James Leeper Deed to George Cummings (1820)

This Indenture made this 8th day of August in the Year of our Lord one thousand eight hundred and Twenty Between James Leeper of Bedford County and State of Tennessee of the one part and George Cummings of the county and state aforesaid of the other part.

Witnesseth: That the said James Leeper, For and in consideration of the sum of Fifteen hundred and One Dollars and eighty seven and One Half cents to him in hand paid by the s’d George Cummings, the receipt whereof is hereby acknowledged, Hath granted, bargained, sold, aligned, conveyed and Confirms unto the s’d George Cummings, his heirs and assigns forever, a certain Tract or Parcel of Land situate lying or being in the County of Bedford and sate aforesaid on the Head Waters of Rock Creek on the South side of Duck River:

Beginning at a Sugartree in Rosses line, thence West along Rosses line one hundred and ninety five poles to an Elm on the Widow Murray’s line, thence South along said Widow Murray’s line Eighty six poles to a Dogwood on the Ridge, thence East Twenty five poles to a Beech, thence South Fifty poles to a Sugartree on the Ridge, thence East along the Ridge thirty two poles to a Sugartree, thence North thirteen poles to a Beech, thence East one hundred and two poles along the Ridge to a Lynn stump, thence East one hundred and forty-eight poles to a stake and pointers, Sugartree, Hickory & Elm, thence North Seventy two poles to a Black Oak, thence North 50-degrees West 20 poles to a Beech near the fence, thence North 64 poles to the place of Beginning. Containing One hundred and fifty eight acres, be the same, more or less.

To Have and to Hold the above land with all and singular the rights, profits, emoluments, hereditaments and appurtenances of and in to the same belonging or in any wise appertaining to the only use and behoof of him, the s’d George Cummings, his heirs and assigns forever & he, the aforesaid James Leeper, for himself, his heirs & admins. doth covenant and agree to and with the s’d George Cummings, his heirs and assigns forever that the s’d James Leeper, his heirs and assigns will warrant and forever defend against the right Title, Interest or Claim of all and every person or persons whatever—

BEDFORD COUNTY ) I James McKisick, Clerk of the Court of Pleas and Quarterly Sessions of the County aforesaid do hereby Certify that the execution of the written deed of Conveyance from Jas Leeper to Geo Cummings was proven in Open Court by the Oath of Charles Leeper, one of the subscribing witnesses thereto, who made Oath that he saw Samuel Leeper, the other subscribing witness, sign & attest the same as a witness & that Samuel now resides beyond the limits of this state.

Whereupon the Court ordered the s’d deed to be Certified. Given under my hand at Office this 10th day of October 1822.
