Background:
Joshua Cozart added to his land a tract that adjoined that of his son Gilbert. A month later, December 20, Joshua sold the tract to Gilbert. See deed registered January 1845. There were changes in citing owners of adjoining lands. The January 1845 registration may have corrected mistakes made in November 1844.

Joshua was about 68 years old in November 1844.

This land was in Madison County, 10th Surveyor’s District, 9th Civil District. In 1871 this area became Crockett County, Civil District 1.

        The land in this deed was measured in poles and acres:
        1 pole = 16 1/2 feet
        1 mile = 320 poles = 5,280 feet
        1 acre = 160 square poles = 43,560 square feet
        1 square pole = 272 1/4 feet
        640 acres = 1 square mile

Indenture made this the 18th day of November 1844 between Saml Lancaster of the County of Madison of the State of Tennessee of the one part and Joshua Cazort of the County and State aforesaid of the other part. witnesseth that Samuel Lancaster for and in consideration of the Sum of three hundred and Eighty Six Dollars to him in hand paid by the Said Joshua Cazort the Receipt whereof is hereby acknowledged, hath Given Granted bargained sold aliened conveyed and confirmed unto the Said Joshua Cazort his heirs and assigns forever, a certain Tract or parcel of Land Situated lying and being in the aforesaid County and State Containing four hundred and twenty nine acres to be the Same More or less which will more fully appear by reference to grant No 393 to Said Lancaster bearing date the 13th October 1843, in range 2 & 3 and Section Nine. Beginning at a beach the South east Corner of entry No 78 in the name of James Lodlow [on Jan. 1845 deed the name was “James Scal…”] for 50 acres. Runs West 81 poles to a red oak stump a conditional Corner with Hugh Bauer [Jan. 1845 “Hue Davis”] Thence South 6 decrees east 125 poles to a Stake Thence west 114 poles to a scaly bark Hickory white oak and hickory pointers Thence South 240 poles to 3 Iron wood and ash pointers. Thence east 128 poles to a hickory. Thence North 29 poles to a stake the original S.W. Corner of Entry No. 115. Thence east 125 poles to 4 holleys [sic.] in S.E. Corner. Thence North 140 poles to a stake, cypress Gum and elm pointers on the South boundary line of entry No. 112 for 150 acres in the name of Gilbert Cazort [Cozart]. Thence west 27 poles to its south west Corner. Thence North with its line and the line of Entry No. 2490 in all north 166 poles to an oak [Jan. 1845 “ash”] and dogwood. Thence west 46 poles to an elm the South west corner of Entry No 79 for 48 acres in the name of Jno McIver [Jan. 1845 “Jno McJon”]. Thence North 30 poles to the beginning to have and to hold the aforesaid land with all and Singular the rights profits emaluments [emoluments] hereditaments and appurtenances of in and to the Same belonging or in any wise appertaining to the only proper use once behoof of him the said Joshua Cazort his heirs and assigns forever and the said Samuel Lancaster doth covenant and agree with the said Joshua Cazort his heirs and assigns that the before received land and bargained premises he will warrant and forever defend against the rights title interest or claim of all and every person whatsoever. Background:
The father of Anthony Haywood Cozart, Joshua, bought land from Samuel Lancaster in November 1844. A month later Joshua sold the tract to his son Gilbert, who owned adjoining land. Was the land in the following deed part of the same Lancaster tract?

A reference point was “Nicholas Long.” His land was the starting point or boundary of these deeds: Samuel Lancaster to A. H. & F. L. Cozart, 1847-48; William Pillow to Joshua Cozart, 1850; T. E. Cozart to A. H. Cozart, 1852; Elizabeth Cozart to Joshua M. Cozart, etc., 1854.

If this tract was near Gilbert Cozart, it was in the 10th Surveyor’s District, 9th Civil District. In 1871 this area became Crockett County, Civil District 1.

At this time I do not know who F. L. Cozart was and how he may have been related to Anthony Haywood Cozart.

        The land in this deed was measured in links, poles, and acres:

  1. Indenture made this 17th day of April 1848, between Samuel Lancaster of the County of Madison, State of Tennessee, of the one part and Anthony H. and F. L. Cozart of the County and State aforesaid of the other part. Witnesseth that the said Samuel Lancaster for and in consideration of the sum of three hundred and fifty dollars to him in hand paid by the said A. H. and F. L. Cozart, the receipt whereof is hereby acknowledged, hath given, granted, bargained, sold, aliened, conveyed and confirmed unto the said A. H. & F. L. Cozart, their heirs and assigns forever, a certain tract or parcel of Land, situate, lying and being in the County and State aforesaid, being part of a tract in the name of Nicholas Long for 923 acres, and bounded as follows:

Beginning on a dogwood, the North West corner of Lot No. 1; thence West 112 1/2 poles to a stake, a dogwood and two back oak pointers, the North East corner of Lot No. 3; thence South 177 poles 14 links to a stake and two hickory pointers on the South boundary of the original tract; thence East 112 1/2 poles to a ash, hickory and red oak pointers, the North corner of Lot No. 1; thence North to the beginning, containing one hundred and twenty four and 3/4 acres. To have and to hold the aforesaid Land, with all and singular the rights, profits, emoluments, hereditaments and appurtenances of, in and to the same belonging or in any wise appertaining, to the only proper use and behoof of the said Anthony H. and Fountain [?] L. Cozart, their heirs and assigns forever. And the said Samuel Lancaster, for himself, his heirs, executors and administrators, doth covenant and agree with the said A. H. and F. L. Cozart, their heirs or assigns, that the before received land and bargained premises he will warrant and forever defend, against the right, title, interest or claim of all and every person whomever. And the said Samuel Lancaster doth hereby convey to the said A. H. & F. L. Cozart all the right, title, interest, he has in and to the following tract of Land, being a part of said tract of 923 acres, and known in the division of said tract by Lot No. 8, and bounded as follows:

Beginning at a stake, two maples, black oak and dogwood pointers; thence West 38 1/3 poles to a red oak, the North East corner of Lot No. ___ [just a line; no number]; thence East 38 1/3 poles to a stake in the West boundary of the Location [?] tract; thence North with the same to the beginning.

Kilzer and wife Mary Kilzer have bargained & sold & do hereby convey unto C. C. West all of our undivided interest 111/4 acres of land in Madison County 16 Dist and our interest is same is a 1/3 interest in the 111/4 acres bounded and described as follows to wit: bounded on north J. T. Walker & Mrs. Bell, east by J. J. Davison, south by M. D. Fly, west by C. C. West and contains 111/4 acres more or less and known as E. R. West place and we sell only our one third undivided interest inherited by my wife Mary Kilzer from her sister Donie West deed.

To have and to hold the same to him the said C. C. West his heirs and assigns against all persons whomsoever. We covenant with C. C. West that we are lawfully seized & possessed of a one third undivided interest in the above described tract of land and have a good right to sell the same & we will warrant & forever defend the title to said interest that was inherited from Donie West and we have good right to make this deed & we bind ourselves our heirs to forever warrant & defend the title to same to him the said C. C. West against all persons claiming through or under us this Nov. 11,1908.

Mary Kilzer’s maiden name was West. She had inherited the property actually located in Madison County, but decided to sell it to one of her father’s brothers. The Kilzers moved to Crockett County from Madison County and lived there until her death in the 1930s.

Know all men by these presents, that for the consideration here in after named, we, D.P. Jaynes have this day bargained, sold, aliened, and conveyed unto Joseph Wright and do by these presents hereby sell, transfer and convey unto the said H.J. Wright, his heirs and assigns forever, the following described tracts or parcels of land situated, lying and being in the first civil district of Crockett County, Tenn., and the first of the said tracts is butted and bounded as follows, to wit: Beginning at a red oak, Joshua Casey’s S.E. corner, runs South 86 poles to a red oak with frost oak and red oak pointers; Thence West 81 poles to a stake with two small red oak and frost oak pointers; Thence North 86 poles to a stake with white oak pointers; Thence East 81 poles to the beginning, containing by estimation 47 acres more or less.

Tract No. 2. in the same civil district and adjoining the land above described on the West and is bounded on the North by J.E. Casey; on the East the above described land; on the South by the Richards heirs; on the West by J.E. Casey; and contains by estimation 20 acres. The same 20 acres of land that I purchased from J.W. Emison. And the first named tract is the one upon which we now live and was purchased from Thos W. Kennen. I further covenant and agree with the said H.J. Wright that I am lawfully seized of the said land and have a right to convey the same. The same being unincumbered (sic) except the first tract herein named is incumbered (sic) with a mortgage of $200.00 executed to the Bank of Crockett or its cashier, which the said H.J. Wright assumes to pay as a part of the consideration herein after named. I further agree that I will warrant and forever defend the title to the said two tracts of land against the lawful claims of any and all persons whomsoever. The consideration for the said two tracts of land is nine hundred dollars ($900.00) which is paid or assumed to be paid in the following manner, that is to say: the said H.J. Wright is to pay the two hundred dollars aforesaid to the Bank of Crockett, and two notes for three hundred and fifty dollars each bearing even date herewith. The one due and payable on or before the first of November, 1897, and the other due and payable on the 1st of November, 1898. The usual lien retained herein to secure the payment of said notes. In testimony whereof I have hereunto affixed my signature, this December, 19th, 1896.

Background:
This was marked “deed,” but it does not seem that land was involved, perhaps money and effects. The deed referred to Jane Cozart Hathaway and her husband as “legatees” of her father Joshua’s last will and testament of 1851. Jane was about 41 in 1851. Jane died before December 1859 when her husband remarried.

The difference in dates was striking. The initial deed was signed and sealed on 2nd August 1853. On 6th March 1854, the clerk, Thomas W. Gamewell, authorized R.W. Sims, Esquire, to interview Jane apart from her husband to verify her intent. R.W. Sims examines her 8th December 1854. The registration did not take place until 5th September 1856, three years from the beginning of the process.

William H. Marlow and his wife Mahulda Cozart Marlow also “bought out” another “legatee,” Thornton Ellsworth Cozart. See deed of 1858.

Background:
Joshua M. Cozart was the youngest of Joshua and Elizabeth Marsh Cozart’s ten children. In March 1854 his mother deeded him, his sister Mahulda and her husband William H. Marlow property that was to be divided between the two families. It is not known for sure where in Madison County this property was, but it may have been close to the land Joshua brought from Alexander Greer in 1853.

On February 17, 1858, Joshua M. married Julia Frances Marlow, thought to be a sister of William H. Marlow. Joshua M.’s premature death came just three years later, January 12, 1861.

At the time of this 1853 deed he was about 24; at death about 32.

A reference was made in the deed to “Brants corner.” Two other deeds carried such reference: the March 1838 deeds from F. W. Huling to William Davis Cozart and to James Boals. In the James Boals deed it stated that George Allen’s 100-acre tract was “formerly Brands.” George was the third person that day in March 1838 who bought land from F. W. Huling. George Allen was married to Malinda Cozart and was a brother-in-law to William Davis Cozart and Joshua M.

If the tract Joshua M. bought from Alexander Greer was in the same area as that of William Davis Cozart and James Boals, it was near Cypress Creek in Madison County civil district 18. In 1871 this area became Crockett County, civil district 3. Gadsden was the big town of the district.

Joshua M. paid Alexander Greer $135 for this tract; in December 1853 he sold it to his sister and brother-in-law, Mahulda and William H. Marlow for just $125.

Cozart of the county and state aforesaid of the second part. Witness that the said Alexander Greer for and in consideration of the sum of one hundred and thirty five dollars to him in hand paid by the said Joshua M. Cozart the receipt whereof is hereby acknowledged hath given granted bargained sold conveyed & confirmed unto the said Joshua M. Cozart his heirs and assigns forever a certain tract of land and being in the county of Madison and State of Tennessee In Range [blank space follows] and bounded as follows.

Beginning at the south West corner of John Woodell sixty sixty [sixty-six] acre tract thence N. 110 poles to the original line of which this is a part, thence West 65 poles to the corner of original tract thence South 110 poles to a Stake Brants corner, thence East 65 poles to the Beginning containing forty-five acres more or less to have and to hold the same to the said Joshua M. Cozart his heirs and assigns forever and the said Alexander Greer for himself his heirs Executors or administrators doth covenant & agree with the said Joshua M. Goodloe, Back Tax Attorney in and for the said county and state, exposed for sale a certain tract or parcel of land in Civil District No.1 in said county and bounded as follows, to wit: on the north by the lands of Ellington; on the south by the lands of Bickerstaff; on the east by the lands of Turner; and on the west by the lands of Richards; containing 30 acres: the same was assessed to Mrs. Nancy Wright for state and county taxes for the years 1893 and 1894; And whereas at said sale Y.A. Davis became the purchaser at and for the sum of seventeen and 41/100 Dollars, that being the amount of taxes, including interest, costs and damages up to that date for said years; and the said was paid in cash by said Y.A. Davis; said proceedings were had under and by virtue of the delinquent tax law for Tennessee existing at that time- See chapter 120, Acts, 1895—same was passed May 13, 1895 and approved May 14th, 1895: And whereas is appears that H.J. Wright is one of the owners and heir to said land and has a right under said law to redeem the same by complying with said law in such cases made and provided by said Act. Of 1895; And whereas it appears that he has paid the said Y.A. Davis in full the amount paid by said Davis, together with the interest, damages, penalty and cost, as provided for in section 39 of said chapter 120 of the Acts of 1895;And whereas on the 4th day of November 1895, I, as Back Tax Attorney, executed to the said Y. A. Davis, a certificate among other things it is recited that unless said land shall be redeemed within the time required by law a deed will be executed to the purchaser: And whereas it appears that as one of the heirs to said estate, H. J. Wright, has paid in full as aforesaid; Now therefore, in consideration of the premises, I, C.A. Goodloe, as Back Tax Attorney, acting under and by virtue of authority vested in me by said act of 1895, and by further authority conferred by act of 1897, authorizing Back Tax Attorneys to perfect and complete sales of land already made under formed acts, do hereby transfer and convey unto the said H. J. Wright the land herein before described and I do so in as full and ample a maneuver as I should or ought to do as Back Tax Attorney as aforesaid and not otherwise.Given under my hand,

Town lot for B. J. Lea have this day
In Alamo. bargained and Sold and do
$480. hereby transfer and convey to
T. H. Durham and J. M. Klyce a
certain house and lot in Alamo Crockett, Co, Tennessee,
known as lot No 3 of Said town bounded as follows
Commencing at the North East corner of lot No 2 of
Said town. runs East 24 feet thense South Eighty five
feet thense west 24 feet thense North 85 feet to the
beginning To have and to hold to the Said T. H. Durham
& J. M. Klyce forever we do hereby covenant that we are
lawfuly possessed of Said property and have a perfect
right to convey the Same give that it is unincumbered.
The Said Durham and Klyce to hold Said property
as follows to wit the lot to go to them in equil parts
forever but the use of the upper story of the building to
be for the Sole benefit of Said Klyce and of the lower
Story for the benefit of Said Durham while Said build=
ing Stands on Said lot In consideration of which Said
Durham & Klyce have paid us One hundred Dollars cash
in hands and have Executed their notes for one hundred Dollars
due the 15th day of Nov, 1878 one note for two hundred
Dollars due the 1st day of February 1879 and have also
deeded to J. P. Burns one lot in the town of Alamo

is subject to this further restriction, that it is re-

I do hereby covenant with the said A.A.Austin that I am lawfully seized and possessed of
said house and lot of land and the same is unincumbered and I will forever warrant and
defend the title of the same to the said A.A.Austin his heirs and assigns, against the
lawful claims of all persons whomsoever. A special lien is retained of said land to
secure the notes above named until all of them are paid in full.

Alamo , butted and bounded as follows to-wit; Beginning at a stake south margin of
West Main Street, on hundred feet west of the north-east corner of the building of the
Bank of Alamo, and at the west margin of Alley, back of the Bank of Alamo building,
runs thence west Fifty Eight (58) feet to a stake in D.W.Cate’s north east corner
thence south with the said D.W.Cate’s east bounder line Eighty Seven (87)feet to a
stake in north margin of a thirty foot Alley, thence east Fifty Eight (58) feet to
west margin of Alley, thence north Eighty Seven (87) feet with said Alley to the
beginning . To have and to hold said lot or parcel of land unto him the said J.T.Jen-
nings his heirs and assigns forever I covenant with the said J.T.Jennings his heirs
and assigns that I am lawfully seized and possessed of said lot or parcel of land and
same being unincumbered I therefore have a good right to convey the same , and I fur-
ther covenant and bind myself my heirs and assigns to forever warran ad defend the
title thereto to the said J.T.Jennings his heirs and assigns against the lawful claims
claims of all persons whomsoever. And part of the consideration of the conveyance is
that I there is never to be erecten on this lot any kind building except a brick or
concrete building closer than Fifty Six (56) feet to the building of the Bank of Alamo
or the other buildings now on said row with the Bank building, and this clause in this
conveyance is to be perpetuate, and in any conveyance that may be made of this property
by the said J.T.Jennnings will be subject to this restricting clause.And the said J.T.
Jennings is also to keep the buildings on this lot or parcel of land insured for the
benefit of the holder of the unpaid purchase money notes.And to secure and make sure
the payment of the defered payments or unpaid purchase money notes herein above descr
ibed, a special lien is hereby expressly reserved and retained on the lot or parcel
of land herein conveyed untill said two unpaid.purchased money notes or defered payment
are paid in full.In testimony whereof I have hereunto set my hand this 5th day of June

the land and an acceptance of the within conveyace by the grantee is an acceptance of the fo
regoing covenant and by which he bins himself his heirs and assigns to refrain from erecti
ng any buildingor structure of any description on said lot or parcel of land unless same be
constructed of brick, stone or concrete.

W.N. NOLEN ET ALS months from this date ; signed by W.N. Nolen ; J.P. Nolen and L.N. Nolen
The said note of $175.00 is to bear interest from date ..
I T. H. Durham have bargained and sold , and by these presents do transfer and convey unto
the said W.N. Nolen , J.P. Nolen , and L.N. Nolen their heirs and assigns , a certain tract
or parcial of land in Crockett county ,State of Tennessee , as follows :
In the town of Alamo lying and being on the East side of the hard surface road; south of the
public of the public square begining at the south west corner of said lot on the said hard
surface road ; and running east 116 feet to Emerson West boundary line ; thence North 169
feet to Nolen’s lot ; thence west 116 feet to said Bells St . on hand surface road ; thence
South 116 feet to the beginning .
A special lien is retained on said lot by said T.H. Durham to secure and make certain the
payment of same .
To have and to hold the said tract or parcial of land , with the appurtenances ,estate , title ,
and interest thereto belonging ,to the said W.N. Nolen , J.P. Nolen , and L.N. Nolen their
heirs and assigns , forever . And I do covenant with th e said J.P. Nolen , W.N. Nolen and
L.N. Nolen that I am lawfully seized and possessed of said land in fee simple ; have a good right

And I do futher covenant and bind myself and my heirs and representatives , to warrant and
