W. J. WINN was this day appointed Guardian of ELIZA J. WINN Minor orphan and Grand child of LITTLETON MEDLIN Deceased Whereupon the said W. J. WINN came into Court and entered into Bond in the sum of Two hundred dollars with H. H. MAYHON and DANIEL WHITE as his securities which Bond was severally acknowledged in open Court approved by the Court and orderd to be recorded and W. J. WINN was duly Qualified as Guardian of ELIZA J. WINN Minor orphan & Grand child of LITTLETON MEDLIN deceased.

ELIZA WINN

In this Court it appearing to the Court that defendant ELIZA J. WINN is a minor under Twenty one years of age without a regular Guardian. It is therefore ordered by the Court that WILLIAM A. POWELL an attorney of this Court, be appointed Guardian ad Litem for her, to plead, answer or demur to petitioners petition.

The answer of ELIZA J. WINN Minor defendant by her Guardian ad litem W. A. POWELL to pet—-? petition? This defendant for answer to pet—-? petition says that she admits the death of D. W. MEDLIN that he owned the Real property that she & petitioners own the same in shares as stated yet she can not say as to whether it would be to her interest to petition or sell for? partition said Land and being a minor puts herself on the Court for —-? of all her right in the premises and being as fully as she can pays to diss—-?

This cause came on to be heard before the Worshipful County Court of Crockett County upon petition or petitioners, answer of Guardian ad litem, Proof and report of the Clerk, which report in words and figures as follows. JAMES LITTLE Et al VS ELIZA J. WINN. The Clerk of this Court to whom was refered, this Cause to take proof and report as to the title to the Land discribed, in the pleadings - whether it would be to the material interest of Parties to sell the same for partition, and what said Land is worth per acre &c;, Begs leaf to report as follows:

That he finds from Deed that LITTLE MEDLIN, seized in fee, of the Lands described, That Petitioners own the same in Comon as his distributees in shares as follows JAMES LITTLE and wife CARLINE one share, FRANK YOUNG, and wife AGNES, one share, CLINT BAILEY and wife EMILY, one share, JAMES BEARD and wife MATILDA, one share, A. J. MEDLIN one share, WILLIAM A., GEORGE D. and ELIZA J. WINN one share.

That said Land can not be partitioned between said parties without material injury to them and that it would be to their material interrest to sell the same for partition and refers to W. A. JOHNSON and WILLIAM M. CRADDOCK depositions on file among the papers in this Court and that the Lands are worth from Fifteen to twenty Dollars per acre, all of which, is respectfully submitted. And it appearing to the Court that said report is unaccepted to, and is in all things Correct that petitioners and defendant are the Heirs of LITTLE MEDLIN Deceased. That they are entitled to shares as stated in said report to Clerk in the following described tract of Land lying in District No. 6 of Crockett County. Bounded as follows on the North by the land of JAMES SMITH, and on the west by the Land of W. A. WEBB, containing by Estimation (54) Fifty Four acres said Land being the tract bought by Deceased MEDLIN, from ALSA REID, Containing by estimation (54) Fifty four acres more or less, and that it would be manifestly to the interest of said Parties that said Lands be sold for partition.

It is therefore ordered and decreed that said Lands be sold by the Clerk of this Court in the Town of Cageville after advertising as the Law directs by printed posters to the highest Bidder for Twenty per Cent Cash balance on a credit of one half payable on the (25) Twenty fifth day of December 1872 the other half on the Twenty fifth day of December 1873. Note and approved security required and a Lein retained on sald Land for Balance of purchase money.

It is further ordered that the Clerk report his action in the premises to the next term of this Court until which time all things else herein are held up.

Monday, July the 1st A.D. 1872

On this Cause upon motion of the Petitioners and it appearing that the Clerk has failed to sell the Lands described in the pleadings for the want of time It is ordered by the Court that he be allowed until the next term of this Court to sell said lands as heretofore directed by interbocuery decree and that he report to the next term of this Court until the Coming in of which report all things else herein are held up.

To the Worshipful County Court of Crockett County

The undersigned Clerk of this Court in persuance to an order of your worshipful Court made at the June term hereof in the above cause after advertising as directed by Law did proceed to sell the tract of Land described in the pleadings at Cageville in Crockett County on the 27 day of July last for 20 per cent cash the balance in Equal sums due by note December 25 1872 and 1873 and W. A. WEBB being the highest bidder the same was knocked off to him at 29 dollars per acre and the said parties has complied with the terms of sale all of which is respectfully submitted.

And it appearing to the Court that said report is in all things correct it is therefore ordered and decreed that the same be in all things Confirmed and that all the right title and interest of JAMES LITTLE and wife BURLINE – FRANK YOUNG and wife AGNES – CLINTON BAILEY and wife EMILY – JAMES BEARD and wife MATILDA, A. J. MEDLIN, WILLIAM H. WINN, GEORGE G. WINN, ELIZA J. WINN, in and to the following described tract of Land, situated in the 6 Civil district of Crockett County, Tenn; on the waters of Cpyress Creek, and formerly lived upon by LIT MEDLIN deceased and Bounded as follows, To wit. On the South by the Lands of ROBERT EMMERSON and ALEX WEBB, on the East by Lands of JAMES FOLLACE, on the North by Lands of JAMES SMITH and JOHN D. EVANS and on the West by the Lands of W. A. WEBB, it’s South west corner being at the field gate of W. A. WEBB on a Willow Oak, the N E Corner on an Elm on ROBERT EMMERSON’S Line, and at his Corner the N Corner on ROBERT EMMERSONS North Line, at the Creek, and the East Corner at the Bridge on the Creek at ROBERT EMMERSONS Corner, & another N. E. Corner at JAMES SMITH Corner, on the old Madison County line, and the N W Corner at a stake, at W. A. WEBB Corner, containing by esstimation 54 acres, bough by LIT MEDLIN of A. REECE, divested out of them and each of them their heirs &c; & vested in W. A. WEBB his heirs, assigns &c; forever subject to a lean for the unpaid purchase Money, It is further ordered that the cost of this proceeding be paid out of the cash proceeds, of said sale including, attorneys fees, and that the Clerk, pay over to the parties, hereto after payment of cost fees &c; as aforesaid, out of the proceeds of said sale as they are entitle to receive the same, and that he pay to the Guardian of EIZA J. WINN, her portion of said fund, upon his executing Bond therefor with good security.
