Washington CARTER et al§ Ex Parte Petition to Sell Slaves
Be it remembered that this cause came on for a further hearing before the worshipful county Court of Wayne County Tennessee on this 5th day of January 1852 upon the report of the Special Commissioner appointed [by – crossed out] at a former term of this Court which said report is in the words and figures following to wit
“The undersigned who was appointed to sell the slaves belonging to the Estate of Robert N MACK deceased (mentioned in the pleadings in this cause) by a decreetal order of your worshipful Court would submit the following Report
That on the first day of January 1852 he proceeded to sell said negroes pursuant to notice previously given as be said decretal order directed when said slaves were struck off and sold to Bennet COLE at the following prices the same being the highest and best bids to wit Lucy [or Levy/] at the price of $700.50 Hannah at the price of $476.50 and Lewis? at the price of 334.50 $1511.50 making in the agregate the sum of fiften hundred and eleven dollars and 50 cents and said Benet COLE executed his bond for the sum payable twelve months after this date thereof with James ARNETT as his security who is deemed good and sufficient All which is Respectfully submitted Jany 5 1852 //s// John McDOUGAL Comm’r”
Which being in no wise excepted to it is considered by the Court that said report be and the same is hereby in all things confirmed all other matters being reserved &c.

This day came John C. BLACKBURN Jesse S. ROSS Solomon JOBE Eli BYNUM James GRANT King PRATER and Elijah WARRINGTON who were appointed a jury of view at the December Term 1851 of this Court to view and mark out a second class road from the Turnpike road at or near the head of Eagle Creek to Carrollville in Wayne County and reported a road found as directed in the order issued from this Court whereupon the petition of Jonathan C ELLIOTT and thirty six others were presented in opposition of said road and proof being also heard by the Court as to the practicality and utility of said Road [It was considered by the Court that it is not practical to establish said Road – crossed out] Whereupon on motion to concur in the report of the Jury of view and establish the Road those who voted in the affirmative are David J JONES Chairman Solomon JOBE & W CARTER 3 those who voted in the negative are W HAYES W M LAFFERTY

A MONTAGUE J. C. G. WILSON J. P. VOORHIES J MONTAGUE & G HERRAN Noes 7 so said motion [road – crossed out] was lost Whereupon on motion it is ordered by the Court that Eli BYNUM John C. BLACKBURN and Solomon JOBE be made parties to this suit whereupon the said Eli BYNUM John C. BLACKBURN and Solomon JOBE pray an appeal to the next term of the Circuit Court of Wayne County Tennessee which is granted them they having entered into bond and security according to law.

A majority of the Justices of the peace of Wayne County present the Court proceeded to Levy a County Tax for said County and on motion of Lay said Tax of ten cents on [the evry – crossed out] each hundred dollars worth of Tax able property and twenty five cents on each Poll and fifty percent on the State Tax for all privileges for said County purposes and [A majority of – crossed out] the Justices aforesaid voting in the affirmative the motion carried and said Tax was Layed

Upon the petition of Nathan BIFFLE it is ordered by the Court that A C RASBERRY James DURHAM John G HILL James E McKNIGHT William HILL John STOCKARD or any five of them be appointed a Jury of View and mark out a change in the road leading from Waynesboro to Ashland so as to [and – crossed out] run on the left hand side [so as to leave – crossed out] of the farm on which Joshua MATHENY now lives on and that they report the same to the April term of this Court Issued Febr 2, 1852

Ordered by the Court that W CARTER and Jesse S ROSS Commissioners appointed by this Court the sell certain Lots in the Town of Waynesboro pay the proceeds of said lots to the Treasurer of the Poorhouse Commissioners
Came Solomon JOBE Guardian to the minor heirs of A MELSON Dec’d into Court and renewed his bond in the sum of two hundreds with Elijah WARRINGTON his security which was received by the Court and ordered to be recorded

Ordered by the Court that John CHURCHWELL Jr be appointed overseer of the Road of second Class in the place of Wm. HOLLOWAY and that he have the [bounds in his d – crossed out] hands in the same bounds to work under his direction Issued Jan 21, 1852

Ordered by the Court that John H GRAVES be appointed overseer of the road of second Class in the place of Robert A ROBNETT and that he have the hands in the same bounds to work under his direction Issued Jan 8, 1852

Ordered by the Court that Wade H DEAN be appointed overseer of the road of first Class in the place of Isaac McGLAMERY removed and that he have the hands in the same bounds to work under his direction Issued Jan 8, 1852

Came Nathan C. DAVID into Court who was this day chosen and appointed Guardian to Isaac A. James and Pocahontas [ROBINSON – crossed out] the minor heirs of James ROBINSON Deceased and entered into Court in the sum of Thirteen thousand dollars with John S BURNS and Thomas H MABRY his securities which was approved of by the Court and ordered to be recorded Whereupon the said N C DAVID took the necessary oath for his qualification [in margin: Issued March]

Came D J JONES Administrator of the estate of John N. STAGGS Dec’d and returned into Court an Inventory and account of sales of said estate verified by his oath which was received by the Court and ordered to be recorded

A majority of the Justices of the peace present the court proceeded to elect a Tax Collector for the present year 1852 Whereupon Thomas H MABRY was duly and lawfully elected

Came William RAY who was this day appointed administrator of the Estate of Stephen S RAY deceased and entered into bond in the sum of two hundred dollars with Albert G CLAY and George E. HUCKABY his securities which was approved of by the Court and ordered to be recorded Whereupon the said Wm RAY took the necessary oath for his qualification

A majority of the Justices present the Court proceeded to elect a Quorum for the present year 1852 and Whereupon David J JONES was duly Elected Chairman of said Court and Abraham MONTAGUE and Lewis B. GANT his associates to hold the Quorum County Courts for the twelve months next ensuing

Came Leonard H GRIMES who was this day appointed Guardian to the minor heirs of Elihu S GRIMES deceased and entered into bond in the sum of one hundred dollars with Bennet HALE and Isaac W ROSS his securities conditioned for the faithful performance of said Guardianship whereupon the said L H GRIMES took the necessary oath for his qualification

Upon the petition of John JACKSON it is ordered by the Court that the Sheriff of Wayne County summons a Jury not to consist of less than five nor more than twelve freeholders and unconnected with the parties therein Concerned to View and mark out a change in the road of second Class leading down forty eight mile Creek so as to leave the old road oposite John JACKSONs Jr field near the rock quarry and intersect the same about one fourth mile below and that they report the same to the April term of this Court Issued Febr 2, 1852

Ordered by the Court that Wm BURRIS be appointed overseer of the road of second Class in the place of Litle CHOAT and that he have the hands in the same bounds to work under his direction Iss. Jan. 8, 1852

Ordered by the Court that John RUTLEDGE be appointed overseer of the road of second Class in the place of Marcus COOK removed and that he have the hands in the same bounds to work under his direction. Iss’d Jan 8, 1852


Upon motion it is ordered by the Court that David MITCHELL and all the hands above him on Mitchells branch be released from working on the Waynesboro and Savannah road and that said hands and all in that bounds work on the road [under – crossed out] from the Turnpike road on Eagle Creek to the Stage road on Hardins Creek under George H REA

Ordered by the Court that John FUSON be appointed overseer of the road of first class in the place of Bethel FUSON and that he have the hands in the same bounds to work under his direction Issued Jan 8, 1852

Ordered by the Court that John H. EAST be appointed overseer of the road of first Class in the place of Isaac MORRIS and that he have the hands in the same bounds to work under his direction Issued Jan 8, 1852

Upon motion it is ordered by the Court that Abraham MONTAGUE and James ANDERSON be appointed County Commissioners for Wayne County to settle with the revenue officers for the year 1852

Ordered by the Court that Wm H HILL be appointed overseer of the road of second Class in the place of Elijah MATHENY and that he have the hands in the same bounds to work under his direction Issued Jan 21, 1852

Came James HOLLIS Administrator of the estate of Thomas GIST deceased and suggested to the Court in writing the Insolvency of said estate alledging that there has been more claims presented against said estate than there are means to pay [the Court – crossed out] and prays the court to make such orders in the case as is required by the laws in such cases It is therefore ordered by the Court that the said James HOLLIS Administrator as aforesaid give notice by advertisement in the Messenger a newspaper published in the town of Lawrenceburg in the State of Tennessee for 3 successive weeks the last of which shall be three months before the first Monday in January 1853 and also at the Courthouse door in the town of Waynesboro in County of Wayne in said state notifying all persons having claims against said estate to appear and file their claims with the Clerk of the County Court of Wayne County Tennessee duly authenticated on or before the first Monday in January 1853 or the same will be forever barred

Upon the petition of Lewis B. GANT it is ordered by the Court that the Sheriff of Wayne County summons a Jury of View to consist of not less than five nor more than twelve freeholders & unconnected to the persons concerned to view and mark out so as to change the road of second Class leading up Indian Creek leaving the old road below said GANTs plantation and runn up on the west side of said Creek and intersect the same near the forks of the road above said GANTs plantation and that they report the same to the April term of this court Iss’d Febr 8, 1852

A Settlement between Wm Jones Clerk of this Court and James M RAMSEY Administrator of the estate of John N SHIELDS dec’d was this day submitted to the court which was confirmed by the Court and ordered to be recorded

Upon motion it is ordered by the Court that David J JONES Abraham MONTAGUE & George W BARKER be appointed Commissioners [to super – crossed out] to superintend the Poor house in [said – crossed out] Wayne County for the year 1852 and that David J JONES be appointed Treasurer of said board of Commissioners Whereupon the said D J JONES entered into bond in the sum of one thousand dollars with A MONTAGUE his security which was received by the Court and ordered to be recorded Whereupon the said D J JONES and A MONTAGUE took the necessary oaths for their qualifications

It appearing to the Court that Elizabeth DICKSON [WARREN – crossed out] wife of Samuel DICKSON has died in [this – crossed out] Wayne County intestate And the said Samuel DICKSON having this day come into open Court and renounced his right to administer upon the separate estate of his said wife and Thomas WARREN [having – crossed out] son of the said Elizabeth having applied to this Court for Letters of Administration upon the separate estate of said Elizabeth WARREN It is therefore ordered by the Court that Letters of Administration upon the goods and chattles rights and credits of said Elizabeth WARREN upon his entering into bond and security as required by law and came into Court said Thomas WARREN and William POLLARD and John M McDOUGAL his securities and entered into bond in the [sum – crossed out] the penal sum of four thousand dollars conditioned for his faithful administration of said estate which bond was duly acknowledged in open Court by said Thomas WARREN William POLLARD and John McDOUGAL and approved by the Court And thereupon the said Thomas WARREN was duly sworn in open Court Faithfully to discharge his duty as such Administrator as prescribed by law

Came Wm M LAFFERTY and others who was at a former term of this Court appointed Commissioners to allot and set apart to the widow of John ALTOM deceased one years support and reported accordingly which was received by the Court and ordered to be recorded

Came D J JONES Administrator of the estate of Cynthia STOCKARD dec’d and returned into Court an inventory and Account of sales of said estate verified by his oath which was received by the Court and ordered to be recorded

Came D K HOOD and others who was at a former term of this Court appointed to lay off to Samuel STOCKARD minor heir of Cynthia STOCKARD deceased a support for one year and reported accordingly which was received and ordered to be recorded

Came Wm BENHAM Administrator of the estate of John ALTOM deceased and returned into Court and Inventory and Accounts of sales verified by his Oath which was received by the Court and ordered to be recorded

Came C B McLEAN Administrator of the estate of Henry GRIMES deceased and returned into Court an Act. of second sale of said estate verified by his Oath which was received by the Court and ordered to be recorded

Came John McDOUGAL and other who was at a former term of this Court appointed Commissioners to lay off to the widow of Lemuel ASKEW deceased one years support for herself & family and reported accordingly which was received by the Court and ordered to be recorded

This day the non cupative will of James W STANDFIELD was produced in Court and proven to be the last will and testament of said James W STANDFIELD by John W SHULL Robinson TALLY and P. S STANDFIELD who after having been duly sworn deposed and said that they were acquainted with said James W STANDFIELD on the 22d day of August 1851 during his last sickness and in his own dwelling house in said County and in their presence they being be him called upon [by – crossed out] them and particularly the said John W. SHULL made the following deposition of his property to wit that it was his will and desire that his father and John W SHULL should administer upon his effects and take care of his children and keep them together on his plantation and that all his household property should be kept for their benefit also two cows to wit one called pink and the one called the Gillis cow also one filly to be kept with the children for their use & benefit the ballance sold and

his matters settled up and all his debts paid off The children to be kept on his place if they could be satisfied if not the land to be rented our until the youngest child come of age that he died the same day that it was made that at the time said testator was of disposing mind and memory and not under any undue influence that the said non cupative will was reduced to writing by them and signed by them on the 30th day of August 1851 It is therefore ordered by the Court that the noncupative will be established and that the same as committed to writing by said witnesses be recorded and thereupon William STANDFIELD and John W SHULL the executors nominated in said will applied for Letters testamentary upon said Will and they having entered into bond in the penal sum of fifteen hundred dollars with John A STANDFIELD William WEST T H DICKERSON and Robinson TALLY as their securities conditioned for their faithful execution of the trusts in said will which bond was acknowledged in open Court and which was duly approved by the Court It was therefore ordered by the Court that Letters Testamentary issue to said Executors accordingly And thereupon the said John W. It appearing to the Court that John S STANFIELD who is a citizen of the County of Wayne is unable to procure the means of living by manual labor from bodily infirmity and it further appearing to the Court that said STANFIELD is in indigent circumstances and has no other means of support Is it therefore ordered by the Court a majority of all the Justices present [and – crossed out] that the said John S STANFIELD is hereby authorized and empowered to hawk and peddle or Merchandize without License in the said County of Wayne and State of Tennessee provided said STANFIELD shall take an oath before the Clerk of this Court that he will not retail the Goods of any other persons directly nor indirectly but that the goods sold by him shall be exclusively his own and provided further that this shall be no authority to said STANFIELD to sell Spiritous Liquors or Clocks without obtaining a License therefore Isued Jan 17, 1852


Personally appeared in open Court Buckly HAM Administrator of the estate of William HEFFINGTON deceased and suggested the insolvency of said estate It is therefore ordered by the Court that said administrator give notice in the Nashville Weekly Union a public Newspaper published in the Town of Nashville in said State for three successive weeks and also by a written notice on the Court house door in the Town of Waynesboro for all those creditors of said estate to come forward and file their claims on or before the first Monday in October 1852 with the Clerk of this Court properly authenticated or they will be for ever barred

Justices holding the County Court upon the petition of petitioners and the exhibits when by order of the Court this cause is referred to the Clerk & Master to take proof and report whether or not the heirs at law of said John N SHIELDS are correctly set out in said petition and whether or not it is necessary to sell said land to pay the debts against said estate and whether or not the said lands can be partitioned among the said heirs at law advantageously without a sale thereof and report to the present term of the court

Be it remembered that this cause came on this day for further hearing before the worshipful David J JONES William LAFFERTY and James T YOUNG Justices of the peace for the County of Wayne and State of Tennessee duly commissioned and qualified to hold the County Court for said County then and there presiding and hold said Court upon petition order pro confessor exhibits and proof When it appeared to the satisfaction of the Court that Lemuel POPE died in said county of Wayne in January 1848 leaving and surviving him neither widow or descendants but leaving and surviving him the petitioners and defendants his distributes and heirs at law as mentioned and set for in the petition in this cause and that they as such distributees and heirs at law are entitled to the land and slaves as mentioned and so for in said petition and it further appearing to the Court from the proof in the cause that the same be sold It is therefore ordered adjudged and decreed by the Court that Samuel L. BURNS be appointed commissioner who after having given 30 days notice in written advertisement at the Court House in Waynesboro, Ashland, Clifton and Sorby, in said County shall proceed upon said land to sell the same upon a credit of one and two years to the highest bidder that he take bonds from the purchase money with two or more good and sufficient securities retaining a lien until the same is paid that he enter into bond with two securities payable to the chairman of this court in the sum of six thousand dollars conditioned for the faithful performance of this duties as such commissioner and that he report to the next term of this Court.

It is further ordered & adjudged and decreed by the court that John McDOUGAL Jonathan I BIFFLE Franklin WITHERSPOON David J JONES and John A BURNS or a majority of them be appointed commissioners who after having been duly sworn for said purpose shall proceed to value the slaves mentioned in the said petition to wit Daniel, Bandy, Ann, Crawford, Calvin, Henry, Anthony, Wiley, Grundy, Melissa, Louisa, Ben , Sibba, Lutitia and John

and add their whole value together and shall then divide said slaves into nine lots making each lot as near equal in value as can be and charging the lots greater in vale than the one ninth part of the value of the whole number and with the excess over such average value and giving to such lots as may be less in value than such average value such sums as will make them all equal in value and that they allot and set apart to said Thomas A POPE, Cary W POPE, Martha CRUMP and Ann MITCHELL each one lot and to the said children of John POPE deceased one lot to the said children of William R. POPE deceased one lot to the said children of Elizabeth ANDREWS deceased one lot to the said children of Amarilla BAUGH deceased one lot and that they make their report of the same under their hands and seals to the next term of this Court
Said Samuel L BURNS came into Court and enter into bond with Jonathan J BIFFLE and Claiborn ACKLIN his securities in the sum of sic[sic] thousand dollars payable to David J. JONES Chairman of this Court and his successors in office conditioned as the law directs for the faithful performance of his duties Samuel L. CYPERT all of the County [of Wayne – crossed out] and State aforesaid are held and firmly bound unto the State of Tennessee in the sum of twenty five hundred dollars which payment well and truly to be made we bind ourselves our heirs executors & administrators dated this 1st day of April 1850 The condition of the above obligation is such that whereas the above bound Thomas H MABRY is trustee of Wayne County whose duty is to receive and pay over all fines by him received under an act of the Assembly entitled an act to punish small offenses. It is ordered by the Court (there being more than [a majority-crossed out] two thirds of the Justices of the Peace in said County present) that an additional civil district to be known as district No 14 be and the same is hereby established and bounded as follows to wit commencing where the old line between Wayne and Hardin County intersects the Tennessee River thence up the river to the point where the line between Wayne and Hardin County as established by the act of 1849-50 attaching a portion of Hardin County to Wayne County leaves said river thence with said line to the old Wayne County lines thence north with said line to the beginning being that portion so attached to the County of Wayne It is further ordered by the Court that the Town of Clifton in said District be and is hereby established the place of holding elections and the precinct in and for said District until the same is changed by a majority of the voters of said District voting in any District election voting for the same. Ordered by the Court that the Commissioners appointed at a former Term of this Court to sell the lots on the west Square of the town of Waynesboro hand over to the Treasurer of the Poorhouse Commissioners the balance of the proceeds of said sales and said Treasurer pay the same toward the land purchased by the Poorhouse Commissioners.

Ordered by the court that John McDOUGAL one of the Commissioners appointed at a former term of this court to set apart provisions for the Widow Shields & family for one year amend said order so as to set apart such additional articles which was done and rec’d by the Court and ordered to be recorded.

  • It appearing to the Court that Thomas M JONES a Student at law is twenty one years of age and a man of good moral carachter[sic] it is ordered by the Court that he same be certified accordingly Isued Nov 26th 1849
  • It appearing to the Court here that Thomas B[?] MELTON has lately died in Wayne County having left no last will and testament and it farther appearing to the Court that Elizabeth MELTON his widow does not wish to administer upon said Estate and King BREWER having made application for letters of administration upon said estate and he having given bond in the sum of three hundred dollars with Lot DANIEL and Andrew J BREWER his securities conditioned for the faithful administration of said estate and he having taken the oath prescribed by law it is ordered by the Court that letters of administration issue to him accordingly

It is ordered b the Court that Sampson BREWER, Joseph COCKMAN, and Joseph PRITCHETT freeholders and unconnected with the parties by affinity or consanguinity be appointed commissioners who after having been duly qualified for said purpose proceed to allot and set apart to Elizabeth MELTON widow of Thomas B MELTON deceased so much of the stock crop provisions monies or other assetts belonging to the estate of said Thomas B MELTON as shall be sufficient for the support of herself and family for one year next after the death of her said husband and report to the next term of this Court

  • It is ordered by the Court that the poor house commissioners are hereby authorized to contract for a tract of land with [from – crossed out] John L FOWLER situated upon Hardins Creek being the place upon which Messes JONES and BALDRIDGE now live known as the old BOYD [BALDRIDGE – crossed out] place including 400 Acres including the Buildings [all the lands owned and claimed by the said Bal.. FOWLER – crossed out] at said place provided the same can be obtained for seven hundred and fifty dollars four hundred dollars to be by the 25th December 1849 and the balance due 25th December 1850 and if said payments are not paid when due the interest to be paid on the balance due until the same [until – crossed out] is paid provided said FOWLER makes or causes to be made a good and sufficient title in fee simple to said land with general warrantee
  • This day Elijah H PUGH Sheriff and Tax Collector of Wayne County for the year 1849 made his report of insolvents showing the amount of Tax on insolvents and removals due the State is to be $6.25 [$14.25 – crossed out] and that due the County of Wayne $14.24 [$19.56 – crossed out] verified by the affidavit required by law It is therefore ordered by the Court said report be confirmed and that said Elijah H PUGH Collector etc be allowed a credit for said amounts respectively in his settlements with the Treasurer of the State of Tennessee and the Trustee of Wayne County It is farther ordered by the Court that said report and affidavit be recorded in the Revenue dockett of this Court.
