I Charles B. Smith of the County of Carroll and State of Tennessee do make and publish this my last will and testament
I bequeath to my wife Sarah A. P. Smith my home place including my residence and all improvements up to a certain cross fence west of the Stables running north & south and down to a cross fence east of the lane running north and south to have and to hold the same during her natural life And I hereby empower my Executors to rent the balance of the land as they may think most advantageous to the Estate I also bequeath to my wife Sarah A. P. Smith all my personal Estate including household and kitchen furniture stock of horses cattle hogs and sheep farming utensils &c and all money notes and accounts which may be on hand at the time of my death I request my Executors out of the means which I have hereby bequeathed to my wife to give to all my children as them may become of age including my son Thomas now in the State of Massouri the same amount of property as near as they can that I have given to my older children and at the death of my wife I will and bequeath that my land and all the personal estate of every discription be sold and out of the proceeds thereof I bequeath one hundred dollars to my son Beverly A. Smith and the balance to be equally divided among all my children including the said Beverly A. Smith.
I nominate and appoint my wife Sarah A. P. Smith my sons William Smith and James M. Smith my Executors and having full confidence in them that they will execute my will in good faith they are not requested to give security for the same and the surviving Executors or executor after the death of my wife – are hereby authorized and empowered to sell the land as before bequeathed and make title to the same as full as if I were alive and doing the same myself.
In testimony whereof I have hereunto set name and seal this 20th day of July 1863.
