Haywood County } August Term 1837

The Last Will and Testament of Sally Tyner.

In the name of God, Amen. I, Sally Tyner, of the county of Madison and the state of Tennessee, being of sound and perfect mind and memory, blessed be God, do this the twelfth day of January in the year of our Lord, One Thousand, Eight Hundred and Twenty-Six, do make and publish this, my last will and testament, in manner as follows, that is to say, after all my just debts being paid I lend my Negro girl, Tamer, to Isaac (?) and Ann Wellings during their lives, and after their deaths, her increase, if any, to be equally divided between Probate Colyer Midyett and Sarah Catherine Tiner, to them and their heirs forever. My large church Bible to Micajah Midgett. If anything is left after paying my just debts it is to go to Josiah Midyett.

I do ordain Micajah Midgett my executor to this my last will and testament, in witness whereof I have hereunto set my hand and seal this 12th day of January 1836.

An instrument of writing purporting to be the last will & testament of Salley Tyner was this day produced in open court and proven by the oaths of John McClellan & Albert McClellan, witnesses thereto and ordered to be recorded. Micajah Midgett, executor to the last will & testament of Salley Tyner, came into court and entered into bond of $1400.00 with John McClellan and Albert McClellan as his securities.

The settlement of Micajah Midgett, executor of Sally Tyner, dec’d., made with the clerk on Sept. 30th last, was this day confirmed by the court and ordered to be recorded in Record Book A, page 175.
