CHANCERY NOTICE William FITZGERALD vs Hanibal HARRIS
and
James ELLIOTT Chancery Court, Mon. August Term 1839 Dresden,
TN.
That on the 1st of February 1836, complainant
purchased
of HARRIS, 10 acres and 5 poles of land adjoining the town of
Paris, for which he executed his notes totaling $3000.00.
At the time the notes were executed, defendant HARRIS gave to
FITZGERALD his title bond, binding him to make a good title to
the tract of land whenever the notes were discharged; that some
time before HARRIS sold the land to FITZGERALD, he had sold it
to James ELLIOTT; that the sale was in fact for the benefit of
ELLIOTT; that shortly after the transaction, the notes were
handed over to ELLIOTT, who applied to FITZGERALD for payment;
that the note was given to John H. DUNLAP for collection; that
FITZGERALD informed DUNLAP he was ready at any time to pay it;
that shortly after this FITZGERALD was informed that Solomon
COPELAND had laid a warrant on part of the land, alleging that
it was vacant; that after this entry of COPELAND, FITZGERALD
proposed to DUNLAP'S recision of the contract and the payment
of rent; alleging at the same time that he would not pay the
purchase money until satisfied of the sufficienty of HARRIS'
title to the land; that upon this DUNLAP sued on the notes in
the name of HARRIS for the use of ELLIOTT, in the Circuit Court
of Henry County; that FITZGERALD believes that HARRIS has not
title; that from the filing this Bill FITZGERALD considers the
contract at an end and offers to pay rent for the time he has
enjoyed the place; that ELLIOTT at the time he received the
notes, well known for what they had been given and in fact, that
the sale was made for him and to serve his interest.
James COWAN vs W.J. DE WITT and John M. HURT September 1839,
Chancery Court, Dresden, Tenn.
Washington J. DE WITT, one of the Defendants, is a nonresident
of this state. It is ordered that he, DE WITT appear before the
Chancellor at the next term on the 3rd Monday in February 1840.
The bill charges that DEWITT, of Mississippi, is indebted to
COWAN for the sum of $268.24. He has no means in Tennessee,
except a debt due to him from HURT on a judgment rendered at
the May term of Circuit Court of Henry County, Tenn., 1839,
for $161.00.
William NORRIS vs Robert SEARCY's Estate Robert
SEARCY, one
of the defendants in this case, is a new resident of this state.
Complainant's wives are the daughters of John REED and Elizabeth
REED, that Elizabeth was the sister of Geroge W. BLAKES, who died
in Henry county some time in 182_; and that SEARCY was appointed
admin. of the estate, and entered into bond with Heydon E. WELLS
and Augustine BUMPASS, his securities; that BLAKES was never
married and left no heirs or relations to inherit except
complainants' wives, who are the only children of Elizabeth REED
BLAKES and the wife of Robert SEARCY, a sister of Geroge W; that
SEARCY took into his possession the estate of George W.
consisting of a large number of negroes, cash notes, cash
accounts, and property of various kinds; that SEARCY has
failed to make a RETURN of a large amount of the estate and
that he has converted the whole of the estate into horses;
and has often been requested to pay over the sum; that Elizabeth
REED died sometime before George W. BLAKES and her children are
entitled to one third part of the estate.
Terence COONEY vs Samuel NELSON, et al - Bill charges Samuel
NELSON is indebted to COONEY in the sum of $7572.94 on a note
executed by NELSON to Samuel BULLOCK and that BULLOCK endorsed
to COONEY; that NELSON has no means known in Tennessee, except
the following property, one tract of land lying in Henry county
of about seventy acres; that NELSON by virtue of his marriage
with the daughter of Nathan WILLIAMS, deceased, to wit Eunice
WILLIAMS, is entitled to a child's part of all the estate of
Nathan, subject to the life estate of the widow; that Francis
WILLIAMS and said Jennings H. COURT are the Executors of the last
will and testament of Nathan WILLIAMS.
A man named Daniel SWEENEY was arrensted on Saturday by
officer ROOME, with two hogs in his posession worth $16, which
he had stolen from Patrick GRAY's premises, in Walter Street
between Mulberry and Orange Streets, and for which he was
committed in full to answer.
A man named KOBLER was arrested here last spring, on suspicion
of having murdered a pedlar in the neighborhood of Lancaster,
PA. His trial has been going on at that place during the past
week, and we learn that on Tuesday, the jury returned a verdict
of murder against him. There has also been arrested on this
charge, a boy named William. He was acquitted and used as a
witness on the trial of KOBLER, and it is said that the details
of the murder as disclosed by him exhibited a scene of horrible
atrocity. The jury were absent from the box not over ten
minutes--Patriot

We are sorry to report the severe illness of our efficient and
accomodating postmaster Dr. Isaac C. REAVIS, who has been
confined to his bed for several days, and was for a day or two
considered in a dangerous condition; but we were glad to hear
yesterday, was improving.
L. W. REAVIS, of this county, has been appointed route agent on
the Nashville and Northwestern Road. W. F. HAMPTON, removed, and
we learn entered upon the discharge of his duties yesterday. We
congratulate Mr. REAVIS upon his appointment, and can wish him
nothing better in his new position than that he may make as
efficient and accurate an agent as his predecessor.
On last Sunday morning, about 2 oclock, our senior was aroused
from his refreshing slumber to answer a knock on his door. On
opening it, he found, two young friends accompanied by other
friends, awaiting admittance. Their wishes were soon made known,
and Squire PRESTWOOD was summoned to unite two loving friends.
It is unnecessary to state that this was done in the Squires
best style, and after receiving the congratulations of those
present, Mr. George STAFFORD and bride, nee Miss Adelia PARKER,
returned to their home with two souls with but a single thought,
two hearts that beat as one.
We regret to have to report today, the severe illness of Dr.
Thos. EDWARDS, one of our oldest and most prominent physicians.
