Be it remembered that a Quarterly County Court was began & held for the County of Wayne at the Court House in the Town of Waynesboro on the sixth day it being the first Monday in October in the year of our Lord one thousand Eight hundred and fifty one When and where the following Justices were present and presiding to wit D J JONES Chairman LAFFERTY BARKER HAM HAYNES A B GANTT [B HAM – crossed out] Solomon JOBE, John MONTAGUE, George G HERRON, L B GANT, A J BREWER C W POPE PHILIP & CARTER

It appearing to the Court that Elizabeth DICKSON [WARREN – crossed out] wife of Samuel DICKSON has died in [this – crossed out] Wayne County intestate And the said Samuel DICKSON having this day come into open Court and renounced his right to administer upon the separate estate of his said wife and Thomas WARREN [having – crossed out] son of the said Elizabeth having applied to this Court for Letters of Administration upon the separate estate of said Elizabeth WARREN It is therefore ordered by the Court that Letters of Administration upon the goods and chattles rights and credits of said Elizabeth WARREN upon his entering into bond and security as required by law and came into Court said Thomas WARREN and William POLLARD and John M McDOUGAL his securities and entered into bond in the [sum – crossed out] the penal sum of four thousand dollars conditioned for his faithful administration of said estate which bond was duly acknowledged in open Court by said Thomas WARREN William POLLARD and John McDOUGAL and approved by the Court And thereupon the said Thomas WARREN was duly sworn in open Court Faithfully to discharge his duty as such Administrator as prescribed by law

Upon the petition of Wm POLLARD Administrator of the estate of Jacob A KEATON deceased [amend – crossed out] it is ordered by the Court that said Administrator amend his settlement with the Clerk of this Court

This day the non cupative will of James W STANDFIELD was produced in Court and proven to be the last will and testament of said James W STANDFIELD by John W SHULL Robinson TALLY and P. S STANDFIELD who after having been duly sworn deposed and said that they were acquainted with said James W STANDFIELD on the 22d day of August 1851 during his last sickness and in his own dwelling house in said County and in their presence they being be him called upon [by – crossed out] them and particularly the said John W. SHULL made the following deposition of his property to wit that it was his will and desire that his father and John W SHULL should administer upon his effects and take care of his children and keep them together on his plantation and that all his household property should be kept for their benefit also two cows to wit one called pink and the one called the Gillis cow also one filly to be kept with the children for their use & benefit the ballance sold and

his matters settled up and all his debts paid off The children to be kept on his place if they could be satisfied if not the land to be rented our until the youngest child come of age that he died the same day that it was made that at the time said testator was of disposing mind and memory and not under any undue influence that the said non cupative will was reduced to writing by them and signed by them on the 30th day of August 1851 It is therefore ordered by the Court that the noncupative will be established and that the same as committed to writing by said witnesses be recorded and thereupon William STANDFIELD and John W SHULL the executors nominated in said will applied for Letters testamentary upon said Will and they having entered into bond in the penal sum of fifteen hundred dollars with John A STANDFIELD William WEST T H DICKERSON and Robinson TALLY as their securities conditioned for their faithful execution of the trusts in said will which bond was acknowledged in open Court and which was duly approved by the Court It was therefore ordered by the Court that Letters Testamentary issue to said Executors accordingly And thereupon the said John W. SHULL and William STANDFIELD were duly sworn [to – crossed out] faithfully to execute the trusts of said will

Upon the petition of Wm Melton & others it is ordered by the Court that A J BREWER Jefferson BREWER Wilie BREWER Jr G W BREWER Lewis BREWER A J RISNER or any five of them be appointed a Jury to View and mark out so as to change the road of 2d Class leading down Butlers Creek so as to leave the Florence Road between P W HENSLEYs house and the house of William MELTON and run on the west sid[sic] of said MELTONs plantation and intersect the old road below Wm MELTONs plantation And that they report they same to the January term of this Court and that order Issued Oct 8, 1851

A majority of the Justices of the peace present Came Rial BREWER Collector of the public Taxes of Wayne County the present year 1851 and reported to the Court the amount of Removals and insolvencies to the amount of ten 51/100 [Eight – crossed out] dollars [and thirty two and one fourth cent – crossed out] State and [Eighteen 81/100 dollars – crossed out] Twenty 76/100 dollars County Tax which report was received and ordered to be recorded Iss’d Dec 1, 1851

Came C F DIXON into Court and resigned his office as Constable of the Twelfth Civil district of Wayne County which was received by the Court and ordered to be recorded

Upon motion to appropriate to A T HASSELL the sum of Eleven dollars and ninety five cents for 116 llbs Bacon and Tobacco furnished the poorhouse commissioners July the 15th and 25th 1851 Those who voted in the affirmative were D J JONES Chr LAFFERTY BARKER HAYNES JOBE CARTER GANT L B GANT J. MONTAGUE & HERRON 10 Noes none so said appropriation was made to be paid out of any monies in the hands of the County Trustee not otherwise appropriated Issued Oct 20, 1851

Upon motion it is ordered by the Court that David COOK Wm HAWK and A B GANT be appointed Commissioners to allot and set apart to the minor heirs of James W STANFIELD deceased under the age of fifteen [fourteen – crossed out] years old so much of the stock crop provisions and moneys as shall be sufficient for the support of said heirs one year from the death of their said father and that they report the same to the next term of this Court Issued Oct 13 1851

It appearing to the Court that John S STANFIELD who is a citizen of the County of Wayne is unable to procure the means of living by manual labor from bodily infirmity and it further appearing to the Court that said STANFIELD is in indigent circumstances and has no other means of support Is it therefore ordered by the Court a majority of all the Justices present [and – crossed out] that the said John S STANFIELD is hereby authorized and empowered to hawk and peddle or Merchandize without License in the said County of Wayne and State of Tennessee provided said STANFIELD shall take an oath before the Clerk of this Court that he will not retail the Goods of any other persons directly nor indirectly but that the goods sold by him shall be exclusively his own and provided further that this shall be no authority to said STANFIELD to sell Spiritous Liquors or Clocks without obtaining a License therefore Isued Jan 17, 1852

Personally appeared in open Court Buckly HAM Administrator of the estate of William HEFFINGTON deceased and suggested the insolvency of said estate It is therefore ordered by the Court that said administrator give notice in the Nashville Weekly Union a public Newspaper published in the Town of Nashville in said State for three successive weeks and also by a written notice on the Court house door in the Town of Waynesboro for all those creditors of said estate to come forward and file their claims on or before the first Monday in October 1852 with the Clerk of this Court properly authenticated or they will be for ever barred

On motion it is ordered by the Court that George W BROWN J C ELLIOTT and S[?] H GRIMES be appointed Commissioners to allot and set apart to Mahuldah Maranda and Jincy Minor heirs of Dilly GOFORTH deceased and under the age of fifteen [fourteen – crossed out] years so much of the stock crop provision and money as will be sufficient for one year support for said minors from the death of their said Mother and that they report the same to the same to the November term of this Court that Order Isue accordinly Isued Oct 13, 1851

Came Wm BENHAM into Court who was this day appointed Admr. of the estate of Dilly GOFORTH deceased and entered into bond in the sum of Eight hundred dollars with Jacob BENHAM AND Rial BREWER his securities which was received by the Court and ordered to be recorded Whereupon the said Wm BENHAM took the necessary oath for this qualification

A settlement between Wm JONES Clerk of this Court and David TACKETT Guardian to the minor heirs of Wiley B TACKETT deceased was this day submitted to the Court which was confirmed by the Court and ordered to be recorded

On Motion [Came D J JONES – crossed out] it is ordered by the Court that James ANDERSON D. J. JONES and John McDOUGAL by appointed Commissioners to allot and set apart to Rachel MERRYMAN widow of Eli MERRYMAN deceased so much of the stock crop [stock – crossed out] provision and money as shall be sufficient for the support of herself and family for the term of one year from the death of her said husband and that they report the same to the November term of this Court and that Order Isue accordingly
Rachel MERRYMAN Widow of Eli MERRYMAN deceased this day relinquished her right of Administration on said estate in writing to the Court and request the Court to appoint Joacim DUGGER adm’r on said Estate And Whereupon the said Joacim DUGGER came in to Court and entered into bond in the sum of Twenty five hundred dollars with John McDOUGAL and Stephen BIVENS his securities and whereupon the said DUGGER and each of his securities came into Court and acknowledged the execution of said Bond which was received by the Court and ordered to be recorded And whereupon the said Joacim DUGGER took the necessary Oath for his qualification

Ordered by the Court that the commissioners appointed at a former term of this Court to superintend the painting of the Court house also have the windows of said house [the Entry Takers Office in said house – crossed out] repaired [in said – crossed out] except the offices occupied by the Clerks & Register

Ordered by the Court that George W CABB be appointed overseer of the road of first Class [in the place of – crossed out] leading from Waynesboro to Savannah in the place of Green WILSON and John L. McKNIGHT came into Court and entered into bond in the sum of six hundred dollars conditioned for the faithful performance of his Administration with D J JONES and C ACKLIN his securities and whereupon the said McKNIGHT and each of his said securities came into open Court and Acknowledged the execution of said bond which was received by the Court and ordered to be recorded Where upon the said McKNIGHT took the necessary oath for his qualification

Where as at the july term of this Court the Court made an appropriation to A MONTAGUE an Jonathan MORRIS the sum of two dollars and fifty cents each for their services as Comm’s settlement with the County Trustee the year 1851 And where as it was omitted and not put on the minutes of said Court it there fore ordered by the Court that it appear on the minutes now as for then. Those who voted in the affirmative were D J JONES Chr. LAFFERTY MONTAGUE BARKER VOORHIES WATKINS CYPERT L B GANT CURTIS BREWER HAM DIXON & HUCKABY 14 Noes none So said appropriation was made to be paid out of any monies in the hands of the County Trustee not otherwise appropriated Issued Aug 13, 1851

Ordered by the Court that John McDOUGAL James ANDERSON and Samuel R LAND be appointed Commissioners to allot and set apart to the widow of Lemuel ASKEW dec’d so much of the stock crop provisions and money as shall be sufficient for the support of herself and family for one year from the death of her said husband and that they report the same to the next term of this Court Isued Aug 15th 1851

Came Jacob B BIFFLE in to Court who was on the second day of August 1851 duly and Legally elected Constable of Wayne County by the qualified voters of the fourth Civil District there of an entered into the following bond to wit [here follows the standard bond] Securities were William J. YOUNG C. ACKLIN R BREWER Smauel L BURNS D K HOOD & Solomon PHILIPS. Bond dated 4 August 1851.
The condition of the above obligation is such that whereas the above bound Jacob B BIFFLE was on the 2d of August 1851 duly and legally elected Constable for said County by the qualified voters of the 4th Civil District there of for the unexpired term of Joseph N ROBNETT

David ROGERS this day presented to the Court his resignation to the office of Justice of the peace of Wayne County in writing which was received by the Court and ordered to be recorded
The last will and testament of William W GRIMES deceased was this day duley[sic] proven in open Court by the oaths of J C ELLIOTT and George W BROWN both subscribing witnesses there to which was rec’d by the Court and ordered to be recorded And where upon the Court ordered that Leonard H GRIMES the executor there in named have letters without giving bond as directed in said will where upon the said Leonard H GRIMES took the necessary oath for his qualification
Came into court Thomas H MABRY trustee of Wayne County and entered into bond in the sum of twenty five hundred dollars with D J JONES J J BIFFLE and R BREWER his securities Conditioned for the faithful destribution of the public School monies for the year 1851 which was rec’d by the Court and ordered to be recorded
Came into Court James H McLEMORE Guardian to Joel McLEMORE and renewed his bond in the sum of two thousand dollars with James C WHITAKER and John WHITAKER his securities which was received by the Court and ordered to be recorded

Be it remembered that this cause coming on for a further hearing this 4th day of August 1851 upon the Report of the Clerk & Master of this Court which is in the words & figures following to wit:
“The undersigned Clerk of the County Court of Wayne County, Tennessee who was directed to sell certain Salves mentioned in the pleading in this cause by a decree of the Worshipful County Court of said County of Wayne at the June Term thereof for the year 1851, begs leave to make the following Report
That after advertising said Salves as directed in said decree he sold said slaves to the highest bidder on a credit of twelve months at the court house door in Waynesboro on the 7th day of July 1851 and Cary W POPE because the purchaser of the Boy Wiley at the price of seven hundred and thirty one dollars & fifty cents And Clayton THARP became the purchaser of the Girl Sibba at the price of Three hundred & fifty dollars who executed their notes with good security for said sums of money respectively and retained a lien on said slaves until said purchase money is paid
All which is respectfully submitted August 4, 1851 //s// William JONES Clerk Which being in no wise excepted to it is considered by the court that said report be and the same is in all things confirmed.

Whereas satisfactory evidence has been exibted[sic] to the Court here that Robert CYPERT Late of said County is dead and was before death a United State pensioner and that he died on the 28th day of January 1851 it is therefore ordered by the Court that the Clerk of this Court Certify accordingly Came James HAGGARD who was at the January term 1851 of said County Court appointed Commissioner to take and make out in writing an accurate and complete list of the number of free white Male inhabitants who are twenty one years old and over and returned his list accordingly the aggregate of which is Thirteen hundred and seventy one verified by his oath which was received by the Court and ordered to be recorded
Upon motion to appropriate to Jesse S. ROSS and W CARTER each the sum of four dollars for their services as commissioners to sell certain lots in Waynesboro Those who voted in the affirmative were D J JONES, Chr. Came George WHITE and others a Jury summonds and sworn to view and mark out a change in the road of 2d Class leading from David TACKETTs to Waynesboro on the lands of T P CYPERT and report to the Court a change made as directed in the order which was received and ordered to be recorded

Came Jonathan MORRIS and others a Jury summonds and qualified to view and mark out a pass way sufficient for a third class road from Mary H SHIELDS so as to intersect the Waynesboro Road near John A KENNEDYs and report a way found as directed in said Order Which report was received and ordered to be recorded

Came Baker CYPERT and others a Jury summonds and qualified to view and report the expediency of disannulling the new Road and opening the old one leading from Baker CYPERTs to John McGLAMERYs and report to the Court that said change is necessary as the old road is the best which report was received and ordered to be recorded

SHIELDS being the highest and best bidder therefor became the purchaser of all the said lands lying upon Green River and described in the petition in this cause in exhibits A & C subject to the dower of the said Mary H SHILDS[sic] at the sum of $50-00 [$50.00?] who executed her bond with Samuel R LAIRD security thereto payable twelve months

after date And Henry H HUNTER at the same time being the highest and best bidder therefor became the purchaser of the lands mentioned in said petition lying on Chalk Creek and described in exhibits B & D at the price of $214-00 who executed his bond for the same payable twelve months after date with John McDOUGAL security thereto both of which securities are decreed good and sufficient a lien being retained upon said lands until said purchase money is paid. It is therefore ordered and decreed by the Court that all the right and title to the use and occupation of in and to said land above laid out and allotted to said Mary H. SHIELDS be divested out of the said petitioners heirs at law of said John N SHIELDS be

T M WHITTON who was on the 27th Febr. 1851 duly and legally elected Constable of Wayne County by the qualified voters of the 10th Civil District thereof to fill the unexpired term of Lawson HAYS removed came into Court and entered into the following bond to wit

Be it remembered that this cause came on this day for further hearing before the worshipful county court of Wayne County David J JONES Washington CARTER William M LAFERTY James T YOUNG & Others Justices of the peace of said County present and presiding Upon the report of Samuel L BURNS commissioner to set said land and John McDOUGAL & others commissioners to divide and allot the slaves mentioned in the pleadings of this cause which report ar[sic] in the words and figgers[sic] as follows to wit to the worshipful County Court of Wayne County the undersigned in Obedience to a directed order maid[sic] by the Last term of your Worshipful Court after having given the notice in the manner and upon the time mentioned in said order Proceeded on this day to sell the land mentioned therein belonging[sic] to the heirs at law of Lemuel POPE deceased when William R. It is further ordered and decreed by the Court that all the rights title claim and interest of the petitioners in and to said Slave Willie and Sibley be divested out of them and the same be vested jointly in the said Samuel J ANDREWS and others who take as the children and descendants of Elizabeth ANDREWS it is further ordered and decreed by the Court that said Samuel J ANDREWS and others taking as aforesaid pay to the said minor heirs of William R POPE Dec’d the said sum of thirty four dollars and sixty six cents and that pay to said Daniel BAUGH as other Guardian of said Sarah E BAUGH George ARMSTRONG & wife Ann L the said sum of forty one Dollars and sixty six cents it is further ordered and decreed by the Court that said sums so due from said Samuel J. ANDREWS and others be paid by said Samuel L. BURNS Administrator &c out of any funds in his hands to which said Lemuel J. It is further Ordered and decreed by the Court that said Gustavus A. PARHAM Matthew P PARHAM William PARHAM and Henry PARHAM pay to said Thomas A POPE said Sum of Eight dollars and 34 cents It is further ordered and decreed by the Court that all the right title claim and interest of said other petitioners and defendants in and to said Slave Arthur be divested out of them and be vested in Sara E BAUGH and George ARMSTRONG and wife Ann ARMSTRONG jointly their heirs and assigns forever that is to say the one half in interest of the Sarah E BAUGH and the other half in the said George ARMSTRONG and wife Ann It is further ordered and decreed by the Court that all the title claim and interest of the other petitioners and defendants in and to said Slave Melissa and Ben be divested out of them and that the same be vested in said Leonida POPE Gustavus POPE James POPE Lucy A. POPE and Mary POPE jointly their heirs and assigns forever It is further ordered by the Court that said Samuel L BURNS make such provisions for said Slave Daniel as the necessity of the case may require and pay the expenses of the same out of any assets in his hands belonging to the estate of said Lemuel POPE Deceased until further directed by this Court. It is further ordered and decreed by the Court that said Samuel L BURNS out of any assets in his hands belonging to the said estate not heretofore paid over or herein directed to be paid pay to Robert A. HILL the sum of twenty five Dollars his counsel fee in this cause and that he pay to each of the said commissioners in like manner for their services the sum of two dollars except F. It appearing to the Court that Robert L CYPERT one of the Constables of Wayne County in and for the 8th district had been duly notified agreeable to the Statute in such cases made and provided to appear at this term of this Court and give other and better security and the said Robert L CYPERT having failed to come into Court agreeable to said notice and enter into bond with good and sufficient Security The Court [proceeded to appoint a constable to fill-crossed out] declared the office of constable in the said Eight Civil district of Wayne County to be vacant and thereupon the court appointed Robert J CYPERT Constable pro tem to fill said vacancy until said office shall be filled by the people of said Eighth district And thereupon the said Robert J Cypert entered into the following bond to wit [standard bond follows. Be it remembered that this cause came on this day for further hearing before the worshipful David J JONES William LAFFERTY and James T YOUNG Justices of the peace for the County of Wayne and State of Tennessee duly commissioned and qualified to hold the County Court for said County then and there presiding and hold said Court upon petition order pro confessor exhibits and proof When it appeared to the satisfaction of the Court that Lemuel POPE died in said county of Wayne in January 1848 leaving and surviving him neither widow or descendants but leaving and surviving him the petitioners and defendants his distributes and heirs at law as mentioned and set for in the petition in this cause and that they as such distributees and heirs at law are entitled to the land and slaves as mentioned and so for in said petition and it further appearing to the Court from the proof in the cause that the same be sold It is therefore ordered adjudged and decreed by the Court that Samuel L. BURNS be appointed commissioner who after having given 30 days notice in written advertisement at the Court House in Waynesboro, Ashland, Clifton and Sorby, in said County shall proceed upon said land to sell the same upon a credit of one and two years to the highest bidder that he take bonds from the purchase money with two or more good and sufficient securities retaining a lien until the same is paid that he enter into bond with two securities payable to the chairman of this court in the sum of six thousand dollars conditioned for the faithful performance of this duties as such commissioner and that he report to the next term of this Court.

It is further ordered & adjudged and decreed by the court that John McDOUGAL Jonathan I BIFFLE Franklin WITHERSPOON David J JONES and John A BURNS or a majority of them be appointed commissioners who after having been duly sworn for said purpose shall proceed to value the slaves mentioned in the said petition to wit Daniel, Bandy, Ann, Crawford, Calvin, Henry, Anthony, Wiley, Grundy, Melissa, Louisa, Ben , Sibba, Lutitia and John

Said Samuel L BURNS came into Court and enter into bond with Jonathan J BIFFLE and Claiborn ACKLIN his securities in the sum of sic[sic] thousand dollars payable to David J. JONES Chairman of this Court and his successors in office conditioned as the law directs for the faithful performance of his duties Samuel L. It appearing to the Court that Tiding THOMPSON [and, crossed out] William D COPELAND and John W CYPERT three of the securities of Robert L CYPERT for the faithful performance of his duties as constable of Wayne County have removed from the State of Tennessee it is therefore ordered by the Court that the Clerk issue a notice to said Robert L CYPERT requiring him to appear at the next term of this Court and give an additional bond with other and better [security, crossed out] security for the performance of his duties as such constable or his said office will be declared vacant [void, crossed out] and this Court will proceed to fill his place as such Constable by appointing some other person thereto.

Court met according to adjournment Present D J JONES Chairman LAFFERTY & CARTHER his associates.

Came in Court John McDOUGAL and others who was at a former term of this Court appointed to allot to Mary A E GRIMES one years provision and reported to the court accordingly which was received by the Court and ordered to be recorded.

Ordered by the Court that Jesse HALFORD be appointed overseer of the road of 2d Class in the place of H W. DAVIS and that he have the hands in the same bounds to work under his direction Issued Oct 14th 1850.
