given the notice and upon the terms therein mentioned – crossed out] sold the lands mentioned in said order when Mary H. SHIELDS being the highest and best bidder therefor became the purchaser of all the said lands lying upon Green River and described in the petition in this cause in exhibits A & C subject to the dower of the said Mary H SHILDS[sic] at the sum of $50-00 [$50.00?] who executed her bond with Samuel R LAIRD security thereto payable twelve months

after date And Henry H HUNTER at the same time being the highest and best bidder therefor became the purchaser of the lands mentioned in said petition lying on Chalk Creek and described in exhibits B & D at the price of $214-00 who executed his bond for the same payable twelve months after date with John McDOUGAL security thereto both of which securities are decreed good and sufficient a lien being retained upon said lands until said purchase money is paid. State of Tennessee, Wayne County§ By order of the Court Court of Wayne County February term 1851 We Jesse S ROSS Surveyor Joseph EAST and John R HELTON Commissioners to allot and set apart to Mary H SHIELDS her dower out of the lands of John N SHIELDS her deceased husband after having understood the whole matter have proceeded to run and mark off 132½ acres as her dower beginning at the South West corner of James HELTONs 155 acres Entry Running South passing TURNERs So East corner at 2 poles in all 25 poles to a large poplar Thence East 32º South 32 poles to a Rock hickory and sweet gum pointers, Thence South 40 poles to a chesnut[sic] Thence east 10º south 126 poles to a stake Thence north 110 poles to the S B lines of A G McDOUGAL Entry Thence West on McDOUGAL & HELTON S B 175 poles to the beginning including the improvements lots dwelling houses &c being in our Judgement the one third part in value of the real estate of John N SHIELDS deceased died seized and possessed of Given under our hands this Feb 27th 1851 //s// Jesse S ROSS Surveyor Joseph EAST John R HELTON

It is therefore ordered and decreed by the Court that all the right and title to the use and occupation of in and to said land above laid out and allotted to said Mary H. SHIELDS be divested out of the said petitioners heirs at law of said John N SHIELDS be

T M WHITTON who was on the 27th Febr. 1851 duly and legally elected Constable of Wayne County by the qualified voters of the 10th Civil District thereof to fill the unexpired term of Lawson HAYS removed came into Court and entered into the following bond to wit

This day Matthew J SIMS presented to the Court his resignation to the office of Justice of the peace of the eight civil district Wayne County in writing which was received by the Court and ordered to be recorded

Notice was this day given to the Court by Katherine COPELAND widow of Jesse COPELAND Dec’d that she will apply at the August term of this court to have two freeholders appointed to apportion her dower

Ordered by the Court that Joseph HAM be appointed overseer of the road of 2d Class in the place of G R BIFFLE and that he have the hands in the same bounds to work under his direction Isued July 25th 1850

Came James ANDERSON who was at a former term of this Court appointed Administrator of all and singular the goods & Chattles rights and credits of Jesse COPELAND dec’d and suggested in writing the Insolvency of said estate it is therefore ordered by the Court that such publication be given as in by law in such cases required and that notice be given to all person having Claims against said estate to file them with the Clerk of this Court by the first day of January net duly authenticated as the law directs for prorate distribution[sic] or they will be forever barred

Came Joseph HOLT & others who was at a former term of this Cort[sic] appointed a Jury to view so as to change the Waynesboro & Florence Road by the plantation of Samuel LAWSON and report a change as directed in the order which was received by the Court and ordered to by[sic] recorded

A settlement between Wm JONES Clerk of this Court and T.H. MABRY Trustee of said County of the apportionment and distribution of the Common School monies in the year 1849 was this day submitted to the Court which was received and ordered to be recorded

Know all men by these presents that we Thomas H. MABRY Wm POLLARD Thomas MEREDITH Jonathan MORRIS S L BURNS and John L. CYPERT all of the County [of Wayne – crossed out] and State aforesaid are held and firmly bound unto the State of Tennessee in the sum of twenty five hundred dollars which payment well and truly to be made we bind ourselves our heirs executors & administrators dated this 1st day of April 1850 The condition of the above obligation is such that whereas the above bound Thomas H MABRY is trustee of Wayne County whose duty is to receive and pay over all fines by him received under an act of the Assembly entitled an act to punish small offenses. Now if the said Thomas H MABRY as such trustee shall indemnify said County for any loss occasioned by [any – crossed out] breech of his duty in proceeding under said act and pay as lawfully directed all fines received or which might have been received by him under said act then this obligation to be void else to be and remain in full force and effect / / s / / T H MABRY (seal) William POLLARD (seal) Thomas MEREDITH (seal) Jonathan MORRIS (seal) S L BURNS (seal) John L CYPERT (seal)

Ordered by the Court that the Commissioners appointed by this Court to examine in to the Condition of the town lots in Waynesboro be authorized to compromise with any persons having in possession by any Color of title any of said lots belonging to Wayne County without any pay for the improvements there on as they may think just.

Ordered by the Court that Solomon COOCH George I WALKER David VOORHIES Elisha POLLOCK and John VOORHIES freeholders be appointed a Jury of View to View and mark out so as to change the Buffalo road Beginning at David VOORHIES and thence down on the South side of said River and intersect the Mt. Pleasant road at John CRAIGs and that they report the same to the next turn of this Court.

Came John H HENDRICK & others who was appointed at a former term of this Court a Jury of View to View and mark out a change in the road leading up Holly Creek and report the Change made as directed in the order which was received by the Court.

On motion to appropriate to John ROBNETT the sum of three dollars the amount by him expended for the support of James J BOYD a pauper of Wayne County in the year 1849 those who voted in the affirmative were D J JONES Cr. YOUNG LAFFERTY CARTER MONTAGUE WILSON VOORHIES WATKINS HOPSON GRAY PHILLIPS & WHITTEN 12 Noes none so said appropriation was made to be paid out of any monies in the hands of the County Trustee not otherwise appropriated

It is ordered by the Court (there being more than [a majority-crossed out] two thirds of the Justices of the Peace in said County present) that an additional civil district to be known as district No 14 be and the same is hereby established and bounded as follows to wit commencing where the old line between Wayne and Hardin County intersects the Tennessee River thence up the river to the point where the line between Wayne and Hardin County as established by the act of 1849-50 attaching a portion of Hardin County to Wayne County leaves said river thence with said line to the old Wayne County lines thence north with said line to the beginning being that portion so attached to the County of Wayne It is further ordered by the Court that the Town of Clifton in said District be and is hereby established the place of holding elections and the precinct in and for said District until the same is changed by a majority of the voters of said District voting in any District election voting for the same. It is further ordered by the Court that the Sheriff open and hold an election for on Constable and two Justices of the peace for said District after having given the notice required by law

A majority of the Justices of Wayne County present the Court proceeded to elect a Ranger for said County for the next ensuring two years whereupon David J JONES was duly elected And entered into bond in the sum of five hundred dollars with C B McLEAN and R A HILL his securities conditioned for the faithful performance of his duties as such ranger And the said D J JONES and each of his said securities Acknowledged the execution of said bond in open Court and the Court approved and received said bond and ordered it to be recorded. Came Wilson GRIMES & others who was at a former term of this Court a Jury of view and mark out so as to change the Waynesboro and Savannah Road on the lands of A MONTAGUE and report a change made which was rec’d by the Court

Monday, Jany 7th, 1850

Came E. H. PUGH Tax Collector for Wayne County 1849 and returned in to the Court alist of the picked up Taxes verified by his oath which was received by the court and ordered to be recorded

Ordered by the Court that the Commissioners appointed at a former Term of this Court to sell the lots on the west Square of the town of Waynesboro hand over to the Treasurer of the Poorhouse Commissioners the balance of the proceeds of said sales and said Treasurer pay the same toward the land purchased by the Poorhouse Commissioners.

Ordered by the court that John McDOUGAL one of the Commissioners appointed at a former term of this court to set apart provisions for the Widow Shields & family for one year amend said order so as to set apart such additional articles which was done and rec’d by the Court and ordered to be recorded.

Came A MONTAGUE and D J JONES who was at a former term of this Court appointed commissioners to superintend the recovering of the Court house and report that on examination they think that the present Roof will do for several years to come with slight repairs which was received by the Court and ordered to be recorded and that the said Commissioners be discharged.

Came Thomas W HILL who was at a former term of this Court appointed Guardian of Augustus W BATT and reported to the Court the amount that has come into his hands as such Guardian verified by his oath which was received by the Court and ordered to be recorded.

Upon application of J.I.BIFFLE and others, it is ordered by the Court that L.L. MACK, Thompson MORGAN, Stephen BIVINS and Joseph EAST be appointed a Jury of View to view so as to change the Waynesboro and East Point Road so as to run with the line between the lands J.I. BIFFLE and H.H.HUNTER and that they report the same to the next term of this Court Isued Jan 10. 1850.

On motion to appropriate to W CARTER D J JONES and Jonathan MORRIS Poorhouse Commissioners the sum of fifteen Dollars each for theirservises Those who voted in the affirmative were LAFFERTY WILSON VOORHIES WATKINS HOPSON GRIMES 6 Noes BURNS MONTAGUE GANT SIMS and LEE 5 So said appropriation was made to be paid out of any monies in the hands of the Trustee not otherwise appropriated. Came James E McKNIGHT and others who was at former term of this Court appointed a Jury of View to view and mark out a road from Ashland to the Lawrence county Line and report a road found as directed in said order

Ordered by the court that Mw M HORTON be appointed overseer of the road of 2nd Class in the place of Allen FOX and that he have the hands in the same bounds to work under his direction Isued Jan’ 11th 1850

Ordered by the Court that John W YOUNGBLOOD be appointed overseer of the road of first Class and that he work the Waynesboro & East Port Road from the ford of the Creek at P M SATTERFIELDS to John LOYD and that he have the following hands to work under his direction to wit Allen SISK A R SISK Isaac HORTON, Jr. P. M. HORTON Isued Jan 14 1850

On Motion a majority of the justices being present the Court proceeded to lay the public taxes for the year 1850 for the county of Wayne as follows to wit for each poll fifty cents and for each hundred dollars worth of taxable property twenty three and a half cents and an privileges fifty per cent and the State tax.

The court proceeded to elect a chairman & quorum for said court for the present year when David J JONES was duly elected chairman of the court for the present year and said David J JONES William M LAFFERTY & James T?[or S] YOUNG were elected a quorum to hold the quorum courts for the present year.

[the following entry crossed out] On motion to appropriate three dollars to John ROBNETT for furnishing 115 lbs of pork for J.J.BOYD a pauper of Wayne County the justices who voted in the affirmative are Chairman CARTER YOUNG LAFFERTY BURNS MONTAGUE WATKINS GANT & HOPSON yeas 8 noes none so said appropriation was made to be paid out of any moneys in the hands of the County Trustee not otherwise appropriated

On motion to appropriate to Washington CARTER Abraham MONTAGUE and David J JONES ten Dollars each for holding the Quoram Courts for the year 1849

Justices who voted in the affirmative are W. Came Samuel L BURNS Administrator wit the will anexed of Lemuel POPE dec’d and presented a supplemental report of assets which have come into his hands such as since his former Report which was rec’d by the court and ordered to be recorded

Matthew H BURKS [?] Guardian of the Minor heirs of David TILLMAN [?] came into Court and presented his report of the assets which have come into his hands as such which was received and ordered to be recorded

Ordered by the Court that John SHIPMAN be overseer of the Road of the 3rd Class in the place of Josiah YOUNGBLOOD and have the hands on the head of the creek above said SHIPMANs house Isued Jan 14, 1850
