This cause came on to be heard, witnesses on the part of the State being absent on motion and by Consent of defendant, the same was continued until the 2nd day of the next term of this Court. And it was further ordered that Notice issue to AMY SCALES Witness on behalf of the State to make her personal appearance at the Court House in the Town of Alamo, on the first Tuesday after the first Monday in October next to give evidence in behalf of the State, This she shall in no wise? omit under the penalty prescribed by Law.

This Case Came on for hearing and the prosecutor in behalf of the state failing to appear after being duly subpoenaed as required by Law It is therefore ordered by the Court that this Case be dismissed and stricken from the docket and that Judgement against prosecutor for the Cost Execution May Issue.
