State of Tennessee Wayne County

Know all men by these presents that we Thomas H. MABRY Wm POLLARD Thomas MEREDITH Jonathan MORRIS S L BURNS and John L. CYPERT all of the County [of Wayne – crossed out] and State aforesaid are held and firmly bound unto the State of Tennessee in the sum of twenty five hundred dollars which payment well and truly to be made we bind ourselves our heirs executors & administrators dated this 1st day of April 1850 The condition of the above obligation is such that whereas the above bound Thomas H MABRY is trustee of Wayne County whose duty is to receive and pay over all fines by him received under an act of the Assembly entitled an act to punish small offenses. Now if the said Thomas H MABRY as such trustee shall indemnify said County for any loss occasioned by [any – crossed out] breech of his duty in proceeding under said act and pay as lawfully directed all fines received or which might have been received by him under said act then this obligation to be void else to be and remain in full force and effect / / s / / T H MABRY (seal) William POLLARD (seal) Thomas MEREDITH (seal) Jonathan MORRIS (seal) S L BURNS (seal) John L CYPERT (seal)

And the said Thomas H. MABRY and each of his said securities acknowledged the execution of said bonds in open Court which was approved of and received by the Court and ordered to be recorded whereupon the said Thomas H MABRY took the necessary Oath for his qualification.

Ordered by the court that Hiram MORRISON be appointed overseer of the road of 1st Class in the place of John MORRISON and that he have the hands in the same bounds to work under his direction Isued Apr 3, 1850

A settlement between the County Commissioners and the County Trustee was this day presented to the Court which was received by the Court and ordered to be recorded

Ordered by the Court that John LEE be appointed overseer of the road of 2d Class in the place of Joseph DIAL removed and that he have the hands in the same bounds to work under his directions Isued Apr 3, 1850

Monday April 1st 1850

Upon the petition of Nathan F BIFFLE It is ordered by the Court that the Sheriff summon a Jury to consist of not less than five nor more than twelve free holders who after they have been duly sworn for said purpose shall view and report the propriety of changing the road leading from Waynesboro to Ashland where it passed his residence so as to run on the north instead of the south side of the branch and that they report to the next term of the Court Isued May 28th 1850

Ordered by the Court that the following good and lawful men of the County of Wayne be appointed and summoned by the Sheriff of said County to be and attend at the next term of our Circuit Court to be held for said County of Wayne at the Court house in the town of Waynesboro on the fourth Monday in May next to wit Thomas MABERRY David C McADOO Jonathan C ELLIOTT Robert W SIMS Samuel L. On petition of Mason TIDWELL and it appearing to the satisfaction of the Court that said TIDWELL is blind and in indigent circumstances and unable to do manual Labor it is ordered by the Court that the said Mason TIDWELL have the privilege of Hawking and Peddling within the Court of Wayne on his taking the Oath prescribed by law in such Cases

On motion to appoint EAST & CARTER the sum of six dollars and sixty four cents for repair on the Court house those who voted in the affirmative were D J JONES Chr. YOUNG HAYNES LAFFERTY MONTAGUE WILSON VOORHIES WATKINS SIMS HOPSON GRAY BREWER HAM DIXON LEE PHILLIPS and WHITTEN 17 noes none so said appropriation was made to be paid out of any monies in the hands of the County trustee not otherwise appropriated Isued May 28th 1850

Ordered by the Court that the Commissioners appointed by this Court to examine in to the Condition of the town lots in Waynesboro be authorized to compromise with any persons having in possession by any Color of title any of said lots belonging to Wayne County without any pay for the improvements there on as they may think just.

Monday April 1st 1850

Ordered by the Court that Solomon COOCH George I WALKER David VOORHIES Elisha POLLOCK and John VOORHIES freeholders be appointed a Jury of View to View and mark out so as to change the Buffalo road Beginning at David VOORHIES and thence down on the South side of said River and intersect the Mt. Pleasant road at John CRAIGs and that they report the same to the next turn of this Court.

Came John H HENDRICK & others who was appointed at a former term of this Court a Jury of View to View and mark out a change in the road leading up Holly Creek and report the Change made as directed in the order which was received by the Court.

On motion to appropriate to James T YOUNG Thomas MEREDITH John GRIMES John P VOORHIES A B GANT M J SIMS Wm R CURTIS B HOPSON B HAM John DIXON and John PHILLIPS the sum of five dollars each and to W CARTER and Wm. Came in to Court Rial BREWER who was on the first Saturday in March 1850 duly and constitutionally elected Sheriff for Wayne County by the qualified Voter thereof for the next two years thereafter ensuing and entered into the following bond to wit [here follows a standard bond which carried over to page 105, no heading] bond signed Rial BREWER (seal) Wm BENHAM (seal) John HAYES(seal) J W STANFIELD (seal) Brinkley HOPSON (seal) J I BIFFLE (seal) And the said Rial BREWER and each of his said securities Acknowledged the execution of said bond in open Court which was approved of and received by the Court whereupon the Said Rial BREWER took the necessary Oaths for his qualifications [here follows another version of the above bond which has been crossed out]

Ordered by the Court that Joseph S[?] ROBNETT be appointed overseer of the road of 2d Class in the place of John JACKSON Jr. and that he have the hands in the same bounds to work under his direction Isued Apr 13 1850

Ordered by the Court that Allen KERLEY work on the Waynesboro and Ashland Road under John FISH and that he be exempt from working on road that he formly worked on

On motion to appropriate to John ROBNETT the sum of three dollars the amount by him expended for the support of James J BOYD a pauper of Wayne County in the year 1849 those who voted in the affirmative were D J JONES Cr. YOUNG LAFFERTY CARTER MONTAGUE WILSON VOORHIES WATKINS HOPSON GRAY PHILLIPS & WHITTEN 12 Noes none so said appropriation was made to be paid out of any monies in the hands of the County Trustee not otherwise appropriated

It is ordered by the Court (there being more than [a majority-crossed out] two thirds of the Justices of the Peace in said County present) that an additional civil district to be known as district No 14 be and the same is hereby established and bounded as follows to wit commencing where the old line between Wayne and Hardin County intersects the Tennessee River thence up the river to the point where the line between Wayne and Hardin County as established by the act of 1849-50 attaching a portion of Hardin County to Wayne County leaves said river thence with said line to the old Wayne County lines thence north with said line to the beginning being that portion so attached to the County of Wayne It is further ordered by the Court that the Town of Clifton in said District be and is hereby established the place of holding elections and the precinct in and for said District until the same is changed by a majority of the voters of said District voting in any District election voting for the same. It is further ordered by the Court that the Sheriff open and hold an election for on Constable and two Justices of the peace for said District after having given the notice required by law

This day came Rial BREWER into Court who was on the first Saturday in March 1850 duly & constitutionally elected Sheriff [of Wayne County-crossed out] and Collector of the public taxes of Wayne County and entered into the following bonds to wit [here follows a standard bond] / / s / / Rial BREWER (seal) Wm BENHAM (seal) John HAYSE (seal) Wiley BREWER (seal) Brinkley HOPSON (seal) J W STANFIELD (seal) Z M JOHNSON (seal) Lasson HAYS (seal) [there follows here another bond carrying over to page 108 with the same signatories] And the said Rial BREWER and each of his said securities acknowledged the execution of said Bonds in open Court which was received by the Court and ordered to be recorded Whereupon the said Rial BREWER took the necessary Oaths for his qualification

Ordered by the Court that Sheriff pay over to the Commissioners of the Poorhouse the sum of five hundred and fifty dollars out of the County Tax when collected the present year 1850

On motion to appropriate to M J SIMS the sum of Eight dollars for holding the Election for County officers in March 1850 Those who Voted in the affirmative were D J JONES chr. YOUNG HAYNES LAFFERTY JOBE CARTER WATKINS BREWER DIXON LEE PHILLIPS & WHITTEN 12 Noes MONTAGUE So said appropriation was made to be paid out of any monies in the hands of the trustee not otherwise appropriated Isued May 28th 1850

On petition it is ordered by the Court that Wm B WALKER A C RASBERRY Andrew JACKSON Peter YOUNG John STOCKARD and James E McKNIGHT be appointed a Jury to View and mark out so as to change the road leading down fortyeight mile Creek by the plantation of E D BIFFLE and that they report the same to the next term of this Court Isued May 28th 1850

A majority of the Justices of Wayne County present the Court proceeded to elect a Ranger for said County for the next ensuring two years whereupon David J JONES was duly elected And entered into bond in the sum of five hundred dollars with C B McLEAN and R A HILL his securities conditioned for the faithful performance of his duties as such ranger And the said D J JONES and each of his said securities Acknowledged the execution of said bond in open Court and the Court approved and received said bond and ordered it to be recorded. Whereupon the said D J JONES took the necessary Oaths for his qualification

A majority of the Justices of the peace being present the Court proceeded to elect a Corner for Wayne County for the next two years ensuing Whereupon John L CYPERT was duly elected and the said John L CYPERT entered into bond in the sum of Twenty five hundred dollars with S L BURNS T H MABRY Wm BENHAM and Jon. MORRIS his securities Conditioned for the faithful discharge of his duties in said office And the said John L CYPERT and each of his securities acknowledged the execution of said bond in open court which was approved of and received by the Court and ordered to be recorded Whereupon the said John L CYPERT took the necessary Oaths for his qualification

Ordered by the Court that Soloman PHILLIPS be appointed Overseer of the road of 2d Class in the place of John S BURNS and that he have the hands in the same bounds to work under his direction Isued Apr 13 1850

Came into Court Thomas MEREDITH and Clabon ACKLIN who was this day appointed deputy Sheriff by Rial BREWER Sheriff of Wayne County and took the necessary Oaths for their qualification

George W BARKER this day presented to the Court his Commission as Justice of the peace in the 5th Civil District Wayne County Whereupon the said George W BARKER took the necessary Oath for his qualification

Ordered by the Court that E H PUGH R A HILL & L L MACK be appointed commissioners to Examine the public Square as worked on by A T HASSELL and report to the next term of this Court whether or not said HASSELL completed said work according to contract and if not what is lacking

  • State of Tennessee) Be it remembered that Quarterly County Court was began Wayne County) and held for the County of Wayne at the Court House in the Town of Waynesboro on the first day it being the first Monday in January A.D. one thousand Eight hundred and forty nine the following Justice were present and presiding (viz) W. CARTER Chairman, HAYNES, LAFFERTY, JOBE, POPE, James ROBERTS, MONTAGUE, WALKER, WILSON, WATKINS, GANT, A. GRAY, HOBSON, T. GRAY, BREWER, LEE AND SHEPARD.
  • A settlement between Wm. JONES, Clerk of this Court and Burrel WALKER Executor of John SHAW Dec’d was this day [exhibited crossed out] submitted to the court for their consideration and was confirmed and ordered to be recorded.
  • Came Thomas H. MABRY trustee of Wayne County into Court [and reported to the Court crossed out] and Presented the following report which is ordered to be rec’d and spread on the mintues [sic] of the court and which is in the words and figures following to wit: To the worshipful County court of Wayne County now in session Thomas H. MABRY Trustee of said County submits for your inspection the following report and showing of the amount of claims that has come into his hands by an order of your court as common School funds to wit 1 Rec’d of Thomas M. EAST on the 1st of March 1847 various Bonds & Notes and have collected in cash on said Bonds after paying some costs of Suits $67.75 and have a judgment well secured for same on Stephen COOPER for $24. and have Jesse S. ROSS and John McDOUGALS note for a balance due of $46.95. I have brought suit vs John CLEMENS et al and William L. T. EDWARDS et. al. and Martin SCOTT and had to pay the cost in each case the cost amounts to $9.75 also one on John G. HILL and S. L. BURNS for $42.21 stayed by Andrew JACKSON (making the aggregate) $180.91
  • Paid R. A. HILL atts fee aff. 5.00 secured & on hand $175.91                                                   I would further state to your worshipful body that I have used the best means that I could to ascertain the true situation of the balance of the claims I have on hand and believe they are worthless as that it would cost more to collect them than they are worth as the greater portion of them have moved off from this County. I return with this report all the bonds in my possession for you to do with as you may think best all of which is respectfully submitted this 1st day of January 1849. Thomas H. MABRY Tte.

  • On Motion to appropriate to William JONES Clerk of this Court for fees for Road orders and Venirafacias [sic] etc for the year 1848. Fourteen Dollars. Those who voted in the affirmative are W. CARTER Chairman HAYNES, LAFFERTY, JOBE, POPE , MONTAGUE, WILSON, WATKINS, A. GRAY, HOPSON, Thomas GRAY, SHEPARD & GRIMES – 13 Noes none so said appropriation was made to be paid out of any money in the hands of the County Trustee not otherwise appropriated.
  • This day John GRIMES came into court and presented his commission as a justice of the peace in the 5th District of Wayne County, and whereupon he took the necessary oaths for his qualifications and took his seat on the Bench.
  • On Motion to appropriate the sum of Twenty seven Dollars and sixty [?] three and three fourth cents to Littlebury L. MACK a former clerk of this Court for Road orders Juries of venue Tax book making tax book &c those who voted in the affirmative are W. Whereafter having been duly sworn according to law report a road found. Whereupon it is ordered by the Court that Berry FOWLER be appointed overseer to open and clear out said road and that he have Josiah, DARBY, Joshua DARBY, A.T. GALLAHER took the necessary oath for her qualification.
  • On application it is ordered by the Court that John CLEMANS, Eliphus RILEY, John SMITH, William J. YOUNG and S. L. BURNS be appointed a Jury of View to view and mark a 2nd Class road beginning at the mouth of Mockison Creek on Buffalo and runn the best way that can be found to Samuel RILEYs mill and that they report the same to the next term of this court. Isued Jan 6, 1849.
  • This day Jesse S. ROSS by attorney moved the court to be released as one of the securities of Flora M. HARRIS Executrix of Robert HARRIS deceased and it appearing to the Court that said Flora M. has had the notice required by law it is ordered by the Court that said Flora M. give bond with other and sufficient security in the sum of ten thousand dollars conditioned as the law directs for the faitful execution of trusts bequests and devised made in the last will and testament of said Robert deceased. Whereupon William WITHERSPOON and Franklin WITHERSPOON as securities aforesaid came into court and entered into bond [into bond crossed out] in the sum of ten thousand dollars conditioned as the law directs. it is thereupon ordered by the court that said Jesse S. ROSS be released as such security aforesaid.

WALKER, Burrell WALKER and Nathan BIFFLE freeholders be appointed commissioners who after having been duly sworn for the said purpose shall a lot and set apart to Elizabeth KYLE widow of Alexander KYLE deceased so much of the crop stock provisions money and other property on hands belonging to the estate of said Alexander KYLE as shall be sufficient for the support and maintenance of herself and family for one year next after the death of her said husband and report to the next term of this court. ARNOLD, Thomas Jefferson Harrison, of Yale, Arkansas, was born March 20, 1842 in the County of Wane, Tenn., the son of Thomas Arnold and Mary Lackey of Wane Co., Tenn. Thomas Arnold was a Baptist preacher for about 40 years up till his death. Subject attended private school in Izard Co., Arkansas for about 8 years. His teachers were Thos. Arnold, John Byler, and Sullivan. He was a farmer, and enlisted in Izard Co., Ark. in June 1862 under Marion Gipson, was in Batesville Inf. In active service 3 years. Commissioned officers were S. S. Tailor, and Gray. Regt. Officers were M. Gipson, Matthew McGlothlin, Capt. Hollowell, James Shale. Some of the private soldiers were T. J. H. Arnold, J. D. Arnold, Jas. Cobb, Green Cobb. Rutlage Smith, George Gipson, I. R. Gun, Stanch Smith, Watt Grimit, Amos Moody, John Johnson, Davidson Johnson, Jos. Pernan, Bill Permian, Jim Ross, Bill Taylor, Arch. Milton, Bill Hopkins, Jim Self, Chris Stroud, Bill Hutton, John Hooker, Jef Dickson, Bill Rose, Jo. Byler, Ben Brady, John Jacops, John Scipert, Pies Thompson, Bill Broos. He stated, “My company joined Jas. R. Shales Reft. at Batesville from which place we marched to Van Bruen from there over to Fort Smith where there was a little scrimmaging. Nothing of importance between Ft. Smith and Little Rock. At Little Rock there I took sick and not able to be with the army any more. Subject’s wife was Malinda Catherine Moody, who he married in May, 1868 in Berry Co., MO. She was the daughter of Joshua Moody and his wife Joanna Moody, who lived at Independence Co., Ark. Children:

Maiden name of subject’s mother was Dabney Ray, daughter of ____Ray and his wife, Jennie, who lived in Bedford Co., TN. Subject was educated in Lincoln Co., TN, was a farmer, a Democrat and a Methodist. Private Co., K, 12th Ark. Regt. 4 years of service. Married Matilda Sutton, daughter of James and Isabella Sutton who lived in Wayne Co., TN. married 8 Nov 1853. Children:

CYPERT, Jesse Newton of Searcy, Ark., born 5 Dec 1823, at Indian Creek, Wayne Co., TN, son of Jesse Cypert born at Tar River, NC Was in Cornwalls Brigade, Andrew Jackson Div., in War of 1812. Was at Battle of New Orleans. There he was honorably discharged after the Battle, Jan. 8, 1815. He was the son of Francis Cypert and his wife Abigal Johnson Cypert, who lived at Wayne Co., TN. Maiden name of subject’s mother was Jamima Wortham, dau. of Jas. Wortham of Warren Co. TN. “None of my ancestors was in the Revolution. My great uncle Robin Cypert, brother of my grandfather Francis Cypert was a Revolutionary veteran and I have seen his discharge and pension certificate. My father was at athe Battle of New Orleans in War of 1812.” Subject was educated in county school in Wayne Co., TN and was licensed to practice in 1849. Began active practice of law in Marion, Crittenden Co., [ARK] in May, 1850 and came to Searcy, White Co.,, Feb 14 1851 where he served, resided and practiced law. Was a Whig until after the Civil War – since has been identified with the Democratic Party. Was a member of M. E. Church, South; Masons and Oddfellows. “Have written for publication a Chapter on Secession Convention of Ark. published in Vol. One, pages 314-324, Arkansas Historical Publication. Was a Captain of Co. A, Deshias’ 5th Ark. Bat. on the organization of same. Was elected Major at Pocahontas, Ark., in Nov., 1861, after the Battle of Shiloh – it was consolidated with 8th Ark. Reft and was discharged and sent in Commissary Dept. in Train, Mississippi. Married Sarah Harlen Crow, daughter of Joshua B. Crow and wife Lavinia West Crow who lived at West Point, Ark. Married in White Co., Ark, Feb 6, 1855. “J. B. Crow, my wife’s father, was the son of Rev. Charles Crow and his wife Sarah Harlon. Her mother, Lavinia (West) Crow, was the daughter of the Rev. William West and his wife Mary (Howard) West.” Children:

1. Florence, oldest daughter married Wm. Watkins, died August 6, 1896
2. Allice m. H. W. Smith and died Feb. 11, 1896
3. Eugene Cypert, my only son, married L. I. Seat, and they now reside at Searcy, Ark. Eugene Cypert is my present law partner.

FREDEKING, Alford Thedore of Caldren, Ark. was born Feb. 6, 1845 at Waynsboro, Wayne Co., Tenn. the son of George Thedore Fredeking of Germany. Maiden name of subject’s mother was Martha Richerson, dau. of William Richerson. Subject was a farmer and a Democrat. He was assigned to Reeves Regt. Cav. under Capt. John Mitchell, Col. Reeves and Gen. McCray; was in battles at Grand Prairie, Ark. and Fredericktown, Mo. Married in Lawrence Co., Ark Edna Matilda Thompson.

HOLLABAUGH, James Calvin, of Prairie Grove, Ark, born 4 Jul 1845 in Perry Co., TN, the son of Jacob Hollabaugh, born at Linden, Perry Co., TN, who lived in Wayne Co., TN. He was the son of George Hollabaugh and his wife Catherine Fraley who was raised in Roan Co., NC near Salsbury. Maiden name of subject’s mother was Catharine Fralay, originally from Germany. “My great-grandmother Catharine Fraley in the time of the Revolutionary War, and died at the age of 104 years, came across the ocean in a walnut chest (?)”. Subject was educated in the German language and had a German Bible. He was a Democrat, Mason and Southern Methodist. Was a soldier in the Civil War, 2nd Corporal, 9th Tenn. Cav., Co. H, Forrest old Brigade. Married the daughter of James and Rachel Harvey of Wayne Co., TN (name not given). The Harveys came from Georgia to Tennessee and were of Irish descent. Children:

He was the son of Jonathan Alexander Isom and his wife Elizabeth Walker, who lived in Wayne Co., TN. Maiden name of subject’s mother was Elizabeth Kenneday, daughter of Alexander Kenneday of Wayne Co., TN. “My great-grandparents came from England and first settled in Virginia, then my grandfather, Jonathan Isom, came to Wayne Co., TN.” Subject was educated in country schools of Marshall Co., Miss. He was a farmer, beginning in 1857 in Marshall Co., MS and continued there until 1858, then moved to Drew Co., Ark, and then continued my occupation until present. Was a Democrat and a Mason, M.E. Church South. Was a Capt of Co. B, 9th Ark. Regt. Enlisted at Pine Bluff, Ark in 1861, served about 12 months and was wounded on April 16 at Shiloh, Tenn. was then transferred to Texas post service, Commissary Dept. and remained in this service till end of war, surrendered at Sherveport, LA. “After 4 years service in Confederate War, I came back to Drew Co., Ark, and took part in resisting the horrible “Carpet Bag” rule to which we were subject to ten or eleven years, which was finally overcome by our persistent efforts and I am thankful to say, we now have a happy and prosperous country.” Married Dorcus A. Erwin, daughter of John and Priscilla Erwin on 21 Jun 1859 in Drew Co., Ark. Raised two orphan girls, Fannie Harris who married Reubin Smith, Selma, Ark. and Kate Stephenson who married William Bradley, Selma, Ark.

Grandfather was Daniel Kerley; grandmother was Ann Kerley, both of whom lived in Albermoile Co. VA. ROSS, James Wilson, of Charleston, Ark, RFD#, was born 13 Jan 1845 at Waynesboro, Wayne Co., TN, the son of William Benham Ross born near Waynesboro, Tenn. He held office of Sheriff in Wayne Co., Tenn, also of Kern Co., Calif. He lived in Tenn. until 1854, then went to Calif, where he lived two years, died 1872. He was the son of James W. and Catherine Ross who lived near Waynesboro. Maiden name of subject’s mother was Serene? Mack, daughter of Aquilla Wilson Mack who lived near Waynesboro, afterwards at Mt. Hope School, three miles north of Waynesboro. He was a farmer, Democrat, Cumberland Presbyterian, Mason and Odd Fellow. Was a private in Co. A, 9th Tenn. Cav. which was consolidated with another Co. and was known as Co. F of said regiment. Enlisted 10 Aug 1862 and at the surrender under Gen. Bedford Forrest at Gainesville, Ala., on the 10 day of May, 1865. Married 1st Harriet Elizabeth Jones, daughter of William Jones and his wife, Nancy Helton, dau. of Samuel Helton, 3 Oct 1876, near Waynesboro, Tenn. (Does not name 2nd wife). Children:
