STATE OF Tennessee, COUNTY OF Campbell, SS:
ON THIS 7th day of July A. D. one thousand eight
hundred and ninety, personally appears before me, William Allen,
the Clerk
of the Circuit Court OF RECORD within and for
the County and State aforesaid, B.
F. Smith Guardian of Jordan Smith, Martha Smith, and Arch. Smith,
resident of Stockville, County of Campbell, State
of Tennessee aged ------------ years, respectively, who being duly
sworn according to law, make the following declaration in order
to obtain the pension provided by Act of Congress for children
under sixteen years of age. That they are the legitimate children
of Brice
M. Smith, who
(1) Enlisted under the name of Brice
M. Smith at London, KY, on
the ------- day of July A. D. 1863, (2) in Co.
C, 9 Regt Tenn, Cav., in the war of 1861-65, who (3) is
now in the Insane Asylum at Knoxville Tenn, and that
said minor children are left wholy without support, discharged
at Nashville on the -------- day of Sept A. D., 1865, and who bore at the time
of his discharge the rank of a private, in (4) Co
C, 9 Reg Tenn Cav that he left no widow surviving (5) that Jordan
Smith, Martha Smith and Arch. Smith, that the above-named are the only surviving
legitimate children of Brice M. Smith, who were under sixteen years
of age at the time of his Insanity, of whom (6) that this
application is under the provisions of Act of June 27, 1890, that said children
were the issue of soldier, as follows, the dates of their birth
being as hereinafter stated:
(7) Jordan Smith, of soldier by ------------------------------,
born August 27, 1873
Martha Smith, of soldier by ---------------------------------, born April 28,
1876
Arch. Smith, of soldier by ------------------------------------, born Sept
22, 1878
Brice M. Smith, of soldier by --------------------------------, born Dec 23,
1840
and is now in the Insane Asylum at Knoxville, Tenn.
That the mother was married under the name of Frankie
Lasley,
to (8) Brice M. Smith, there being no legal barrier to such marriage;
that the said children have not aided or abetted the rebellion;
and that no prior application has been files (9) that B.
F. Smith is the true & legal guardian appointed by Court, that
he B. F. Smith (guardian) that declarant hereby appoint with full power
of substitution and revocation, W. A. Owens of Stockville, Campbell Co, Tenn, his attorney to prosecute the above claim; that his post
office address is Stockville, Campbell County State of Tennessee.

Also personally appeared S.C. Rutherford, residing at Big
Creek Gap, Tennesseeand John P. McGee, residing at Caryville,
Tenn, persons whom I certify to be respectable and entitled
to credit, and who being by me duly sworn according to law, say
that they were present and saw B. F. Smith, the claimant,
sign name (or make his mark)
to the foregoing declaration; that they have every reason to
believe, from appearance of said claimant and their acquaintance
with him, that is the identical person he represents himself to
be; and that they have no interest in this claim.

D. 1890, and I hereby certify that the contents of the
above declaration, &c, were fully made known and explained
