Will of James P GRIFFIN Deceased

I James P GRIFFIN a citizen of Weakley County Tennessee being of sound mind and memory and realizing the uncertainty of life and the certainty of death do make and publish this my last will and testament hereby revoking any all former wills at any time made by me.

 1st My executor who I will hereafter name will as soon after my death as practicable out of any money or effects that I may die seayed (?) or possessed of pay all my just debts including my funeral and burial expenses

 2nd I give and bequeath to my wife Polly Ann GRIFFIN the following household goods to wit one rocking chair one small table one safe one trunk one bedstead bed and its belongings one set of plates five bowls one dish plate one pitcher three pictures.

 3rd The remainder of my property both real and personal I give and bequeath equally one fifth to my wife Polly Ann GRIFFIN one fifth to my daughter Laura STACKS one fifth to my daughter Rebecker VICKERS (as spelled) one fifth to my daughter Tiney GARNER an (as spelled) one fifth to the heirs of my deceased daughter Minnie MCDANIEL and having heretofore made advancement of one hundred dollars to my daughter Rebecca VICKERS and fifty dollars to my deceased daughter Minnie MCDANIEL the said amounts will be charged to them in the division of my estate by my executor.

 4th I nominate and appoint my friend Geo T ERVINE as executor to this my last will and testament and authorize him to sell my personal property in any manner or at anytime it seems best in his judgement and to collect any and all debts that may be due my estate and after paying any debts that I may owe and all expenses incident to carrying out the provisions of this will the will then prorate the remainder among the beneficiries (as spelled) named and set out in clause 3 of this instrument.  My real estate shall not be sold by my executor until the expiration of two years from the date of my death when at the expiration of said time my executor shall sell my said real estate either publicaky (as spelled) or privately for cash or for 1/3 cash and the remainder on a credit using his best judgement in making terms of sale provided if my wife Polly Ann GRIFFIN and my daughters Laura STACKS Rebecca VICKERS and Tiny GARNER or their legal representatives shall make written request to my executor for an earlier sale of my said real estate then my executor may make sale at anytime upon the terms set out above Geo T ERVINE executor is hereby fully empowered to make and deliver to the purchaser or purchaseers (as spelled) of said real estate deed pr deeds with full warranty.

 5th My executor is empowered to take possession of my real estate upon my death and rent same until sale is made of same and when said sale is made he will then prorate the proceeds of said sale as the same comes into his hands to the beneficiries (as spelled) named and set out in clause 3 of this instrument

6th Having full confidence in the honesty integrity and judgement of my friend Geo T ERVINE I hereby waive his exemting (as spelled) any bond for the faithful carrying out the promises as executor of this my last will and testament witness my signature by X mark

I W J JETER Clerk of the County Court of Weakley County Tennessee Weakley County     do hereby certify that the above and foregoing is a full and true and correct copy of the paper writings dated 19th day of January 1915 and admited (as spelled) to probate and decreed to be the last will and testament of James P GRIFFIN Deceased; In the County Court of Weakley County Tennessee Ordered filed and entered in the will book of said court.
