BURTON gdn. of Frank Gray BURTON minor all of TN VS Frank Gray BURTON, Mary Bulah BURTON, Martha Cornelia BURTON, Nora Clarence BURTON and Wm. Rush BURTON all minors and citizens of Ark. Petitioners show that sometime about Oct. 1843 Col. Robert M. BURTON a citizen of Lebanon died ... leaving heirs, his widow Martha H. BURTON and four children: Bettie C., W.D., A.J. and Robert M. BURTON. In June 1879 Robert M. BURTON died leaving his widow Lucelia P. BURTON who afterwards married A.J. DONELSON on 7 Apr. 1880, also Robert M. left Mary Bulah Martha Cornelia "Nellie" Nora Clarence and Wm. Rush BURTON as his heirs....

PEYTON died in this county in 1852 testate. Jno. KELLY exor. Testator left a widow, Nancy M. and 7 children: G.W.L., Jas. W., Jno. S., & Thos. H. PEYTON and three daus., L.A., Fanny, who married Green H. WHITE, Sarah Jane who married Lewis WESTBROOKS and died leaving two children Nannie and Charles and M. Elizabeth who married Rufus ANDERSON.... Thomas H. died a minor without issue after his father; Jno. S. PEYTON died in 1862 unmarried and no issue. MABRY, Mary AUSTIN and husband Henry AUSTIN, Sarah BYROM and husband George BYROM Charles DILL and wife Augusta DILL all of Wilson Co., TN; Pybus MABRY and Mary BRANCH of Davidson Co., TN; Augusta DILL and husband Andrew DILL, of Stewart Co., TN; Mary DOYLE and husband William DOYLE, and Robert PARRISH of KY; John MABRY of MO; William PROCTOR, Jon PROCTOR, Robert PROCTOR, Julia PROCTOR and Augusta PROCTOR of TX; Rufus PARRISH, and Elisabeth REEVES dec'd. residence unk. to complt. Complt. is son of defdt. A.W. MABRY and nephew of R.W. MABRY, dec'd. R.W. MABRY died in this county intestate on 30 Sept. 1895. He was never married and his only heirs are his brothers and sisters and their issue. Complt. is admr. He had been the partner of Defdt. A.W. MABRY in farming operations for at least 35 years and died with the business unsettled.... He had been an invalid for 12 years. He first had a spell of pneumonia and before he had recovered was taken with rheumatism, which lasted till his death. During these 12 years he could never walk except on crutches. For the last 6 or 7 years of his life he never left his room without he was carried on complts. back.... R.W. MABRY had the following brothers and sisters: A.W., Ed, John, Amanda PROCTOR, dec'd., Martha PARRISH, dec'd., Mary DOYLE, Elisabeth REEVES, dec'd. and Augusta DILL. Ed MABRY left as his only issue Pybus MABRY and Mary BRANCH. Amanda PROCTOR left as her only heirs her children Wm., John, Robert, Julia, and Augusta PROCTOR. Martha PARISH left children Mary AUSTIN, Sarah BYROM, Augusta DILL, Robert PARRISH, and Rufus PARISH. The heirs of Elisabeth REEVES if any are unk.
1896 Deposition of R.E. MANN says he knew R.W. MABRY since he was a small boy for 40 years. They were in the same company together. It was said he had a trunk of gold. His brother Lee had two children. R.W. MABRY went to California about 1849. - Deposition of Lee DILL says he and his wife opened the trunk. There were papers, $.35, and two rings. - Deposition of W.F. BENNETT says his sister married Lee [R.L.] MABRY. Robert HOLMAN and Lee MABRY married sisters. - Deposition of A.A. MCGEE, aged 30. - Deposition of A.M. PERKINS, aged 64. - Deposition of J.W. TURNAGE, aged 30 says he is a cousin of Lee MABRY.
1897 Deposition of R.L. MABRY says he is son of A.W. MABRY. R.W. MABRY was his uncle. R.L. would be 33 the 25th of Nov. Evidence was a letter written in R.W. MABRY'S handwritting from Sanora Tuommimy Co., CA in 1860. R.L. says his father had 5 children all dead but himself. His brother Bud died in 1887 or 1888. - Deposition of W. Harve BROWN says Dick and R.T. BROWN are the same person. - Deposition of Mary Ann AUSTIN says her mother was sister of R.W. and A.W. MABRY. She says she lived with them 10 years. Says R.W. was buried the 1st day of Oct. 1895. She saw R.W. had a wash pan hardly full of gold. It was in gold money. She handled a $20. and a $10. piece. Reckon there was a half peck. She told her Uncle William DOYLE that came from KY and a brother Robert PARISH. - Deposition of A.A. DILL niece of A.W. & R.W. MABRY. She says the father of her mother has been dead since she was a little child. - Deposition of Sarah J. BYRUM niece of Bob [R.W.] MABRY. - Deposition of Mary J. BRANCH niece of R.W. MABRY. She took him some Kickka Poo Indian Sagwa and Kickapoo Indian oil and Kickapoo Indian pills, patent medicines.

TUCKER, dec'd., Tabitha ANDREWS and husband Jesse ANDREWS, Wallie TUCKER, of Wilson Co., TN, Elizabeth CARUTH and Isaac CARUTH of TX. O.B. TUCKER died intestate in Wilson Co., TN, J.R. WIER admr. J.G. & O.B. TUCKER, dec'd. were the children of Tabitha J. TUCKER who died in 189_ intestate in Wilson Co., TN owner of 61a in Civil District 6. She left her husband E.F. TUCKER who is now living and four children: Tabitha who married Jesse Andrews, Elizabeth who married Isaac CARUTH, two sons J.G. and Olin B. TUCKER. 1899 deposition of J.G. TUCKER says J.C. ANDREWS married his sister. He went to TX in 1890 and stayed two years. E.L. BROCKETT is dead. - Deposition of Jesse ANDREWS says John G. TUCKER is his brother-in-law. He has been married about 10 years. J.G. is blind.

SMITH died in this county some years since testate. Wife Sarah Caroline SMITH appointed extrx. She died 6 or 8 months since. His youngest son Richard. Other children defdt. 2028 - 1896 June 26 - (O.B.) Mary MILLER (Col'd) Against Louis MILLER both of Wilson Co., TN. They married in Wilson Co., TN some 5 or 6 years ago. They have 4 children: James 5, Willie 4, Bessie 2, and Gussie an infant.

1897 deposition of Louis A. BATES a N.Y. druggist. He refurbished the NICHOLSON House in 1892, Nashville. - Deposition of J.B. HANCOCK says when he first took charge of the NICHOLSON House as manager, it was run by the NICHOLSON Hotel Co. [There is a letterhead of the Hotel in these papers.] Deposition of J.H. HANCOCK 65 says J.B. HANCOCK is his nephew.

NEAL of Marshall Co., TN and Ellen BRANCH non residents William NEAL died in this county in 1845 testate... children Claiborne W., William G., Thos. B., L. Yandell, Charles, Sally who married J.B. SCOBY, Ellen married (Blank) BRANCH and Jane married William WOOD.... His wife Jane died in the early part of this year. Charles NEAL married her in the year 1857, her maiden name being Emily O. DINGES and lived together until 26 Mar. 1859 when he died intestate leaving widow and child Charles F. NEAL. Charles, their only child, died 28 Oct. 1861, being a little over two years old....

2045 - 1896 Oct. 20 - (O.B.) N.G. ROBERTSON, admr. of A.P. SHARP of Wilson Co., TN Against Pleasant BAKER of Wilson Co., TN. A.P. SHARP died intestate in Wilson County in the summer of 1896....

2046 - 1898 Mar. 3 - (O.B.) Eli SHORTER Against John H. SMITH, Mrs. Delia TRICE, Ed TRICE & Bettie Lee BRUCE all of Wilson Co., TN. On 3 Oct. 1896 he and one Miranda SMITH made a written contract by which orator agrees to live with her and devote his entire time and attention to her and her business, work her farm and garden and get her wood and water, and in every way make a hand on her premises looking after her in her sickness and health ... upon her death all the property she might die owner of, money ... belong to your Orator. He believes that some 7 or 8 years ago Miranda made a will by the terms of which the defdts. John H. SMITH and Bettie Lee BRUCE and L.A. TRICE were made legatees. L.A. TRICE is now dead and Delia TRICE is his widow and Ed TRICE is only child. Miranda is a very old woman over 80 years of age, very sick and probably will die in 24 to 48 hours. The answer of John, Delia and Bettie say it looks strange to think of a feeble old woman should introduce into her home an old bachelor to look after her. He was no relation ... she did not die, but is getting well....
1898 - Deposition of J.B. JOHNSTON, physician. He was a wit. at the request of Miranda to the contract. She fully understands what she does and says.... - Deposition of Miranda SMITH says she is nearly 82 years of age. She fully understood the contract she made. She has one living brother and sister; no children of her own. She has nieces and nephews the children of dec'd. brothers and sisters. She is in no way related to L.A. TRICE or his wife or to Bettie Lee BRUCE that she knows of. She is a second cousin of John H. SMITH. SMITH and TRICE were nephews of her husband. She sent for the will to destroy it. She did not get the will so she issued papers to have it set aside.. - Deposition of Elizabeth SHORTER, 50, sister of Eli.

WILKERSON, 32, Waco McLennan Co., TX. They married 13 Dec. 1883. Her maiden name was SNOW.... - Deposition of David CHAMBERS, 37, formerly lived Wilson Co., TN and went to TX with John M. - Deposition of Josie says John M.'s sister is Mrs. CRAGWALL. - Deposition of Mrs. SNOW mother of Josie. - Deposition of Mrs. WATSON sister of Josie.

CROWELL, father of complts., died in this county about the last day of Sept. this year testate. His only children Robt. L. CROWELL, and Mrs. Mary E. ARRINGTON. 4915 - 1863 - Petition of William C. DOUGLASS and his wife Lucy Ann, formerly Lucy Ann SEAWELL & Ellridge G. SEAWELL, Nancy W. SEAWELL, Adelade SEAWELL, who are minors, gdn., William SEAWELL. They are joint owners in land in Wilson County, the same on which said William SEAWELL now lives ... 716a. This land was sold on 26 Nov. 1824 by David MARSHALL to said William SEAWELL and Indiana SEAWELL who was a dau. of said William and a sister of your petitioners Land includes the two tracts mentioned in said deed with the exception of 116a which was sold to John KEARN by Indiana and her husband David GILLASPIE. The interest of said William and Indiana in said land was a joint and undivided ... and as they stood in the relation of father and child no partition was ever made. But soon after Indiana married with David GILLASPIE William sold his interest to him and David and his wife became then the owners of the whole.... In Feb. 1829 Indiana died without leaving issue, intestate. Petitioners maintain they are the heirs of Indiana.... Petitioner William C. DOUGLASS married Lucy Ann on the 12 day of Jan. 1836 and that she is now of age and a sister of Indiana. Minors are also sisters....

1868 Aug. 14 - Deposition of W.M. LASSITER, son of Jacob B. LASSATER, says, "Kezia lived first with her mother, then for 18 or 20 years or longer with Absalom. She stayed there until he died, which was I reckon in 1857. Kezia went then to his father's the summer after the Fall in which Absalom died. She stayed there 7 or 8 years before she died. She has been dead since Oct. 1864. Absalom was my uncle. I have heard my father and my aunt Mrs. ALLEN, say they had sold their interest to Absolom for the benefit of Kezia.... I reckon Mrs. ALLEN has been a widow some 7 or 8 years. Her husband died just before the war commenced, I think her husband was living in July 1855 the date of the deed purporting to be from Elizabeth ALLEN to Absolom LASSATER. I do not think Fanny BARKER was a married woman in 1853. She is not married now... A man by the name of BUTLER, a preacher of the gospel, did rent the land. He is dead now...." /S/ Wm. M. LASATER.

She being one of the heirs of Sarah LIGON ... one of the heirs of Martha WILBOURN, dec'd.... 1852 Apr. 15 - (Notice) to take the depositions of John H. WILBOURNE, Robt. S. WILBOURNE and Thomas JOLLEY. Deposition of John says he knows the children of Robert LIGON: Martha Jane is about 25, Nancy Piety is about 23, Dick is about 21, and Leonidas Marion is about 19. During the time thechildren remained in the county, they were very little expense as they staid with their relations. 1852 Dec. 18 - Deposition of F.J. WILBOURNE says that during the year 1850 he was at Robt. W. LIGGON' house in KY. LIGGON then had the white swelling or some disease of that kind in one of his legs and was unable to walk with out crutches. Four of his children were then living with him. He had two boys, both large enought to plough. There were no negroes on the place. LIGGON' wife was there. Two of the girls were nearly grown. He was there in the winter. /S/ F.J. Tracey SPICER during her natural life two negro slaves named Daniel and Hasty and on the death of Tracy and her husband William SPICER shall be vested in the children of said Polly INGRAM, his dau., and son, Jessee DELOACH. They have a copy of the will in Ark. Tracy and her husband received the slaves in N.C., but sometime after her father's death, they moved to Wilson Co., TN bringing with them the two slaves and their increase. Tracy and her husband are still living in Wilson County, but are now very old being something over 70 years of age.... The said girl Hasty has as your Orators are informed, twenty one children, a portion of whom are now in the possession of the defdts. the others have been carried away to other states perhaps.... Henry SMITH has girl Hasty and the following named children of said Hasty, to wit: Jacob, Jane, Paralee, Huston, Leionidus, Hannah, Harriet, John and Tabby - Henry got said Hasty and several of her children from his father, who purchased Hasty and some of the others at the sale. Several children of Hasty have been sold ... one by the name of Charles.... Dr. J.M. SMITH has one of Hasty's children named Lewis, but how he got him cannot state.... Joseph SMITH has in his possession a girl named Emeline a dau. of Hasty and the defdt. Alfred MCCLAIN has a woman by the name of Judy, also a dau. of Hasty and two of said Judy's children, whose names are not known.... Jesse DELOACH, with a family of several children, who have an interest of 1/2 in the said slaves live in the state of Miss ... do not know the names of the children of Jesse. - Bondsmen for Defdts.: James INGRAM, Jorden STOKES, and Robert L. 15 Apr. 1848: Statement of William SPICER and Lucretia SPICER relative to Hasty and Daniel two negroes willed by Saml. DELOCH do make the following statement. Said negroes was willed as they have always understood for the support of sd. Lucretisha in her lifetime and at the death of sd. L. and William the said negroes was to be divided between Jessee DELOCH'S heirs and Polly INGRAM'S heirs. The possession of said negros remained with us about 15 years during which time Haster had 3 children named Charles Toney and Hardy. William SPICER swapped Hester and two children (Toney and Charles) in about 1823 to George SMITH for a boy named Isaac ... Henry SMITH'S store.... Hardy was morgaged to William MCGREGOR ... he was drowned. He sold Daniel to William MOORE who is now dead. Daniel has also been drowned....
1848 Sept. 28 - Answer of Henry F. SMITH says that the will names negroes Daniel and Hester ... cannot therefore admit that the said Samuel DELOACH devised the negro woman Hasty to the children of Polly and Jessie.... He has been informed that a great many years before the death of Samuel DELOACH the said Tracey intermarried with her husband and that upon the marriage DELOACH gave her a small girl, then not more than 7 or 8 years old, that Tracy raised the girl to womanhood, when she gave birth some one or more children older than (blank) Hasty and Daniel long before the making of the will.... Spicer sold the mother of Hasty and Daniel with the knowledge of Samuel DELOACH.... SMITH explains how he became the owner. Sometime in the years 1819 or 1820 his father exchanged a negro boy and perhaps one or two small children for the woman Hasty with William SPICER.... Sometime in the year 1833 the father of complainant departed this life. In the division of the estate of his father the negro woman Hasty and three of her children were alloted to Martha SMITH the sister of respondent. That sometime thereafter Martha intermarried with one Ross WEBB who thereby became the owner of Hasty and her three children and that some time in the year 1837 respondant bought Hasty and three children to wit Jane, Paralee, and Houston ... and he bought with them a negro man the husband of Hasty.... Hasty has had some 18 or 20 children but cannot tell the precise number.
