ZACK M. MIDGETT’S DEATH CERTIFICATE STATES HIS FATHER AS M.B. MIDGETT (BORN IN TN.) AND HIS MOTHER AS ADELINE JOHNSON (BORN IN TN.). HE DIED ON OCTOBER 14, 1918 AT 8:00 P.M. OF BRONCHIAL PNEUMONIA AND SPANISH INFLUENZA. HE WAS BURIED AT THE HOLLYWOOD CEMETERY ON OCTOBER 16, 1918. HIS DEATH CERTIFICATE WAS SIGNED BY HIS WIFE AS BEING TRUE TO THE BEST OF HER KNOWLEDGE.

IT IS THEREFORE ORDERED BY THE COURT THAT IF UPON THE PRODUCTION OF HIS DEED, THIS FACT SHOULD APPEAR, THEN THE SAID WM. R. IT APPEARING TO THE COURT THAT IN APRIL 1864 C.R. JOHNSON DEPARTED THIS LIFE INTESTATE IN SAID COUNTY LEAVING NO WIDOW BUT THE FOLLOWING CHILDREN: WM. R. & C.R. JOHNSON, ANN E. WHO HAS INTERMARRIED WITH L.D. WHITAKER, PEGGY WHO HAS INTERMARRIED WITH JNO. CASTELLOW, SALLIE SANDERS WHOSE HUSBAND IS DEAD, ADELINE WHO HAS INTERMARRIED WITH MILTON MIDYETT, NANCY, ZACK T. G.B.BLACK,judge of the Circuit Court of Crockett County pursuant to the law the undersigned tax collector after advertizing according to law for three consecutive weeks in the Crockett County Sentinal,a newspaper published in the town of Alamo,the County seat of said County,proceeded to sell and did sell at the Court House door in Alamo on the 1st day of September between the hours 10 a.m. and 2 p.m. for the taxes,penalties and costs due thereon for the year 1872–Tp Wit:(page 219) 100 acres of land in Civil District 10–Sold as the property of M.B.MIDGETT for taxes,penalties and cost for the year 1872 amounting to $19.43.

SMITH,tax collector of Crockett County do hereby report the following tracts of land as having been sold for the taxes,penalty and cost for the year of 1873 at the Court House door in the town of Alamo on the first Monday in July 1874 between the hours of 12 & 3 o’clock p.m. (page 327) M.B.MIDYETT: 100 acres of land in the 10th District bought by J.HALL for $18.62.All of which was duly advertized and sold as the law directs for the taxes,penalties and costs for the year 1873. J.B.SMITH ; Tax Collector It is therefore ordered by the courts that all rights,title and interests be divested out of the respective owners of the tract of land or town lots and vested in the respective purchasers thereof.

History Notes for Caroline E. Midyett

Caroline E. Midyett was born March 1827 in Madison County,TN. She married abt. 1851 to David S. MOODY in Haywood Co.TN. When Crockett was formed their farm was in Crockett County. She died between the 1910 & 1920 census of Crockett County, TN. I found no documents to show her death as her property was to go to her daughters at her death, per David’s will.

I GIVE TO MY DAUGHTER ELIZABETH J. LOVING, THE SUM OF ONE THOUSAND DOLLARS AND ONE SORRELL COLT, THREE YEARS OLD, VALUED BY ME AT ONE HUNDRED AND FIFTY DOLLARS, THIS VALUATION SHE ACCEPTED AND RECEIVED INSTEAD OF THE COLT.
I GIVE TO MY DAUGHTER MARTHA J. MOODY ONE MOUSE-COLORED COLT, ONE YEAR OLD TO BE VALUED TO HER WHEN SHE TAKES SAID COLT IN POSSESSION, MARRIES OR BECOMES TWENTY-ONE YEARS OLD.
IT IS MY WILL THAT MY AFORESAID CHILDREN, JAMES S. MOODY, ELIZABETH LOVING AND MARTHA J. MOODY BE CHARGED WITH RESPECTIVE AMOUNTS TO THEM IN THE DIVISION OF MY GENERAL ESTATE.

ITEM 6th: IT IS MY WILL THAT THE REMAINDER OF MY ESTATE CONSISTING OF REAL ESTATE NOTES AND RAILROAD STOCKS TO BE DIVIDED EQUALLY AMONG ALL MY CHILDREN, J.S. MOODY, ELIZABETH J. LOVING, MARTHA J. MOODY, THOMAS E. MOODY, DAVID S. MOODY, WILLIAM S. MOODY, MONROE E. MOODY, HENRY S. MOODY AND JOHN D. MOODY, SHARE & SHARE ALIKE.

ITEM 7th: I HOLD THREE NOTES AGAINST A.J. LOVING, THE PRINCIPLES OF WHICH AMOUNTS TO TWENTY SIX HUNDRED DOLLARS, ALSO ______________________ _______________THESE NOTES AND LOANS I WISH NOT COLLECTED UNTIL THE TWENTY-FIFTH OF DECEMBER 1875, PROVIDED SAID LOVING WILL MAKE PRINCIPLES AND INTEREST SECURE, OTHERWISE THEY MUST BE COLLECTED AS SOON AS PRACTICABLE.

ITEM 8th: IT IS MY WILL THAT AT THE DEATH OF MY WIFE, THE LAND LOANED HER SHALL GO TO MY CHILDREN ABOVE MENTIONED, SHARE & SHARE ALIKE WITH ALL THE PERISHABLE PROPERTY ON THE PLACE SOLD AND PROCEEDS EQUALLY DIVIDED AMONG MY CHILDREN.

ITEM 9th: IT IS MY WILL SHOULD MY WIFE MARRY THAT THE LAND LOANED HER BE EQUALLY DIVIDED AMONG ALL MY CHILDREN AND THE PERISHABLE PROPERTY ON THE FARM OF EVERY DESCRIPTION BE SOLD TO THE HIGHEST BIDDER AND FIVE HUNDRED DOLLARS OF THE PROCEEDS BE GIVEN TO MY WIFE ELIZABETH MOODY AND THE REMAINDER EQUALLY DIVIDED AMONG ALL MY CHILDREN.

ITEM 10: IT IS MY INTENTION THAT MY CHILDREN SHALL INHERIT MY PROPERTY, SHARE & SHARE ALIKE AND NOTHING IN THIS INSTRUMENT MUST BE CONSTRUED DIFFERENTLY.

ITEM 11th: I HAVE ONE-HALF INTEREST IN A HOUSE AND LOT AT BELLS DEPOT DEEDED TO NOEL AND MOODY AND WISH THOMAS E. NOEL TO HAVE THE PRIVILEDGE AND POWER OF SELLING THE SAME WHEN HE THINKS BEST AND TO MAKE A DEED FOR THE SAME, HE PAYING OVER TO MY ESTATE ONE-HALF THE AMOUNT IT SELLS FOR.

ITEM 12th: I DESIRE MY BROTHER DAVID S. MOODY TO ACT AS GUARDIAN FOR MY CHILDREN AND TO HAVE THE POWER TO EMPLOY A TEACHER FOR THEM AT A STATED SALARY IF HE THINKS BEST.

LASTLY, I HEREBY APPOINT THOMAS E. He died before 1869 in Lauderdale County,TN. Martha was born 9 Nov. 1835 in GA and died 13 Jan 1921 in Lauderdale Co. TN. Their children were:

THIS DAY CAME PHILLIP C. McCOWET, CLERK AS AFORESAID, AND MOVED THE COURT FOR JUDGMENT AGAINST THE SAID A.A. MIDYETT AND MILES C. HAYES, AND IT APPEARING TO THE COURT THAT BY ITS DECREE, THOMAS GAMEWELL, THE THEN CLERK, ON THE 27th DAY OF NOVEMBER 1858, SOLD CERTAIN PROPERTY OF ALLEN HILL, DEC’D., FOR THE PURPOSE OF PARTITION AND DISTRIBUTION AMONG HIS DISTRIBUTEES AND THAT OF WHICH PROPERTY A.A. MIDYETT BECAME THE PURCHASER FOR WHICH HE EXECUTED HIS 2 NOTES WITH MILES C. HAYS AS HIS SURETY, EACH FOR $574.75 DUE RESPECTIVELY ON NOV. 27, 1859 & 1860 AND PAYABLE TO THOMAS W. GAMEWELL, CLERK OF COURT, AND HIS SUCCESSORS IN OFFICE. AND IT APPEARING FURTHER THAT EACH OF SAID NOTES ARE NOW DUE AND PAYABLE AND THAT NEITHER A.A. MYDYETT, THE MAKER OF THE NOTE, OR MILES C. HAYS, THE SURETY TO SAID NOTES, HAS PAID THE SAME AND IT ALSO APPEARING THAT ON JAN. 26, 1861, THE CLERK ISSUED NOTICE TO MYDYETT AND HAYS OF THIS MOTION AND THE NOTICE CAME TO THE HANDS OF G.B. WRAY, DEPUTY SHERIFF OF MADISON COUNTY, ON THE SAME DAY IT WAS ISSUED AND WAS EXECUTED UPON MILES C. HAYS, THE SURETY ONLY. ON JAN. 30, 1861 IT WAS RETURNED ENDORSED AS TO MYDYETT “NOT FOUND”. THEREFORE IT IS CONSIDERED BY THE COURT THAT PHILLIP C. McCOWET, CLERK, RECOVER OF A.A. MIDYETT AND OF MILES C. AND IT APPEARING TO THE COURT THAT JOHN BEATY, LATE OF THE COUNTY OF MADISON, HAS DEPARTED THIS LIFE INTESTATE LEAVING AN ESTATE OF ABOUT $175.00 IN VALUE, UPON WHICH THERE SHOULD BE ADMINISTRATION. AND IT APPEARING TO THE COURT THAT ASHLEY A. BEATY, LATE OF THE COUNTY OF MADISON, HAS DEPARTED THIS LIFE INTESTATE LEAVING AN ESTATE, REAL AND PERSONAL, OF ABOUT THE VALUE OF $1200.00, THE PERSONAL SUPPOSED TO BE WORTH $200.00, UPON WHICH IT IS NECESSARY THERE SHOULD BE ADMINISTRATION. AND IT APPEARING FROM THE PETITION THAT THE PARTIES INTERESTED DESIRE THAT SUCH ADMINISTRATION SHOULD BE GRANTED TO THE PETITIONER, ERASMUS R. FRANCIS A. BEATY MAKES PETITION TO BECOME ADMINISTRATOR OF THE ESTATE OF ALBERT G. BEATY, DEC’D. BE IT REMEMBERED THAT ON THIS DAY CAME ON THIS CAUSE TO BE HEARD UPON PETITION AND IT APPEARING THAT ALBERT G. BEATY, LATE OF SAID COUNTY, HAS DEPARTED THIS LIFE INTESTATE LEAVING A VALUABLE ESTATE UPON WHICH THERE SHOULD BE ADMINISTRATION. AND IT APPEARING TO THE COURT THAT IT IS THE DESIRE OF THE PARTIES INTERESTED, THAT SUCH ADMINISTRATION SHOULD BE GRANTED THE PETITIONER, FRANCIS A. BE IT REMEMBERED THAT ON THIS DAY CAME ON THIS CAUSE TO BE HEARD AND IT APPEARING THAT THE SAID ALBERT G. BEATY, AT THE TIME OF HIS DEATH, LEFT 5 CHILDREN UNDER THE AGE OF 15 YEARS AND THAT IT IS NECESSARY THAT SAID CHILDREN SHOULD HAVE A YEARS SUPPORT OUT OF THE ESTATE. THEREFORE IT IS CONSIDERED BY THE COURT THAT EATON BOND, TURNER BRYAN, GEORGE HARSTON, ASHLEY A. MIDYETT AND JOHN T. CORNER OF A TRACT SOLD BY THE HEIRS OF ALLEN HILL TO JOHN BATCHELOR AND RUNS TO A TRACT SOLD BY T.H. NEWBERN TO SMITH. THIS LAND WAS TITLED TO JACKSON SANDERLIN AND THE PROCEEDS AFTER COSTS TO GO TO THE HEIRS OF ALLEN HILL.

  2. Ewell McKager “Will” Midyett born 12 Apr.1853 in Haywood Co.TN died 3 Oct 1925 in Tipton Co.TN. He married Willie Coleman BELL on 8th Sept.1875 in Crockett Co.TN.
    Their children were: (a) Mary Maria MIDYETT
    (b) Mamie MIDYETT born 22 June 1876 married John WILLIAMS in Haywood Co.TN
    (c) James Collier MIDYETT born May 1884 in Crockett Co.TN

In this case it appearing to the Court that an execution was issued for a balance due to the Plaintiff after condemnation and sale of land, sold in this Court, under order of condemnation–the said execution for such balance issuing from this Court, and it appearing that said execution came into the hands of R.H.HARRIS, Sheriff, and was by him levied on the following land and as property of W.H. GUTHRIE, namely situated in State of Tennessee District 5—and it also appearing that said execution was levied on the following tract of land, as the land of L.M.JELKS namely situated in the State of Tennessee County of Crockett, Bells Depot; bounded on the East by J.N.CAMERON, West by T.E.NOEL, South by F.B.WOODWARD, and North by E.M. MIDYETT.

VOSS’ 14th REGIMENT OF CAVALRY, COMPANY “C” OF HAYWOOD CO., TENNESSEE AND THAT HE WAS DISCHARGED APRIL 1865. SHE STATES HER HUSBAND DIED MARCH 11, 1913.
