{"id":2250,"date":"2019-01-13T11:21:07","date_gmt":"2019-01-13T17:21:07","guid":{"rendered":"https:\/\/tngenweb.org\/wayne2\/?p=2250"},"modified":"2019-01-13T11:21:07","modified_gmt":"2019-01-13T17:21:07","slug":"court-novemeber-1850","status":"publish","type":"post","link":"https:\/\/tngenweb.org\/wayne\/court-novemeber-1850\/","title":{"rendered":"Court Novemeber 1850"},"content":{"rendered":"<p><strong><span style=\"font-family: times new roman,times,serif;font-size: 14pt\">Monday Nov. 4, 1850<\/span><\/strong><br \/>\n<span style=\"font-family: times new roman,times,serif;font-size: 14pt\">State of Tennessee Wayne County Be it remembered that a quorum [ quarterly-crossed out] County Court was began and held for the County of Wayne at the Courthouse in the Town of Waynesboro on the first Monday it being the 4th day of in November in the year one thousand eight hundred and fifty the <span style=\"font-size: 18pt\">following<\/span> Justices Present and presiding (To wit) David J <strong>JONES<\/strong> Char. <strong>YOUNG<\/strong> [and-crossed] <strong>CARTER &amp; CYPERT<\/strong> his associates<\/span><\/p>\n<p><span style=\"font-family: times new roman,times,serif;font-size: 14pt\">It appearing to the Court that Benjamin <strong>BROADAWAY<\/strong> of the State of Alabama is dead and application being made by Alfred <strong>REED<\/strong> to be appointed special Administrator of all and singular the goods &amp; Chattles rights and credits of the said Dec&#8217;d in the County of Wayne &amp; State of Tennessee and he having entered into bond in the sum of one hundred and fifty dollars with Robert <strong>REED<\/strong> his security which was approved of by the Court whereupon the Court ordered letters to isue to him accordingly whereupon the said <strong>REED<\/strong> took the necessary Oath for his qualification.<\/span><\/p>\n<p><span style=\"font-family: times new roman,times,serif;font-size: 14pt\">Ordered by the Court that John <strong>MONTAGUE<\/strong> be appointed Overseer of the road of second Class from the Florence road near James <strong>ELLIOTT<\/strong>s Gin to the County line towards <strong>PATTON<\/strong>&#8216;s Ferry and that he James <strong>GILL<\/strong> &amp; hands Axim?&#8221; &amp; Wesley <strong>GRIFFIN<\/strong> Jeremiah<strong> ALISON<\/strong> Robert <strong>SPEAR<\/strong> Jas?<strong> WARR<\/strong>s? hands H.S. <strong>OLDS<\/strong>s hands William W <strong>OLDS<\/strong> J M <strong>BANKS<\/strong> C R <strong>WALKER<\/strong>s hands J B <strong>WALKER<\/strong> A <strong>HARDIN<\/strong>s hands &amp; A K <strong>HARDIN<\/strong> John <strong>MONTAGUE<\/strong> and hands to work under his direction Isued <strong>Nov 16th 1850<\/strong><\/span><\/p>\n<p><strong><span style=\"font-family: times new roman,times,serif;font-size: 14pt\">Monday Nov. 1850<\/span><\/strong><br \/>\n<span style=\"font-family: times new roman,times,serif;font-size: 14pt\">Notice was this day given to the Court that Elizabeth <strong>SHIELDS<\/strong> widow of John N <strong>SHIELDS<\/strong> would apply to the next term of this Court to have her dower allotted her of said estate<\/span><\/p>\n<p><span style=\"font-family: times new roman,times,serif;font-size: 14pt\">It appearing to the Court here that William <strong>HOLD<\/strong> late of said County is dead and relinquishment by the widow to her right of Admrship. as shown by the Oath of John <strong>HAYES<\/strong> and application being made by said John <strong>HAYES<\/strong> to have letters Testamentary granted to him upon all and singular the goods &amp; Chattles rights and Credits of the William <strong>HOLT<\/strong> and he having entered into bond in the sum of two thousand with C <strong>ACKLIN<\/strong> &amp; John <strong>McDOUGAL<\/strong> his securities which was approved of by the Court where upon the Court ordered that he have letters accordingly where upon the said John <strong>HAYES<\/strong> Took the necessary Oath for his qualification<\/span><\/p>\n<p><span style=\"font-family: times new roman,times,serif;font-size: 14pt\">Thomas A<strong> POPE<\/strong> vs Samuel A <strong>ANDREWS<\/strong> [ANDERSON- crossed out]) Petition to divide slaves and sell real estate. Came the petitioner by his attorney and it appearing to the Court from the petition sworn to and filed in this course that Samuel? A <strong>ANDREWS<\/strong>, Mary A. E. <strong>RENSHAW<\/strong>, James D <strong>ANDREWS,<\/strong> Sarah A. <strong>JACKSON<\/strong>, Harriet M <strong>ANDREWS<\/strong> Susan B <strong>ANDREWS<\/strong> Frances M <strong>ANDREWS<\/strong>, Thomas C. <strong>ANDREWS<\/strong> and Elizabeth<strong> ANDREWS<\/strong> are non residents of this State, Therefore Order the Clerk to have publication made with regard to said non residents in the Western Weekly Review a newspaper published in the Town of Franklin requiring said defendants to appear at the next term of this Court and plead answer or demur? to said complainants bill or the same will be taken proconfesor?<\/span><\/p>\n<p><span style=\"font-family: times new roman,times,serif;font-size: 14pt\">Ordered by the Court that Brinkley<strong> HOPSON<\/strong> Thomas<strong> LAWSON<\/strong> and William <strong>DAVIS<\/strong> freeholders &amp; unconnected with the parties be appointed commissioners to allot and set apart to DaIannah widow of William <strong>HOLT<\/strong> deceased so much of the Crop stock provisions and money as shall be sufficient for the support of herself &amp; family for one year from the death of her said husband and that they report the same to the next term of this court<\/span><\/p>\n<p><span style=\"font-family: times new roman,times,serif;font-size: 14pt\">Ordered by the Court that E H <strong>TURNBOUGH<\/strong> be appointed overseer of the Road of 2d Class in the place of A G <strong>PHEPPS<\/strong> and that he have the hands in the same bounds to work under his direction Isued Nov 16, 1850<\/span><\/p>\n<p><strong><span style=\"font-family: times new roman,times,serif;font-size: 14pt\">Monday Nov. 6th 1850<\/span><\/strong><br \/>\n<span style=\"font-family: times new roman,times,serif;font-size: 14pt\">This day D J <strong>JONES<\/strong> Chairman of the County Court of Wayne County by the consent of Lucinda <strong>ATWOOD<\/strong> the mother of William <strong>ATWOOD<\/strong> age about 6 years old the 11th Nov 1850 Bound unto Joseph<strong> COCKMAN<\/strong> said Child untell he arrives to the age of twentyone years [of age- crossed out] and said D J <strong>JONES<\/strong> as such Chr. &amp; said Joseph<strong> COCKMAN<\/strong> entered indenters accordingly<\/span><\/p>\n<p><span style=\"font-family: times new roman,times,serif;font-size: 14pt\">This day D J<strong> JONES<\/strong> Chairman of the County Court of Wayne County by the Consent of Lucinda <strong>ATWOOD<\/strong> mother Mary Ann <strong>ATWOOD<\/strong> age 8 years the 6th Oct last bound said child to W.J. <strong>BREWER<\/strong> untell she arrives at the age of eighteen years old and the said D J <strong>JONES<\/strong> as such Chr. and the said W J <strong>BREWER<\/strong> entered into indentures accordingly<\/span><\/p>\n<p><span style=\"font-family: times new roman,times,serif;font-size: 14pt\">Came David<strong> COOK<\/strong> and others who were appointed at a former term of this Court commissioners to allot and set apart to the widow <strong>HARWELL<\/strong> one year&#8217;s provision and reported to the Court accordingly which was received by the Court and ordered to the Recorded<\/span><\/p>\n<p><span style=\"font-family: times new roman,times,serif;font-size: 14pt\">It appearing to the Court here that Daniel <strong>MABERRY<\/strong> late of said County is dead and proof being made by Abraham<strong> MABERRY<\/strong> in open Court that the widow relinquishes her right to Administer and request Thomas T <strong>MABERRY<\/strong> to Administer upon said estate And pplication[sic] being made by Thomas T <strong>MABERRY<\/strong> to have letter Testamentary granted to him upon all and singular the goods &amp; Chattles rights and credits of the said deceased and he having entered into bond in the sum of one thousand dollars with Abram <strong>MABERRY<\/strong> his security which was approved of by the Court and ordered to be recorded whereupon the Court ordered letters to isue to him accordingly Whereupon the said Thos.
