M. L. ALLEN & OTHERS TO BARZELEA HOPPER – DEED

This indenture made this 9th day of February in the year 1853 Between Miles L. Allen and his wife Mary Elizabeth formerly Mary Elizabeth Berry, William Carr and his wife Harriet M., formerly Harriet M. Berry, and the County of Gibson and state of Tennessee the other part, and Barzelea Hopper of the County Madison and State of Tennessee aforesaid of the other part:

Witnesseth that the said parties of the first part for and in consideration of the sum of Eighty dollars to them in hand paid, the receipt whereof is hereby acknowledged; hath given, granted bargained and sold unto the said Hopper and do hereby give, grant, bargain and sell to the said Hopper all the right title claim interest that they have unto a certain tract of land in the county of Madison containing twenty acres adjoining the land Hopper now lives on on the North and the land of Louis Pearcy on the East and South and Hugh Montgomery on the south and West said tract of land belonging to the said Elizabeth and Harriet as two of the heirs of Nancy Berry, Dec’d. The said Harriet and Elizabeth being each entitle to the one fourth part of said twenty acres a line described as jointly to the one half which interest they hereby jointly with their heirs bonded aforesaid they hereby convey. To have and to hold to the said Barzelea Hopper his heirs, executors, administrators, and assigns forever. To his own proper use and behoof,. And the said parties of the first part do covenant and agree with said Hopper that they are lawfully seized of said bargained and sold premises have a good right and title to the same and that the said premises are unencumbered and that they will forever warrant and defend right and title to the same to the said Hopper his heirs and assigns and also against themselves and all and every person or persons whatever lawfully claiming the same. In testimony whereof the said parties have herewith put their hands and seals the day and year above written.

I, J.J. Birdsong of Madison County and State of Tennessee have this day bargained and sold unto James H. Davenport of the Said County and State a certin tract of land in Madison County Tenessee in Civil District No 16 for and in consideration of the sum of Thirteen Hundred and fifty one Dolars to me in Hand paid the recipt. Where of is hearby acknowledge and bounded as follows beginin at a Stake at Z. H. Bannett South West Corner on J M Simpson East boundary line thence East 114 poles to a sweat gum at John Umpstend South East Cornen Thence South with J N Barnett line 81 ½ poles to a Stake with a Black oake Past Oake pointing thence west with J J Birdsong line 114 poles to a stake thence North with J M Simpson line 81 1/5 poles to the beginin containing Fifty Six Acres more or les the said J J Birdsong Binds himself his ? and assigns to ? and forever defend the wright and titl to the whole described tract of land againest the lawful clames of all persons whatsoever
