{"id":2188,"date":"2014-08-17T16:56:06","date_gmt":"2014-08-17T21:56:06","guid":{"rendered":"https:\/\/tngenweb.org\/wayne2\/?p=2188"},"modified":"2014-08-17T17:10:44","modified_gmt":"2014-08-17T22:10:44","slug":"court-may-1849","status":"publish","type":"post","link":"https:\/\/tngenweb.org\/wayne\/court-may-1849\/","title":{"rendered":"Court May 1849"},"content":{"rendered":"<p><strong><span style=\"font-family: times new roman,times\">Monday, May 7th 1849<\/span><\/strong><br \/>\n<span style=\"font-family: times new roman,times\"> State of Tennessee) Be it remembered that a Corum County Court was began Wayne County) and held for the County of Wayne at the Court house in the town of Waynesboro on the <strong>7th day it being the first Monday in May in the Year of our Lord one thousand Eight hundred and forty nine<\/strong> the following Justice present and presiding To wit W <strong>CARTER<\/strong> Chairman<strong> MONTAGUE<\/strong> and D J <strong>JONES<\/strong> his associates.<\/span><\/p>\n<ul>\n<li><span style=\"font-family: times new roman,times\"> Upon application of Robert A <strong>HILL<\/strong> it is ordered by the Court that [all crossed out]<\/span><\/li>\n<\/ul>\n<p><span style=\"font-family: times new roman,times\"> It appearing to the satisfaction of the Court that Wille T<strong> RUDGERS<\/strong> a Student at law is a man of Good Moral character and is twenty one years of age It is ordered by the court that the Clerk of this Court issue to him a certificate accordingly<\/span><\/p>\n<ul>\n<li><span style=\"font-family: times new roman,times\">A settlement between Wm <strong>JONES<\/strong> Clerk of this Court and John T <strong>BURNS<\/strong> Guardian of Charles D C minor heir of R H <strong>MACK<\/strong> Dec&#8217;d was this day submitted to the Court which was received and ordered to be recorded<\/span><\/li>\n<\/ul>\n<p><span style=\"font-family: times new roman,times\">A Settlement between Wm.<strong> JONES<\/strong> Clerk of this Court and John S<strong> BURNS<\/strong> Guardian of James V <strong>MACK<\/strong> minor heir of R. H.<strong> MACK<\/strong> Dec&#8217;d was this day submitted to the Court which was confirmed by the Court and ordered to be recorded.<\/span><\/p>\n<ul>\n<li><span style=\"font-family: times new roman,times\">A Settlement between Wm. <strong>JONES<\/strong> Clerk of this Court and Joseph<strong> BREWER<\/strong> Guardian of Wasson minor heir of Mary <strong>ROBERTSON<\/strong> dec&#8217;d was this day submitted to the Court which was confirmed by the court and ordered to be recorded.<\/span><\/li>\n<\/ul>\n<ul>\n<li><span style=\"font-family: times new roman,times\">A settlement between Wm. <strong>JONES<\/strong> Clerk of this court and Wm<strong> HEFFINGTON<\/strong> Guardian of the minor heirs of Mary <strong>HENSLEY<\/strong>, dec&#8217;d was this day submitted to the Court which was confirmed and ordered to be recorded<\/span><\/li>\n<\/ul>\n<ul>\n<li><span style=\"font-family: times new roman,times\">A settlement between Wm.<strong> JONES<\/strong> Clerk of this Court and C B <strong>McCULLEY<\/strong> Administrator of the Estate of James <strong>DICKSON,<\/strong> dec&#8217;d was this day presented to the Court which was confirmed by the Court and ordered to be recorded<\/span><\/li>\n<\/ul>\n<ul>\n<li><span style=\"font-family: times new roman,times\">Came John <strong>McDOUGAL<\/strong> H <strong>ROBERTS<\/strong> &amp; T H<strong> MABRY<\/strong> who was appointed at a former term of this Court commissioners to lay off and set apart to olly<strong> BURGESS<\/strong> widow of Polly. <strong>BURGESS<\/strong> Dec&#8217;d one year support and reported to the court the amts. set apart to said widow<\/span><\/li>\n<\/ul>\n<p><strong> <span style=\"font-family: times new roman,times\">Monday May 7th 1849<\/span><\/strong><\/p>\n<ul>\n<li><span style=\"font-family: times new roman,times\"> A Settlement between Wm<strong>. JONES<\/strong> Clerk of this Court and T H <strong>MABRY<\/strong> Trustee of Wayne County [and the Clerk of the Court of the Common School &#8211; crossed out] was this day presented to Court which was rejected by the Court and said Trustee &amp; Clerk was given further time to make and presented said settlement [in the margin is written what appears to be the word &#8220;monies&#8221;]<\/span><\/li>\n<\/ul>\n<ul>\n<li><span style=\"font-family: times new roman,times\">Came William <strong>SINCLAIR<\/strong> Executor of the Estate of John<strong> SINCLAIR<\/strong> Dec&#8217;d and after having been duly sworn depose and say that he returned a certain note in the inventory of said Estate made by Andrew J<strong> COFFEE<\/strong> payable to William and John<strong> SINCLAIR<\/strong> Jointly and said note was claimed as the property of John<strong> SINCLAIR<\/strong> Dec&#8217;d where upon the Court ordered that said Executor &amp; Executrix? be released of half the amount of said note<\/span><\/li>\n<\/ul>\n<ul>\n<li><span style=\"font-family: times new roman,times\">Came John S<strong> BURNS<\/strong> who was at a former term of this Court appointed Guardian of the minor heirs of Robert H<strong> MACK<\/strong> deceased into Court &amp; entered into Bond of seven hundred and seventy two dollars with David <strong>VOORHEIS<\/strong> Nathan <strong>BIFFLE<\/strong> and S L<strong> BURNS<\/strong> his securities which was approved by the court and ordered to be recorded.<\/span><\/li>\n<\/ul>\n<ul>\n<li><span style=\"font-family: times new roman,times\">Came John G <strong>HILL<\/strong> Adminstrator of the Estate of Thomas <strong>BURGESS<\/strong> deceased and returned into Court an Inventory and account of sales which was ordered to be recorded<\/span><\/li>\n<\/ul>\n<ul>\n<li><span style=\"font-family: times new roman,times\">Came William <strong>SINCLAIR<\/strong> Executor of the Estate of John <strong>SINCLAIR<\/strong> Deceased and returned in to Court an acct of a second sale which was ordered to be recorded<\/span><\/li>\n<\/ul>\n<ul>\n<li><span style=\"font-family: times new roman,times\">Came James B <strong>DAVIS<\/strong> into Court who was on the 21st of April last Duly and Constitutionally Elected Constable [of erased] by the qualified voters of the Civil District No. 1 Wayne County for two years from the 4th day of March 1884 [sic] next there after and entered into the following bond to wit [there follows a long recital of the exact bond. The bondsmen were James B.<strong> DAVIS<\/strong>, David C.<strong> McADOO<\/strong> and Anderson <strong>DAVIS<\/strong> all of Wayne County, Tennessee. The bond was signed \/\/s\/\/ James B. <strong>DAVIS<\/strong>, D. C. <strong>McADOO<\/strong> and Anderson <strong>DAVIS<\/strong> by his mark Wm<strong>. JONES<\/strong> attest. This bond carries over to page 49, same date.]<\/span><\/li>\n<\/ul>\n<p><span style=\"font-family: times new roman,times\"> Where upon the said James B. <strong>DAVIS<\/strong> and each of said securities came into the court and acknowledged the execution of said bond which was approved of by the Court and ordered to be recorded.
