Margaret Boyd        April in the year of Our Lord 1838–
Between Henry A. Rutledge of Taladega County and State of
Alibama of the one part and Margaret Boyd of Gibson County
and State of Tennessee of the Other part Witnesseth that for and
in consideration of the sum of one hundred and eigte Dollars
to him in hand paid by the said Margaret Boyd the receipt
whereof is hereby acknowledged hath given granted bargained
sold aliened conveyed and confirmed unto the said Margaret
Boyd his heirs and assigns forever a certain tract or parcel of
Land Situate lying and being in the County of Gibson on
the XXXXX South side of the middle fork of forked Deer river
being part of a 5000 acre entry in the name of Thomas
Travis and bounded as follows (to wit) Beginning at a
walnut the south west corner of a tract of 100 acres sold
by said Rutledge to John Price running thence south
with the east boundary line of a 1000 acre entry in the

name of Wm L Browne Seventy four poles to a Beech thence
East one hundred and twenty four poles to a small Hickory
thence North Seventy four poles to a Black Oak thence West One
hundred and twenty four poles to the beginning containing Fity

the right profits emoluments hereditaments and appurtenances

Background:
This land grant was awarded to William Boals, brother of James Boals and Susana Boals Cozart among others. Both James and Susana lived in parts of Madison County that became Crockett County. It is not known for sure where this parcel was located. William died in Haywood County.

        The land in this grant was measured in poles and acres:
        1 pole = 16 1/2 feet
        1 mile = 320 poles = 5,280 feet
        1 acre = 160 square poles = 43,560 square feet

Know ye, That for and in consideration of the sum of 12 1/2 cents per acre, paid into the Office of the Entry Taker of Madison County, and entered on the 22nd day of June 1847 pursuant to the provisions of an Act of the General Assembly of said State, passed 11th day of June 1842, by No. 348, THERE IS GRANTED by the said State of Tennessee, unto William Boals a certain tract or parcel of Land, containing 15 Acres by survey, bearing date the 22nd day of June 1847 lying in said County.

In Range 3 & 4, Section 11

Beginning at the S.W. corner of Range [blank] & Section 11 Thence West 100 poles to a White Oak Thence North 160 poles to a Willow-Oak & Elm; thence East 130 poles to a Black Oak & Maple. Thence South 160 poles to 3 Black Oaks on the Section line; Thence West 50 poles to the Beginning.

With the hereditaments and appurtenances. To have and to hold the said tract or parcel of land, with its appurtenances, is the said William Boals and his heirs forever.

Background:
The seller of this tract, James Boals, was the brother of Susana Boals Cozart Hathaway, widow of William Davis Cozart and wife of Kinchen Hathaway.

The same day James Boals purchased a 200-acre tract in 1838, William Davis Cozart and George Allen bought adjoining lands. All were brothers-in-law. George Allen sold his property to another brother-in-law, Madison Cozart — 50 acres in 1838 (registered December 28, 1838, in Deed Book 6, pages 277-278) and 50 in 1842 (April 12, 1842; registered April 16, 1842, in Deed Book 8, page 222).

Now in August 1849 James Boals was selling 140 of the 200 acres. He would be 48 on September 13, 1849. Peyton Marlow was about 62. His daughter Emily already had married Madison Cozart in 1847. This tract adjoined Madison’s.

William H. Marlow would marry Mahulda Cozart in 1852; Julia Marlow would marry Joshua M. Cozart in 1858.

One of the witnesses was James Emison [also spelled “Emmerson,” “Emmison,” etc.] He was born 1821, the son of Margaret “Peggy” Boals, the sister of James Boals; thus his nephew.

This property was in Madison County, 10th Surveyor’s District, 18th Civil District, near the waters of Cypress Creek. In 1871 this area became Crockett County, Civil District 3. Gadsden was the big town of the district. We know the civil district, because it was stated on the 1865 deed of Cozart to Spraggins for adjoining tract William Davis Cozart bought in 1838.

        The land in this deed was measured in poles and acres:
        1 pole = 16 1/2 feet
        1 link = 7.92 inches
        1 mile = 320 poles = 5,280 feet
        1 acre = 160 square poles = 43,560 square feet
        1 square pole = 272 1/4 feet
        640 acres = 1 square mile

This Indenture made and entered into this 10th day of August in the year of our Lord, one thousand, eight hundred and forty-nine, between Jas Boals of the County of Madison and the State of Tennessee, on the one part, and Peyton Marlow of the said County of Madison and State of Tennessee of the other part: Witnesseth that the said James Boals, for and in consideration of the sum of four hundred and twenty dollars [Boals paid $300 for 200 acres in 1838] to him in hand paid by the said Peyton Marlow, the receipt whereof is hereby acknowledged, hat granted, bargained, sold, aliened, conveyed and confirmed, and do by these presents grant, bargain, sell, alien, convey and confirm unto the said Peyton Marlow and his heirs and assigns forever, a certain tract or parcel of land situated, lying and being in the said County and State aforesaid, being a part of a 200 acre tract, purchased by said Boals from F. W. Huling, and bounded as follows, to wit: Beginning at South East corner of George Allen’s 100 acre tract [by this time George Allen had sold tract to Madison Cozart], at a stake, thence North 156 1/2 poles to a stake [223 1/2 poles in 1838] with hickory, black oak and black gum pointers, in G. Cozart’s line [Gilbert owned Wm. Davis Cozart’s plot for a while], thence East 143 1/2 poles to a stake, two black and one white oak pointers, thence South 156 1/2 poles to the South East corner of the original 640 acre tract, entered in the name of said Huling, thence West 143 poles to the beginning [1838 deed had South 223 1/2 poles to SE corner then west with the line to beginning], containing 140 acres, same more or less, with all and singular the hereditaments and appurtenances there unto belonging, or in any wise appertaining to the only proper use, benefit and behoof of him the said Peyton Marlow and his heirs and assigns forever. And the said James Boals doth further agree and bind himself, his heirs &c.; [etc.] to warrant and will forever defend the title of said Land to said Marlow, his heirs &c.; [etc.] against the claim or claims of all and any person whatsoever.

     This indenture made the 13th day of November 1878, one thousand eight hundred and seventy eight, between Y. H. Berry of the one part, and M. L. Allen of the other part, both of the county of Crockett and state of Tennessee Witnesseth, that the said Y. H. Berry, in consideration of the sum of ($360.00) three hundred and sixty dollars to wit: one hundred and twenty dollars, cash, the receipt whereof, is hereby acknowledged; the remainder in two promissory notes, to wit, the first calling for the sum of one hundred and twenty dollars, due the 15th day of November 1879, the second to wit, one promissory note calling for one hundred and twenty dollars due the 15th day of November 1880, the said Y. H. Berry hath bargained, and sold, and by these presents, doth transfer and convey unto the said M. L. Allen, his heirs and assigns, a certain tract or parcel of land, containing sixty acres, more or less, situated and lying in the county of Crockett, and state of Tennessee and in the fourth civil District of said county butted and bounded as follows to wit, Beginning at a stake on the north east corner and runs west one hundred and fourteen and two sevenths poles to a stake, thence south eighty four poles to a stake, thence east one hundred and fourteen and two sevenths poles to a stake, thence to the beginning eighty four poles containing by estimation sixty acres, more or less, to have and hold said tract or parcel of land, with its appurtenances, estate title and interest thereunto belonging to him, the said M. L. Allen, his heirs and assigns forever, and the said Y. H. Berry doth hereby covenant with the said M. L.      Know all men by these presents that for the love and affection we Reddick Berry and wife Catherine A. Berry entertain for Young H. Berry we do hereby give transfer and convey to him his heirs and assigns forever a certain piece or parcel of land containing 92 1/2 acres lying being and situated in the county of Crockett and state of Tenn. in civil District No. 4, known and described as follows, Beginning at a Black oak the S.W. corner of Robt. McLeary’s 200 acre entry, runs South 84 poles to a stake with 4 blk oak pointers thence East 144 poles, to a stake and white oak black oak and hickory pointers thence North 84 poles to a stake and post oak pointer, thence West 144 poles to the beginning, and the part bought of J. Cassels contains 20 acres more or less bounded as follows, Beginning at a stake 37 2/10 poles east of the N.W. corner of a 150 acre tract deeded to Jesse Cassels by J. Goff runs thence south 35 1/2 poles to a stake thence east, 89 8/10 poles to a stake thence North 35 1/2 poles to a stake the S.E. corner of a 30 acre acre tract sold to P.P. Baker by said J. DEED – REDDICK H. BERRY TO JOHN L. BERRY
State of Tennessee, Crockett County –

Know all men by these presents that we Redick H. Berry and wife Catharine A. Berry for the love and affection we entertain for our son John Lewis Berry aged about 13 years do by these presents give transfer and convey unto the said John L. Berry all of our right title and interest in and to the following described tract or parcel of land, Bounded as follows Beginning at 2 post oaks the south east corner of a 200 acre tract granted to the heirs of Robert McLeary runs south 160 poles to a stake in a field, thence west 85 poles to a stake, thence north 76 poles to a stake thence west 19 1/3 poles to a stake and hickory white oak and black oak pointers thence north 84 poles to a stake, black oak pointer thence east 104 and 1/3 poles to the beginning containing by estimation 95 acres more or less. To have and to hold the same unto the said John L. Berry his heirs and assigns forever, We further covenant and agree to and with the said John Lewis Berry, that we are lawfully seized and possessed of said land and have a good right to sell and convey the same. We bind ourselves our heirs and legal representatives to warrant and defend the title to said land with all the appurtenances thereunto belonging. But this conveyance is made upon the following conditions, to wit; We Reddick H. Berry and Catharine A. Berry reserve the right to live on said land and control all of it, the whole term of our natural life and have all the benefits of all profits in the way of tillage rents and c. But at the death of both of us, then the foregoing conveyance shall take effect and remain in full force forever. In testimony whereof we hereunto subscribe our names on this 19th day of Feby 1874.

Berry the bargainer to the attached Deed, with whom I am personally acquainted, and acknowledged that he executed the same for the purposes therein contained, And Catharine A. Berry wife of said Reddick H. Berry having appeared before me privately and apart from her husband, acknowledged the execution of the said Deed to have been made by her, freely, voluntarily, and understandingly, without compulsion or constraints from her husband, and for the purposes therein expressed. Background
George Allen, husband of Malinda Cozart, bought 100 acres of a 640-acre tract near Cypress Creek. The original grant was to Frederick W. Huling of Mississippi. In December 1838 George sold 50 acres to his brother-in-law, Madison Cozart. Then on April 12, 1842, he sold the other 50 acres to Madison. The deed was registered in Madison County on April 16, 1842. Neighboring tracts were owned by William Davis Cozart, James Boals, and Kinchen Hathaway — all relatives.

This property was in Madison County, 18th Civil District, near the waters of Cypress Creek. We know the civil district from the 1865 deed, Cozart to Spraggins, when William Davis Cozart’s sons sold their tract. In 1871 this area became Crockett County, Civil District 3. Gadsden was the big town of the district.

A copy of the 1842 Allen to Cozart deed has been misplaced, was not available to Denise Cozart to be transcribed.

Background
In March 1838 James Boals (the brother-in-law of William Davis Cozart) bought 200 acres of a 640-acre tract of land near Cypress Creek in Madison County. William Davis Cozart bought 100-150 acres; George Allen, husband of Malinda Cozart, 100 acres; and Kinchen Hathaway, husband of Jane Cozart, 154 acres.

Originally the 640-acre tract was granted to Frederick W. Huling of Mississippi. In December 1838 Madison Cozart bought 50 acres from brother-in-law George Allen. Later on April 12, 1842, Madison bought the other 50 acres from George Allen. That sale was registered April 16, 1842, in Deed Book 8, page 222.

This property was in Madison County, 10th Surveyor’s District, 18th Civil District, near the waters of Cypress Creek. In 1871 this area became Crockett County, Civil District 3. Gadsden was the big town of the district.

        The land in this deed was measured in poles and acres:
        1 pole = 16 1/2 feet
        1 mile = 320 poles = 5,280 feet
        1 acre = 160 square poles = 43,560 square feet
        1 square pole = 272 1/4 feet
        640 acres = 1 square mile

I George Allen of the county of Madison and State of Tennessee have this day bargained and sold and do hereby transfer and convey to Madison Cozart of the county of Madison and State of Tennessee and his heirs forever for the consideration of three hundred dollars to me paid a certain tract of Land situated lying and being in the county of Madison and State of Tennessee one half of the following described tract of Land off of the East End. Beginning at the South west corner of a 640 acre tract Entered in the name of F W Huling on a black gum running thence East 178 8/10 poles to a Stake two white oak and dogwood pointers, thence north 89 & 1/2 poles to a Stake post oak and black gum pointers, thence west 178 & 8/10 poles to a black walnut and three white oak pointers, thence South to the Beginning containing one hundred acres To have and to hold the Same to the Said Cozart his heirs and assigns forever. I do covenant with the Said Cozart that I am lawfully seized of Said Land have a good right to convey it and that the Same is unencumbered I do further covenant and bind myself my heirs and representatives to warrant and forever defend the title to the Same Land and every part thereof to the Said Cozart his heirs and assigns forever against the lawful claims of all persons whatsoever this 28th day of December 1838
