{"id":2289,"date":"2019-12-01T14:15:26","date_gmt":"2019-12-01T20:15:26","guid":{"rendered":"https:\/\/tngenweb.org\/wayne2\/?p=2289"},"modified":"2019-12-01T15:13:24","modified_gmt":"2019-12-01T21:13:24","slug":"court-in-july-1851","status":"publish","type":"post","link":"https:\/\/tngenweb.org\/wayne\/court-in-july-1851\/","title":{"rendered":"Court in July 1851"},"content":{"rendered":"\n<p>Monday<strong> July 7th 1851<\/strong><br \/>State of Tennessee Wayne County\u00a7 Be it remembered that a quarterly County Court was began and held for the County of Wayne at the Court house in the town of Waynesboro on the 7th day it being the first Monday in July in the year of our Lord one thousand Eight hundred &amp; fifty one when and when the following Justices were present &amp; presiding to wit: David J <strong>JONES<\/strong> Chr.<strong> LAFFERTY CARTER MONTAGUE BARKER WILSON VOORHIES WATKINS CYPERT CURTIS HAM BREWER HUCKABY WHITAKER DIXON<\/strong> A B <strong>GANT<\/strong> L B <strong>GANT YOUNG<\/strong> &amp;<strong> POPE<\/strong><br \/>Whereas satisfactory evidence has been exibted[sic] to the Court here that Robert <strong>CYPERT<\/strong> Late of said County is dead and was before death a United State pensioner and that he died on the 28th day of January 1851 it is therefore ordered by the Court that the Clerk of this Court Certify accordingly Came James <strong>HAGGARD<\/strong> who was at the January term 1851 of said County Court appointed Commissioner to take and make out in writing an accurate and complete list of the number of free white Male inhabitants who are twenty one years old and over and returned his list accordingly the aggregate of which is Thirteen hundred and seventy one verified by his oath which was received by the Court and ordered to be recorded<br \/>Upon motion to appropriate to Jesse S<strong>. ROSS<\/strong> and W<strong> CARTER<\/strong> each the sum of four dollars for their services as commissioners to sell certain lots in Waynesboro Those who voted in the affirmative were D J<strong> JONES<\/strong>, Chr. <strong>LAFFERTY MONTAGUE BARKER VOORHIES WILSON WATKINS CYPERT CURTIS a<\/strong>nd<strong> HUCKABY<\/strong> ten Noes none so said appropriation was made to be paid out of any monies in the hands of the County Trustee not otherwise appropriated Issued July 24, 1851<\/p>\n<p>Ordered by the Court that Daniel <strong>STROUD<\/strong> be appointed Overseer of the road of 2d Class in the place of C M<strong> BROWN<\/strong> and that he have the hands in the same bounds to work under his direction Issued July 23d 1851<\/p>\n<p>Ordered by the Court that William<strong> HOLLOWAY<\/strong> be appointed overseer of the road of 2d Class in the place of John<strong> STOCKARD<\/strong> and that he have the hands in the same bounds to work under his direction Issued July 23d 1851<br \/>On motion to appropriate to John A<strong> GRIMES<\/strong> the sum of three dollars his fee in a certain bill of Cost against Wayne County to wit: State of Tennessee vs. F CORBIN those who voted in the affirmative were D J <strong>JONES<\/strong> Chr. <strong>LAFFERTY WHITAKER CARTER MONTAGUE BARKER VOORIES WILSON WATKINS CYPERT<\/strong> L B<strong> GANT CURTIS HAM<\/strong> &amp;<strong> HUCKABY<\/strong> 14 Noes none so said appropriation<\/p>\n<p><br \/>Monday July 7th 1851<br \/>was made to be paid out of any monies in the hands of the trustee of said County not otherwise appropriated Issued July 23, 1851 [on page 184]<br \/>Upon motion to appropriate to John <strong>McDOUGAL<\/strong> Clerk of the Circuit Court and other entitled thereto their fee respectively in a certain bill of Cost against Wayne County which are duly certified to wit: State of Tennessee vs. James C<strong> WILEY<\/strong>\u00a7 John<strong> McDOUGAL<\/strong> Clerk $7.18 \u00be R A<strong> HILL<\/strong> $5. Wm B<strong> ROSS<\/strong> $4.25 John<strong> HOLLIS<\/strong> $2.35 Ria<strong>l BREWER<\/strong> $3.16\u00bd Hardin C <strong>HOLLIS<\/strong> $2.03 Those who voted in the affirmative were D J <strong>JONES LAFFERTY WHITAKER CARTER BARKER VOORHIES WILSON WATKINS CYPER<\/strong>T L B<strong> GANT CURTIS HAM DIXON<\/strong> &amp;<strong> HUCKABY<\/strong> 14 Noes none so said appropriation was made to be paid out of any monies in the hands of the Trustee not otherwise appropriated Issued Aug. 11th 1851<br \/>A majority of the Justices of the peace present John <strong>SHIPMAN<\/strong> presented in open Court the Scalp of a wolf over four months old and proved the killing of said Wolf in Wayne County by his own oath and said scalp was destroyed by the Sheriff according to an Act of the General assembly in such made &amp; provided Issued to John SHIPMAN July 8, 1851<br \/>A majority of the Justices of the peace present William M<strong> HORTON<\/strong> presented in open Court the Scalps of five wolves under four months old and proved the killing of them in Wayne County by his own oath and said scalps was destroyed by the Sheriff according to an act of the General assembly in such cases made and provided Isued Aug 4th 1851<br \/>Ordered by the Court that Alonzo H. MONTAGUE be appointed Overseer of the road of 2d Class in the place of Isaac W ROSS and that he have the hands in the same bounds to work under his direction Isued July 23d 1851<br \/>On the petition of Felix <strong>WEST<\/strong> and it appearing to the satisfaction of the Court that the said <strong>WEST<\/strong> is in indigent circumstances and unable to do manual labor It is ordered by the Court that the said Felix <strong>WEST<\/strong> have the privilege of hawking and peddling in the County of Wayne during his inability to Labor as afore said an his taken the oath prescribed by law Isued July 7th 1851<\/p>\n<p>Ordered by the Court that Jacob<strong> LUTES<\/strong> be appointed overseer of the road of 1st Class in the place of Thomas <strong>STAGGS<\/strong> and that he have the hands in the same bounds to work under his direction Issued Aug. 2, 1851<br \/>Upon motion to appropriate to William B. <strong>ROSS<\/strong> the sum of six dollars for building a pissery in Waynesboro Those who voted in the affirmative were D J <strong>JONES <\/strong>Chr <strong>LAFFERTY WHITAKER CARTER MONTAGUE BARKER VOORHIES WILSON WATKINS CYPERT<\/strong> L B <strong>GANT CURTIS<\/strong> &amp;<strong> DIXON <\/strong>13 Noes <strong>BREWER<\/strong> 1 So said appropriation was made to be paid out of any monies in the hands of the County trustee not otherwise appropriated Issued Aug 6th 1851<\/p>\n<p>Monday July 7th 1851<br \/>[State of Tennessee, Wayne County\u00a7 Be it remembered that a Quarterly County Court was began and held for the County of Wayne at the Courthouse in the Town of Waynesboro on the ___ day it being the first Monday in July in the year of our Lord one thousand Eight hundred and fiftyone When and where the following Justices were present and presiding to wit) \u2013 this is all crossed out]<br \/>This day came Joseph N. <strong>ROBNETT<\/strong> in to Court and tendered to the Court his resignation to the office of Constable of Wayne County which was received by the Court and ordered to be recorded.<br \/>David J.<strong> JONE<\/strong>S Chairman of this Court and in behalf of the Court [bound \u2013 crossed out] by the Consent of Thomas<strong> CARR<\/strong> orphan and George W. <strong>BROWN<\/strong> bound the said Thomas<strong> CARR<\/strong> to Marcus <strong>COOK<\/strong> [the said \u2013 crossed out] and the said D. J.<strong> JONES<\/strong> as Chr. And the said Marcus<strong> COOK<\/strong> entered into indentures binding the said Orphan to the said<strong> COOK<\/strong> util[sic] he attains the age of Eighteen years and the Court releases the said George W. <strong>BROWN<\/strong> from his obligation in the former indentures.<\/p>\n<p>Upon motion to appropriate to William<strong> JONES<\/strong> Clerk of this Court and others their fee in a certain bill of Cost against County To wit) State of Tennessee vs John L.<strong> FOWLER<\/strong>\u00a7 William<strong> JONES<\/strong> Clerk $1.50 W<strong> CARTER<\/strong> Justice $ .50 R J <strong>CYPERT<\/strong> Constable .50 Those who voted in the affirmative were D J <strong>JONES<\/strong> Chr. <strong>CARTER VOORHIES CYPERT<\/strong> L B<strong> GANT DIXON<\/strong> &amp; H<strong>UCKABY<\/strong> 7 Noes <strong>MONTAGUE<\/strong> &amp;<strong> BREWER<\/strong> 2 So said appropriation was made to be paid out of any monies in the hands of the County trustee not otherwise appropriated. Issued Aug 12, 1851.<\/p>\n<p>Cam William <strong>HAWK<\/strong> and others a Jury summons &amp; qualified to view &amp; mark out a change in the road of 2d Class near John<strong> DOWNING<\/strong>s on Indian Creek and report a road found as directed in said Order which was received by the Court and ordered to be recorded.<\/p>\n<p>Came T P <strong>CASH<\/strong> and others a Jury summons and sworn to examine and report to this term of the Court whether Lucy <strong>BREWER<\/strong> of Wayne County is an Idiot or not if so what effects there is belonging to said Idiot and report said Lucy <strong>BREWER<\/strong> to be an idiot but that they find no property belonging to said Idiot<\/p>\n<p>Monday July [August \u2013 crossed out] 1851<br \/>Came N F <strong>JOHNSON<\/strong> and others a Jury summonds and sworn to view and mark out a change in the road of 2d Class leading from Carrollville to Florence on the lands of James<strong> ELLIOTT<\/strong> and report a change made as directed in said order.<\/p>\n<p>A settlement between Thomas H<strong> MABRY<\/strong> Trustee of Wayne County and A <strong>MONTAGUE<\/strong> and Jonathan<strong> MORRIS<\/strong> Commissioners appointed by this Court to settle with the revenue Collectors of said County the year 1851 was this day submitted to the Court which was Confirmed by the Court and ordered to be recorded<\/p>\n<p>Came George <strong>WHITE<\/strong> and others a Jury summonds and sworn to view and mark out a change in the road of 2d Class leading from David<strong> TACKETT<\/strong>s to Waynesboro on the lands of T P <strong>CYPERT<\/strong> and report to the Court a change made as directed in the order which was received and ordered to be recorded<\/p>\n<p>Came Jonathan <strong>MORRIS<\/strong> and others a Jury summonds and qualified to view and mark out a pass way sufficient for a third class road from Mary H <strong>SHIELDS<\/strong> so as to intersect the Waynesboro Road near John A <strong>KENNEDY<\/strong>s and report a way found as directed in said Order Which report was received and ordered to be recorded<\/p>\n<p>Came Baker <strong>CYPERT<\/strong> and others a Jury summonds and qualified to view and report the expediency of disannulling the new Road and opening the old one leading from Baker<strong> CYPERT<\/strong>s to Joh<strong>n McGLAMERY<\/strong>s and report to the Court that said change is necessary as the old road is the best which report was received and ordered to be recorded<\/p>\n<p>Ordered by the Court that Mathew <strong>JOHNSON<\/strong> be appointed overseer of the road of 2d Class in the place of Charles<strong> LISLES<\/strong> and that he have the hands in the same bounds to work under his direction Isued July 23? 1851<\/p>\n<p>Came William<strong> WEST<\/strong> Administrator of the Estate of James <strong>WEST<\/strong> dec\u2019d and returned into Court an Inventory and account of sales verified by his Oath which was received by the Court and ordered to be recorded<\/p>\n<p>A settlement between William<strong> JONES<\/strong> Clerk of this Court and Henry<strong> DARBY<\/strong> Executor to the last will and testament of Bazel <strong>ROBINSON<\/strong> Dec\u2019d was this day submitted to the Court which was confirmed and ordered to be recorded<\/p>\n<p>Settlement between William<strong> JONES<\/strong> Clerk of this Court and Thomas W <strong>WALDRIP<\/strong> Guardian to the minor heirs of Reuben <strong>WHITE<\/strong> Dec\u2019d was this day submitted to the Court which was confirmed by the Court and ordered to be recorded<\/p>\n<p>Monday July 7th 1851<br \/>Came Benjamin<strong> WATKINS<\/strong> and other a Jury summonds and qualified to view and mark out so as to change the Road of 2d Class leading down Weatherfords fork of Indian Creek and report said change as follows leaving said Road near John C<strong> JOHNSON<\/strong>s and runn with the foot of the hill and intersect the said road at Ben<strong>\u2019 WATKINS<\/strong> which report was received and ordered to be recorded<\/p>\n<p>A settlement between William<strong> JONES<\/strong> Clerk of this Court and James N <strong>BLACKSHAR<\/strong> Guardian of H.P.<strong> BLACKSHEAR<\/strong> was this day submitted to the Court which was received by the Court and ordered to be recorded<br \/>Ordered by the Court that the following Good and lawful men of the County of Wayne and State of Tennessee be appointed and summonds by the Sheriff of said County to and be and attend at the next term of the Circuit Court to be holden for the County of Wayne at the Court house in the Town of Waynesboro on the fourth Monday in September next (To wit) Josiah <strong>ROBINSON<\/strong> Solomon <strong>JOBE<\/strong> Oze <strong>DICUS<\/strong> Charles W <strong>THOMPSON<\/strong> Clayton <strong>THORP<\/strong> Hiram<strong> THOMAS<\/strong> Sylvester L<strong> SHIELDS<\/strong> William <strong>POLLARD<\/strong> &amp; William J <strong>YOUNG<\/strong> A.H.M. <strong>STUBBLEFIELD<\/strong> John P. <strong>VOORHIES<\/strong> James N. <strong>STAGGS<\/strong> James <strong>COPELAND<\/strong> Jr. James W <strong>STANFIELD<\/strong> George<strong> WHITE<\/strong> Josiah <strong>YOUNGBLOOD<\/strong> William R <strong>CARTER<\/strong> Benjamin <strong>HOLT<\/strong> Buckley<strong> HAM<\/strong> William <strong>MELTON<\/strong> Edwar<strong>d MORRISON<\/strong> George E <strong>HUCKABY<\/strong> Josiah DARBY Robert <strong>SPEER<\/strong> Robert C<strong> HAMPHILL<\/strong> and that Z M<strong> JOHNSON<\/strong> and John F<strong> HALL<\/strong> be appointed and summonds to attend as Constables to wait on said Court and that Venirafacious Issue returnable to said Court Is\u2019d.<\/p>\n<p>Upon motion to appropriate to William <strong>BENHAM<\/strong> the sum of Two dollars and thirty eight cents the amount of Walter <strong>BRIDGE<\/strong>s fee in a case in the Circuit Court Elizabeth<strong> BURNS<\/strong> vs John S <strong>BURNS<\/strong> Those who voted in the affirmative were D J <strong>JONES<\/strong> Chr. <strong>CARTER BARKER A B GANT CYPERT<\/strong> L B<strong> GANT DIXON<\/strong> and <strong>HUCKABY<\/strong>. 8. J. <strong>YOUNG<\/strong><\/p>\n<p>Tuesday July the 8th 1851<br \/>Court met pursuent to adjournment thare[sic] being no corum[sic] present the Court adjourned untill tomorrow morning 10 Oclock \/\/s\/\/ W<strong> CARTER<\/strong> Chr.
