State of Tennessee Wayne County§ Be it remembered that a Quarterly County Court was begun & held for the County of Wayne at the Court House in the Town of Waynesboro on the fifth day it being the first Monday in January AD one thousand Eight hundred and fifty Two when and where the following Justices were present and presiding. A Settlement between William JONES Clerk of said Court and S L BURNS Adm’r with the Will annexed of the estate of Lemual POPE dec’d was this day submitted to the Court which was confirmed and ordered to be recorded

A settlement between Wm JONES Clerk of this Court and Solomon JOBE Guardian to the minor heirs of A MELSON decreased was this day submitted to the Court which was confirmed by the Court and ordered to be recorded

A settlement between Wm. JONES Clerk of this Court and William THORNTON Guardian to Wm R DUNCAN was this day submitted to the Court which was received by the Court and ordered to be recorded

A settlement between Wm JONES Clerk of this Court and John PHILIPS Guardian to the minor heirs of John WHITTEN decd was this day submitted to the court which was confirmed by the Court which was received [by the c – crossed out]

Washington CARTER et al§ Ex Parte Petition to Sell Slaves
Be it remembered that this cause came on for a further hearing before the worshipful county Court of Wayne County Tennessee on this 5th day of January 1852 upon the report of the Special Commissioner appointed [by – crossed out] at a former term of this Court which said report is in the words and figures following to wit
“The undersigned who was appointed to sell the slaves belonging to the Estate of Robert N MACK deceased (mentioned in the pleadings in this cause) by a decreetal order of your worshipful Court would submit the following Report
That on the first day of January 1852 he proceeded to sell said negroes pursuant to notice previously given as be said decretal order directed when said slaves were struck off and sold to Bennet COLE at the following prices the same being the highest and best bids to wit Lucy [or Levy/] at the price of $700.50 Hannah at the price of $476.50 and Lewis? at the price of 334.50 $1511.50 making in the agregate the sum of fiften hundred and eleven dollars and 50 cents and said Benet COLE executed his bond for the sum payable twelve months after this date thereof with James ARNETT as his security who is deemed good and sufficient All which is Respectfully submitted Jany 5 1852 //s// John McDOUGAL Comm’r”
Which being in no wise excepted to it is considered by the Court that said report be and the same is hereby in all things confirmed all other matters being reserved &c.

This day came John C. BLACKBURN Jesse S. ROSS Solomon JOBE Eli BYNUM James GRANT King PRATER and Elijah WARRINGTON who were appointed a jury of view at the December Term 1851 of this Court to view and mark out a second class road from the Turnpike road at or near the head of Eagle Creek to Carrollville in Wayne County and reported a road found as directed in the order issued from this Court whereupon the petition of Jonathan C ELLIOTT and thirty six others were presented in opposition of said road and proof being also heard by the Court as to the practicality and utility of said Road [It was considered by the Court that it is not practical to establish said Road – crossed out] Whereupon on motion to concur in the report of the Jury of view and establish the Road those who voted in the affirmative are David J JONES Chairman Solomon JOBE & W CARTER 3 those who voted in the negative are W HAYES W M LAFFERTY

A MONTAGUE J. C. G. WILSON J. P. VOORHIES J MONTAGUE & G HERRAN Noes 7 so said motion [road – crossed out] was lost Whereupon on motion it is ordered by the Court that Eli BYNUM John C. BLACKBURN and Solomon JOBE be made parties to this suit whereupon the said Eli BYNUM John C. BLACKBURN and Solomon JOBE pray an appeal to the next term of the Circuit Court of Wayne County Tennessee which is granted them they having entered into bond and security according to law.

A majority of the Justices of the peace of Wayne County present the Court proceeded to Levy a County Tax for said County and on motion of Lay said Tax of ten cents on [the evry – crossed out] each hundred dollars worth of Tax able property and twenty five cents on each Poll and fifty percent on the State Tax for all privileges for said County purposes and [A majority of – crossed out] the Justices aforesaid voting in the affirmative the motion carried and said Tax was Layed

A Settlement between William JONES Clerk of this Court and John LAMB guardian to the minor heirs of Washington JOHNSON Dec’d was this day submitted to the Court which was received and ordered to be recorded
Settlement between Wm JONES Clerk of this Court and A P PHILIPS Guardian to the minor heirs of John D KING deceased was this day submitted to the Court which was received by the Court and ordered to be recorded

A Settlement between Wm JONES Clerk of this Court and Leonard H GRIMES Executor of the estate of Wm W GRIMES Dec’d was this day submitted to the Court which was received by the Court and ordered to be recorded

Came William THORNTON Guardian to Wm R DUNCAN minor heir of William DUNCAN Dec’d into Court and renewed his bond in the sum of two thousand dollars with Brinkley HOPSON his security which was approved of by the Court and ordered to be recorded

Upon the petition of Nathan BIFFLE it is ordered by the Court that A C RASBERRY James DURHAM John G HILL James E McKNIGHT William HILL John STOCKARD or any five of them be appointed a Jury of View and mark out a change in the road leading from Waynesboro to Ashland so as to [and – crossed out] run on the left hand side [so as to leave – crossed out] of the farm on which Joshua MATHENY now lives on and that they report the same to the April term of this Court Issued Febr 2, 1852

Ordered by the Court that W CARTER and Jesse S ROSS Commissioners appointed by this Court the sell certain Lots in the Town of Waynesboro pay the proceeds of said lots to the Treasurer of the Poorhouse Commissioners
Came Solomon JOBE Guardian to the minor heirs of A MELSON Dec’d into Court and renewed his bond in the sum of two hundreds with Elijah WARRINGTON his security which was received by the Court and ordered to be recorded

Ordered by the Court that John CHURCHWELL Jr be appointed overseer of the Road of second Class in the place of Wm. HOLLOWAY and that he have the [bounds in his d – crossed out] hands in the same bounds to work under his direction Issued Jan 21, 1852

Ordered by the Court that John H GRAVES be appointed overseer of the road of second Class in the place of Robert A ROBNETT and that he have the hands in the same bounds to work under his direction Issued Jan 8, 1852

Ordered by the Court that Wade H DEAN be appointed overseer of the road of first Class in the place of Isaac McGLAMERY removed and that he have the hands in the same bounds to work under his direction Issued Jan 8, 1852

Came Nathan C. DAVID into Court who was this day chosen and appointed Guardian to Isaac A. James and Pocahontas [ROBINSON – crossed out] the minor heirs of James ROBINSON Deceased and entered into Court in the sum of Thirteen thousand dollars with John S BURNS and Thomas H MABRY his securities which was approved of by the Court and ordered to be recorded Whereupon the said N C DAVID took the necessary oath for his qualification [in margin: Issued March]

Came D J JONES Administrator of the estate of John N. STAGGS Dec’d and returned into Court an Inventory and account of sales of said estate verified by his oath which was received by the Court and ordered to be recorded

A majority of the Justices of the peace present the court proceeded to elect a Tax Collector for the present year 1852 Whereupon Thomas H MABRY was duly and lawfully elected

Came William RAY who was this day appointed administrator of the Estate of Stephen S RAY deceased and entered into bond in the sum of two hundred dollars with Albert G CLAY and George E. HUCKABY his securities which was approved of by the Court and ordered to be recorded Whereupon the said Wm RAY took the necessary oath for his qualification

A majority of the Justices present the Court proceeded to elect a Quorum for the present year 1852 and Whereupon David J JONES was duly Elected Chairman of said Court and Abraham MONTAGUE and Lewis B. GANT his associates to hold the Quorum County Courts for the twelve months next ensuing

Came Leonard H GRIMES who was this day appointed Guardian to the minor heirs of Elihu S GRIMES deceased and entered into bond in the sum of one hundred dollars with Bennet HALE and Isaac W ROSS his securities conditioned for the faithful performance of said Guardianship whereupon the said L H GRIMES took the necessary oath for his qualification

Upon the petition of John JACKSON it is ordered by the Court that the Sheriff of Wayne County summons a Jury not to consist of less than five nor more than twelve freeholders and unconnected with the parties therein Concerned to View and mark out a change in the road of second Class leading down forty eight mile Creek so as to leave the old road oposite John JACKSONs Jr field near the rock quarry and intersect the same about one fourth mile below and that they report the same to the April term of this Court Issued Febr 2, 1852

Ordered by the Court that Wm BURRIS be appointed overseer of the road of second Class in the place of Litle CHOAT and that he have the hands in the same bounds to work under his direction Iss. Jan. 8, 1852

Ordered by the Court that John RUTLEDGE be appointed overseer of the road of second Class in the place of Marcus COOK removed and that he have the hands in the same bounds to work under his direction. Iss’d Jan 8, 1852


Upon motion it is ordered by the Court that David MITCHELL and all the hands above him on Mitchells branch be released from working on the Waynesboro and Savannah road and that said hands and all in that bounds work on the road [under – crossed out] from the Turnpike road on Eagle Creek to the Stage road on Hardins Creek under George H REA

Ordered by the Court that John FUSON be appointed overseer of the road of first class in the place of Bethel FUSON and that he have the hands in the same bounds to work under his direction Issued Jan 8, 1852

Ordered by the Court that John H. EAST be appointed overseer of the road of first Class in the place of Isaac MORRIS and that he have the hands in the same bounds to work under his direction Issued Jan 8, 1852

Upon motion it is ordered by the Court that Abraham MONTAGUE and James ANDERSON be appointed County Commissioners for Wayne County to settle with the revenue officers for the year 1852

Ordered by the Court that Wm H HILL be appointed overseer of the road of second Class in the place of Elijah MATHENY and that he have the hands in the same bounds to work under his direction Issued Jan 21, 1852

Came James HOLLIS Administrator of the estate of Thomas GIST deceased and suggested to the Court in writing the Insolvency of said estate alledging that there has been more claims presented against said estate than there are means to pay [the Court – crossed out] and prays the court to make such orders in the case as is required by the laws in such cases It is therefore ordered by the Court that the said James HOLLIS Administrator as aforesaid give notice by advertisement in the Messenger a newspaper published in the town of Lawrenceburg in the State of Tennessee for 3 successive weeks the last of which shall be three months before the first Monday in January 1853 and also at the Courthouse door in the town of Waynesboro in County of Wayne in said state notifying all persons having claims against said estate to appear and file their claims with the Clerk of the County Court of Wayne County Tennessee duly authenticated on or before the first Monday in January 1853 or the same will be forever barred

Upon motion to appropriate to Abraham HENRY the sum of seven Dollars for building a Chimney at the poorhouse in Wayne County Those who voted in the affirmative were D J JONES Chr HAYNES LAFFERTY CARTER A MONTAGUE BARKER WILSON VOORHIES A B GANT WATKINS L B GANT CURTIS HOPSON BREWER HUCKABY PHILIPS WHITTEN J MONTAGUE & HERRON 19 Noes none so said appropriation was made and ordered to be paid out of any monies in the hands of the Treasurer of the Poorhouse not otherwise appropriated. On motion to appropriate to D J JONES William M LAFFERTY and George W BARKER each the sum of twelve dollars for their services for holding the Quorum Courts for Wayne County the year 1851 Those who voted in the affirmative were D J JONES Chr HAYNES LAFFERTY CARTER A MONTAGUE BARKER VOORHIES L B GANT HOPSON J MONTAGUE & HERRON 11 Noes WILSON CURTIS HUCKABY PHILIPS & WHITTEN 5 So said appropriation was made to be paid out of any monies in the hands of the Trustee of said County not otherwise appropriated Iss’d Jan 1852

Upon the petition of Lewis B. GANT it is ordered by the Court that the Sheriff of Wayne County summons a Jury of View to consist of not less than five nor more than twelve freeholders & unconnected to the persons concerned to view and mark out so as to change the road of second Class leading up Indian Creek leaving the old road below said GANTs plantation and runn up on the west side of said Creek and intersect the same near the forks of the road above said GANTs plantation and that they report the same to the April term of this court Iss’d Febr 8, 1852

A Settlement between Wm Jones Clerk of this Court and James M RAMSEY Administrator of the estate of John N SHIELDS dec’d was this day submitted to the court which was confirmed by the Court and ordered to be recorded

Upon motion it is ordered by the Court that David J JONES Abraham MONTAGUE & George W BARKER be appointed Commissioners [to super – crossed out] to superintend the Poor house in [said – crossed out] Wayne County for the year 1852 and that David J JONES be appointed Treasurer of said board of Commissioners Whereupon the said D J JONES entered into bond in the sum of one thousand dollars with A MONTAGUE his security which was received by the Court and ordered to be recorded Whereupon the said D J JONES and A MONTAGUE took the necessary oaths for their qualifications

A Settlement between William JONES Clerk of this Court and James W. CANTRELL and William THORNTON Executors of the estate of Josiah THORNTON Dec’d and this day submitted to the Court which Settlement was confirmed by the Court and ordered to be recorded

Upon the petition of George W. JOHNSON and others It is ordered by the Court that John C. BLACKBURN Litle[?] CHOAT King PRATER Solomon JOBE James GRANT Eli BYNUM Matthew H BURKS Bennet HALE Elijah WARRINGTON and Jesse S ROSS or any five of them be appointed a jury of view to view and mark out a first class road from the Central Turnpike road at or near the head of Eagle Creek on [the – crossed out] and along the dividing ridge between Eagle and Beech creeks to Carrollville in said County and that said jury report to the January term next of the Court Isd Dec 2, 1851.

Came William BEHAM Administrator of the estate of John ALTOM Deceased and on motion of said Administrator it is ordered by the court that he have leave to amend the account of sales by him reported to a former term of this court by adding the following items at the following prices to wit 6 barrels of corn @ $1.50 = $9. one pair Steetyards[?]. one small ____? 50 cents one Broad ax 25 cents

Came William BENHAM Administrator of the estate of Delila GOFORTH Deceased and on motion of said William BENHAM it is ordered by the court that he have leave to ament[sic] the account of sale of said Estate by him returned at a former term of this Court by adding thereto one thousand bundles of fodder sold to L H GRIMES at the price of 50 cents per 100 makes $5.00

It appearing to the Court from the written statement of Clarissa STAGS that her late husband John N. STAGGS late of Wayne County is dead intestate and further that said Clarissa STAGGS relinquishes

her right to administer on the estate of her said husband and requests that David J JONES be appointed administrator of said estate Whereupon the said David J JONES came into Court and entered into bond in the sum of five hundred dollars conditioned for the faithful performance of his administration with James N. STAGGS and William BEHAM as his securities and thereupon the said David J JONES and the said James N. STAGGS and William BENHAM came into Court and acknowledged the execution of said bond which was approved by the Court and ordered to be recorded and that letters of Administration be granted accordingly whereupon the said David J JONES took the necessary Oaths for his qualification as such Administrator

Ordered by the Court that Washington CARTER John McDOUGAL and Cavel B. McLEAN be appointed commissioners to lay off to Clarissa STAGGS widow of John N. STAGGS deceased a years support for herself and family our of the provisions money or other assetts[sic] belonging to said estate and that they report to the next term of this Court Isued Dec 3. 1851

Ordered by the Court that Henry G BREWER be appointed guardian of Jasper Newton BREWER minor heir of William BREWER Deceased he being chosen as such Guardian by the said Jasper N who is over the age of fourteen years, who entered into bond in the sum of one hundred dollars conditioned for the faithful discharge of his duty as such guardian with Rial BREWER his security and took the necessary oath for his qualification as such guardian

MORGAN or any five of them be appointed a jury of view to view to view[sic] and mark out a change in the road leading from Waynesboro to Florence to leave the old road at the south end of said BIVENS lain and intersect said road again at or near the ford of Green River North of Lewis HARDINs place and that said jury make report to the next term of this Court Isued Dec 3, 1851

Upon the petition of Edward A. RUTLEDGE it is ordered by the Court that Bennet COLE Isaac[?] MORRIS David PULLEY Daniel C. WALKER Green WILSON Joseph EAST George W. BARKER John L FOWLER Abraham MONTAGUE and Thomas YOUNG or any five of them be appointed a jury of view to view and mark a change in the road leading from Waynesboro to Savannah so as to leave the old road at the Daniel WALKER road and running down the ridge with the WALKER road a half mile or more and intersect the old road at or near the poor house on Hardins Creek and that they report to the January term next of this Court Isued Dec 3, 1851

Ordered by the Court that John R KYLE be appointed overseer of the Road of 2nd Class in the place of George JACKSON and that he have the same hands to work under his direction Isued Dec 2, 1851

Ordered by the Court that A J TURNBOUGH be appointed Overseer of the Road of 2nd Class in the place of Abram MABRY and that he have the hands in the same bounds to work under his directions Isued Dec 4. 1851

A Settlement between William JONES Clerk of this Court and William SINCLAIR and Resign SINCLAIR Guardians of Nancy J SINCLAIR minor heir of John SINCLAIR deceased [presented – crossed out] was this day presented to the Court which was confirmed by the Court and ordered to be recorded

This day came Joacim DUGGER Administrator of the estate of Eli MERRYMAN Deceased [which account of sales is ordered to be recorded – crossed out] and presented an account of sales of said estate which is received by the Court and ordered to be recorded

JONES Chairman John MONTAGUE & George W. BARKER his associate Justices

Ordered by the Court that Andrew M. SOUTH be appointed Guardian of Elizabeth Ann TYCER John M TYCER and Martha Jane TYCER Minor heirs of William TYCER dec’d and that he enter into [give – crossed out] bond and sufficient security in the sum of sixteen hundred Dollars conditioned for the faithful execution of his guardianship whereupon the said Andrew M SOUTH entered into bond in the sum of sixteen hundred dollars with George COOK and John McDOUGAL as his securities which were approved by the Court and ordered to be recorded and the said Andrew M. SOUTH took the necessary oath for his qualification as such Guardian
Washington CARTER & wife et al Exparte Petition to sell slaves§ Be it remembered that this cause came on for a hearing before the worshipful County Court for the County of Wayne and State of Tennessee on the 3rd day of November 1851 upon the petitioners petition and it appearing to the satisfaction of the Court that said petitioners are the owners of said three slaves mentioned in the petition in this cause as tenants in common to wit Lucy Hannah and Lewis that is to say, Washington CARTER & wife Susan CARTER one third part Charles D MACK one third part & James V MACK one third part of said Slaves, and it further appearing to the Satisfaction of the Court that said Slaves Cannot be equally divided between said parties, and that it is necessary to sell said Slaves so that the proceeds may be equally divided between said parties according to law. It is therefore ordered and decreed by the court that said three Slaves be sold to the highest bidder at the Court house door in Waynesboro on a Credit of twelve Months the purchasers giving bond & good security and a lien retained upon said Slaves until the purchasers money is paid. And it is further ordered by the Court that John McDOUGAL be and is hereby appointed a Commissioner to Sell said Slaves and it is further ordered that he Sell the same as above discribed after giving at least thirty days notice at three or more public places in said County one of which shall be upon the Court house door in said town Waynesboro and it is further ordered that he report to the January Term of this Court and that all other things be reserved

Ordered by the Court that Carry RAY be appointed overseer of the road of second class in place of Moses PRINCE and that he have the hands in the same bounds to work under his directions Isued Nov. 21st 1851

Came William BEHAM Administrator of the estate of Delila GOFORTH and returned into Court an Inventory and account of sales by his oath which was received b the Court and ordered to be recorded
John M. BEHAM who was this day appointed deputy Sheriff of said County of Wayne by Rial BREWER Sheriff of said County came into Court and took the necessary oaths for his qualification as such deputy Sheriff
State of Tennessee Wayne County§ Ss. On the 3rd day of November A.D. one thousand eight hundred and fifty one personally appeared in open court

Josiah YOUNGBLOOD and John W. YOUNGBLOOD residents of Wayne County and State of Tennessee who being duly sworn according to law declare that they and Lydia HORTON are the Children and only heirs at law of William YOUNGBLOOD deceased who was a private in the company commanded by Captain TWIGGS in the 7th Regiment of Infantry (the names of the commanding colonel not remembered) but will be [shown – marked out] known by reference to the original Certificate of discharge) in the war of 1812 that their said father enlisted in November 1814 for the term of five years and served near two years and five months as declarents now remember and believe and was honorably discharged as will appear by reference to his original Certificate of discharge which may be found appended to a former declaration made by Edith YOUNGBLOOD the widow of William YOUNGBLOOD deceased and which has been acknowledged by the commissioner of pensions to be in his possession Declarents would further state that the aforesaid declaration made by Edith YOUNGBLOOD (who is the mother of declarents and widow of William YOUNGBLOOD deceased set out all the facts with regard to the service of the said William YOUNGBLOOD deceased – the time and place he enlisted – the time he remained in service and when and where discharged and also the time of his death more fully than declarents are now able to say and so would respectfully suggest a reference to said declaration for a more general and full statement of the facts. And therefore came Edith YOUNGBLOOD in open Court and after being duly sworn according to law desposes as follows to wit that she is the mother of the aforementioned Josiah [Joseph – crossed out] YOUNGBLOOD, John W. YOUNGBLOOD and Lydia HORTON and also the widow of the said William YOUNGBLOOD deceased and that the said Josiah, J. W. and Lydia are the only heirs at law in fee of the said William YOUNGBLOOD deceased as stated in their declaration That deponent sometime ago made her declaration and had it sent unto the pension office (the reception of which has since been acknowledged by the Commissioner of Pensions) for the purpose of obtaining said bounty land in which declaration deponent stated all the facts pertaining to the rights of the said William YOUNGBLOOD deceased to bounty land during his lifetime and expecting now to obtain the same as his widow but has since learned that she is not entitled to it under the act of 1812 but that his heirs at law in fee are only entitled who are the aforesaid Josiah YOUNGBLOOD John W YOUNGBLOOD and Lydia HORTON – And also Zachariah CYPERT in open Court and after having been duly sworn according to law deposed as follows to wit that he was a neighbor of the said William YOUNGBLOOD for many years during his lifetime and that at his death he bequeathed all his estate to his widow and that the said Josiah YOUNGBLOOD John W. YOUNGBLOOD and Lydia HORTON and that deponent believes the said William YOUNGBLOOD deceased regarded the aforesaid Josiah John W & Lydia as his only heirs at law in fee and that they are his only children and heirs as deponent believes and that he believes all the statements made in the foregoing declaration are true It is considered by the Court that the said Witnesses are persons of good character and standing and that full faith and credit are due to and ought to be given to their foregoing statements It is therefore considered by the Court that the above proceedings[?] be entered of record and a duly certified copy thereof be furnished by the Clerk of this Court to said declarents to enable them to procure the bounty land to which they are entitled as the children and only heirs at law of William YOUNGBLOOD deceased under the Act of Congress passed 11th January 1812.

It appearing to the Court that John S STANFIELD who is a citizen of the County of Wayne is unable to procure the means of living by manual labor from bodily infirmity and it further appearing to the Court that said STANFIELD is in indigent circumstances and has no other means of support Is it therefore ordered by the Court a majority of all the Justices present [and – crossed out] that the said John S STANFIELD is hereby authorized and empowered to hawk and peddle or Merchandize without License in the said County of Wayne and State of Tennessee provided said STANFIELD shall take an oath before the Clerk of this Court that he will not retail the Goods of any other persons directly nor indirectly but that the goods sold by him shall be exclusively his own and provided further that this shall be no authority to said STANFIELD to sell Spiritous Liquors or Clocks without obtaining a License therefore Isued Jan 17, 1852


Personally appeared in open Court Buckly HAM Administrator of the estate of William HEFFINGTON deceased and suggested the insolvency of said estate It is therefore ordered by the Court that said administrator give notice in the Nashville Weekly Union a public Newspaper published in the Town of Nashville in said State for three successive weeks and also by a written notice on the Court house door in the Town of Waynesboro for all those creditors of said estate to come forward and file their claims on or before the first Monday in October 1852 with the Clerk of this Court properly authenticated or they will be for ever barred

State of Tennessee§ Be it remembered that a quorum County Court was begun and held in and for Wayne County at the Court house in the town of Waynesboro on the first Monday being the first day of September in the year of our Lord one thousand eight hundred and fifty one there were present and presiding the following justices of the peace of said County to wit David J JONES, Chairman George W BARKER & William M LAFFERTY
Sufficient cause appearing to the Court for the same it is ordered by the Court that the venerefacious heretofore issued from this court be so changed that James D COPELAND be appointed instead of James COPELAND and that Alexander M CRAVEN be appointed instead of James W. STANFIELD and William J HADDOCK be appointed instead of Josiah DARBY and that the sheriff of Wayne County summon the persons so appointed instead of those who were heretofore appointed as in the original order specified
William STANFIELD presented the Nuncupative Will of James W. STANFIELD deceased: when it appearing to the Court that fourteen days have not elapsed since the death of said James W. STANFIELD It is therefore ordered by the Court that said Nuncupative will (which had been reduced to writing) be filed with the Clerk of this Court and that process issue calling in the next of kin, (that is to say John J. WOODY & wife Nancy Jane and Elizabeth M. STANFIELD, Peyton A. STANFIELD, Elijah B. STANFIELD John STANFIELD & Lucinda M. STANFIELD all of whom are minors under the age of twenty one years except the said John J. WOODY and wife) at the next term of this court to contest said will if they think proper, and that John STANFIELD be appointed guardian adlitem for said minor heirs and represent them at the said next term of this court.

Came into Court William BEHAM who on application was appointed Administrator of the estate of John ALTOM Dec’d and entered into bond in the sum of six hundred dollars with Rial BREWER and Jonathan MORRIS as his securities whereupon the Court ordered that he have letters accordingly and thereupon the said William BENHAM took the necessary oath for his qualification. And thereupon the Court appointed William M. LAFFERTY Clifton M. BROWN and Calvin B McCULLEY commissioners to lay off for the widow of said John ALTOM Isued Sept 18, 1851

JONES and the said Jonathan MORRIS & Rial BREWER acknowledged in open Court the execution of said bond Whereupon the Court ordered that said David J JONES have letters of Administration accordingly and therefore the said DAVID J JONES took the necessary oath for his qualification as such

Be it remembered that this cause coming on for a further hearing this 4th day of August 1851 upon the Report of the Clerk & Master of this Court which is in the words & figures following to wit:
“The undersigned Clerk of the County Court of Wayne County, Tennessee who was directed to sell certain Salves mentioned in the pleading in this cause by a decree of the Worshipful County Court of said County of Wayne at the June Term thereof for the year 1851, begs leave to make the following Report
That after advertising said Salves as directed in said decree he sold said slaves to the highest bidder on a credit of twelve months at the court house door in Waynesboro on the 7th day of July 1851 and Cary W POPE because the purchaser of the Boy Wiley at the price of seven hundred and thirty one dollars & fifty cents And Clayton THARP became the purchaser of the Girl Sibba at the price of Three hundred & fifty dollars who executed their notes with good security for said sums of money respectively and retained a lien on said slaves until said purchase money is paid
All which is respectfully submitted August 4, 1851 //s// William JONES Clerk Which being in no wise excepted to it is considered by the court that said report be and the same is in all things confirmed.
Ordered by the Court that Esquire TURNBOUGH be appointed overseer of the road of 2d class in the place of Obediah WEBSTER and that he have the hands in the same bounds to work under his direction Isued August 15, 1851

Whereas satisfactory evidence has been exibted[sic] to the Court here that Robert CYPERT Late of said County is dead and was before death a United State pensioner and that he died on the 28th day of January 1851 it is therefore ordered by the Court that the Clerk of this Court Certify accordingly Came James HAGGARD who was at the January term 1851 of said County Court appointed Commissioner to take and make out in writing an accurate and complete list of the number of free white Male inhabitants who are twenty one years old and over and returned his list accordingly the aggregate of which is Thirteen hundred and seventy one verified by his oath which was received by the Court and ordered to be recorded
Upon motion to appropriate to Jesse S. ROSS and W CARTER each the sum of four dollars for their services as commissioners to sell certain lots in Waynesboro Those who voted in the affirmative were D J JONES, Chr. This day came Joseph N. ROBNETT in to Court and tendered to the Court his resignation to the office of Constable of Wayne County which was received by the Court and ordered to be recorded.
David J. JONES Chairman of this Court and in behalf of the Court [bound – crossed out] by the Consent of Thomas CARR orphan and George W. BROWN bound the said Thomas CARR to Marcus COOK [the said – crossed out] and the said D. J. JONES as Chr. And the said Marcus COOK entered into indentures binding the said Orphan to the said COOK util[sic] he attains the age of Eighteen years and the Court releases the said George W. BROWN from his obligation in the former indentures.

A settlement between Thomas H MABRY Trustee of Wayne County and A MONTAGUE and Jonathan MORRIS Commissioners appointed by this Court to settle with the revenue Collectors of said County the year 1851 was this day submitted to the Court which was Confirmed by the Court and ordered to be recorded

Came George WHITE and others a Jury summonds and sworn to view and mark out a change in the road of 2d Class leading from David TACKETTs to Waynesboro on the lands of T P CYPERT and report to the Court a change made as directed in the order which was received and ordered to be recorded

Came Jonathan MORRIS and others a Jury summonds and qualified to view and mark out a pass way sufficient for a third class road from Mary H SHIELDS so as to intersect the Waynesboro Road near John A KENNEDYs and report a way found as directed in said Order Which report was received and ordered to be recorded

Came Baker CYPERT and others a Jury summonds and qualified to view and report the expediency of disannulling the new Road and opening the old one leading from Baker CYPERTs to John McGLAMERYs and report to the Court that said change is necessary as the old road is the best which report was received and ordered to be recorded

Ordered by the Court that Mathew JOHNSON be appointed overseer of the road of 2d Class in the place of Charles LISLES and that he have the hands in the same bounds to work under his direction Isued July 23? 1851
