State of Tennessee Be it remembered that a quorum County Court was begun and held in and for the County of Wayne at the Court house in the town of Waynesboro on the first Monday being the third day of November in the year of our Lord one thousand eight hundred an fifty one there were present and presiding David D. JONES Chairman John MONTAGUE & George W. BARKER his associate Justices

Ordered by the Court that Andrew M. SOUTH be appointed Guardian of Elizabeth Ann TYCER John M TYCER and Martha Jane TYCER Minor heirs of William TYCER dec’d and that he enter into [give – crossed out] bond and sufficient security in the sum of sixteen hundred Dollars conditioned for the faithful execution of his guardianship whereupon the said Andrew M SOUTH entered into bond in the sum of sixteen hundred dollars with George COOK and John McDOUGAL as his securities which were approved by the Court and ordered to be recorded and the said Andrew M. SOUTH took the necessary oath for his qualification as such Guardian
Washington CARTER & wife et al Exparte Petition to sell slaves§ Be it remembered that this cause came on for a hearing before the worshipful County Court for the County of Wayne and State of Tennessee on the 3rd day of November 1851 upon the petitioners petition and it appearing to the satisfaction of the Court that said petitioners are the owners of said three slaves mentioned in the petition in this cause as tenants in common to wit Lucy Hannah and Lewis that is to say, Washington CARTER & wife Susan CARTER one third part Charles D MACK one third part & James V MACK one third part of said Slaves, and it further appearing to the Satisfaction of the Court that said Slaves Cannot be equally divided between said parties, and that it is necessary to sell said Slaves so that the proceeds may be equally divided between said parties according to law. It is therefore ordered and decreed by the court that said three Slaves be sold to the highest bidder at the Court house door in Waynesboro on a Credit of twelve Months the purchasers giving bond & good security and a lien retained upon said Slaves until the purchasers money is paid. And it is further ordered by the Court that John McDOUGAL be and is hereby appointed a Commissioner to Sell said Slaves and it is further ordered that he Sell the same as above discribed after giving at least thirty days notice at three or more public places in said County one of which shall be upon the Court house door in said town Waynesboro and it is further ordered that he report to the January Term of this Court and that all other things be reserved

Ordered by the Court that Carry RAY be appointed overseer of the road of second class in place of Moses PRINCE and that he have the hands in the same bounds to work under his directions Isued Nov. 21st 1851

Josiah YOUNGBLOOD and John W. YOUNGBLOOD residents of Wayne County and State of Tennessee who being duly sworn according to law declare that they and Lydia HORTON are the Children and only heirs at law of William YOUNGBLOOD deceased who was a private in the company commanded by Captain TWIGGS in the 7th Regiment of Infantry (the names of the commanding colonel not remembered) but will be [shown – marked out] known by reference to the original Certificate of discharge) in the war of 1812 that their said father enlisted in November 1814 for the term of five years and served near two years and five months as declarents now remember and believe and was honorably discharged as will appear by reference to his original Certificate of discharge which may be found appended to a former declaration made by Edith YOUNGBLOOD the widow of William YOUNGBLOOD deceased and which has been acknowledged by the commissioner of pensions to be in his possession Declarents would further state that the aforesaid declaration made by Edith YOUNGBLOOD (who is the mother of declarents and widow of William YOUNGBLOOD deceased set out all the facts with regard to the service of the said William YOUNGBLOOD deceased – the time and place he enlisted – the time he remained in service and when and where discharged and also the time of his death more fully than declarents are now able to say and so would respectfully suggest a reference to said declaration for a more general and full statement of the facts. Declarents make this declaration for the
[page 207 – no heading] purpose of obtaining the bounty land to which William YOUNGBLOOD deceased was entitled in his lifetime under the act passed January 11th 1812 and to which they and the said Lydia HORTON (their sister and now entitled as heirs at law in fee as their father (the said William YOUNGBLOOD) never obtained the said bounty land during his lifetime //s// Josiah YOUNGBLOOD J. And therefore came Edith YOUNGBLOOD in open Court and after being duly sworn according to law desposes as follows to wit that she is the mother of the aforementioned Josiah [Joseph – crossed out] YOUNGBLOOD, John W. YOUNGBLOOD and Lydia HORTON and also the widow of the said William YOUNGBLOOD deceased and that the said Josiah, J. W. and Lydia are the only heirs at law in fee of the said William YOUNGBLOOD deceased as stated in their declaration That deponent sometime ago made her declaration and had it sent unto the pension office (the reception of which has since been acknowledged by the Commissioner of Pensions) for the purpose of obtaining said bounty land in which declaration deponent stated all the facts pertaining to the rights of the said William YOUNGBLOOD deceased to bounty land during his lifetime and expecting now to obtain the same as his widow but has since learned that she is not entitled to it under the act of 1812 but that his heirs at law in fee are only entitled who are the aforesaid Josiah YOUNGBLOOD John W YOUNGBLOOD and Lydia HORTON – And also Zachariah CYPERT in open Court and after having been duly sworn according to law deposed as follows to wit that he was a neighbor of the said William YOUNGBLOOD for many years during his lifetime and that at his death he bequeathed all his estate to his widow and that the said Josiah YOUNGBLOOD John W. YOUNGBLOOD and Lydia HORTON and that deponent believes the said William YOUNGBLOOD deceased regarded the aforesaid Josiah John W & Lydia as his only heirs at law in fee and that they are his only children and heirs as deponent believes and that he believes all the statements made in the foregoing declaration are true It is considered by the Court that the said Witnesses are persons of good character and standing and that full faith and credit are due to and ought to be given to their foregoing statements It is therefore considered by the Court that the above proceedings[?] be entered of record and a duly certified copy thereof be furnished by the Clerk of this Court to said declarents to enable them to procure the bounty land to which they are entitled as the children and only heirs at law of William YOUNGBLOOD deceased under the Act of Congress passed 11th January 1812.

It appearing to the Court that Elizabeth DICKSON [WARREN – crossed out] wife of Samuel DICKSON has died in [this – crossed out] Wayne County intestate And the said Samuel DICKSON having this day come into open Court and renounced his right to administer upon the separate estate of his said wife and Thomas WARREN [having – crossed out] son of the said Elizabeth having applied to this Court for Letters of Administration upon the separate estate of said Elizabeth WARREN It is therefore ordered by the Court that Letters of Administration upon the goods and chattles rights and credits of said Elizabeth WARREN upon his entering into bond and security as required by law and came into Court said Thomas WARREN and William POLLARD and John M McDOUGAL his securities and entered into bond in the [sum – crossed out] the penal sum of four thousand dollars conditioned for his faithful administration of said estate which bond was duly acknowledged in open Court by said Thomas WARREN William POLLARD and John McDOUGAL and approved by the Court And thereupon the said Thomas WARREN was duly sworn in open Court Faithfully to discharge his duty as such Administrator as prescribed by law

This day the non cupative will of James W STANDFIELD was produced in Court and proven to be the last will and testament of said James W STANDFIELD by John W SHULL Robinson TALLY and P. S STANDFIELD who after having been duly sworn deposed and said that they were acquainted with said James W STANDFIELD on the 22d day of August 1851 during his last sickness and in his own dwelling house in said County and in their presence they being be him called upon [by – crossed out] them and particularly the said John W. SHULL made the following deposition of his property to wit that it was his will and desire that his father and John W SHULL should administer upon his effects and take care of his children and keep them together on his plantation and that all his household property should be kept for their benefit also two cows to wit one called pink and the one called the Gillis cow also one filly to be kept with the children for their use & benefit the ballance sold and

his matters settled up and all his debts paid off The children to be kept on his place if they could be satisfied if not the land to be rented our until the youngest child come of age that he died the same day that it was made that at the time said testator was of disposing mind and memory and not under any undue influence that the said non cupative will was reduced to writing by them and signed by them on the 30th day of August 1851 It is therefore ordered by the Court that the noncupative will be established and that the same as committed to writing by said witnesses be recorded and thereupon William STANDFIELD and John W SHULL the executors nominated in said will applied for Letters testamentary upon said Will and they having entered into bond in the penal sum of fifteen hundred dollars with John A STANDFIELD William WEST T H DICKERSON and Robinson TALLY as their securities conditioned for their faithful execution of the trusts in said will which bond was acknowledged in open Court and which was duly approved by the Court It was therefore ordered by the Court that Letters Testamentary issue to said Executors accordingly And thereupon the said John W. SHULL and William STANDFIELD were duly sworn [to – crossed out] faithfully to execute the trusts of said will

Came C F DIXON into Court and resigned his office as Constable of the Twelfth Civil district of Wayne County which was received by the Court and ordered to be recorded

Upon motion it is ordered by the Court that David COOK Wm HAWK and A B GANT be appointed Commissioners to allot and set apart to the minor heirs of James W STANFIELD deceased under the age of fifteen [fourteen – crossed out] years old so much of the stock crop provisions and moneys as shall be sufficient for the support of said heirs one year from the death of their said father and that they report the same to the next term of this Court Issued Oct 13 1851

It appearing to the Court that John S STANFIELD who is a citizen of the County of Wayne is unable to procure the means of living by manual labor from bodily infirmity and it further appearing to the Court that said STANFIELD is in indigent circumstances and has no other means of support Is it therefore ordered by the Court a majority of all the Justices present [and – crossed out] that the said John S STANFIELD is hereby authorized and empowered to hawk and peddle or Merchandize without License in the said County of Wayne and State of Tennessee provided said STANFIELD shall take an oath before the Clerk of this Court that he will not retail the Goods of any other persons directly nor indirectly but that the goods sold by him shall be exclusively his own and provided further that this shall be no authority to said STANFIELD to sell Spiritous Liquors or Clocks without obtaining a License therefore Isued Jan 17, 1852


Personally appeared in open Court Buckly HAM Administrator of the estate of William HEFFINGTON deceased and suggested the insolvency of said estate It is therefore ordered by the Court that said administrator give notice in the Nashville Weekly Union a public Newspaper published in the Town of Nashville in said State for three successive weeks and also by a written notice on the Court house door in the Town of Waynesboro for all those creditors of said estate to come forward and file their claims on or before the first Monday in October 1852 with the Clerk of this Court properly authenticated or they will be for ever barred


On motion it is ordered by the Court that George W BROWN J C ELLIOTT and S[?] H GRIMES be appointed Commissioners to allot and set apart to Mahuldah Maranda and Jincy Minor heirs of Dilly GOFORTH deceased and under the age of fifteen [fourteen – crossed out] years so much of the stock crop provision and money as will be sufficient for one year support for said minors from the death of their said Mother and that they report the same to the same to the November term of this Court that Order Isue accordinly Isued Oct 13, 1851

Came Wm BENHAM into Court who was this day appointed Admr. of the estate of Dilly GOFORTH deceased and entered into bond in the sum of Eight hundred dollars with Jacob BENHAM AND Rial BREWER his securities which was received by the Court and ordered to be recorded Whereupon the said Wm BENHAM took the necessary oath for this qualification

Came David TACKETT Guardian to the minor heirs of W B TACKETT Deceased and renewed his bond in the sum of Two hundred dollars with R BREWER and C ACKLIN his securities which was received by the Court [which was rec – crossed out] and ordered to be recorded
On Motion [Came D J JONES – crossed out] it is ordered by the Court that James ANDERSON D. J. JONES and John McDOUGAL by appointed Commissioners to allot and set apart to Rachel MERRYMAN widow of Eli MERRYMAN deceased so much of the stock crop [stock – crossed out] provision and money as shall be sufficient for the support of herself and family for the term of one year from the death of her said husband and that they report the same to the November term of this Court and that Order Isue accordingly
Rachel MERRYMAN Widow of Eli MERRYMAN deceased this day relinquished her right of Administration on said estate in writing to the Court and request the Court to appoint Joacim DUGGER adm’r on said Estate And Whereupon the said Joacim DUGGER came in to Court and entered into bond in the sum of Twenty five hundred dollars with John McDOUGAL and Stephen BIVENS his securities and whereupon the said DUGGER and each of his securities came into Court and acknowledged the execution of said Bond which was received by the Court and ordered to be recorded And whereupon the said Joacim DUGGER took the necessary Oath for his qualification

Upon motion a majority of the Justices present the Court proceeded to elect a Commissioner to take the census of the free white male inhabitants of Wayne County who are twenty one years of age and upwards in Compliance with an act of the last general assembly and whereupon James HAGGARD was duly elected

A majority of the Justices present the Court proceeded to elect a corum Whereupon David J JONES was elected Chairman and William m LAFFERTY and George W BARKER his associates all Justices of the peace for Wayne County were duly elected to hold the Quorum Courts for the County of Wayne the present year 1851

Be it remembered that this cause came on this day for further hearing before the worshipful county court of Wayne County David J JONES Washington CARTER William M LAFERTY James T YOUNG & Others Justices of the peace of said County present and presiding Upon the report of Samuel L BURNS commissioner to set said land and John McDOUGAL & others commissioners to divide and allot the slaves mentioned in the pleadings of this cause which report ar[sic] in the words and figgers[sic] as follows to wit to the worshipful County Court of Wayne County the undersigned in Obedience to a directed order maid[sic] by the Last term of your Worshipful Court after having given the notice in the manner and upon the time mentioned in said order Proceeded on this day to sell the land mentioned therein belonging[sic] to the heirs at law of Lemuel POPE deceased when William R. BELL being the highest and best bidder became the purchaser of the 258 acre tract At the sum of Thirty two hundred and fifty dollars and Cary W POPE being the highest and best bidder because the purchaser of 640 acre tract a t the sum of One hundred dollars and William R BELL Executed his Bonds for said purchas[sic] money One for sixteen hundred and twenty five dollars payable twelve months after date and the other for sixteen hundred and twenty five dollars payable two years after date with Amous T HASSELL and Thomas MEREDITH as his securities to Each which were[?] by me decreed[?] good and sufficient and said Cary W. PARHAM, Mathew P PARHAM William PARHAM Henry PARHAM Henry valued at $800.00 and they are to pay to said Thomas A. POPE the said sum of $8.34 and to the children and heirs of said Thomas A. Which report not being in any wise Excepted to and in all things confirmed it is therefore ordered adjudged and decreed By the Cort[sic] that all the right title claim and Interest of the other petitioners and defendants in all to said slave Crawford be divested Out of them and that the same be vested in the said Carry W POPE his heirs and assigns forever
it is further Ordered and decreed by the Cort[sic ] that said Carry W POPE Pay it to the said Thomas A POPE the said sum of Eight dollars and thirty four cents it is further Ordered ajudged[sic] and decreed By the Court that all the right title[sic] claim and Interest in and to said slave Luisa and John Be divested out of them and vested in said Thomas A POPE his heirs and assigns forever it is further ordered and decreed By the Court that all of the right title[sic] claim and Interest of the other petitioners and of the defendants in and to said slaves Bandy and Grundy be divested out of them and that the same be vested in said Martha CRUMP her heirs and assigns forever it is further Ordered and decreed By the court that said Martha CRUMP Pay to said Licey[?] J POPE Gardina[sic] of the minor heirs of William R. POPE the said sum of Eight dollars and thirty four cents
it is further Ordered and decreed By the Court that all the Wright[sic] title[sic claim and Interest of the other petissuners[sic] and defendants in to said slave An and her two children Lutitia and the said Infant be divested Out of them and that the same be vested in said William MITCHELL and wife Ann there[sic heirs and assigns forever
It is further Ordered and decreed By the Court that said William MITCHEL and wife Ann pay to said minor heirs of William R POPE the said some[sic] of One hundred and thirty three dollars and thirty four cents
It is further Ordered and decreed By the Court that It is further Ordered and decreed By the Court that all the right title{sic] claim and Interest of the Petissuners[sic] and defendants in and to said slave Calvin be devested[sic] Out of them and that the same be vested in the said John O POPE Palmurah[?] POPE W William POPE and Arnastatia[?] POPE and Edwin POPE Jontly their heirs and assigns forever.
It is further ordered and decreed by the Court that all the rights title claim and interest of the petitioners in and to said Slave Willie and Sibley be divested out of them and the same be vested jointly in the said Samuel J ANDREWS and others who take as the children and descendants of Elizabeth ANDREWS it is further ordered and decreed by the Court that said Samuel J ANDREWS and others taking as aforesaid pay to the said minor heirs of William R POPE Dec’d the said sum of thirty four dollars and sixty six cents and that pay to said Daniel BAUGH as other Guardian of said Sarah E BAUGH George ARMSTRONG & wife Ann L the said sum of forty one Dollars and sixty six cents it is further ordered and decreed by the Court that said sums so due from said Samuel J. ANDREWS and others be paid by said Samuel L. BURNS Administrator &c out of any funds in his hands to which said Lemuel J. ANDREWS and others so taking as aforesaid may be entitled as distributors of said Lemuel POPE deceased and the receipts of the regular guardian of said minors and those entitled thereto shall be a good voucher in the hands of said Samuel l BURNS It is further ordered by the Court that said Samuel L BURNS hire out said Slave Willie but so as to have him subject to the further order of this Court [that-crossed out] and that he provide for the maintenance[sic] of said slave Sibby. PARHAM Matthew P PARHAM William PARHAM and Henry PARHAM jointly and their heirs and assigns forever
It is further Ordered and decreed by the Court that said Gustavus A. PARHAM Matthew P PARHAM William PARHAM and Henry PARHAM pay to said Thomas A POPE said Sum of Eight dollars and 34 cents It is further ordered and decreed by the Court that all the right title claim and interest of said other petitioners and defendants in and to said Slave Arthur be divested out of them and be vested in Sara E BAUGH and George ARMSTRONG and wife Ann ARMSTRONG jointly their heirs and assigns forever that is to say the one half in interest of the Sarah E BAUGH and the other half in the said George ARMSTRONG and wife Ann It is further ordered and decreed by the Court that all the title claim and interest of the other petitioners and defendants in and to said Slave Melissa and Ben be divested out of them and that the same be vested in said Leonida POPE Gustavus POPE James POPE Lucy A. POPE and Mary POPE jointly their heirs and assigns forever It is further ordered by the Court that said Samuel L BURNS make such provisions for said Slave Daniel as the necessity of the case may require and pay the expenses of the same out of any assets in his hands belonging to the estate of said Lemuel POPE Deceased until further directed by this Court. It is further ordered and decreed by the Court that said Samuel L BURNS out of any assets in his hands belonging to the said estate not heretofore paid over or herein directed to be paid pay to Robert A. HILL the sum of twenty five Dollars his counsel fee in this cause and that he pay to each of the said commissioners in like manner for their services the sum of two dollars except F. It appearing to the Court that Robert L CYPERT one of the Constables of Wayne County in and for the 8th district had been duly notified agreeable to the Statute in such cases made and provided to appear at this term of this Court and give other and better security and the said Robert L CYPERT having failed to come into Court agreeable to said notice and enter into bond with good and sufficient Security The Court [proceeded to appoint a constable to fill-crossed out] declared the office of constable in the said Eight Civil district of Wayne County to be vacant and thereupon the court appointed Robert J CYPERT Constable pro tem to fill said vacancy until said office shall be filled by the people of said Eighth district And thereupon the said Robert J Cypert entered into the following bond to wit [standard bond follows.
