Court in December 1851

State of Tennessee§ Be it remembered that a Quorum County Court was begun and held in and for the County of Wayne at the Court house in the town of Waynesboro and the first Monday being the first day of December in the year of our Lord one thousand Eight hundred and fifty one there were present and presiding the following Justices of the peace of said County to wit David J JONES Chairman and Washington CARTER and George W. BARKER his associates

A Settlement between William JONES Clerk of this Court and James W. CANTRELL and William THORNTON Executors of the estate of Josiah THORNTON Dec’d and this day submitted to the Court which Settlement was confirmed by the Court and ordered to be recorded

Upon the petition of George W. JOHNSON and others It is ordered by the Court that John C. BLACKBURN Litle[?] CHOAT King PRATER Solomon JOBE James GRANT Eli BYNUM Matthew H BURKS Bennet HALE Elijah WARRINGTON and Jesse S ROSS or any five of them be appointed a jury of view to view and mark out a first class road from the Central Turnpike road at or near the head of Eagle Creek on [the – crossed out] and along the dividing ridge between Eagle and Beech creeks to Carrollville in said County and that said jury report to the January term next of the Court Isd Dec 2, 1851.

Came William BEHAM Administrator of the estate of John ALTOM Deceased and on motion of said Administrator it is ordered by the court that he have leave to amend the account of sales by him reported to a former term of this court by adding the following items at the following prices to wit 6 barrels of corn @ $1.50 = $9. one pair Steetyards[?]. one small ____? 50 cents one Broad ax 25 cents

Came William BENHAM Administrator of the estate of Delila GOFORTH Deceased and on motion of said William BENHAM it is ordered by the court that he have leave to ament[sic] the account of sale of said Estate by him returned at a former term of this Court by adding thereto one thousand bundles of fodder sold to L H GRIMES at the price of 50 cents per 100 makes $5.00

It appearing to the Court from the written statement of Clarissa STAGS that her late husband John N. STAGGS late of Wayne County is dead intestate and further that said Clarissa STAGGS relinquishes

her right to administer on the estate of her said husband and requests that David J JONES be appointed administrator of said estate Whereupon the said David J JONES came into Court and entered into bond in the sum of five hundred dollars conditioned for the faithful performance of his administration with James N. STAGGS and William BEHAM as his securities and thereupon the said David J JONES and the said James N. STAGGS and William BENHAM came into Court and acknowledged the execution of said bond which was approved by the Court and ordered to be recorded and that letters of Administration be granted accordingly whereupon the said David J JONES took the necessary Oaths for his qualification as such Administrator

Ordered by the Court that Washington CARTER John McDOUGAL and Cavel B. McLEAN be appointed commissioners to lay off to Clarissa STAGGS widow of John N. STAGGS deceased a years support for herself and family our of the provisions money or other assetts[sic] belonging to said estate and that they report to the next term of this Court Isued Dec 3. 1851

Ordered by the Court that Henry G BREWER be appointed guardian of Jasper Newton BREWER minor heir of William BREWER Deceased he being chosen as such Guardian by the said Jasper N who is over the age of fourteen years, who entered into bond in the sum of one hundred dollars conditioned for the faithful discharge of his duty as such guardian with Rial BREWER his security and took the necessary oath for his qualification as such guardian

Ordered by the Court that the following persons be appointed Revenue Commissioners for Wayne County to take a list of polls and taxable property within their respective districts for the year 1852 to wit

Upon the petition of Stephen BIVENS It is ordered by the Court that Lewis HARDIN Pleasant MORGAN Andrew CASTEEL Thomas SHIELDS Jonathan BIFFLE Sylvester L SHIELDS Thompson M. MORGAN or any five of them be appointed a jury of view to view to view[sic] and mark out a change in the road leading from Waynesboro to Florence to leave the old road at the south end of said BIVENS lain and intersect said road again at or near the ford of Green River North of Lewis HARDINs place and that said jury make report to the next term of this Court Isued Dec 3, 1851

Upon the petition of Edward A. RUTLEDGE it is ordered by the Court that Bennet COLE Isaac[?] MORRIS David PULLEY Daniel C. WALKER Green WILSON Joseph EAST George W. BARKER John L FOWLER Abraham MONTAGUE and Thomas YOUNG or any five of them be appointed a jury of view to view and mark a change in the road leading from Waynesboro to Savannah so as to leave the old road at the Daniel WALKER road and running down the ridge with the WALKER road a half mile or more and intersect the old road at or near the poor house on Hardins Creek and that they report to the January term next of this Court Isued Dec 3, 1851

Ordered by the Court that John R KYLE be appointed overseer of the Road of 2nd Class in the place of George JACKSON and that he have the same hands to work under his direction Isued Dec 2, 1851

Ordered by the Court that A J TURNBOUGH be appointed Overseer of the Road of 2nd Class in the place of Abram MABRY and that he have the hands in the same bounds to work under his directions Isued Dec 4. 1851

A Settlement between William JONES Clerk of this Court and William SINCLAIR and Resign SINCLAIR Guardians of Nancy J SINCLAIR minor heir of John SINCLAIR deceased [presented – crossed out] was this day presented to the Court which was confirmed by the Court and ordered to be recorded

This day came Joacim DUGGER Administrator of the estate of Eli MERRYMAN Deceased [which account of sales is ordered to be recorded – crossed out] and presented an account of sales of said estate which is received by the Court and ordered to be recorded
