p. 402 - 3 Oct 1837 - Jesse Day of Fayette Co to John Halliburton of Haywood Co for $450, 125 acres on Tisdale Creek, beginning at Amos Rounsavill's se corner, south with Joseph Crocket's line 125 poles to the ne corner of Benjamin(Benajah) Gray's tract, west with Gray's north boundary 160 poles, north 125 poles to Rounsaville's south line, east 160 poles to the beginning.  Wit: Peyton Lytle, A. B. Eubanks, Charles Howard, Wm. W. Lea; proved by Chas. Howard and Wm. W. Lea 19 Feb 1839.  Ack 19 Feb 1839.

p. 405 - 12 Dec 1838 - William Parker to Benjamin F. Jordan, both of Haywood Co. for $250, 100 acres, lying on John Rutherford's line.  Ack 18 Feb 1839.

p. 405 - 1 Aug 1833 - Thos Durham to John Bradford, Jol M. Penick & Robt. H. Miller or their successors, Com. of a Cumberland Presbyterian Church in the town of Durhamville for $50, lot lying on the west side of third alley from Water Street south of Main St. & the Fullen Ferry Road, for the purpose of building a church or meeting house and such other purposed as the officers of said church may think proper...Wit: Furrand Durham.  Proved 5 Aug 1839 by John C. Barnes and Archer Phillips who say they have frequently seen Thos. Durham write and they believe the signature to be his.

p. 406 - 27 Feb 1839 - Byrn, Keller, Campbell, Rutherford, Comm. for Ripley to David Gilliland for $90 lot #77 in Ripley lying on ne corner of Main and Lafayette, 88 1/2' x 107 1/4'.  Ack 1 April 1839.

p. 407 - 2 April 1839 - West Harris relinquishes to Jacob Tipton (both of Tipton Co) tracts of land which Jacob Tipton deeded in trust to Fredrick R. Smith as trustee to secure West Harris in payment of a judgment obtained by Harris against A. J. Morehead & Co, Jacob Tipton & Preston Thomas, and in payment against J. N. Smith & Co, Jacob Tipton & Preston Thomas in and to 3 several tracts, two of which Harris and Fred R. Smith, trustee, in consideration of payment of $2000 paid to West Harris release Tipton in full:  200 acres, 15 of which has been sold, now 185 acres, joining Tiptons 640 acre tract that was also conveyed to F. R. Smith as trustee; and 200 acres held by Tipton by Grant #16047 issued by TN on 26 Oct 1821.  Deed of Trust registered in (Tipton Co?) Register's office in Book D pp 400 & 401.  Wit:  J. H. p. 408 - 2 April 1839 - Jacob Tipton of Tipton Co in trust to Fredrick R. Smith of Tipton Co. to secure debt to Samuel V. Gilliland for $2090, 185 acres bounded by Mark R. Cockrell's 100 acre entry , Harriet Hadley, Tyree Rhodes, Jos. P. Taylor; also 200 acres in 11 SD r8, TN grant #16047 dated 26 Oct 1831; also all the interest Tipton has in an entry, warrant #2997  (described) in 11 SD for 130 acres; also all interest in entry #1139 in the name of James Morrison for 150 acres bounded by Jno. Rhay's 5000 acre survey, James P. Taylor corner on Robt. Nelson's line, Chas. McDowel's corner...advertise for 30 days in the Randolph Whig a newspaper printed at Randolph.  Wit:  J. P. p. 411 -  23 July 1838 - Rezin S. Byrn, Hiram C. Keller, Robt. C. Campbell & G. L. Rutherford, Comm. of town of Ripley to Solomon D. Spain of Col. Co. Missouri for $212, lots 88, 89, & 94.  Lot 89 lies on the south side of Lafayette St. at the eastern boundary of the town, and 88 lies west of it; they are 148.5' (along Lafayette) x 99'.  Lot 94 is on the south side of Jackson Street at the eastern boundary of the town and is 231' (along Jackson) x 198.  Ack. 6 May 1839.

p. 412 - 14 Nov 1839 - J. C. Barnes, sheriff and tax collector to Terry(?) H. Wilie/Wiley for $23.79, taxes, costs and charges, 2500 acres in Dist 5 on bank of the Mississippi River at the nw corner of the 11 SD reportedly owned by J. Terrill and D. S. Goodloe on which taxes were unpaid.  Ack 2 Dec 1839.

p. 413 - 2 Feb 1839 - Thos. J. Gardner in trust to John McWhite 125 acres to secure Reuben Alphin the payment of $125.875--$75.60 went to pay for this land and a note of $56.25 which Alphin assigned to James B. Crook to raise money to pay for the land...obtained a deed from Joseph Boon.  Ack 4 Feb 1839.

p. 414 - 26 July 1837 - Daniel Mason of Madison Co, Alabama to Champ C. Conner of Haywood Co, TN power of attorney to sell his undivided half of 100 acres on Cole Creek joining lands of Robt. C. Campbell, entered in the name of Champ C. Conner & Daniel Mason (entry #85).  Bounds:  J. W. & R. C. Campbell.  Ack in Madison Co, Ala 26 July 1839.

p. 415 - 4 Dec 1839 - John W. Campbell, Jos. Jones, Mathew Pickett, Robt. C. Campbell (by their agent and atty in fact Wm. Conner), and Wm. Conner, proprietors of the town of Ashport to the Right Reverent Richard P    Miles, Bishop of the Roman Catholic Church of Nashville, TN (and his successors in office) in consideration of having a church built at Ashport and for $1, lots #3 & 4 in Block O between 3rd and 4th Streets.  The lots together measure 105' x 200'.  They are to be used only for building thereon a church, College, Nunnery, Priest house or any other charitable institution or other building that the Bishop may think proper, but may not be sold for the benefir of any other church or denomination in any other place whatever.  Ack by Conner 5 Dec 1839.

p. 419 - 7 Oct 1839 - John Flippin to John L. Flippin for love and affection, a negro girl named Rhoda about 1 year old last February. Ack 7 Oct 1839.

p. 420 - 15 July 1839 - Josiah F. Morford, clerk and master of the Chancery Court at McMinnville, TN to Thomas H. Hopkins of Hinds Co, Miss (in accordance with the order to divide lands in the Western District the property of the late Thomas Hopkins, dec'd, and set them over to the heirs at law; George W. Hopkins of Warren Co, TN became entitled to land and he sold his interest to Thomas H. Hopkins and directed the deeds to be made to Thomas H.):  574 acres in Obion Co on the Miss. River, half a tract of 1148 acres entered in name of McLemore & Hopkins; 1350 acres in Perry Co on Tennessee River, the locative interest in a 12000 acre tract granted to John Childress; 368 acres, part of 1700 acre tract deeded by Lusk Colvell to the heirs of Thos. Hopkins in Lauderdale Co on Cane Creek; 320 acres in Gibson Co entered in name of Thomas Hopkins in 13 SD r1s1.  Proved in Warren Co 30 Aug 1839.

p. 422 - 24 Sept 1839 - Thomas H. Hopkins of Hinds Co. Miss. to Samuel Richardson of Gibson Co. for $5858, half of 1148 acres granted to McLemore & Hopkins by Grant #22264 in Obion Co on Miss. River; and 368 acres, part of a 1700 acre tract in Lauderdale Co. deeded to the heirs of Thomas Hopkins by Lusk Colville.  Wit:  A. C. Nemmo, Wm. H. Jones.  Ack. in Gibson Co 24 Sept 1839.

p. 423 - 25 June 1838 - Thos. J. Jordan to Wm. Jordan for $125, all my interest to 50 acres, part of 305 acre tract deeded from Henry Rutherford to Benjamin Jordan.  Wit: Robt. Jordan.  Proved 7 Jan 1839 by Robt Jordan who witnesses the signing; also Benjamin F. Jordan said he had frequently seen Thomas J. Jordan write and the signature to the deed was his.

p. 423 - 1 July 1839 - Jacob Byler of Cole Co, MO to Ebenezer G. Young of Haywood Co, power of attorney to sell lands in Tennessee, Alabama, and Mississippi and settle all my land business in whatever situation or condition they may be.  Wit: Isaac D. Maxwell, John H. Maxwell; proved by the Maxwells 2 Dec 1839.

p. 424 - 29 May 1839 - Isaac J. Pinson to Benjamine F. Jordan for $600, boy slave named Lewis.  Wit:  J.M.C. Robertson, J. R. Robertson; proved by both witnesses 21 Dec 1839.

p. 425 - 19 Oct 1839 - John Flippin to John L. Flippin for $500, negro woman named Hannah about 22; ack 9 Dec 1839.

p. 425 - 7 Oct 1839 - John Flippin to daughter, Mary Ann Flippin, for love and affection, negro girl named Liza about 7 years old.  Ack 7 Oct 1839.

p. 425 - 17 Dec 1838 - John C. McLemore of Shelby Co to John Donelson of Lauderdale Co, Alabama on 15 July 1834 McLemore gave Wm. Donelson and Stokely Donelson a mortgage on land in the Western District to secure them as well as John Donelson in the payment of debts and claims...2500 acres granted by NC to John Rice by Grant #284 founded on John Armstrong warrant on Entry #2097 supposed to contain about 4000 acres which 2500 is to be of average quality and value of the 4000 acres to be laid off and divided between Donelson & McLemore by Wm. Conner, Esq. of Brownsville, TN or such other person as they may agree.  Ack at Davidson Co 20 Dec 1838.

p. 428 - 3 Nov 1838 - Ivy Chandler & Thomas L. Clark, merchants & partners trading under the name of Chandler & Clark in trust to Archibald Phillips their remaining stock of goods, all their notes, their book accounts, judgments and all other claims now due or to become due and payable to them.  He is their security in a Circuit Court judgment in favor of N & H Weed for $3124.25 and costs of suit and in notes payable to Thos. Tuggle and Anthony Carlton; Chandler and Phillips were heretofore in partnership in merchandise & C under the name of A. Phillips & Co, and Clark having bought Phillips' interest and executed his bond to pay all the debts due from the firm of A. Phillips & Co. and to save Phillips from debt due to the firm, and there are debts yet due from the firm to Wm. T. Gamble and James K. Murry of New Orleans and to others.  Wit: D. P. Phillips, John L. Atkinson, Robt. Cooper; proved by D. P. Phillips and Robt. Cooper 5 Nov 1838.

p. 430 - 5 Nov 1838 - Thos. L. Clark in trust to Griffith Rutherford to secure Archer Phillips who is security for the firm of Chandler & Clark of Durhamville, TN of which Clark is one of the partners in debts of $3124.75 for a judgment in Circuit Court, note to Thos Tuggle, and one to Anthony Carleton, and other debts of A. Phillips & Co...2 negroes: David about 27 years and Austin about 19, 5 horses, cows, hogs, wagon and gear, a carriage and horses, 2 beds & furniture, 1 clock, 2 guns, household & kitchen furniture, crop of corn, fodder, etc.  Ack 3 Dec 1838.

Bell of New Orleans, LA to the President, Directors and Company of the Union Bank of the State of TN for $20,000, 400 acres granted to James H. Graves, P. M. Tipton, Aron Rice and Bernard M. Patterson on 2 Oct 1836 by Grant #2993 in r6s7 on Miss River joining lands granted to Jacob Byler by Grant #2681 & 3384; also 600 acres granted to Bernard M. Patterson on 2 Oct 1836 by Grant #2994 in r6s7 on Miss. River below and joining the first mentioned tract of 400 acres and immediately east and joining a 3 acre tract granted to Wm. Byrn by Grant #3294 in 11 SD r4s10&11 (bounds: J. W. Campbell, R. C. Campbell & Wm. Conner's Entry #23 for 203 acres, occupant survey for 200 acres of John Jordan).  Ack in Madison Co by Ransom H. p. 438 - 20 Sept 1839 - Alfred S. Thurmond of the Republic of Texas, County of Harrisburg to Erasmus D. Thurmond of Lauderdale Co, (no money mentioned) 64 acres beginning at Robert P. Currin's corner (the ne corner of John Rutherford's 5000 acre grant) then (east) 10 chains, n 65 chains, west 10 chains to the ne corner of the 800 acre tract to the beginning.  Wit:  H. Rutherford, H. F. Rutherford; ack in Lauderdale Co 11 Oct 1839.

p. 439 - 13 Feb 1839 - Wm. H. McLaughlin to James McLaughlin power of attorney to convey all my interest in 3119.5 acres on the Miss. River (in 13th SD r11s1 founded on Entry 534 granted to Wm. P. Anderson by Grant #18862 by St of TN) to Spurrel Hale and Wm. W. Lea two undivided thirds and to Andrew Erwin one undivided third agreeably to my bonds executed to them at Nashville on 5 Dec 1835.  The land was executed and sold by Henderson Clark, Sheriff of Dyer Co. as the property of John Smith T by virtue of a judgment obtained against him in my favor in the Circuit Court of Dyer Co at the November Term in 1834 and bought in my name by Clark and conveyed by him as sheriff to me on 2 March 1837.  Wit: Thos. S. King, Willis N. Hawkins; proved by both witnesses in Davidson Co on 13 Feb 1839.

p. 440 - 1 March 1839 - Wm. H. McLaughlin (by his atty in fact James McLaughlin) to Andrew Erwin for $3500 all my interest in an undivided third of 3119.5 acres on the Miss. River in Lauderdale Co in the 13th SD r11s1 founded on entry 534 granted to Wm. P. Anderson by Grant #18862, beginning on the River below where the line of section 1 and 2 in range 10 meets...Entry #532 in name of James Boon for 228 acres.  Ack by James McLaughlin in Davidson Co 1 Mar 1839.

p. 441 - 20 Feb 1837 - James Soward to Wm. Espy, both of Dyer Co., for $950, 462 acres on the west side of the south fork of Forked Deer River and judged to be on both sides of the line between Dyer and Lauderdale Co bounded: beginning on west bank of South fork, south 5 chains & 60 links, west 90 chains to John Soward's line, north with his line 36 chains & 80 links to his corner, west 16 chains & 30 links, north 26 degrees east 10 chains, north 40 degrees east 10 chains to the bank of the south fork, up the meanders, being part of the NC Grant #156 of 149 acres to Wm. p. 442 - 8 Mar 1839 - David S. Hill in trust to Samuel V. Gilliland my negroe slave Malb  m to secure a debt to Gilliland of $600 due 25 Dec 1839.  Wit:  David Gilliland, James G. Anthony; proved by David Gilliland 5 Apr 1839 and James G. Anthony 7 Feb 1850.

p. 443 - 19 Feb 1840 - Thos. B. Cousins in trust to James Smith, Robert Macklin & Wm. H. Loving, merchants, partners under the name of Smith Macklin & Loving of Brownsville, Haywood Co to secure debt to the firm of $524.15, hogs (described), a saddle, a jack plane, a draw knife, a spinning wheel & pair of cards, a negro girl named Ellen aged 15 or 16, horse about 7 years, mare about 10 years, cows, 2 castell [cast steel?] axes and hilling hoes, 1 negro fellow named Sterling at this time in possession of Sam W. Cousins of Virginia;ack 19 Feb 1840.

p. 444 - 20 Jan 1840 - Isaac H. Gray of Davidson Co to J. C. & S. M. Copeland of Williamson Co for $1231, 410.5 acres in Lauderdale Co on the west side of the south fork of the Forked Deer River, part of Grant #407.  Begin at Joseph Crocket's sw corner of 1000 acres deeded to Crocket by John L. Wheaton, it being a part also of Grant #407, then west crossing Tisdale Creek 322 poles to the original sw corner of the 5000 acre Grant #407 it being R P Currin's se corner, (north) with Currin's east line 204 poles, east 322 poles to the west boundary line of Joseph Crocket's 1000 acre tract, south with his line 204 poles crossing Tisdale Creek, to the beginning.  Wit:  Able H. Pope, John B. Copeland; proved on 24 Feb 1840 by the witnesses who say they are personally acquainted with Isaac H. Gray.

p. 446 - 17 Feb 1840 - Richard Moore in trust to John C. Barnes for $200, 2 beds and clothing 1 table, trunks, 2 bedsteads, 4 cows (described), mare 9 years old, to secure my debt to Barnes of $200.  Ack 17 Feb 1840.

p. 446 - 14 Feb 1836 - Thos. Brown of Columbus, Lowndes Co, MS, at present of Lauderdale Co, TN appoint Rezin Byrn, Sr. my agent and atty in fact to take possession and care of all my lands in Laud. Co. to rent, lease, or sell...as he sees fit.  Wit:  Saml. Oldham, Chas. White; ack 16 Jan 1837.

p. 447 - 17 Feb 1840 - Hiram C. Keller, Robt. C. Campbell and G. L. Rutherford, Comm. for town of Ripley to Rezin S. Byrn for $90 lot #78, 107.25' (along Lafayette) x 99' (along Randolph) on nw corner of the intersection.  Ack 18 Feb 1841.

p. 448 -   Feb 1840 - Hermis Champ in trust to Jacob N. Wardlaw 6 cows and calves, 2 mares, 3 feather beds, 1 looking glass, 1 clock, half dozen chairs to secure debt to J.M.C. Robertson of $133, and $330; ack 18 Feb 1840.

p. 449 - 1 Aug 1839 - In July of 1829 (or 1839) I, John McWhite, then living in Haywood Co., sold to Reuben Alphin for $700 a negro man named Isaac then about 30 years old and at that time I executed a bill of sale which he informed me that he had failed to register and it is now so mislaid that he cannot find it.  This is to confirm that bill of sale.  Ack 23 Mar 1840.

p. 449 - 6 Feb 1840 - Samuel B. Marshall, marshal of the US for the Dist. of Middle Tenn to Jesse Blackfan of New York City.  On 19 Feb 1839 a writ of the US of fieri facias issued out of the US for the 8th Circuit in the Dist. of West TN bearing teste the 1st Monday in Sept 1838 to the Marshal of West TN commanding him that of the goods and chattels, lands and tenements of John C. McLemore in his district he should cause to be made the sum of $3760.45 which Jesse Blackfan recovered against John C. McLemore at the September term 1838 for debt, damages & costs, those monies to be at the court at Nashville on the first Monday in March then next.  The writ came to Saml B. Marshall, Esq, Marshal of the US for the Dist of W TN on 19 Feb 1839, and he levied on 727 acres in Hardin Co, TN 9 SD rys6 west of Tenn. River, part of 2020 acres conveyed to him by M. H. Howard, part of 2560 acres granted to Wm. Whitehead by grant #22940 dated 29 Dec 1824... McLemore sold part to Thomas Critch, Robt. Woods & Jacob McGavock for the use and benefit of the Nashville Bank...a venditioni exponas issued first Monday in March 1839...advertised it and sale was at the courthouse in Nashville, Davidson Co on 27 May 1839 and Memucan H. Howard bought it for $200 as agent of Jesse Blackfan.  Adk at Davidson Co 6 Feb 1840.

p. 452 - 20 March 1840 - Wm. Armour and Henry Lake of Madison Co make bond to Robt. C. Campbell (penal sum of $7000), to make him a deed for land he bought of them for $3762.64, 640 acres which Armour & Lake bought from Blount near the west boundary of Haywood east from Ripley and on which the said R. C. Campbell has made improvements.  Ack in Madison Co.

p. 453 - 4 Mar 1840 - Wm. Butler by grant #1839; also 437 acres in 13th SD in Lauderdale Co on the Mississippi River, part of 624 acre tract cut off grant #18862 to Wm. P. p. 456 - 1 Nov 1839 - John Ray of Henry Co to Ellen Kirkman of New Orleans, LA for $800 land in Lauderdale Co (formerly in Dyer Co), 160 acres in 13 SD r10s1, part of entry #756 for 640 acres in name of Henderson and Jones and is the locative interest which was by Memucan H. Howard and on 15 July 1831 conveyed to John Ray.  Ack in Henry Co 1 Nov 1839.

p. 457 - 6 Feb 1840 - Samuel B. Marshall, Marshall of the US for the Dist of Middle Tennessee to Jesse Blackfan of New York City as ordered in writ of fieri facies from the Circuit Court of the US for the 8th Circuit in the Dist. of West Tenn dated 1st Monday in Sept 1838 to make $3760.45 of the lands in his dist of John C. McLemore which Jesse Blackfan recovered against him for debt, damages, and costs and the money is to be before the judge at Nashville on the 1st Monday in March...levied on 1920 acres in Lauderdale Co 11SD r5s10&100 on bank of Miss. River, it being an undivided part of Grant #22870 dated 14 Dec 1824 issued to Thos. Henderson, John C. McLemore and Jos. H. Bryan...issued the fiere facies too late to sell before the return day...on 14 Mar 1839 a venditioni exponas issued out of the court dated 1st Monday in March 1839 commanding him to advertise...on 27 May 1839 at the courthouse in Nashville the land was exposed to sale and Memucan H. Howard became the highest bidder for $400 as agent of Jesse Blackfan.  Ack 6 Feb 1840.

p. 459 - 2 May 1840 - J. M.C. Robertson to Francis Shoemake for $1000, 2 negroes, one boy called Isaac about 14 years old and Margaret, a girl about 11 or 12.  Wit:  Jas. Braden; ack 4 May 1840.

McGahee/McGaughey to secure balance of $1068.09 due Francis Shoemake of Marshall Co, Miss. for $4546.64 note, a horse, cows (described), stock hogs, 2 feather beds & furniture, 4 bedsteads, 1 cradle or crib, 1 bureau, 1 folding leaf table, 1 square table, 3 small dressing tables, 1 candle stand, 1 stove, 1 wash kettle, 3 pots, 3 overns, 1 stew kettle, 5 stone jars, 1 side saddle, 2 men's saddles, 1 trunk, 1 clock, 2 pr andirons, 1 looking glass, 1 carpet, 1 pr glass candle sticks, 1 large chest, 1 reflector, 1 pr. scales and weights, 1 coffee mill, 15 geese, 12 chairs.  Wit:  J. R. Robertson, Jas. Braden; proved by witnesses 4 May 1840.

p. 462 - 12 Feb 1840 - Whereas Jacob Tipton by deed of trust on 2 April 1839 conveyed to Fred R. Smith 200 acres 3 miles and 32 chains east of the sw corner of section 8 in 11 SD r8s8 held by grant #16047 dated 26 Oct 1834 to secure to Saml. V. Gilliland the payment of $2090, and the debt not being paid I have proceeded according to terms, advertised and sold it to Samuel V. Gilliland.  Wit:  Probert P. Coller, Robert Miller; ack 8 April 1840.

p. 463 - 12 Feb 1840 - Whereas Jacob Tipton by trust deed on 2 April 1839 conveyed to Fred R. Smith 150 acres founded on certificate issued to James Morrison bounded by James Rhey's 5000 acre survey, James P. Taylor corner, Robert Nelson's line, Charles McDowel's corner, and the debt not being paid I have advertised and sold it to Samuel V. Gilliland for $129.25.  Wit: Probert P. Coller, Robert Miller; ack 8 April 1840.

p. 464 - 12 Feb 1840 - Whereas Jacob Tipton by trust deed on 2 April 1839 conveyed to me all interest in an entry in 11th Dist to Jacob Tipton, Warrant #2977 for 130 acres...to secure Samuel V. Gilliland the payment of $2090...I have proceded according to the terms...sold to Samuel V. Gilliland for $300.  Wit: Robt. I. Chester, Mo. Wood; ack 8 April 1840 in Madison Co.

p. 466 - 3 March 1840 - Matthew Rhea of Fayette Co to Robert P. Rhea (son of Joseph Rhea deceased) of Sullivan Co for $3000 with the interest , etc. due thereon as per contracts and notes of 3 Dec 1836 said contracts being made with James D. Rhea of Sullivan Co and by him assigned to the said Robert P. Rhea, 1000 acres, Matthew Rhea's interest as laid off in a 5000 acre tract devised by John Rhea dec'd to Matthew Rhea and others, lot 3, beginning at Joseph L. Rhea's ne corner...in the Hurricane, Joseph L. Rhea's corner...Samuel Rhea's corner.  Ack in Fayette Co 3 March 1840.

p. 467 - 8 Jan 1840 - Rizen S. Byrn, Robt. C. Campbell, Hiram C. Keller and G. L. Rutherford, commissioners for town of Ripley to Richard H. McGaughey for $103 lot #32, at the sw corner of Lafayette and Randolph Streets, 99'x 99'.  Ack 8 May 1840.

p. 468 - 1 Jan 1840 - Wm. Omohundro, Sr. to Thomas W. Omohundro and Allen C. Omohundro in consideration of the payment of all Wm. Omohundro's just debts on or before 1 Jan 1844 and the comfortable support of Wm. and his wife Martha and their daughter Mary Ellen Omohundro in diet, clothing, lodging, washing, etc. during their lives except if Mary Ellen Omohundro should leave her parents before their death in that case the said Thos. W. & Allen C. are not bound to support her any longer than she lives with her parents.  In exchange for that Wm. Omohundro Sr. conveys to Thomas W. and Allen C. 184 acres on the south side of Mill Creek [also mentions a branch] for 10 years certain or longer if Wm. and Martha should live; also all his stock of horses, cattle, hogs, sheep together with all his plantation utensils, household and kitchen furniture except one bed, bedstead & furniture, 112 barrels of corn and 2 thousand bundles of fodder amounting to $696 valuation.  Wm. and Martha is to have benefit of the dwelling house and kitchen as long as they live and if they should die before 10 years have expired then at the expiration of the 10 years Thos W. and Allen C. bind themselves to return as much property as they receive or the valuation to be divided among the heirs of Wm. and Martha.  If they should live longer than 10 years Thos. and Allen are not bound to give up the property as long as Wm or his wife Martha lives.  If the parents die before Mary Ellen is grown or married Thos and Allen are bound to support her as long as they hold the above property if she wants to live with them.  Further Thos. and Allen may sell the property with the consent of Wm. Omohundro, Sr.  Ack by Wm. and Allen C. Omohundro on 18 Feb 1840 and Thos W. Omohundro on 2 March 1840.

p. 470 - 4 May 1840 - Benjamin Booth in trust to James B. Crook a lease for 7 years given by Brinckly to Benj. Booth and 100 cords of wood on the place to secure a note for $65.  Ack 4 May 1840.

p. 470 - 5 May 1840 - Clement T. Walker to John J. Jett to secure debt to James Robert, Alexander Boyd, and David G. Smith, late merchants & partners of J & R Boyd Smith & Co of $108.38, horse, 2 milch cows, a bureau, a bed and furniture, my household & kitchen furniture.  Wit:  N. A. Longley, Jas. W. Strother.  (Isaac M. Steele, clerk of the County Court was not acquainted with Clement T. Walker, so C. C. Dyer and Wm. T. Hulme, whom he did know, vouched for Walker who acknowledged the instrument.

p. 471 - 20 Jan 1837 - Thos. D. Fisher to Ivy Chandler for $100, 3 half-acre town lots in Durhamville--14,15 and 16, whoch were sold by Thos. Durham to Thos Durham, shoemaker, on the west of the public square and south of Main Street... Wit: D. P. Phillips, John C. Barnes.  Proved by witness, John C. Barnes, and Archer Philips who says he has frequently seen Thos. D. Fisher write and he believes it to be his signature of 4 May 1840.

p. 473 - 25 Dec 1837 - Thos D. and Wm. H. Fisher to Ivy Chandler & Thomas L. Clark for $425, lot in Durhamville fronting Main St. on the south (54') and Water St. on the west (65') which includes the store formerly occupied by Fishers and now by Chandler & Clark.  Wit:  D. P. Phillips, John A. Golding; ack 17 Nov 183_. 

p. 474 - 4 May 1840 - Edwin Williams in trust to A. Philips to secure debt of $47.66 to J. M. C. Robertson, set of blacksmith tools, 2 feather beds & furniture, 3 skillets and lids, a kettle, large pot, 3 small pots, 2 small round-bottom skillets, 3 large chairs, 1 chest, 1 table, 1 set of knives & forks, 1 set of plates, 1 shot gun.  Wit:  David P. Posey, J. R. Robertson; ack 9 May 1840.

p. 475 - 14 May 1840 - Henry Reynolds in trust to Nicholas Reynolds, Jr. horses and cows (described), one of the cows in Joshua Wright's mark, hogs, feather bed & furniture to secure debt to Nicholas Reynolds for $200.  Ack 14 May 1840.

p. 477 - 11 March 1840 - Williamson County Circuit Court on 11 March 1840 judgement issued, jurors: Frederick Ivie, Walter Cummings, Edward W. Pinkard, John Kirkpatrick, Robert A. Hill, Stokely A. Davis, James Raquier, James Carothers, Alexander Moore, John M. Winstead, Wm. B. Johnson and Wm. Johnson, who find for the plantiff and assess their damages by reason of the detention of the debt of $6550.10 in the declaration to $238, and decree that the plantiff recover the debt and the damages.  Ack 27 April 1840; also registered in Tipton Co Bk E, pp. 248-9.

p. 478 - 14 May 1840 - Robert J. Holbrook in trust to Griffith L. Rutherford my interest as a legatee of John Rutherford, dec'd, in a tract that Stith Richardson now lives on, also a yellow girl named Siller about 19 years old and a boy named Joseph aged 10 to secure G. L. Rutherford, admin. of John Rutherford, dec'd, late of Dyer Co, who has, out of his own means, paid off and taken in claims standing against the estate ($2500) with more yet standing.  My proportionate part to be paid by 1 Jan 1842.  Wit:  J. A. Lackey, R. H. McGaughey.  Proved by witnesses 20 May 1840.

p. 479 - 2 March 1840 - David Fitzpatrick to Edmund Fitzpatrick for $2500 261 2/3 acres in 11th SD r3s9.  Bounds: Rhea's line, Pendleton G. Gaines' land formerly the locator's interest of the tract.  Ack 3 Mar 1840.

p. 480 - 24 April 1840 - James A. Morris in trust to James A. Lackey to secure debt of $1017.125 due Absolum G. W. Byrn, 100 acres bounded on west by Donalson's 1001 acre tract, east with Lancy Graves tract to John B. Byrn's corner, with his line north to R. S. Byrn's line, west to the beginning, it being the land on which James A. Morris lives; ack 28 April 1840.

p. 482 - 5 August 1839 - Joseph Jones of Warren Co, MS to Thomas J. Mulhollan of Haywood Co, TN, power of attorney to sell and execute a deed on tracts near Ashport purchased of John C. McLemore and jointly owned by Major Wm. Conner, John W. Campbell, Matthew Pickett and me, and a tract also near Ashport purchased by me of Pleasant C. Miller; a tract in Henderson Co containing about 535 acres purchased of James Boyce; an improved lot in Brownsville containing 30 acres purchased of Thomas Bond.  Ack in Warren Co, MS 5 Aug 1839.
