State of Tennessee Wayne County§ Be it remembered that a quarterly County Court was began and held for the County of Wayne at the Court house in the town of Waynesboro on the 7th day it being the first Monday in July in the year of our Lord one thousand Eight hundred & fifty one when and when the following Justices were present & presiding to wit: David J JONES Chr. LAFFERTY CARTER MONTAGUE BARKER WILSON VOORHIES WATKINS CYPERT CURTIS HAM BREWER HUCKABY WHITAKER DIXON A B GANT L B GANT YOUNG & POPE
Whereas satisfactory evidence has been exibted[sic] to the Court here that Robert CYPERT Late of said County is dead and was before death a United State pensioner and that he died on the 28th day of January 1851 it is therefore ordered by the Court that the Clerk of this Court Certify accordingly Came James HAGGARD who was at the January term 1851 of said County Court appointed Commissioner to take and make out in writing an accurate and complete list of the number of free white Male inhabitants who are twenty one years old and over and returned his list accordingly the aggregate of which is Thirteen hundred and seventy one verified by his oath which was received by the Court and ordered to be recorded
Upon motion to appropriate to Jesse S. ROSS and W CARTER each the sum of four dollars for their services as commissioners to sell certain lots in Waynesboro Those who voted in the affirmative were D J JONES, Chr. LAFFERTY MONTAGUE BARKER VOORHIES WILSON WATKINS CYPERT CURTIS and HUCKABY ten Noes none so said appropriation was made to be paid out of any monies in the hands of the County Trustee not otherwise appropriated Issued July 24, 1851

Ordered by the Court that Daniel STROUD be appointed Overseer of the road of 2d Class in the place of C M BROWN and that he have the hands in the same bounds to work under his direction Issued July 23d 1851

Ordered by the Court that William HOLLOWAY be appointed overseer of the road of 2d Class in the place of John STOCKARD and that he have the hands in the same bounds to work under his direction Issued July 23d 1851

A majority of the Justices of the peace present John SHIPMAN presented in open Court the Scalp of a wolf over four months old and proved the killing of said Wolf in Wayne County by his own oath and said scalp was destroyed by the Sheriff according to an Act of the General assembly in such made & provided Issued to John SHIPMAN July 8, 1851
A majority of the Justices of the peace present William M HORTON presented in open Court the Scalps of five wolves under four months old and proved the killing of them in Wayne County by his own oath and said scalps was destroyed by the Sheriff according to an act of the General assembly in such cases made and provided Isued Aug 4th 1851
Ordered by the Court that Alonzo H. MONTAGUE be appointed Overseer of the road of 2d Class in the place of Isaac W ROSS and that he have the hands in the same bounds to work under his direction Isued July 23d 1851
On the petition of Felix WEST and it appearing to the satisfaction of the Court that the said WEST is in indigent circumstances and unable to do manual labor It is ordered by the Court that the said Felix WEST have the privilege of hawking and peddling in the County of Wayne during his inability to Labor as afore said an his taken the oath prescribed by law Isued July 7th 1851

This day came Joseph N. ROBNETT in to Court and tendered to the Court his resignation to the office of Constable of Wayne County which was received by the Court and ordered to be recorded.
David J. JONES Chairman of this Court and in behalf of the Court [bound – crossed out] by the Consent of Thomas CARR orphan and George W. BROWN bound the said Thomas CARR to Marcus COOK [the said – crossed out] and the said D. J. JONES as Chr. And the said Marcus COOK entered into indentures binding the said Orphan to the said COOK util[sic] he attains the age of Eighteen years and the Court releases the said George W. BROWN from his obligation in the former indentures.

A settlement between Thomas H MABRY Trustee of Wayne County and A MONTAGUE and Jonathan MORRIS Commissioners appointed by this Court to settle with the revenue Collectors of said County the year 1851 was this day submitted to the Court which was Confirmed by the Court and ordered to be recorded

Came George WHITE and others a Jury summonds and sworn to view and mark out a change in the road of 2d Class leading from David TACKETTs to Waynesboro on the lands of T P CYPERT and report to the Court a change made as directed in the order which was received and ordered to be recorded

Came Jonathan MORRIS and others a Jury summonds and qualified to view and mark out a pass way sufficient for a third class road from Mary H SHIELDS so as to intersect the Waynesboro Road near John A KENNEDYs and report a way found as directed in said Order Which report was received and ordered to be recorded

Came Baker CYPERT and others a Jury summonds and qualified to view and report the expediency of disannulling the new Road and opening the old one leading from Baker CYPERTs to John McGLAMERYs and report to the Court that said change is necessary as the old road is the best which report was received and ordered to be recorded

Ordered by the Court that Mathew JOHNSON be appointed overseer of the road of 2d Class in the place of Charles LISLES and that he have the hands in the same bounds to work under his direction Isued July 23? 1851

Came Benjamin WATKINS and other a Jury summonds and qualified to view and mark out so as to change the Road of 2d Class leading down Weatherfords fork of Indian Creek and report said change as follows leaving said Road near John C JOHNSONs and runn with the foot of the hill and intersect the said road at Ben’ WATKINS which report was received and ordered to be recorded

Be it remember that this cause came on this day for hearing before D J JONES A MONTAGUE and G W BARKER Esqrs. Justices holding the County Court upon the petition of petitioners and the exhibits when by order of the Court this cause is referred to the Clerk & Master to take proof and report whether or not the heirs at law of said John N SHIELDS are correctly set out in said petition and whether or not it is necessary to sell said land to pay the debts against said estate and whether or not the said lands can be partitioned among the said heirs at law advantageously without a sale thereof and report to the present term of the court

Be it remembered that this cause came on for further hearing this day before D J JONES A MONTAGUE and G W BARKER Esqurs Justices &c. holding the County Court for Wayne County upon the petition exhibits report of the Clerk & Master and proof in the cause which report not being excepted to is confirmed when it appearing to the Court that the said heirs at law are the only heirs at law of said John N SHIELDS that said John N SHIELDS died seized and possessed of the interests in the lands as set forth in said petition that said Mary H SHIELDS is entitled to dower out of the same and that it is necessary that all of said lands subject to said dower should be sold first that so much of the proceeds thereof as may be necessary to pay the outstanding debts against said estate and for the payment of which said James M RAMSEY has in his hands no personal assets and secondly for petition of the interest of any remainder among said heirs It is therefore ordered adjudged and decreed by the Court that Jesse S ROSS Surveyor of Wayne County Joseph EAST & John R HELLAN
[HELTON ?} free holders and unconnected with the parties by affinity or consanguinity be appointed to allot and set apart to said Mary H. SHIELDS the one third in value of the whole of said lands the intere[sic] dowry interest to be laid off in one tract at such place as she may select so as to injure” the sale of said lands as little as may be and report the same with a plot thereof to the next term of this Court Isued Febr 5, 1851

It is further ordered and decreed by the court that William JONES the Clerk & Master of this Court be appointed commissioner who having executed his bond in the sum of one thousand dollars payable to David J JONES Chairman of this Court and his successor in office [ the State of Tennessee – crossed out] in conditioned for the faithful discharge of his duty as such commissioner and the payment of the proceeds of said lands as he may be hereafter directed by this Court with Wm POLLARD and C ACKLIN his securities shall proceed at the Court House in Waynesboro after having given thirty days notice of the time and place of sale by advertisement at the Court House in Waynesboro and three other public places in said County to sell said lands in such tracts a s he may think most to the interest of all those concerned to the highest bidder upon twelve months credit taking bonds with good and sufficient security for the purchase money thereof and retaining a lien upon said land respectively until said purchase money is paid and report to the next term of this Court after he shall have made such sale all other matters being reserved

Ordered by the Court that C.B. McLEAN Henry MORRIS John McDOUGAL A MONTAGUE & David J JONES or a majority of them be appointed Commissioners to examine in to the condition of the Jail in the Town of Waynesboro and the expediency of selling said lot and purchase elsewhere and the plan and that they report the same to the April term of this Court.

Came Robert C. MACK and tendered to the Court his resignation to the office of Constable for the 4th Civil District Wayne County which was received by the Court and ordered to be recorded.

Ordered by the court that John McDOUGAL one of the Commissioners appointed at a former term of this court to set apart provisions for the Widow Shields & family for one year amend said order so as to set apart such additional articles which was done and rec’d by the Court and ordered to be recorded.

  • Ordered by the Court that John McDOUGAL Hiram ROBERTS and T H MABRY Freeholders be appointed Commissioners who after having been duly sworn for said purpose shall proceed to allot and set apart to Polly BURGESS widow of Thomas BURGESS Deceased so much of the crop stock provisions money and other property on hand belonging to said Estate as shall be sufficient for the support of herself & family for one year next after the death of her said husband and report the same to the next term of this Court

  • Ordered by the Court that Jackson ARNOLD to appointed overseer of the road of 1st class in place of John CARTER removed and that he have the hands in the same bounds to work under his directions.
  • Ordered by the Court that John D HINKLE be appointed overseer of the road of 2nd class in place of David COOK and that he have the hands in the same bounds to work under his direction.

  • Came Rial BREWER, Executor of the Estate of Nathaniel HORTON, decd, and returned into Court an account of sales and of Notes & Acct came that has come in to this hands as the law directs which was rec’d by the Court and ordered to be recorded.
  • Came S.L. BURNS, Adm., with the will annexed of the Estate of Lemuel POPE, dec’d, and returned in to Court an inventory and acpt [?] and acst [?] of many notes & accts of sales that has come to his hands as the law directs which was rec’d and ordered to be recorded. [Of notes, accts & money crossed out].
  • Came Joacim DUGGAR whose [sic] has been this day Chosen & appointed Guardian of William, Melinda and Sarah Ann, minor heirs of George CROSSNO, dec’d and entered in to bond in the sum of two thousand dollars with William BENHAM and Jacob SCOTT, his securities, which was approved of by the Court and ordered to be recorded. Where upon the said Joacim DUGGAR took the necessary oath for his qualification.
  • Ordered by the Court that Thomas MARTIN be appointed overseer of the road of 2nd class in place of Washington MARTIN be appointed overseer of the road of 2nd class in place of Washington MARTIN and that he have the hands in the same bounds to work under his direction. Issued
  • Came William HAWK, adm of the Estate of Elihu C. RAYBURN, dec’d, and returned into court an inventory & acpt of sale of the said Estate which has come into his hands which was rec’d and ordered by the court to be recordered [sic].
