State of Tennessee Wayne County§ Be it remembered that a quarterly County Court was began and held for the County of Wayne at the Court house in the town of Waynesboro on the 7th day it being the first Monday in July in the year of our Lord one thousand Eight hundred & fifty one when and when the following Justices were present & presiding to wit: David J JONES Chr. Whereas satisfactory evidence has been exibted[sic] to the Court here that Robert CYPERT Late of said County is dead and was before death a United State pensioner and that he died on the 28th day of January 1851 it is therefore ordered by the Court that the Clerk of this Court Certify accordingly Came James HAGGARD who was at the January term 1851 of said County Court appointed Commissioner to take and make out in writing an accurate and complete list of the number of free white Male inhabitants who are twenty one years old and over and returned his list accordingly the aggregate of which is Thirteen hundred and seventy one verified by his oath which was received by the Court and ordered to be recorded
Upon motion to appropriate to Jesse S. ROSS and W CARTER each the sum of four dollars for their services as commissioners to sell certain lots in Waynesboro Those who voted in the affirmative were D J JONES, Chr. LAFFERTY MONTAGUE BARKER VOORHIES WILSON WATKINS CYPERT CURTIS and HUCKABY ten Noes none so said appropriation was made to be paid out of any monies in the hands of the County Trustee not otherwise appropriated Issued July 24, 1851

Ordered by the Court that Daniel STROUD be appointed Overseer of the road of 2d Class in the place of C M BROWN and that he have the hands in the same bounds to work under his direction Issued July 23d 1851

A majority of the Justices of the peace present John SHIPMAN presented in open Court the Scalp of a wolf over four months old and proved the killing of said Wolf in Wayne County by his own oath and said scalp was destroyed by the Sheriff according to an Act of the General assembly in such made & provided Issued to John SHIPMAN July 8, 1851
A majority of the Justices of the peace present William M HORTON presented in open Court the Scalps of five wolves under four months old and proved the killing of them in Wayne County by his own oath and said scalps was destroyed by the Sheriff according to an act of the General assembly in such cases made and provided Isued Aug 4th 1851
Ordered by the Court that Alonzo H. MONTAGUE be appointed Overseer of the road of 2d Class in the place of Isaac W ROSS and that he have the hands in the same bounds to work under his direction Isued July 23d 1851
On the petition of Felix WEST and it appearing to the satisfaction of the Court that the said WEST is in indigent circumstances and unable to do manual labor It is ordered by the Court that the said Felix WEST have the privilege of hawking and peddling in the County of Wayne during his inability to Labor as afore said an his taken the oath prescribed by law Isued July 7th 1851

This day came Joseph N. ROBNETT in to Court and tendered to the Court his resignation to the office of Constable of Wayne County which was received by the Court and ordered to be recorded.
David J. JONES Chairman of this Court and in behalf of the Court [bound – crossed out] by the Consent of Thomas CARR orphan and George W. BROWN bound the said Thomas CARR to Marcus COOK [the said – crossed out] and the said D. J. JONES as Chr. And the said Marcus COOK entered into indentures binding the said Orphan to the said COOK util[sic] he attains the age of Eighteen years and the Court releases the said George W. BROWN from his obligation in the former indentures.

A settlement between Thomas H MABRY Trustee of Wayne County and A MONTAGUE and Jonathan MORRIS Commissioners appointed by this Court to settle with the revenue Collectors of said County the year 1851 was this day submitted to the Court which was Confirmed by the Court and ordered to be recorded

Came George WHITE and others a Jury summonds and sworn to view and mark out a change in the road of 2d Class leading from David TACKETTs to Waynesboro on the lands of T P CYPERT and report to the Court a change made as directed in the order which was received and ordered to be recorded

Came Jonathan MORRIS and others a Jury summonds and qualified to view and mark out a pass way sufficient for a third class road from Mary H SHIELDS so as to intersect the Waynesboro Road near John A KENNEDYs and report a way found as directed in said Order Which report was received and ordered to be recorded

Came Baker CYPERT and others a Jury summonds and qualified to view and report the expediency of disannulling the new Road and opening the old one leading from Baker CYPERTs to John McGLAMERYs and report to the Court that said change is necessary as the old road is the best which report was received and ordered to be recorded

Ordered by the Court that Mathew JOHNSON be appointed overseer of the road of 2d Class in the place of Charles LISLES and that he have the hands in the same bounds to work under his direction Isued July 23? 1851

Upon the petition of B WATKINS and others it is ordered by the Court that the Sheriff of Wayne County summons a Jury of View to consist of not less than five nor more then[sic] twelve free holders to View and mark out so as to Change the road of 2d Class leading down Weatherford’s fork of Indian Creek leaving the old road near John C JOHNSON and run with the foot of the hill and intersect the same at some suitable place so as to [intersect the – crossed out] injure the settlers as little as possible and that they report the same to the April term of this Court. Upon the petition of William B WALKER it is ordered by the Court that the Sheriff of Wayne County summons a Jury not to consist of not less than five nor more than twelve freeholders to View and mark out so as to change the road of 2d Class leading up 48 mile Creek commencing near the Creek below said Walker’s and intersect the old Road near the Creek above Burrell WALKERs plantation and that they report the same to the April term of this Court Ishued March 6, 1851

Came Joseph N ROBNETT who was on the 18th day of Febr. 1851 duly elected Constable of Wayne County to fill the unexpired term of Robert E. MACK resigned and entered into the following bond to wit [here follows the standard bond. Bond was for $4000.00 and the securities were Joseph N. Be it remembered that this cause came on this day for hearing before the Worshipful County Court now in session and it appearing to the Court that the petitioners therein named have a Claim thereto It is therefore ordered by the Court that T H MABRY John P VOORHIES A.C. RASBERRY L.G. RASBERRY and David J. JONES freeholders and unconnected with the parties by consanguinity or affinity be appointed Commissioners to examine a cite for a Mill on Buffalo River near Ashland in the Count of Wayne and that they report the same to the April term of this Court and that the Sheriff of said County summons and qualify each of said persons for the purposes aforesaid and that he Notify the defendants to this petition to appear at the April term of this Court and answer said petition and that an order issue accordingly returnable to said Court Isued Mar. 8th 1851

Be it Remembered that this cause came on this day for a final hearing before the Worshipful County Court of Wayne County David J JONES Esq George W BARKER Esq & William M LAFFERTY Esqr. Justices &c present and presiding upon the report of the Commissioner theretofore appointed to lay of the dower of the petitioner out of the lands of her deceased husband which said report is in the words and figures following to wit
[To the worshipful County Court – crossed out] The undersigned being unconnected with the parties either by affinity or consanguinity and entirely disinterested having been notified by the Surveyor for Wayne County have proceed to allot and set off to Catherine MABERRY her Dower out of the real estate of Daniel MABERRY her deceased husband after having duly consider and fully understood the whole matter do hereby assign to the said Catherine MABERRY for her Dower the following described land with the exctions[?] and improvements thereon to wit A tract of land in the County of Wayne on the waters of Beech Creek containing seventy eight acres and bounded as follows Beginning on a Sycamore the so west corner of entry No. 630 in the name of Daniel MABERRY for 77 acres runs south 40 poles to a chinguepin oak then South 10 (degrees) West 20 poles a small persimmon Chestnut oak pointers then East 15 (degrees) So 112 poles to a beech then North crossing Beech Creek at 26 poles in all 71 poles to a Hackberry then East 10 poles

Which not being in any wise excepted to is in all things confirmed it is therefore ordered adjudged and decreed by the Court that all the right title claim and interest of said defendants in and to the above described tract of land be divested out of them for and during the natural lifetime of said petitioner Catherine MABRY and that the same be vested in the said Catherine MABRY for and during her natural life it is further ordered and adjudged by the Court that said petitioner Catherine MABRY

East corner at 2 poles in all 25 poles to a small sweet Gum then east 5 (degrees) south 20 poles to a large poplar then East 32 degrees South 32 poles to a Rock hickory and sweet gum pointer thence South 40 poles to a chestnut then East 10 degrees South -? to a stake then North 110 poles to the S.B. of A.G. McDOUGALs entry then West with McDOUGAL s & HELTONs S.B. 175 poles to beginning Including the improvements dwelling houses lots &c being in our judgement one third in value of the real estate of John N. State of Tennessee vs John L FOWLER Warrant for Bastardy
This day came the defendant by his attorney and by leave of the Court enters a motion to quash the warrant in this case whereupon It is considered by the Court that said motion be sustained and that said warrant be quashed and that the defendant be hereof discharged a go hence it is further considered by the Court that the County of Wayne pay the cost of the part of the State expended

Ordered by the Court that John F HALL be appointed overseer of the road of 1st class in the place of John M BENHAM removed and that he have the hands in the same bounds to work under his direction Isued Mar. 8th 1851

Where as at the Febr. term of this Court Thomas H MABRY Trustee of Wayne County reported to the Court the Condition of the revenue of said County which was received by the Court and ordered to be recorded And whereas said report does not appear on the minutes of said Court it is therefore ordered by the Court that it now be recorded as for then

Death Records 1908-1912

This file was prepared from a transcription of these records for Wayne County, Tennessee. The original transcription was done by Mrs. Nelle Jones Berry in 1985 and was published in “Wayne County, Tennessee Cemetery And Death Records” which was published jointly by the Wayne County Historical Society and The Byler Press. Input of these records was done by Mrs. Linda Davis Ledlow.

These records are found in the County Clerk’s office in the courthouse in Waynesboro, TN. The book is a large book, measuring approximately 12″x18″ in size, and about one-and-one-half inches thick. On the front cover is the title “Vital Statistics”. The first half of the book lists records of births between 1908 and 1912. The second half lists deaths for the same period. Only the records of deaths have been abstracted here.

This was used as a record book. The original certificates were sent to Nashville and are now on file at the State Library and Archives. A microfilm copy of both the records book in the clerk’s office and the original certificates from the Office of Vital Records is on file in the Wayne County Room at the Wayne County Public Library.

Only the entries in the record book for 1908-1912 have been copied here. The original certificates for 1908-1912 have not been copied for this book.

Each entry in the book covers a line on two pages of the book. Only the right hand pages are numbered. The deaths are listed by a combination of Civil and School District for a two year period, i.e., 1908-09, 1909-10, etc.

The headings at the top of each page are Name of Deceased, Date of Death, Sex, Color, Age, Married or Single, Place of Death, Cause of Death, lace of Birth, Occupation, Name of Physician Last in Attendance, Name of J.P. or Coroner Holding Inquest, and Date Recorded. Only the following have been abstracted: Name of Deceased, Date of Death, Sex, Color, Age, Place of Death and Place of Birth.

Lindsey’s Chapel Church & Cemetery is located in Lauderdale County north of Florence, Alabama on Alabama Highway # 157 approximately 1 mile south of Cypress Inn, Tennessee on the west side of the highway.

The church was built approximately 55 years ago with donations from residents of the community. Mr. Albert Lindsey, buried here, spearheaded the move to build the church. The church was built as a community church with no particular denominational ties. There are Confederate, World War II and Korean War veterans buried here. The oldest known grave is 1867. The oldest known person buried here was born in 1836. There are 20 graves with no headstones or information.

All names and dates were recorded from headstones and markers. They have been diligently checked for accuracy. The cemetery is well taken care of. This survey was completed August 02, 2003.
