Thomas Cooper Will (1848)

Marshall County Will Book A, page 180

I Thomas COOPER of the County of Marshall and the State of Tennessee do publish and make this my will revoking all other wills by me made at any time;

first I desire and direct that my debts shall be paid out of any money that I shall die seized or possessed of or shall first come into the hands of my Executors

Secondly I give and bequeath to my much beloved wife Elizabeth COOPER my tract of land Containing of about 50 acres during her natural life time and at her death to be sold on a Credit of one and two years with purchaser giving Bond & security and a lien retained on the land untill the purchase mony is paid and the proceeds of said land to be equaly divided between all of my lawful heirs Marcillious son of my Daughter Eliza Coming in for an Equal Share

3rd- I give and bequeath also to my much beloved wife Elizabeth COOPER all of my household and kitchen funiture and also as much of the stock on hand as she may think proper to keep and the balance to be sold on a Credit of Twelve months and the proceeds of said sale to be kept in the hands of my Executors and to be paid out to my wife at any time when she calls for it Except so much as may be necessary to pay the expenses of my Esta. and the balance if any at the deaeth of my wife to be equally divided between all of my heirs

4th- and lastly I hereby nominate and appoint my son John COOPER my lawful Executor in witness whereof I subscribe my name and affix my seal this the 15th day of July 1848 Thomas COOPER (seal)

Personally appeared in open Court Humphrey N. COWDEN and William R. DAVIS the subscribing witnesses to the within will who being first sworn here in open Court proved the due Execution of said will as the Law directs It is therefore ordered by the Court that said will be entered of Record Witness my hand at office this 7th day of August 1848
