5334 - 1854 Dec. 21 - (O.B.) Richard H. PARKS and wife Sarah E., formerly BAGARTY, Thos.
A. BAGARTY, Felix Y. BAGARTY, and John W., Andrew A. and Frances W. BAGARTY, last
three minors by there next friend Felix Y. BAGARTY all of Wilson Co., TN except PARK'S and
wife citizens of N.C. against Cinthon BAGARTY, Luke S., Andrew J., James M., Wm. C., and
Thos. J. ROBINSON and Wm. BROWN, gdn. of ROBINSON minors. Alpheas BAGARTY died
in N.C. sometime in 1842 testate.... The will proved in Iredale Co., N.C. He was the father of all
of complts. except. PARKS, who married complt. Sarah E. Clause in the will: "...to my beloved
wife Cinthia BAGARTY property ... my 7 children (naming them) [not named here] at her death
share alike ... if she should marry to have a child's part or 1/8 ... there are still 10 or 11
negroes left among others a girl named Zilpha. After the settlement Cinthea and her children
moved to this state, bringing with them the negroes belonging to the estate. She has sold several
of these negroes.... She sold Zilpha to Esq. KIRKPATRICK ... Kirkpatrick sold her to (blank)
and by him sold to Jordan ROBINSON, the father of defdts. Luke S., Andrew J., &C by whom
she was held until his death. He has been dead a year or two. By will he left girl to his wife and
children. The past year his wife has died having not married again and intestate. Wm. BROWN is
their reg. gdn...."

PHILIPS and Benjamin BERRY all citizens of Wilson Co., TN. Your oratrix Lucy BERRY
would show that she married with defdt. Thomas H. BERRY at her mother's house in Wilson
County on 11 Feb. 1851. At the time of the marriage she was owner of a negro, bequeathed to
her by her father, which defdt. made way with shortly after the marriage. RAGLAND is exor. of
oratrix's father, Richard PRUETT, and the admr. of Frances PRUETT, dec'd. oratrix's mother.
She and husband in Aug. 1852 agreed to separate. Thomas H. conveyed to defdt. PHILIPS as
trustee all right and interest in oratrix's father's and mother's estate. Husband left the state to go to
VA on business she supposes. She drew 21 3/4a of land in Wilson Co., TN.... She wants her name
be changed to Lucy A. PRUETT her maiden name.

Petitioner says the wards are his children and he became gdn. more than a year ago. Wards estates
consist of the property settled on their mother at the time of her marriage with petitioner and their
distributive share in the estate of their Uncle Norman S. HOBSON, dec'd. They have a tract of
land on Barton Creek. They have a likely young negro woman and child about 19 years old and a
negro man named Arter aged about 55. Petitioner intends to move to TX next fall and wishes to
carry his children and their means with him ... climate will suit them better than this state. Arter is
an old family negro and has a wife in this county....

5342 - 1865 Sept. 5 - Petition to sell land. William C. RICE of Wilson Co., TN against the
unknown heirs at law of Elizabeth GATES, non resident of state. Orators father Benjamin RICE,
died about 2 years ago, intestate in this county. He owned a small tract of 100a in Civil District
23 bound by Samuel SHERRELL, by the farm which Newton SHERRELL now lives, Lara
HARALSON, on which dec'd. lived at time of his death. He left no widow surviving him and his
only heirs at law your orator, his son, and two children whose names and ages are unknown to
your orator, the children of a dau. of the intestate whose name is Elizabeth, but who married
(blank) GATES several years ago and moved with him to MO and there died leaving two or more
minor children.

same. They were married in 1859 in GA and after the marriage resided in AL unill the fall of 1865
they moved to Wilson Co., TN. ROBUN while in the army in the year 1864 married another
woman in Davidson Co., TN and lived with her for some time and has one child by her which she
never knew till about August last they then separated.... She states that they have two children a
girl in her 6th year named Jane, a son about 4 years old named Eli Monroe....

RUTLAND in year 18(blank) and died in Dec. 1841 leaving her husband and 4 sons surviving her:

on the 8th of Oct. 1859. Isaac their father died on the 22 May 1854. On 16 Mar. 1852 Isaac the

against David A. OZMENT of Bedford Co., TN. Orators in Feb. of 1854 purchased of defdt. in
Bedford Co., TN a steam Saw and grist mill, consisting of one steam engine, one broiler and other
machinery connected with such an establishment. W.A. did the trading, defdt. said machinery was
first rate. Brought equipment to Wilson Co., TN. Boiler was useless ... could not be fixed....
5352 - 1853 Aug. 30 - (O.B.) Sydney J. SMITH and his wife, McHenry Ann SMITH of Wilson
Co., TN against James EDWARDS of Marshall Co., TN. Richard HILL died in Maury Co., TN
testate. Testator gave to his three great grand children Penelope, Elizabeth and McHenry Ann
BRIDGES a negro man named Peter. EDWARDS claimed said slave under an alleged gift from
the testator during the life of the latter. That he brought suit against the heirs of Richard HILL,
dec'd. ... pending the suit, two of the legatees, Penelope and Elizabeth being yet minors, married,
the first with James M. HUNT and the second with Thomas BABB. They agreed to
compromise.... In 1842 Sydney was in Lewisburg.

citizens of MO Against Joseph RUTLAND a citizen of Wilson Co., TN and James B. RUTLAND
a citizen of Davidson Co., TN. W.G. STEELE died in 1838 in Wilson Co., TN - that the father of
W.G. STEELE, whose name was Samuel, gave by deed to his son 5 negroes during his life,
remainder to the children of W.G. STEELE. W.G. STEELE had 11 children living at the time of
his death. In 1838 James ZERGEN became the admr. of W.G. STEELE, and at the request of the
heirs, petitioned to sell slaves for distribution. James B. RUTLAND was the C&M at this time.
He collected the money for the slaves and paid out the same to the various heirs ... with the
exception of George STEELE who was one of the heirs and children. George, son of W.G.
STEELE, died before his father. The portion coming to him was not payable to his admr., but to
his heirs, the complts. They suppose that defdt. did not know where your orators resided. When
James B. resigned office he deposited notes to John K. HOWARD the present C&M....

same and Margaret HUNTER of KY. Orator says, "...about the years 1859 or 1860 he purchased
from defdt. SIMS land in Civil district 6 of Wilson Co., TN ... between 140a or 150a bounded by
John T. NEW, J.B. SHEPHERD, the heirs of Sterling TAPLEY and John T. NEW, Cumberland
river, Mary SULLIVAN and Wm. SIMS home tract. Orator refused to take Confederate money
for two reasons first because he was opposed to the principles for which the money was issued to
carry out - And in the next place he did not consider it money or of any real value, but the said
SIMS told your Orator about a law passed by the Confederate government making it a very high
offence for a man to refuse to take it and that the penalty was imprisonment and confiscation of
property and told your orator that Gen FORREST was nearly with his cavelry and that he the
defdt. would have the cavelry on your orator if he refused to take it, and knowing that the cavelry
was in a short distance, took the money or trash under duress to avoid being imprisoned.... Orator
further charges that the Margaret HUNTER is a mother-in-law of the William SIMS and that she
furnished the Confederate money...."

Co., TN. Your Orator shows that in about the year 1841 or '42, being somewhat involved in debt,
and fearing lest his family, who belonged to him, might be levied on and sold by his creditors, he,
at the suggestion of the said KIRKPATRICK, made a deed of trust of his family to Joseph
RUTLAND, the said Kirkpatrick saying that he wished to befriend your orator and prevent any of
his family from being sold. In the said deed of trust, a note for 750$ and one for 1113$,
are mentioned, said to be due by your orator, to Kirkpatrick and to secure the payment of which,
the deed upon it face is alledged to be made. These sums, Kirkpatrick told your orator, were
placed in the deed for form sake, to make it good, so that it would hold the negroes and prevent
your orator's creditors from taking them; and not that the sd. Kirkpatrick really held at the time,
any such notes, as the two mentioned, upon your Orator. It is true that your Orator, at the time of
making the deed, might have been owing Kirkpatrick something, but the amount was very small.
He feels certain and so charges, that if his signature was ever obtained to any such notes, as then
above mentioned, it was done by fraud ... 5 slaves mentioned in the deed, your orator's wife
named Betsy, and his 4 children Wesley, Evalie, Martha and Nancy, were sold at public sale and
Kirkpatrick became the purchaser of them all, for the sum of about 1145$. He took none of them
in to his possession, or exercise any act of ownership over them, for several years after the sale,
orator retained possession. The last year or two, past, Kirkpatrick claims them as his property.
Kirkpatrick has within the last two years sold 4 of them, his wife Betsy to Deft. SULLIVAN, the
girl Martha to Deft. BROWN, the girl Nancy to deft. HOOKER and the boy Wesley to John FLY
of Madison Co., TN. The other girl, Evaline, died sometime in the year 184_ while hired to H.H.
SIMMONS by Kirkpatrick... Kirkpatrick made a similar representation to John RICE of this
county, from whom your orator bought his said family ... neither RICE or your orator could
read.... Orator rafted lumber for Kirkpatrick in this county and on the river, at different points,
from the mouth of Stone's River to New Orleans ... latter part of 1860, he was imprisoned in the
county jail. Kirkpatrick took orator's papers to add them up to see what he owed orator, but did
not return the papers. In 1842 he paid Kirkpatrick by the hands of his son John Kirkpatrick, which
sum was sent from Natches ... by the hand of Robert BROWN.... In the same year he made three
trips to Clarksville with timber, one with Richard GIBSON, one with a Mr. FLANAGIN and one

wife Mahenry Ann. Richard HILL died in Maury Co. in June or July 1832. James C. RECORD
and John R. HILL exors. In the year 1824 the defdt. married Nancy BRIDGES who was a
grandchild of Richard HILL and the mother of the complt. Mahenry Ann, Penelope and Elizabeth
by a former husband, at this time the defdts. were living in N.C. and he and his wife continued to
live having with them the complt. Mahenry Ann and her sisters until the year 1831. Richard HILL
sent word to the defdt. that if he would move out to Maury Co. with his family and settle them, he
would give the defdt. and his wife 2 negroes named Molly and Peter.... He sold out his homestead
and moved to this state. He arrived at the house of Richard HILL with his family on the 1st day of
Jan. 1832. Defdt. in a few days moved into a house that had just been vacated by a son of Richard
HILL and took with him the slaves Peter and Molly and continued in the possession from that
time until a few weeks before the death of Richard HILL, when one of Richard's sons came into
the field where Peter was at work and forcibly took him from the possession of the defdt. At the
time of the suit, Peter was 15 years of age.... When he married her mother, Mahenry Ann was
about 3 years old and from the date of the marriage over to the year 1839 Mahenry Ann had been

1854 Nov. 25 - Dep. of Penelope E. HUNT says, "...we moved to the house I called "Bob's
House", his son Bob HILL lived in the house at the time. Great grand father died in July. After
Peter was taken away from Edward my grand father HILL, who had a cancer on is face, went
about a good deal. I remember he walked to my aunts, where I was staying about half a mile from
his house. I was about 17 when I came to this county from N.C. My sister, Mrs. SMITH was not
sent to school more than a month by EDWARDS. My sister, Mrs. SMITH, was about 3 years old
when my mother married EDWARDS. My sister, Mrs. SMITH, eloped when she married. My
husband and I approved of the match. My mother was not keeping house in N.C. when she
married EDWARDS. After my mother's marriage while they remained in N.C. I made his house
my home. After my mother's marriage my cousin Frank HILL came to N.C. from this state. I
never saw a man named William LEONARD from this state, in N.C. There was a man named
Leonard, who married EDWARDS sister-in-law, who lived near him in N.C...."
1854 Nov. 28 - Marshall Co., TN. Dep. of Benjamin S. WEAVER about 60 says he knew
Richard HILL late of Maury Co., in N.C. and was intimately acquainted with him after he moved
to TN which he thinks was in 1816.... "I was at Richard HILL'S house the night EDWARDS
landed there from N.C. and stayed all night. In the morning the old man HILL, Mr. EDWARDS
and myself walked out in to the yard where the negroes were killing a hog. Mr. HILL turned to
Mr. EDWARDS and pointed at the boy Peter and said to EDWARDS that is the boy I gave to
you last night ... the old man had a cancer...."
1854 Nov. 30 - Dep. of Jas. M. HUNT says "I am brother-in-law of complt. I married his wife's
sister - have know complt. SMITH since he was a boy - SMITH married complt. McHenry Ann
on the 12th Dec. 1840.... It would take SMITH 5 days to go to Lewisburg and return allowing
him one day to remain. SMITH was not married at my house, but a house in the neighborhood.
SMITH'S wife resided at my house nearly 5 years before she was married. I supported her....
When she went backwards and forwards to Marshall Co. to see her mother, I paid her traveling
expenses. By the will, Peter was bequeathed to the three BRIDGES children one of whom
witness married, another married BABB, and the third complt. McHenry Ann, married SMITH....
The suit was moved from BCT to Marshall Co.... There was a little coolness between my family
and SMITH'S on account of SMITH'S wife's not marrying at my house. I think Mrs. SMITH is 33
or 34.... Mrs. SMITH was 18 or 19 when she married."

Post. Poor John DAVIS was shot by that old Scorrepn DABS on last Saturday about 10 oclock
and died about 12 oclock at night. DAVIS was a keeping store at BERNARDS Store house.
DABES shot him from under the old factery. I never saw as much indignation manifested amongst
a croud as was yesterday. At the trial I herd some express them selves infavor of a dopting the
California rule and if it had bein proposed it would have been hard to have resisted it no dout the

1853 Mar. 25 - Ellis Co., TX. Dear Sir ... you had sold my land.... I want to make but one trip
more and then make a full wind up of all my business there.... You can now buy near 600a of land
adjoining me, with a fine Mill seat adjoining on a never failing stream which can be purchased
altogether for $1200 ... plenty of timber and fine farming land praire. You had better come and
see the prospects it will not take long within 2 miles of Waxahachie town. This country is new not
setled longer than 3 or 4 years. I have 18a of wheat growing on rented land ... about 40a at home
of new land. I shall put up about 12,000 new rails fencing some hundred acres. I should be very
glad to see you all and enjoy your society again. I have one of the prettyest places in TX a
beautiful area before my door. I can set and see 20 deer at a time all in sight feeding 7 miles south
without a house and on the west 15 with some small exception.... I can have if I chose a farm of a
1000a without a break - a good neighborhood the people moral we have no church near but at
some distance several. Pierce is at my house engaged in practicing medicine. When you receive
this then send it to SCOBY. I conclude by giving my respects to you children and accept the same

1853 Nov. 18 - Letter. Near Waxahatchie, Ellis Co., TX, from Edward SWEATT. "Dear
Betsey and LIGGON your kind favor and SCOBY came to hand two days ago ... found us all in
tolerable health except myself. I was taken sick in Aug. and was sick for sometime when I began
to convalesce I indulged to freely in eating which gave me the cramp Colic and entirely deranged
my Stomach. ...you say too you have given out coming to TX, which I was sorry to hear. I think
we have a fine country in which any industrious man can make a good living.... I conceive you
ought to come Betsey I should not have been willing to have left you if I had not expected you to
have come. I still hope you will come. I conclude by subscribing myself your affectionate Father
write soon. A.B. I have sent you enclosed a power of Atty.... Dear Berry, I next address you, ...
good banks in New Orleans.... I want you to asertain what a likely negro girl from 12 to 18 years
old could be had for there.... We have a fine country here fine production land deer and Turkey
plenty this would be a favorable falt to move here a plenty of meat and bread corn can bought for
.25 cts per bushel, wheat .15 cts. pork a plenty for from $2.50 to $3.00 per hundred, the health of
the country generally very good the country has enjoyed a healthy season. I want you to come out
and see me and see our country. I think you would be pleased with the country. You have no
stock to feed, cattle will winter in the range. I have a pretty little stock of cattle. I have some
upwards of one hundred head. I can not tell you one tenth of the prospects of our country in a
letter come and I will tell and show you and you'll be your own judge. Tell James howda for me
tell him I want to see him tell him to be a good boy and well improve his time at school. Give my
respects to your wife and family and to all my old friends give my respects to your father and

not at home and Mr. CARUTH wanted the note that pap held against him and Mother would not
give it to him and he would not give up the note he said that he could report him to General
FORIST and FORIST would dispose him of the note and pres him in to service for six months
then i asked Mr. SIMS if he could do it and SIMS said yes that is the order. Mr. SIMS and Mr.
CARUTH belonged to the Rebel army.... SHEPARD said that that was the 2nd time Thomas
RAMSEY had come there medling with Mr. SHEPARD business and if he come any more he
