Came Andrew P DULIN & William J YOUNG and presented to the Court their Commissioners[sic] as Justices of the peace for Wayne County which was received by the Court whereupon the said DULIN and YOUNG took the necessary oaths for their qualification.

Upon the petition of B WATKINS and others it is ordered by the Court that the Sheriff of Wayne County summons a Jury of View to consist of not less than five nor more then[sic] twelve free holders to View and mark out so as to Change the road of 2d Class leading down Weatherford’s fork of Indian Creek leaving the old road near John C JOHNSON and run with the foot of the hill and intersect the same at some suitable place so as to [intersect the – crossed out] injure the settlers as little as possible and that they report the same to the April term of this Court. Monday March 3d 1851
Upon the petition of William B WALKER it is ordered by the Court that the Sheriff of Wayne County summons a Jury not to consist of not less than five nor more than twelve freeholders to View and mark out so as to change the road of 2d Class leading up 48 mile Creek commencing near the Creek below said Walker’s and intersect the old Road near the Creek above Burrell WALKERs plantation and that they report the same to the April term of this Court Ishued March 6, 1851

Came Joseph N ROBNETT who was on the 18th day of Febr. 1851 duly elected Constable of Wayne County to fill the unexpired term of Robert E. MACK resigned and entered into the following bond to wit [here follows the standard bond. Bond was for $4000.00 and the securities were Joseph N. Be it remembered that this cause came on this day for hearing before the Worshipful County Court now in session and it appearing to the Court that the petitioners therein named have a Claim thereto It is therefore ordered by the Court that T H MABRY John P VOORHIES A.C. RASBERRY L.G. RASBERRY and David J. JONES freeholders and unconnected with the parties by consanguinity or affinity be appointed Commissioners to examine a cite for a Mill on Buffalo River near Ashland in the Count of Wayne and that they report the same to the April term of this Court and that the Sheriff of said County summons and qualify each of said persons for the purposes aforesaid and that he Notify the defendants to this petition to appear at the April term of this Court and answer said petition and that an order issue accordingly returnable to said Court Isued Mar. 8th 1851

Be it Remembered that this cause came on this day for a final hearing before the Worshipful County Court of Wayne County David J JONES Esq George W BARKER Esq & William M LAFFERTY Esqr. Justices &c present and presiding upon the report of the Commissioner theretofore appointed to lay of the dower of the petitioner out of the lands of her deceased husband which said report is in the words and figures following to wit
[To the worshipful County Court – crossed out] The undersigned being unconnected with the parties either by affinity or consanguinity and entirely disinterested having been notified by the Surveyor for Wayne County have proceed to allot and set off to Catherine MABERRY her Dower out of the real estate of Daniel MABERRY her deceased husband after having duly consider and fully understood the whole matter do hereby assign to the said Catherine MABERRY for her Dower the following described land with the exctions[?] and improvements thereon to wit A tract of land in the County of Wayne on the waters of Beech Creek containing seventy eight acres and bounded as follows Beginning on a Sycamore the so west corner of entry No. 630 in the name of Daniel MABERRY for 77 acres runs south 40 poles to a chinguepin oak then South 10 (degrees) West 20 poles a small persimmon Chestnut oak pointers then East 15 (degrees) So 112 poles to a beech then North crossing Beech Creek at 26 poles in all 71 poles to a Hackberry then East 10 poles

This day came the defendant by his attorney and by leave of the Court enters a motion to quash the warrant in this case whereupon It is considered by the Court that said motion be sustained and that said warrant be quashed and that the defendant be hereof discharged a go hence it is further considered by the Court that the County of Wayne pay the cost of the part of the State expended

  • Came E. H. PUGH sheriff and collector of Wayne County and entered into Bond in the sum of Fifty five hundred [ Two Thousand – crossed out] dollars with Hiram ROBERTS, Johnathan MORRIS, Wm. BROWNLOW & John McDOUGAL his securities Where upon the said E H PUGH and Each of said securities came into Court and acknowledged the execution of the same the said Bonds is in work and form to wit

State of Tennessee) Know all men by these presents that we Elijah H. PUGH,
Wayne County) Hiram ROBERTS, Jonathan MORRIS. Wm. BROWNLOW John McDOUGAL all of the County and State aforesaid are held and firmly bound unto the State of Tennessee in the sum of Two thousand dollars for the payment of which well and truly to be made we bind ourselves our heirs Executors and administrators Jointly and severally firmly by these presents sealed with our seals and dated this 3rd April 1849.

The condition of the above obligation is such that where as the above bound Elijah H. PUGH was on the first Saturday in March 1848 Duly and Constitutionally Elected Sheriff and Collector of the State and county Tax for said County of Wayne for two years from the time of such Election. Now if the said Elijah H PUGH as such Collector of the public Tax shall well and truly collect all the State Tax and also all the Tax on School lands within said County of Wayne which by law he ought to collect and shall well and truly account for and pay over to the Treasurer of the State of Tennessee all Tax by him Collected or which by law he aught to have collected during the year 1849 at the time and in the manner directed by law then this obligation to be void otherwise to remain in full force and effect

E. H. PUGH bond [this is another bond, worded like that on page 45, except the amount of the bond is $3500.00 and the bond is for PUGH as Sheriff and Collector. The same securities are given and the same five men signed the bond.]
Whereupon the said E H PUGH took the necessary Oath for his qualification.
