Burgess Hardin Will (1848)

In the name of God amen. I Burgess HARDIN of the County of Marshall and State of Tennessee being weak in body, but of sound disposing mind and memory, do make constitute and ordain this my last will and testament in manner and form following VIZ:
Item first – My will is that my beloved wife Kinion HARDIN keep all my estate both real and personal in her possession during her natural life or widowhood and that she may leave her such property as she can spare and that they may need so as to keep them as near equal as possible.
Item 2nd – My will is that my son Henry Hardin have a legal title made to him of the land on the North West corner of the Reed tract including the field on the North west, and five acres of the field south of that on the west end of said field – thence running to the best advantage so as to include timber sufficient to keep it up
3rd – At the death or marriage of my beloved wife my will is that all my estate both real and personal be equally divided by sale or otherwise among all my children, VIZ Mary B. PATTERSON, Henry HARDIN, William HARDIN, Judith DAVIS ELLIOTT, Nancy Rosanna HARDIN, Burgess HARDIN, Sally Jane HARDIN and John JARDIN, be each accounting for what they had before received –
Lat I appoint my beloved wife Kinion HARDIN and my son Henry AHRDIN Executrix and Executor of this my last Will and testament hereby revoking all others –
in witness whereof I have hereunto set my hand affixed my seal this 9th day of August A. D. 1848

State of Tennessee Marshall County, County Court May Term 1848 –
Personally appeared in open Court David NOWLEN and Shadrick MUSTERN two of the subscribing witnesses to the fore-going will who being first sworn here in open court proved the due execution of said will as the law directs. It is therefore ordered by the court that said Will be entered of Record
