Whereas on the 9th day of Febuary 1850 John Stone executed a Deed of trust to Hiram Hartsell as trustee to secure to Michael Harvey thee payment of one hundred and two Dollars and fifty cents evidenced by two promissary Notes therein Expressed and to secure to Cox & Brother thee payment of one hundred and forty-nine Dollars and thirty seven cents evidenced by promissary note – therein Expressed and also forty-eight Dollars and eighteen cents to H. Tallant, Cox Evidenced by promissary Note – therin Expressed to a certain tract or parcel of Land ___________ after described and ___________ it is bargained and agreed upon between parties that said Michael Harvey have title to said Land by releasing to thee said stone his claim of one hundred and two Dollars & fifty cents aforesaid and pay to thee said Cox & Brother thee sum of one hundred & sixty-one and 31/100 Dollars thee amount of thee claim neither interest therefore in consideration of thee premises and thee payments above mentioned made by Thee said Harvey to thee said Cox Brother and thee said stone thee receipts of which is hereby acknowledged. We thee said Hiram Hartsell trustee and Cox & Brother and H.T. Cox we have ___________ John Stone holding are equitable interest in hereby each and all of us jointly and ____________ transfer and convey to thee said Michael Harvey his heirs and assigns all thee right title interest or claim that we have in and to a certain tract or parcel of Land in Blount County Tennessee State lying on the Waters of Halston River in the tenth civil District of said County joining the Lands of Benjamin Bonham Lonard Saffeell & others and containing by estimation seventy seven and one half Acres More or less and bounded as follows Beginning on a post oak at or near a line of Leonard Saffell and running thence in divisional line North twenty four West – seventy two and four tenth chains to a stake thence North Sixty five East thirty Eight and five tenths chains to a stake in Wrights line thence South fifty Eight East Eighty chains to an Ash thence North seventy three East twenty seven chains to a stake. in Saffells line Thence with his line South seventy -Eight- and one fourth West – seven and one half chains to an Iron Wood thence south five West – forty- nine chains to a sassafras in a hollow thence South fifty three West thirty chains to thee beginning. To have and to hold thee same to the said Michael Harvey his heirs and assigns forever we do comment with thee said Harvey that We are lawfully seized with interest in said land as aforesaid and that we have a good right to transfer thee same we further comment and bind ourselves and our heirs and representatives to warrant and forever defend thee title to our interest on said land as heretofore expressed to thee said Michael Harvey his heirs and assigns against any person or persons claiming _______ or under in this _______ thee 11th day of June 1851.

This day came before me Jns. S. Bonham one of thee subscribing witnesses to thee foregoing Deed who having duly sworn says he saw H. Hartsell Cox & Brother H. T. Cox and John Stone thee bargainors to thee foregoing Deed to him well known execute thee same thee purposes therein contained and also that thee said William Brady thee other witness who is now dead sign thee same as a witness also came Lea H. Chaffin who being duly sworn says that he was acquainted with thee signature of William Brady and that he believes thee signature of thee said Brady signed to thee foregoing Deed is genuine Given under my hand this Aug 2nd 1869 H C Tucker Clk County Clerk
