Candis A. PERMENTER vs W. B. PERMENTER et al

On motion of the Plaintiff, it appearing that L.H.PERMENTER died on the 12th day of February 1874, seized in fee of a tract of land, seventy-five acres lying in Crockett County, on which he resided at the time of his death. It appearing further that the plaintiff was his lawful wife and is entitled to dower in said land, It appearing also that the plaintiff has given the defendants; M. B. PERMENTER, R. G. PERMENTER, G. W. BOLING, Mary BOLING, Hiram GIBBONS, Nancy GIBBONS, James RAY, Sarah RAY, Ann PERMENTER and Adams PERMENTER, the only heirs of said deceased and M. B. PERMENTER, his Administrator’s notice–which being notified of this application. It is therefore ordered by the Court that Thomas COOK and John {page 378} EMERSON, free holders of said County be appointed Commissioners in conjunction with William A. JOHNSON, the County surveyor of said County to allot and set off to the Plaintiff the one third part in value of said land for her dower and report to the next term of this Court. It further appearing to the satisfaction of this Court that the petitioner, Candis A. PERMENTER entitled to Homestead out of the lands described in the petition, in addition to Dower. It is therefore ordered by the Court that the said Thomas COOK and John EMERSON together with Wm. A. JOHNSON, County surveyor, after first setting apart the Dower to set apart Homestead the value of One Thousand Dollars out of said land as provided for by the laws of Tennessee.
