Washington CARTER et al§ Ex Parte Petition to Sell Slaves
Be it remembered that this cause came on for a further hearing before the worshipful county Court of Wayne County Tennessee on this 5th day of January 1852 upon the report of the Special Commissioner appointed [by – crossed out] at a former term of this Court which said report is in the words and figures following to wit
“The undersigned who was appointed to sell the slaves belonging to the Estate of Robert N MACK deceased (mentioned in the pleadings in this cause) by a decreetal order of your worshipful Court would submit the following Report
That on the first day of January 1852 he proceeded to sell said negroes pursuant to notice previously given as be said decretal order directed when said slaves were struck off and sold to Bennet COLE at the following prices the same being the highest and best bids to wit Lucy [or Levy/] at the price of $700.50 Hannah at the price of $476.50 and Lewis? at the price of 334.50 $1511.50 making in the agregate the sum of fiften hundred and eleven dollars and 50 cents and said Benet COLE executed his bond for the sum payable twelve months after this date thereof with James ARNETT as his security who is deemed good and sufficient All which is Respectfully submitted Jany 5 1852 //s// John McDOUGAL Comm’r”
Which being in no wise excepted to it is considered by the Court that said report be and the same is hereby in all things confirmed all other matters being reserved &c.
This day came John C. BLACKBURN Jesse S. ROSS Solomon JOBE Eli BYNUM James GRANT King PRATER and Elijah WARRINGTON who were appointed a jury of view at the December Term 1851 of this Court to view and mark out a second class road from the Turnpike road at or near the head of Eagle Creek to Carrollville in Wayne County and reported a road found as directed in the order issued from this Court whereupon the petition of Jonathan C ELLIOTT and thirty six others were presented in opposition of said road and proof being also heard by the Court as to the practicality and utility of said Road [It was considered by the Court that it is not practical to establish said Road – crossed out] Whereupon on motion to concur in the report of the Jury of view and establish the Road those who voted in the affirmative are David J JONES Chairman Solomon JOBE & W CARTER 3 those who voted in the negative are W HAYES W M LAFFERTY

A MONTAGUE J. C. G. WILSON J. P. VOORHIES J MONTAGUE & G HERRAN Noes 7 so said motion [road – crossed out] was lost Whereupon on motion it is ordered by the Court that Eli BYNUM John C. BLACKBURN and Solomon JOBE be made parties to this suit whereupon the said Eli BYNUM John C. BLACKBURN and Solomon JOBE pray an appeal to the next term of the Circuit Court of Wayne County Tennessee which is granted them they having entered into bond and security according to law.
A majority of the Justices of the peace of Wayne County present the Court proceeded to Levy a County Tax for said County and on motion of Lay said Tax of ten cents on [the evry – crossed out] each hundred dollars worth of Tax able property and twenty five cents on each Poll and fifty percent on the State Tax for all privileges for said County purposes and [A majority of – crossed out] the Justices aforesaid voting in the affirmative the motion carried and said Tax was Layed

Upon the petition of Nathan BIFFLE it is ordered by the Court that A C RASBERRY James DURHAM John G HILL James E McKNIGHT William HILL John STOCKARD or any five of them be appointed a Jury of View and mark out a change in the road leading from Waynesboro to Ashland so as to [and – crossed out] run on the left hand side [so as to leave – crossed out] of the farm on which Joshua MATHENY now lives on and that they report the same to the April term of this Court Issued Febr 2, 1852

A majority of the Justices of the peace present the court proceeded to elect a Tax Collector for the present year 1852 Whereupon Thomas H MABRY was duly and lawfully elected
Came William RAY who was this day appointed administrator of the Estate of Stephen S RAY deceased and entered into bond in the sum of two hundred dollars with Albert G CLAY and George E. HUCKABY his securities which was approved of by the Court and ordered to be recorded Whereupon the said Wm RAY took the necessary oath for his qualification
A majority of the Justices present the Court proceeded to elect a Quorum for the present year 1852 and Whereupon David J JONES was duly Elected Chairman of said Court and Abraham MONTAGUE and Lewis B. GANT his associates to hold the Quorum County Courts for the twelve months next ensuing
Came Leonard H GRIMES who was this day appointed Guardian to the minor heirs of Elihu S GRIMES deceased and entered into bond in the sum of one hundred dollars with Bennet HALE and Isaac W ROSS his securities conditioned for the faithful performance of said Guardianship whereupon the said L H GRIMES took the necessary oath for his qualification
Upon the petition of John JACKSON it is ordered by the Court that the Sheriff of Wayne County summons a Jury not to consist of less than five nor more than twelve freeholders and unconnected with the parties therein Concerned to View and mark out a change in the road of second Class leading down forty eight mile Creek so as to leave the old road oposite John JACKSONs Jr field near the rock quarry and intersect the same about one fourth mile below and that they report the same to the April term of this Court Issued Febr 2, 1852
Ordered by the Court that Wm BURRIS be appointed overseer of the road of second Class in the place of Litle CHOAT and that he have the hands in the same bounds to work under his direction Iss. Jan. 8, 1852
Ordered by the Court that John RUTLEDGE be appointed overseer of the road of second Class in the place of Marcus COOK removed and that he have the hands in the same bounds to work under his direction. Iss’d Jan 8, 1852

Upon motion it is ordered by the Court that Abraham MONTAGUE and James ANDERSON be appointed County Commissioners for Wayne County to settle with the revenue officers for the year 1852
Ordered by the Court that Wm H HILL be appointed overseer of the road of second Class in the place of Elijah MATHENY and that he have the hands in the same bounds to work under his direction Issued Jan 21, 1852
Came James HOLLIS Administrator of the estate of Thomas GIST deceased and suggested to the Court in writing the Insolvency of said estate alledging that there has been more claims presented against said estate than there are means to pay [the Court – crossed out] and prays the court to make such orders in the case as is required by the laws in such cases It is therefore ordered by the Court that the said James HOLLIS Administrator as aforesaid give notice by advertisement in the Messenger a newspaper published in the town of Lawrenceburg in the State of Tennessee for 3 successive weeks the last of which shall be three months before the first Monday in January 1853 and also at the Courthouse door in the town of Waynesboro in County of Wayne in said state notifying all persons having claims against said estate to appear and file their claims with the Clerk of the County Court of Wayne County Tennessee duly authenticated on or before the first Monday in January 1853 or the same will be forever barred

GANT it is ordered by the Court that the Sheriff of Wayne County summons a Jury of View to consist of not less than five nor more than twelve freeholders & unconnected to the persons concerned to view and mark out so as to change the road of second Class leading up Indian Creek leaving the old road below said GANTs plantation and runn up on the west side of said Creek and intersect the same near the forks of the road above said GANTs plantation and that they report the same to the April term of this court Iss’d Febr 8, 1852
A Settlement between Wm Jones Clerk of this Court and James M RAMSEY Administrator of the estate of John N SHIELDS dec’d was this day submitted to the court which was confirmed by the Court and ordered to be recorded
Upon motion it is ordered by the Court that David J JONES Abraham MONTAGUE & George W BARKER be appointed Commissioners [to super – crossed out] to superintend the Poor house in [said – crossed out] Wayne County for the year 1852 and that David J JONES be appointed Treasurer of said board of Commissioners Whereupon the said D J JONES entered into bond in the sum of one thousand dollars with A MONTAGUE his security which was received by the Court and ordered to be recorded Whereupon the said D J JONES and A MONTAGUE took the necessary oaths for their qualifications

It appearing to the Court that Elizabeth DICKSON [WARREN – crossed out] wife of Samuel DICKSON has died in [this – crossed out] Wayne County intestate And the said Samuel DICKSON having this day come into open Court and renounced his right to administer upon the separate estate of his said wife and Thomas WARREN [having – crossed out] son of the said Elizabeth having applied to this Court for Letters of Administration upon the separate estate of said Elizabeth WARREN It is therefore ordered by the Court that Letters of Administration upon the goods and chattles rights and credits of said Elizabeth WARREN upon his entering into bond and security as required by law and came into Court said Thomas WARREN and William POLLARD and John M McDOUGAL his securities and entered into bond in the [sum – crossed out] the penal sum of four thousand dollars conditioned for his faithful administration of said estate which bond was duly acknowledged in open Court by said Thomas WARREN William POLLARD and John McDOUGAL and approved by the Court And thereupon the said Thomas WARREN was duly sworn in open Court Faithfully to discharge his duty as such Administrator as prescribed by law

Came Wm BENHAM Administrator of the estate of John ALTOM deceased and returned into Court and Inventory and Accounts of sales verified by his Oath which was received by the Court and ordered to be recorded
Came C B McLEAN Administrator of the estate of Henry GRIMES deceased and returned into Court an Act. of second sale of said estate verified by his Oath which was received by the Court and ordered to be recorded

This day the non cupative will of James W STANDFIELD was produced in Court and proven to be the last will and testament of said James W STANDFIELD by John W SHULL Robinson TALLY and P. S STANDFIELD who after having been duly sworn deposed and said that they were acquainted with said James W STANDFIELD on the 22d day of August 1851 during his last sickness and in his own dwelling house in said County and in their presence they being be him called upon [by – crossed out] them and particularly the said John W. SHULL made the following deposition of his property to wit that it was his will and desire that his father and John W SHULL should administer upon his effects and take care of his children and keep them together on his plantation and that all his household property should be kept for their benefit also two cows to wit one called pink and the one called the Gillis cow also one filly to be kept with the children for their use & benefit the ballance sold and

his matters settled up and all his debts paid off The children to be kept on his place if they could be satisfied if not the land to be rented our until the youngest child come of age that he died the same day that it was made that at the time said testator was of disposing mind and memory and not under any undue influence that the said non cupative will was reduced to writing by them and signed by them on the 30th day of August 1851 It is therefore ordered by the Court that the noncupative will be established and that the same as committed to writing by said witnesses be recorded and thereupon William STANDFIELD and John W SHULL the executors nominated in said will applied for Letters testamentary upon said Will and they having entered into bond in the penal sum of fifteen hundred dollars with John A STANDFIELD William WEST T H DICKERSON and Robinson TALLY as their securities conditioned for their faithful execution of the trusts in said will which bond was acknowledged in open Court and which was duly approved by the Court It was therefore ordered by the Court that Letters Testamentary issue to said Executors accordingly And thereupon the said John W. SHULL and William STANDFIELD were duly sworn [to – crossed out] faithfully to execute the trusts of said will
Came Wm BENHAM and others who was at a former term of this Court appointed a Jury to View and mark out so as to change the road of 2d Class through the lands of N F JOHNSON and report a road found as directed in said order which was received by the Court and ordered to be recorded

It appearing to the Court that John S STANFIELD who is a citizen of the County of Wayne is unable to procure the means of living by manual labor from bodily infirmity and it further appearing to the Court that said STANFIELD is in indigent circumstances and has no other means of support Is it therefore ordered by the Court a majority of all the Justices present [and – crossed out] that the said John S STANFIELD is hereby authorized and empowered to hawk and peddle or Merchandize without License in the said County of Wayne and State of Tennessee provided said STANFIELD shall take an oath before the Clerk of this Court that he will not retail the Goods of any other persons directly nor indirectly but that the goods sold by him shall be exclusively his own and provided further that this shall be no authority to said STANFIELD to sell Spiritous Liquors or Clocks without obtaining a License therefore Isued Jan 17, 1852
Personally appeared in open Court Buckly HAM Administrator of the estate of William HEFFINGTON deceased and suggested the insolvency of said estate It is therefore ordered by the Court that said administrator give notice in the Nashville Weekly Union a public Newspaper published in the Town of Nashville in said State for three successive weeks and also by a written notice on the Court house door in the Town of Waynesboro for all those creditors of said estate to come forward and file their claims on or before the first Monday in October 1852 with the Clerk of this Court properly authenticated or they will be for ever barred

On Motion [Came D J JONES – crossed out] it is ordered by the Court that James ANDERSON D. J. JONES and John McDOUGAL by appointed Commissioners to allot and set apart to Rachel MERRYMAN widow of Eli MERRYMAN deceased so much of the stock crop [stock – crossed out] provision and money as shall be sufficient for the support of herself and family for the term of one year from the death of her said husband and that they report the same to the November term of this Court and that Order Isue accordingly
Rachel MERRYMAN Widow of Eli MERRYMAN deceased this day relinquished her right of Administration on said estate in writing to the Court and request the Court to appoint Joacim DUGGER adm’r on said Estate And Whereupon the said Joacim DUGGER came in to Court and entered into bond in the sum of Twenty five hundred dollars with John McDOUGAL and Stephen BIVENS his securities and whereupon the said DUGGER and each of his securities came into Court and acknowledged the execution of said Bond which was received by the Court and ordered to be recorded And whereupon the said Joacim DUGGER took the necessary Oath for his qualification

5 days notice of her intention to a make this application and are present and assenting to the decree the said said Thomas T. MABRY being also Administrator of the Estate of the said Daniel MABRY Dec’d It further appearing to the Court that the following named persons are heirs of said Daniel MABRY dec’d and minors under the age of twenty one years [to wit, crossed out] and have no regular Guardian to wit [line blank]

Upon motion a majority of the Justices present it is ordered by the Court that Abraham MONTAGUE and James ANDERSON be appointed Commissioners to settle with the Clerk and trustee of Wayne County the present year 1851
Upon motion a majority of the Justices present the Court proceeded to elect a Commissioner to take the census of the free white male inhabitants of Wayne County who are twenty one years of age and upwards in Compliance with an act of the last general assembly and whereupon James HAGGARD was duly elected

Be it remembered that this cause came on this day for further hearing before the worshipful county court of Wayne County David J JONES Washington CARTER William M LAFERTY James T YOUNG & Others Justices of the peace of said County present and presiding Upon the report of Samuel L BURNS commissioner to set said land and John McDOUGAL & others commissioners to divide and allot the slaves mentioned in the pleadings of this cause which report ar[sic] in the words and figgers[sic] as follows to wit to the worshipful County Court of Wayne County the undersigned in Obedience to a directed order maid[sic] by the Last term of your Worshipful Court after having given the notice in the manner and upon the time mentioned in said order Proceeded on this day to sell the land mentioned therein belonging[sic] to the heirs at law of Lemuel POPE deceased when William R. To the worshipful County Court of Wayne County We the undersigned in obedience to a decretal order issued by your Worships at the last term of your Court after having been duly sworn for said purpose have proceeded to value the Slaves mentioned in said Order Except Daniel who from an Injury Received since the making of said Order is at present considered worthless and is left for further action By you. Which report not being in any wise Excepted to and in all things confirmed it is therefore ordered adjudged and decreed By the Cort[sic] that all the right title claim and Interest of the other petitioners and defendants in all to said slave Crawford be divested Out of them and that the same be vested in the said Carry W POPE his heirs and assigns forever
it is further Ordered and decreed by the Cort[sic ] that said Carry W POPE Pay it to the said Thomas A POPE the said sum of Eight dollars and thirty four cents it is further Ordered ajudged[sic] and decreed By the Court that all the right title[sic] claim and Interest in and to said slave Luisa and John Be divested out of them and vested in said Thomas A POPE his heirs and assigns forever it is further ordered and decreed By the Court that all of the right title[sic] claim and Interest of the other petitioners and of the defendants in and to said slaves Bandy and Grundy be divested out of them and that the same be vested in said Martha CRUMP her heirs and assigns forever it is further Ordered and decreed By the court that said Martha CRUMP Pay to said Licey[?] J POPE Gardina[sic] of the minor heirs of William R. it is further Ordered and decreed By the Court that all the Wright[sic] title[sic claim and Interest of the other petissuners[sic] and defendants in to said slave An and her two children Lutitia and the said Infant be divested Out of them and that the same be vested in said William MITCHELL and wife Ann there[sic heirs and assigns forever
It is further Ordered and decreed By the Court that said William MITCHEL and wife Ann pay to said minor heirs of William R POPE the said some[sic] of One hundred and thirty three dollars and thirty four cents
It is further Ordered and decreed By the Court that It is further Ordered and decreed By the Court that all the right title{sic] claim and Interest of the Petissuners[sic] and defendants in and to said slave Calvin be devested[sic] Out of them and that the same be vested in the said John O POPE Palmurah[?] POPE W William POPE and Arnastatia[?] POPE and Edwin POPE Jontly their heirs and assigns forever.
It is further ordered and decreed by the Court that all the rights title claim and interest of the petitioners in and to said Slave Willie and Sibley be divested out of them and the same be vested jointly in the said Samuel J ANDREWS and others who take as the children and descendants of Elizabeth ANDREWS it is further ordered and decreed by the Court that said Samuel J ANDREWS and others taking as aforesaid pay to the said minor heirs of William R POPE Dec’d the said sum of thirty four dollars and sixty six cents and that pay to said Daniel BAUGH as other Guardian of said Sarah E BAUGH George ARMSTRONG & wife Ann L the said sum of forty one Dollars and sixty six cents it is further ordered and decreed by the Court that said sums so due from said Samuel J. ANDREWS and others be paid by said Samuel L. BURNS Administrator &c out of any funds in his hands to which said Lemuel J. ANDREWS and others so taking as aforesaid may be entitled as distributors of said Lemuel POPE deceased and the receipts of the regular guardian of said minors and those entitled thereto shall be a good voucher in the hands of said Samuel l BURNS It is further ordered by the Court that said Samuel L BURNS hire out said Slave Willie but so as to have him subject to the further order of this Court [that-crossed out] and that he provide for the maintenance[sic] of said slave Sibby. It is further ordered and decreed by the court that all the right title claim and interest of the other petitioners and defendants in and to the said slave Henry be divested our of them and that the same be vested in said Gustavus A. PARHAM Matthew P PARHAM William PARHAM and Henry PARHAM jointly and their heirs and assigns forever
It is further Ordered and decreed by the Court that said Gustavus A. PARHAM Matthew P PARHAM William PARHAM and Henry PARHAM pay to said Thomas A POPE said Sum of Eight dollars and 34 cents It is further ordered and decreed by the Court that all the right title claim and interest of said other petitioners and defendants in and to said Slave Arthur be divested out of them and be vested in Sara E BAUGH and George ARMSTRONG and wife Ann ARMSTRONG jointly their heirs and assigns forever that is to say the one half in interest of the Sarah E BAUGH and the other half in the said George ARMSTRONG and wife Ann It is further ordered and decreed by the Court that all the title claim and interest of the other petitioners and defendants in and to said Slave Melissa and Ben be divested out of them and that the same be vested in said Leonida POPE Gustavus POPE James POPE Lucy A. POPE and Mary POPE jointly their heirs and assigns forever It is further ordered by the Court that said Samuel L BURNS make such provisions for said Slave Daniel as the necessity of the case may require and pay the expenses of the same out of any assets in his hands belonging to the estate of said Lemuel POPE Deceased until further directed by this Court. It is further ordered and decreed by the Court that said Samuel L BURNS out of any assets in his hands belonging to the said estate not heretofore paid over or herein directed to be paid pay to Robert A. HILL the sum of twenty five Dollars his counsel fee in this cause and that he pay to each of the said commissioners in like manner for their services the sum of two dollars except F. WITHERSPOON who shall receive three dollars and that he also pay in like manner the others costs of this cause which have not…[unreadable]. it is further ordered by the court that Executions _____[unreadable] issue upon the application of the parties for the sums so decreed to be paid as aforesaid respectively all other matters in this cause not herein disposed of are reserved for the further action of this Court
It appearing to the Court that Robert L CYPERT one of the Constables of Wayne County in and for the 8th district had been duly notified agreeable to the Statute in such cases made and provided to appear at this term of this Court and give other and better security and the said Robert L CYPERT having failed to come into Court agreeable to said notice and enter into bond with good and sufficient Security The Court [proceeded to appoint a constable to fill-crossed out] declared the office of constable in the said Eight Civil district of Wayne County to be vacant and thereupon the court appointed Robert J CYPERT Constable pro tem to fill said vacancy until said office shall be filled by the people of said Eighth district And thereupon the said Robert J Cypert entered into the following bond to wit [standard bond follows. Know all men by these presents that we Thomas H. MABRY Wm POLLARD Thomas MEREDITH Jonathan MORRIS S L BURNS and John L. CYPERT all of the County [of Wayne – crossed out] and State aforesaid are held and firmly bound unto the State of Tennessee in the sum of twenty five hundred dollars which payment well and truly to be made we bind ourselves our heirs executors & administrators dated this 1st day of April 1850 The condition of the above obligation is such that whereas the above bound Thomas H MABRY is trustee of Wayne County whose duty is to receive and pay over all fines by him received under an act of the Assembly entitled an act to punish small offenses. It is ordered by the Court (there being more than [a majority-crossed out] two thirds of the Justices of the Peace in said County present) that an additional civil district to be known as district No 14 be and the same is hereby established and bounded as follows to wit commencing where the old line between Wayne and Hardin County intersects the Tennessee River thence up the river to the point where the line between Wayne and Hardin County as established by the act of 1849-50 attaching a portion of Hardin County to Wayne County leaves said river thence with said line to the old Wayne County lines thence north with said line to the beginning being that portion so attached to the County of Wayne It is further ordered by the Court that the Town of Clifton in said District be and is hereby established the place of holding elections and the precinct in and for said District until the same is changed by a majority of the voters of said District voting in any District election voting for the same. - It appearing to the Court that Thomas M JONES a Student at law is twenty one years of age and a man of good moral carachter[sic] it is ordered by the Court that he same be certified accordingly Isued Nov 26th 1849
- It appearing to the Court here that Thomas B[?] MELTON has lately died in Wayne County having left no last will and testament and it farther appearing to the Court that Elizabeth MELTON his widow does not wish to administer upon said Estate and King BREWER having made application for letters of administration upon said estate and he having given bond in the sum of three hundred dollars with Lot DANIEL and Andrew J BREWER his securities conditioned for the faithful administration of said estate and he having taken the oath prescribed by law it is ordered by the Court that letters of administration issue to him accordingly
It is ordered b the Court that Sampson BREWER, Joseph COCKMAN, and Joseph PRITCHETT freeholders and unconnected with the parties by affinity or consanguinity be appointed commissioners who after having been duly qualified for said purpose proceed to allot and set apart to Elizabeth MELTON widow of Thomas B MELTON deceased so much of the stock crop provisions monies or other assetts belonging to the estate of said Thomas B MELTON as shall be sufficient for the support of herself and family for one year next after the death of her said husband and report to the next term of this Court

FOWLER – crossed out] at said place provided the same can be obtained for seven hundred and fifty dollars four hundred dollars to be by the 25th December 1849 and the balance due 25th December 1850 and if said payments are not paid when due the interest to be paid on the balance due until the same [until – crossed out] is paid provided said FOWLER makes or causes to be made a good and sufficient title in fee simple to said land with general warrantee
- This day Elijah H PUGH Sheriff and Tax Collector of Wayne County for the year 1849 made his report of insolvents showing the amount of Tax on insolvents and removals due the State is to be $6.25 [$14.25 – crossed out] and that due the County of Wayne $14.24 [$19.56 – crossed out] verified by the affidavit required by law It is therefore ordered by the Court said report be confirmed and that said Elijah H PUGH Collector etc be allowed a credit for said amounts respectively in his settlements with the Treasurer of the State of Tennessee and the Trustee of Wayne County It is farther ordered by the Court that said report and affidavit be recorded in the Revenue dockett of this Court. - A settlement between Wm. JONES, Clerk of this Court and Burrel WALKER Executor of John SHAW Dec’d was this day [exhibited crossed out] submitted to the court for their consideration and was confirmed and ordered to be recorded.
- Came Thomas H. MABRY trustee of Wayne County into Court [and reported to the Court crossed out] and Presented the following report which is ordered to be rec’d and spread on the mintues [sic] of the court and which is in the words and figures following to wit: To the worshipful County court of Wayne County now in session Thomas H. MABRY Trustee of said County submits for your inspection the following report and showing of the amount of claims that has come into his hands by an order of your court as common School funds to wit 1 Rec’d of Thomas M. EAST on the 1st of March 1847 various Bonds & Notes and have collected in cash on said Bonds after paying some costs of Suits $67.75 and have a judgment well secured for same on Stephen COOPER for $24. and have Jesse S. ROSS and John McDOUGALS note for a balance due of $46.95. I have brought suit vs John CLEMENS et al and William L. T. EDWARDS et. al. and Martin SCOTT and had to pay the cost in each case the cost amounts to $9.75 also one on John G. HILL and S. L. BURNS for $42.21 stayed by Andrew JACKSON (making the aggregate) $180.91
- Paid R. A. HILL atts fee aff. 5.00 secured & on hand $175.91 I would further state to your worshipful body that I have used the best means that I could to ascertain the true situation of the balance of the claims I have on hand and believe they are worthless as that it would cost more to collect them than they are worth as the greater portion of them have moved off from this County. GALLAHER took the necessary oath for her qualification.

BURNS be appointed a Jury of View to view and mark a 2nd Class road beginning at the mouth of Mockison Creek on Buffalo and runn the best way that can be found to Samuel RILEYs mill and that they report the same to the next term of this court. - This day Jesse S. ROSS by attorney moved the court to be released as one of the securities of Flora M. HARRIS Executrix of Robert HARRIS deceased and it appearing to the Court that said Flora M. has had the notice required by law it is ordered by the Court that said Flora M. give bond with other and sufficient security in the sum of ten thousand dollars conditioned as the law directs for the faitful execution of trusts bequests and devised made in the last will and testament of said Robert deceased. Whereupon William WITHERSPOON and Franklin WITHERSPOON as securities aforesaid came into court and entered into bond [into bond crossed out] in the sum of ten thousand dollars conditioned as the law directs. it is thereupon ordered by the court that said Jesse S. ROSS be released as such security aforesaid.

WALKER, Burrell WALKER and Nathan BIFFLE freeholders be appointed commissioners who after having been duly sworn for the said purpose shall a lot and set apart to Elizabeth KYLE widow of Alexander KYLE deceased so much of the crop stock provisions money and other property on hands belonging to the estate of said Alexander KYLE as shall be sufficient for the support and maintenance of herself and family for one year next after the death of her said husband and report to the next term of this court. - This day came into Court, M.H. BURKS, who was choses [sic] appointed a guardian at a former term of this Court of the minor heirs of David MOSELY dec’d and took the necessary oath for this qualification.
- Ordered by the Court that John A. KENNEDY be appointed overseer of 1st class road in place of J.N. FOREHAND and have the following hands, to wit: H.H. HUNTER, S. SUTTON, John BENHAM, D. HELTON. Wm.[?] KEA, A. BUIE, J.N. SHIELDS, E.D. BURNS, J. WETHERS, Mark WHITE, T. MORGAN, Robt.. MACK, Constantine MACK and all hands within said bounds.
- On motion to appropriate to James ANDERSON and Thomas M. EAST, the amount of ten dollars each for their services a s commissioners to settle with the county Trustee of said County. - Ordered by the Court that Alfred SIMMONS be appointed overseer of the Road in the place of Thomas SHEPPARD and that he have [the hands in the same bounds to work under his directions, crossed out] Mason WHITTEN and all the hands from there to the County line to work under his direction.
- Upon application it is ordered by the court that Josiah DARBY, Josiah FOWLER, George WHITTEN, Caleb HUGHES and Berry FOWLER be appointed a Jury of View and mark out a road commencing at the Florence & Wayneboro road on the land of Josiah DARBY and runn so as to intersect the Waynesboro & Florence road on the Land of Jonathan WHITTEN and runn the nearest and best rout and that they report the same to the next term of this Court.
- Ordered by the Court that James C. QUEEN be appointed overseer of the road of 2nd class in place of Isham TURNBOUGH and that he have the hands in the same bounds to work under his direction.

- Ordered by the Court that John W. MONTAGUE be appointed overseer of the road in the place of James SUTHERLAND and that he have the hands in the same bounds to work under his direction.
- Ordered by the court that John FRANKS be appointed overseer of the road of 2nd class and that he work from the Methodist Campground to the Hardin County line and that he have the following hands to wit: James M. BISHOP, Samuel J. POLLAC, Benjamin MARTIN and all the hands in his settlement to work under his direction.
- Ordered by the court that Joseph DIAL be appointed overseer of the road in the place of James LEE and that he have the hands in the same bounds to work under his direction.
- Ordered by the Court that Samuel C. MITCHELL be appointed overseer of the opening of the road through Ashland from the ford of Buffalo to where it intersects the old road at the end of the lane below John SCOTTs and that he have following hands to wit: all the hands that work under Isaac SURRATT and all that live in Ashland to work under his direction.
Monday, October 2nd, 1848
- Came into Court John G. HILL and others who was appointed at a former term of this court to view and mark out a 2nd class road so as to change the old road so as to runn through Ashland and report a road found as directed in the order.
- On application it is ordered by the court that Joseph PITTS, Charles PARKER, Gideon SMITH, Joseph ROBNETT and William EADS by appointed a jury to view and mark out so as to change the road leading down green River so as to leave the old road at the Baptist Meeting house on John S. BURNS’s land and intersecting the same at or near Joseph PITTS and that they report at the next term of this court.
- Ordered by the court that John L. COPELAND by appointed overseer of the road in the place of William DABBS and that he have the hands in the same bounds to work under his direction.
- Came John M. SCOTT and others who was appointed at a former term of this court a jury to view and mark out a road from Harrison Forge running up Poags Creek across and down Factorys Fork and intersect the West Point road near the Bethlehem Meeting House and report a road found as directed in the order.
- Ordered by the Court that Jacob SCOTT be appointed overseer of the Clearing out a 2nd class road from Harrison Forge so as to intersect the West Point Road near the Bethlehem meeting House as marked out by the Jury.
- A settlement between William Jones, Clerk of this Court and James ARNETT, Administrator of the estate of Guston KINDLE, decd, was this day submitted to the court and confirmed and ordered to be recorded.
- A settlement between William JONES, Clerk of this Court and Geo. W. BARKER, Guardian of Elvira COCKBURN, was this day submitted to the court and confirmed by the Court and ordered to be recorded.
- Came into Court James ARNETT who has this day been Chosen and appointed by the Court, Guardian of Alfred P., Minor heir of Gustan KINDLE, decd, and entered into bond of Three hundred and fifty dollars with John McDOUGAL and Samuel L. BURNS his securities Which was approved of by the court and ordered to be recorded and where upon the said James ARNETT took the necessary oath for his qualification.

MACK to be released from the payment of a balance on an old School Bond and satisfactory proof being made to the Court that the bond had once been paid And a majority of the Justices being present it is ordered by the Court that the said MACK be released from the payment there off.
Waynesboro Oct. 2nd 1848
- A majority of the Justices present came Grief L. MITCHELL and others who was appointed at a former term of this court a jury to view and mark out a 2nd class road leaving the turn pike road at or near John RICKETS on Eagle Creek and runn a cross the dividing ridge between Eagle and Hardins Creek by MITCHELLS mill and intersect the Waynesboro and Savannah road at or near Wm. J. GRIMES and report a road found as directed [crossed] follows leaving the Turnpike road below E.B. THROGMARTINS and runn up the hollow between THROGMORTENS and H. HAGGARDS and cross the ridge and intersect the Waynesboro and Savannah road at Wm. J. GRIMES where upon [crossed out] which was recd by the court.
- Ordered by the Court that E. B. THROGOMORTEN be appointed overseer of the clearing out a 2nd class road as viewed and marked out by Grief L. MITCHELL and other from the turnpike on Eagle Creek across and intersect the Waynesboro and Savannah road at Wm. J. GRIMES and have the hands on Eagle Creek above Wm. M. GALLAGLEYS and all the hands on the branch of Hardins Creek of Hardins Creek that said road runns down to work under his direction.
- Ordered by the Court that Joshua T. BREWER be appointed overseer of the Shannonville road from the ford of the creek near the widow ROBINSON‘S old place to the Perry County line and have the following hands to wit Thomas MONTAGUE, Josiah ROBINSON, Casper HEDRICK, Peter HEDRICK, John HEDRICK, David POWEL, John R. BREWER and Samuel BREWER to work under his directions.
- Ordered by the Court that Jesse S. ROSS and hands work under Wm. BATTLES as overseer of the road in place of working under Sandy GUNTER.
- A majority of the Justices being present Came F. W. LOYD & others who was appointed a jury to view and mark out a 2nd class road and reported in Court a road found as follows leaving the Lawrenceburg Road at Baker CYPERTS and intersecting the same at John McGLAMERY‘S as directed in said order which was reced by the court.
- Ordered by the Court that William SHIPMAN be appointed overseer of the clearing out a 2nd class road as viewed and marked out by F. W. LOYD and others leaving the Lawrenceburg road at Baker CYPERT‘s and intersecting the same at John McGLAMERY‘s and have all the hands on the waters of Indian Creek from Samuel COOPERS to the head to work under his direction.
- Came into Court Joacum DUGGAR who was appointed Guardian of the minor heirs of George CROSSNO decd at the last term of this court and report that there has nothing come into his hands as such Guardian.

- The last will and testament of John SINCLEAR was this day exhibited in open Court and the execution of the same duly proven by the oaths Benjamine WATKINS and James C [crossed out] COPELAND both subscribing witnesses there to and said will was ordered to be recorded Where upon William SINCLEAR and Resign SINCLEAR Executor and Executrix to said will appeared in Court and entered into bond in the sum of twelve thousand dollars with John N. GILLIS, David COOK and James COPELAND who was appointed by the Court as his[crossed out] their securities Where upon the said William SINCLEAR and Resign SINCLEAR took the necessary oaths for their qualification thereupon Court ordered that the following letters Isue to the said William and Resign SINCLEAR to wit) State of Tennessee Wayne County Where as it appears to the Court here that John SINCLEAR late of said County is dead and made his last will in writing in which he hath appointed William SINCLEAR and Resign SINCLEAR his executor and Executrix to the same which said will has been exhibited in open court and proves as the law directs it is therefore ordered the Court that letters testamentary of all and singular the goods and chattles rights and credits of the said John SINCLEAR decd Isue to the said Wm. and Resign SINCLEAR having been qualified agreeable to law to enter into and upon all and singular the goods and chattles rights and credits of the said John SINCLEAR decd and the same into your possession take wheresoever the same may be found and a true and perfect inventory there of mark and return to our ensuing county Court and all Just debts of the said John SINCLEAR to pay and also and truly pay and deliver all the legacies contained and specified in the said testament as far as the said Goods and Chattels rights and credits will there unto extend and the law charge you. - It Appearing to the Court that Samuel HAMM late of said County is dead and having made no last will in wrighting and application being made by E. S. HAMM to have letters of Administration granted him upon all and singular the goods and chattles rights & credits of the said Samuel HAMM where upon the said E.S. HAMM Entered into bond in the sum of Five hundred dollars with Wm. THORNTON and Thomas LAWSON his securities which was approved of by the court where upon the court ordered that the following letters of Administration Isue to the said E.S. HAMM
- State of Tennessee Wayne County Came into Court Joseph PITTS and made oath that he has lost or mislaid an order as overseer of the road and that he had kept said order to be (unreadable). Whereupon it was ordered that the said PITTS be released as such overseer and that Andrew WILLIAMS be appointed in his place and that the said WILLIAMS have the hands in the same bounds to work under his direction.
- A settlement between Wm. JONES, Clerk of this Court & John H. GRAVES and Joseph PITTS, Ad’m of the Estate of Wm. WILLIAMS, dec’d was this day submitted to the court which was rec’d by the court and ordered to be recorded.
