{"id":2313,"date":"2020-01-12T14:32:02","date_gmt":"2020-01-12T20:32:02","guid":{"rendered":"https:\/\/tngenweb.org\/wayne2\/?p=2313"},"modified":"2020-01-12T14:32:04","modified_gmt":"2020-01-12T20:32:04","slug":"court-in-december-1851","status":"publish","type":"post","link":"https:\/\/tngenweb.org\/wayne\/court-in-december-1851\/","title":{"rendered":"Court in December 1851"},"content":{"rendered":"\n<p>State of Tennessee\u00a7 Be it remembered that a Quorum County Court was begun and held in and for the County of Wayne at the Court house in the town of Waynesboro and the first Monday being the first day of December in the year of our Lord one thousand Eight hundred and fifty one there were present and presiding the following Justices of the peace of said County to wit David J<strong> JONES<\/strong> Chairman and Washington <strong>CARTER<\/strong> and George W. <strong>BARKER<\/strong> his associates<\/p>\n<p>A Settlement between William<strong> JONES<\/strong> Clerk of this Court and James W. <strong>CANTRELL<\/strong> and William <strong>THORNTON<\/strong> Executors of the estate of Josiah <strong>THORNTON<\/strong> Dec&#8217;d and this day submitted to the Court which Settlement was confirmed by the Court and ordered to be recorded<\/p>\n<p>Upon the petition of George W.<strong> JOHNSON<\/strong> and others It is ordered by the Court that John C.<strong> BLACKBURN<\/strong> Litle[?]<strong> CHOAT<\/strong> King<strong> PRATER<\/strong> Solomon <strong>JOBE<\/strong> James <strong>GRANT<\/strong> Eli <strong>BYNUM<\/strong> Matthew H<strong> BURKS<\/strong> Bennet <strong>HALE<\/strong> Elijah <strong>WARRINGTON<\/strong> and Jesse S<strong> ROSS<\/strong> or any five of them be appointed a jury of view to view and mark out a first class road from the Central Turnpike road at or near the head of Eagle Creek on [the \u2013 crossed out] and along the dividing ridge between Eagle and Beech creeks to Carrollville in said County and that said jury report to the January term next of the Court Isd <strong>Dec 2, 1851.<\/strong><\/p>\n<p>Came William <strong>BEHAM<\/strong> Administrator of the estate of John <strong>ALTOM<\/strong> Deceased and on motion of said Administrator it is ordered by the court that he have leave to amend the account of sales by him reported to a former term of this court by adding the following items at the following prices to wit 6 barrels of corn @ $1.50 = $9. one pair Steetyards[?]. one small ____? 50 cents one Broad ax 25 cents<\/p>\n<p>Came William <strong>BENHAM<\/strong> Administrator of the estate of Delila <strong>GOFORTH<\/strong> Deceased and on motion of said William <strong>BENHAM<\/strong> it is ordered by the court that he have leave to ament[sic] the account of sale of said Estate by him returned at a former term of this Court by adding thereto one thousand bundles of fodder sold to L H<strong> GRIMES<\/strong> at the price of 50 cents per 100 makes $5.00<\/p>\n<p>It appearing to the Court from the written statement of Clarissa <strong>STAGS<\/strong> that her late husband John N. <strong>STAGGS<\/strong> late of Wayne County is dead intestate and further that said Clarissa <strong>STAGGS<\/strong> relinquishes<br \/>[page 210 \u2013 no heading]<br \/>her right to administer on the estate of her said husband and requests that David J J<strong>ONES<\/strong> be appointed administrator of said estate Whereupon the said David J <strong>JONES<\/strong> came into Court and entered into bond in the sum of five hundred dollars conditioned for the faithful performance of his administration with James N. <strong>STAGGS<\/strong> and William <strong>BEHAM<\/strong> as his securities and thereupon the said David J <strong>JONES<\/strong> and the said James N. <strong>STAGGS<\/strong> and William <strong>BENHAM<\/strong> came into Court and acknowledged the execution of said bond which was approved by the Court and ordered to be recorded and that letters of Administration be granted accordingly whereupon the said David J <strong>JONES<\/strong> took the necessary Oaths for his qualification as such Administrator<\/p>\n<p>Ordered by the Court that Washington <strong>CARTER<\/strong> John <strong>McDOUGAL<\/strong> and Cavel B. <strong>McLEAN<\/strong> be appointed commissioners to lay off to Clarissa<strong> STAGGS<\/strong> widow of John N. <strong>STAGGS<\/strong> deceased a years support for herself and family our of the provisions money or other assetts[sic] belonging to said estate and that they report to the next term of this Court Isued<strong> Dec 3. 1851<\/strong><\/p>\n<p>Ordered by the Court that Henry G <strong>BREWER<\/strong> be appointed guardian of Jasper Newton <strong>BREWER<\/strong> minor heir of William <strong>BREWER<\/strong> Deceased he being chosen as such Guardian by the said Jasper N who is over the age of fourteen years, who entered into bond in the sum of one hundred dollars conditioned for the faithful discharge of his duty as such guardian with Rial <strong>BREWER<\/strong> his security and took the necessary oath for his qualification as such guardian<\/p>\n<p>Ordered by the Court that the following persons be appointed Revenue Commissioners for Wayne County to take a list of polls and taxable property within their respective districts for the year 1852 to wit<br \/>1st District \u2013 William <strong>BEHAM<\/strong><br \/>2nd Do Solomon<strong> JOBE<\/strong><br \/>3rd Do James C. <strong>WHITAKER<\/strong><br \/>4th D. W. <strong>CARTER<\/strong><br \/>5 &#8221; G. W. <strong>BARKER<\/strong><br \/>6 &#8221; John P. <strong>VOORHIES<\/strong><br \/>7 &#8221; Absolom B. <strong>GANT<\/strong><br \/>8. Lewis B. <strong>GANT<\/strong><br \/>9. Andrew <strong>DULIN<\/strong><br \/>10. Brinkley <strong>HOPSON<\/strong><br \/>11. Alexander C. <strong>McDOUGAL<\/strong><br \/>12. George E.<strong> HUCKABY<\/strong><br \/>13. David C. <strong>WHITTEN<\/strong><br \/>14. John <strong>MONTAGUE<\/strong><br \/><br \/>Upon the petition of Stephen <strong>BIVENS<\/strong> It is ordered by the Court that Lewis <strong>HARDIN<\/strong> Pleasant <strong>MORGAN<\/strong> Andrew <strong>CASTEEL<\/strong> Thomas<strong> SHIELDS<\/strong> Jonathan BIFFLE Sylvester L<strong> SHIELDS<\/strong> Thompson M. <strong>MORGAN<\/strong> or any five of them be appointed a jury of view to view to view[sic] and mark out a change in the road leading from Waynesboro to Florence to leave the old road at the south end of said<strong> BIVENS<\/strong> lain and intersect said road again at or near the ford of Green River North of Lewis HARDINs place and that said jury make report to the next term of this Court Isued <strong>Dec 3, 1851<\/strong><\/p>\n<p>Upon the petition of Edward A. <strong>RUTLEDGE<\/strong> it is ordered by the Court that Bennet<strong> COLE<\/strong> Isaac[?]<strong> MORRIS<\/strong> David <strong>PULLEY<\/strong> Daniel C.<strong> WALKER<\/strong> Green <strong>WILSON<\/strong> Joseph<strong> EAST<\/strong> George W. <strong>BARKER<\/strong> John L <strong>FOWLER<\/strong> Abraham <strong>MONTAGUE<\/strong> and Thomas <strong>YOUNG<\/strong> or any five of them be appointed a jury of view to view and mark a change in the road leading from Waynesboro to Savannah so as to leave the old road at the Daniel <strong>WALKER<\/strong> road and running down the ridge with the <strong>WALKER<\/strong> road a half mile or more and intersect the old road at or near the poor house on Hardins Creek and that they report to the January term next of this Court Isued <strong>Dec 3, 1851<\/strong><\/p>\n<p>Ordered by the Court that John R<strong> KYLE<\/strong> be appointed overseer of the Road of 2nd Class in the place of George<strong> JACKSON<\/strong> and that he have the same hands to work under his direction Isued <strong>Dec 2, 1851<\/strong><\/p>\n<p>Ordered by the Court that A J<strong> TURNBOUGH<\/strong> be appointed Overseer of the Road of 2nd Class in the place of Abram<strong> MABRY<\/strong> and that he have the hands in the same bounds to work under his directions Isued<strong> Dec 4. 1851<\/strong><\/p>\n<p>A Settlement between William<strong> JONES<\/strong> Clerk of this Court and William <strong>SINCLAIR<\/strong> and Resign <strong>SINCLAIR<\/strong> Guardians of Nancy J <strong>SINCLAIR<\/strong> minor heir of John <strong>SINCLAIR<\/strong> deceased [presented \u2013 crossed out] was this day presented to the Court which was confirmed by the Court and ordered to be recorded<\/p>\n<p>This day came Joacim<strong> DUGGER<\/strong> Administrator of the estate of Eli <strong>MERRYMAN<\/strong> Deceased [which account of sales is ordered to be recorded \u2013 crossed out] and presented an account of sales of said estate which is received by the Court and ordered to be recorded<\/p>\n<p>Ordered that Court be adjourned until Court in course \/\/s\/\/ D J<strong> JONES<\/strong> Chair W.<strong> CARTER<\/strong> G.
