James M. PATTERSON’s Will (1877)

In the name of God, Amen.
I James M PATTERSON being of sound and disposing mind and memory blessed be God for it, And knowing the uncertainty of life do publish and declare this to be my last will and Testament

First I will that my Executor pay all my just debts and Burial Expenses
out of any Effects I may die possessed of

Second I will and bequeath that all the Remainder of my Estate Real and Personal be sold and after all debts and expenses are paid That my Executor pa the same over to my Brothers and Sisters If living And If dead, To their children representing them dividing the same Equally (share & share alike) To my Brothers & Sisters

Third I having Full Faith In the Integrity of Dr Edward SWANSEN do Hereby nominate and Appoint him my sole Executor To Execute this my Will And I give and clothe Him with full and Complete Power and Authority To Sell any and all my property Real and Personal as he deems best, And Empower and Authorize him To make deeds of conveyance To all Real Estate Sold by him or deed to any I have made Sale during my lifetime To the Purchasers under him or myself And I give him Complete Power and Authority to do and Perform all acts he may deem necessary To Execute my Will. And I Hereby Release Him From giving any Bond or Security as Executor

James Patterson’s Will (1880)

I James PATTERSON do hereby make and publish this as my last will and testament hereby revoking and making void all other wills by Me at any time Made

First: I direct that my funeral expenses And all of My just debts be paid as Soon after my death as possible out of any monies I may die Seized and possessed of or that first may Come into the hand of Executor

Secondly:
I give and bequeathe to my wife Mary M PATTERSON all of the estate both personal and real of wiry[?] description whatever that I may die Seized and possessed of.

Lastly:
I nominate and appoint John M RING my Executor whereunto I set my hand and Seal, this the 3rd day of December A.D. 1880

Matilda PATTERSON’s Will (1894)

I Matilda PATTERSON of Marshall County Tennessee being of sound & disposing mind but Feeble in Health Do Make and publish this my will & Testament. Here by revoking any others by me made.

1st I will & desire that all my just debts & funeral Expenses be paid out of any Effects that I may die possessed of.

2 I will to my Grand children J H MULLEKNIE [?] & Mattnie[?] M. CARTER Each the sum of one dollar.

3 I will to my Great Grand child Nettie CARTER, my Bed & Bed clothing & Bedstead.

4 I will and desire that all my other personal property at my death shall be the property of my daughter Isabella B PATTERSON.

5 I will and desire that all the Balance of my Estate Real or Personal the land consisting of about Sixty Acres in Dist No 8 Marshall County Tennessee shall Pass the title & be the property of my daughter Isabella B PATTERSON To be Rented out for Her use & Benefit But in the Event It should be necessary To sell said Lands for te support of my daughter Isabella B PATTERSON, Then I will that It be sold by my Executor & applied for the Benefit & use of said Isabella B PATTERSON or to pay Her Medical Bill or nurses or Burial Expenses or Board.

I hereby having confidence in the Integrety of Rufus R OGILVIE Appoint Him as my Executor to carry out this will & Hereby give & clothe him will full Power & authority T sell any of my Estate Real or personal. To Execute deeds of conveyance To any & all Real Estate sold by Him To the purchasers.

And to do and perform any act necessary to carry out my will also to rent out the Lands Left by me & pay over To my Daughter Isabella B. PATTERSON until it becomes necessary to sell same, I hereby Release my said Executor R R OGILVIE from Giving any Bond or securety as my Executor.
