I  James B. Nance a native of the State of Tennessee and now a citizen of Tennessee and who was a soldier from the State of Tennessee in the War Between the United States and Confederate States, do hereby apply for aid under the Act of the General Assembly of Tennessee entitled “ an Act for the benefit of the indigent and disabled soldiers of the late war between the States, and to fix fees of attorneys or agents for procuring such pensions, and fixing a penalty for violation of the same, “I do solemnly swear that I was a member of  Company “C” 4th Tennessee Cavalry Regiment [Smith’s]  in the service of the Confederate or United States, and that by reason of disability and indigence I am now entitled to receive the benefit of this Act. I further swear that I do not hold any National, State, or County office, nor do I receive aid or pension from any other state or from the United States, and that I am not an inmate of any soldier’s home and that I am unable to earn a reasonable support for myself and family. I do further solemnly swear that the answers given to the following questions are true:

 

In what county, State, and year were you born----Blount County, Tennessee in the year 1839?

When did you enlist and in what command? Give the name of the regimental and company officers whom you served.

Answer-I first enlisted in Captain Saunders Company in 1861, which after became part of the 4th Tennessee Cavalry Company “C” of that Regiment, Baxter Smith -Colonel, Paul F. Anderson -Lt. Colonel, Scott Bledsoe- Major, George Moore-Captain, Lt. Scruggs, Hogan, and Scroggins.

In what battle were you engaged in and if not wounded, state what disabilities did you receive if any? 

Answer- I was engaged in all the battles of the Army of the Tennessee from Fisher’s Creek to Bentonville, North Carolina. I was slightly wounded at Griswoldville, Georgia in 1864. Has two horses killed and had one bugle shot out of my hand.

What was the precise nature of your wound or disability incurred? 

Answer-A slight wound not disabling me from service, now shortness of breath, full of boils and incapacitated for work.

Were you incapacitated for service by reason of said wounds or disability?

Answer-No

Were you discharged from the army by reason of said wounds or disabilities?

Answer-Not

If discharged from the army, were you and what did you do until the end of the war?

Answer-Not discharged with Johnston at Charlotte, North Carolina at close May 3, 1865.

What was the name of the surgeon who attended you?

Answer-Delany

How did you get out of the army, when and where?

Answer-Paroled at ---Charlotte, North Carolina May 3, 1865

Did you take the Oath of Allegiance to the United States Government?

Answer-Had

If so, when under what circumstances?

Answer-At Charlotte, North Carolina is the only obligation I took and am still a paroled soldier.

Are you married or have you been married?

Answer-Have been     wife now deceased.

If so what is the size of your family living together?

Answer-My children are of all ages and do not live with me.

To what sex do your children belong?

Answer- 4 boys and 2 girls

Are not some of your children able to support you?

Answer-As much as they can do is support their families.

In what business are you now engaged, if any and what do you earn?

Answer-I am doing nothing   not able

What estate have you in your own right, real and personal and what is it value?

Answer-None

What estate has your wife in her own right, real and personal and what is its value?

Answer-None

How have you derived support for yourself and family for the last five years?

Answer-Contracting on a small scale

Do you use any intoxicants to exist?

Answer-Do not

How long have you been an actual resident of the State of Tennessee?

Answer-Moved to Smith County when I was five years old. Have lived in Tennessee all my life.

Have you an Attorney to look after this petition?

Answer-None

If so give his name and address.

One of the subscribing witnesses to the foregoing application and who is a physician of good standing and being duly sworn says that he has carefully and thoroughly examined

James B. Nance the applicant and find him laboring under the following disabilities.

 

Senile disability and shortness of breath which makes the applicant unable to do manual labor. Also continually bothered with boils.

And ________further makes oath to the following facts touching the applicant’s service in the ___________

army.

 

 We were members of the same Regiment with James B. Nance and we both surrendered at Charlotte, North Carolina on May 3, 1865, and know to our own knowledge that James B. Nance was there as I surrendered at the same time. And place.
