{"id":2311,"date":"2020-01-11T18:21:30","date_gmt":"2020-01-12T00:21:30","guid":{"rendered":"https:\/\/tngenweb.org\/wayne2\/?p=2311"},"modified":"2020-01-11T18:21:32","modified_gmt":"2020-01-12T00:21:32","slug":"court-in-november-1851","status":"publish","type":"post","link":"https:\/\/tngenweb.org\/wayne\/court-in-november-1851\/","title":{"rendered":"Court in November 1851"},"content":{"rendered":"\n<p>State of Tennessee Be it remembered that a quorum County Court was begun and held in and for the County of Wayne at the Court house in the town of Waynesboro on the first Monday being the third day of November in the year of our Lord one thousand eight hundred an fifty one there were present and presiding David D.<strong> JONES<\/strong> Chairman John<strong> MONTAGUE<\/strong> &amp; George W.<strong> BARKER<\/strong> his associate Justices<\/p>\n<p>Ordered by the Court that Andrew M. <strong>SOUTH<\/strong> be appointed Guardian of Elizabeth Ann <strong>TYCER<\/strong> John M<strong> TYCER<\/strong> and Martha Jane<strong> TYCER<\/strong> Minor heirs of William<strong> TYCER<\/strong> dec\u2019d and that he enter into [give \u2013 crossed out] bond and sufficient security in the sum of sixteen hundred Dollars conditioned for the faithful execution of his guardianship whereupon the said Andrew M <strong>SOUTH<\/strong> entered into bond in the sum of sixteen hundred dollars with George<strong> COOK<\/strong> and John <strong>McDOUGAL<\/strong> as his securities which were approved by the Court and ordered to be recorded and the said Andrew M. <strong>SOUTH<\/strong> took the necessary oath for his qualification as such Guardian<br \/>Washington<strong> CARTER<\/strong> &amp; wife et al Exparte Petition to sell slaves\u00a7 Be it remembered that this cause came on for a hearing before the worshipful County Court for the County of Wayne and State of Tennessee on the 3rd day of November 1851 upon the petitioners petition and it appearing to the satisfaction of the Court that said petitioners are the owners of said three slaves mentioned in the petition in this cause as tenants in common to wit Lucy Hannah and Lewis that is to say, Washington<strong> CARTER<\/strong> &amp; wife Susan <strong>CARTER<\/strong> one third part Charles D <strong>MACK<\/strong> one third part &amp; James V <strong>MACK<\/strong> one third part of said Slaves, and it further appearing to the Satisfaction of the Court that said Slaves Cannot be equally divided between said parties, and that it is necessary to sell said Slaves so that the proceeds may be equally divided between said parties according to law. It is therefore ordered and decreed by the court that said three Slaves be sold to the highest bidder at the Court house door in Waynesboro on a Credit of twelve Months the purchasers giving bond &amp; good security and a lien retained upon said Slaves until the purchasers money is paid. And it is further ordered by the Court that John<strong> McDOUGAL<\/strong> be and is hereby appointed a Commissioner to Sell said Slaves and it is further ordered that he Sell the same as above discribed after giving at least thirty days notice at three or more public places in said County one of which shall be upon the Court house door in said town Waynesboro and it is further ordered that he report to the January Term of this Court and that all other things be reserved<\/p>\n<p>Ordered by the Court that Carry <strong>RAY<\/strong> be appointed overseer of the road of second class in place of Moses <strong>PRINCE<\/strong> and that he have the hands in the same bounds to work under his directions Isued <strong>Nov. 21st 1851<\/strong><\/p>\n<p>Came William <strong>BEHAM<\/strong> Administrator of the estate of Delila <strong>GOFORTH<\/strong> and returned into Court an Inventory and account of sales by his oath which was received b the Court and ordered to be recorded<br \/>John M. <strong>BEHAM<\/strong> who was this day appointed deputy Sheriff of said County of Wayne by Rial <strong>BREWER<\/strong> Sheriff of said County came into Court and took the necessary oaths for his qualification as such deputy Sheriff<br \/>State of Tennessee Wayne County\u00a7 Ss. On the 3rd day of November A.D. one thousand eight hundred and fifty one personally appeared in open court<\/p>\n<p>Josiah <strong>YOUNGBLOOD<\/strong> and John W. <strong>YOUNGBLOOD<\/strong> residents of Wayne County and State of Tennessee who being duly sworn according to law declare that they and Lydia <strong>HORTON<\/strong> are the Children and only heirs at law of William <strong>YOUNGBLOOD<\/strong> deceased who was a private in the company commanded by Captain TWIGGS in the 7th Regiment of Infantry (the names of the commanding colonel not remembered) but will be [shown \u2013 marked out] known by reference to the original Certificate of discharge) in the war of 1812 that their said father enlisted in November 1814 for the term of five years and served near two years and five months as declarents now remember and believe and was honorably discharged as will appear by reference to his original Certificate of discharge which may be found appended to a former declaration made by Edith <strong>YOUNGBLOOD<\/strong> the widow of William <strong>YOUNGBLOOD<\/strong> deceased and which has been acknowledged by the commissioner of pensions to be in his possession Declarents would further state that the aforesaid declaration made by Edith <strong>YOUNGBLOOD<\/strong> (who is the mother of declarents and widow of William <strong>YOUNGBLOOD<\/strong> deceased set out all the facts with regard to the service of the said William <strong>YOUNGBLOOD<\/strong> deceased \u2013 the time and place he enlisted \u2013 the time he remained in service and when and where discharged and also the time of his death more fully than declarents are now able to say and so would respectfully suggest a reference to said declaration for a more general and full statement of the facts. Declarents make this declaration for the<br \/>[page 207 \u2013 no heading] purpose of obtaining the bounty land to which William<strong> YOUNGBLOOD<\/strong> deceased was entitled in his lifetime under the act passed January 11th 1812 and to which they and the said Lydia <strong>HORTON<\/strong> (their sister and now entitled as heirs at law in fee as their father (the said William <strong>YOUNGBLOOD<\/strong>) never obtained the said bounty land during his lifetime \/\/s\/\/ Josiah <strong>YOUNGBLOOD<\/strong> J. W.<strong> YOUNGBLOOD<\/strong> Sworn to &amp; subscribed in open Court Nov, 3rd 1851. \/\/s\/\/ Wm<strong> JONES<\/strong> Clerk<br \/>And therefore came Edith <strong>YOUNGBLOOD<\/strong> in open Court and after being duly sworn according to law desposes as follows to wit that she is the mother of the aforementioned Josiah [Joseph \u2013 crossed out] YOUNGBLOOD, John W. <strong>YOUNGBLOOD<\/strong> and Lydia <strong>HORTON<\/strong> and also the widow of the said William <strong>YOUNGBLOOD<\/strong> deceased and that the said Josiah, J. W. and Lydia are the only heirs at law in fee of the said William <strong>YOUNGBLOO<\/strong>D deceased as stated in their declaration That deponent sometime ago made her declaration and had it sent unto the pension office (the reception of which has since been acknowledged by the Commissioner of Pensions) for the purpose of obtaining said bounty land in which declaration deponent stated all the facts pertaining to the rights of the said William <strong>YOUNGBLOOD<\/strong> deceased to bounty land during his lifetime and expecting now to obtain the same as his widow but has since learned that she is not entitled to it under the act of 1812 but that his heirs at law in fee are only entitled who are the aforesaid Josiah <strong>YOUNGBLOOD<\/strong> John W <strong>YOUNGBLOOD<\/strong> and Lydia <strong>HORTON<\/strong> \u2013 And also Zachariah <strong>CYPERT<\/strong> in open Court and after having been duly sworn according to law deposed as follows to wit that he was a neighbor of the said William<strong> YOUNGBLOOD<\/strong> for many years during his lifetime and that at his death he bequeathed all his estate to his widow and that the said Josiah <strong>YOUNGBLOOD<\/strong> John W.<strong> YOUNGBLOOD<\/strong> and Lydia <strong>HORTON<\/strong> and that deponent believes the said William <strong>YOUNGBLOOD<\/strong> deceased regarded the aforesaid Josiah John W &amp; Lydia as his only heirs at law in fee and that they are his only children and heirs as deponent believes and that he believes all the statements made in the foregoing declaration are true It is considered by the Court that the said Witnesses are persons of good character and standing and that full faith and credit are due to and ought to be given to their foregoing statements It is therefore considered by the Court that the above proceedings[?] be entered of record and a duly certified copy thereof be furnished by the Clerk of this Court to said declarents to enable them to procure the bounty land to which they are entitled as the children and only heirs at law of William <strong>YOUNGBLOOD<\/strong> deceased under the Act of Congress passed 11th January 1812.<\/p>\n<p>[page 208 \u2013 Monday November 3 1851]<br \/>Came James E.<strong> McKNIGHT<\/strong> Administrator of the estate of William C. <strong>McBRIDE<\/strong> Deceased and returned into Court an Inventory and account of sales of said estate verified by his Oath which was received by the Court and ordered to be recorded<\/p>\n<p>Came William <strong>STANFIELD<\/strong> &amp; John W. <strong>SHULL<\/strong> executors of the estate of James W. <strong>STANFIELD<\/strong> Deceased and returned into Court an Inventory and Account of Sale of said estate verified by their oaths which were received by the Court and ordered to be recorded<\/p>\n<p>Joacim <strong>DUGGER<\/strong> Administrator of the Estate of Eli<strong> MERRRMAN<\/strong> deceased came into Court and returned on Inventory [&amp; account of sales \u2013 crossed out] of said estate verified by his oath which was received by the Court and ordered to be recorded<\/p>\n<p>Ordered that Court be adjourned until Court in course \/\/s\/\/ D J <strong>JONES<\/strong> (Chair) John <strong>MONTAGUE<\/strong> Geo.
