{"id":2167,"date":"2014-08-16T18:02:00","date_gmt":"2014-08-16T23:02:00","guid":{"rendered":"https:\/\/tngenweb.org\/wayne2\/?p=2167"},"modified":"2014-08-16T18:02:00","modified_gmt":"2014-08-16T23:02:00","slug":"court-november-1848","status":"publish","type":"post","link":"https:\/\/tngenweb.org\/wayne\/court-november-1848\/","title":{"rendered":"Court November 1848"},"content":{"rendered":"<ul>\n<li>State of Tennessee) Be it remembered that a Corum County Court was begun and held Wayne County) for the County of Wayne at the Court House in the Town of Waynesboro on the first Monday It being the <strong>6th day of November in the year of our Lord One Thousand Eight Hundred and forty eight.<\/strong> The following Justices of the Peace present and presiding to wit) Washington<strong> CARTER<\/strong>, Chairman, William M. <strong>LAFFERTY<\/strong> and Abraham<strong> MONTAGUE<\/strong><\/li>\n<\/ul>\n<ul>\n<li>Ordered by the Court that Allen <strong>FOX<\/strong> be appointed be appointed overseer of the road beginning at Isaac<strong> HORTON<\/strong>s lane and work to Daniel <strong>MOSIER<\/strong> [??] and that he have Wm. M. <strong>HORTON<\/strong>, Wm. J. <strong>HENRY<\/strong> , John <strong>HENRY<\/strong> &amp; Nathan <strong>HORTON<\/strong> to work on said road under his direction.<\/li>\n<\/ul>\n<ul>\n<li>William M. <strong>GRIMES<\/strong> who was appointed at a former Term of this Court Guardian of John T.S. <strong>GRIMES<\/strong> Reports to the Court on oath that nothing has come unto his hands as such Guardian.<\/li>\n<\/ul>\n<ul>\n<li>John <strong>McDOUGAL<\/strong> who was appointed at a former Term of this Court Guardian of William L., Joseph H. and Andrew W.<strong> KING<\/strong>, minor heirs of John D. <strong>KING<\/strong> deceased came into court and Entered into Bond in the sum of one hundred and fifty dollars with Solomon <strong>PHILLIPS<\/strong> as his security which was approved by the court and ordered to be recorded and the said<strong> McDOUGAL<\/strong> took the necessary oath for his qualification.<\/li>\n<\/ul>\n<ul>\n<li>A settlement between the Clerk of this Court and A. P. <strong>PHILIPS<\/strong> Guardian of the minor heirs of John D<strong>. KING<\/strong>, dec&#8217;d was this day presented and confirmed by the court and ordered to be recorded.<\/li>\n<\/ul>\n<ul>\n<li>The Last will and testament of Isaac <strong>HASSELL<\/strong> late of said county Deceased was this day Presented and duly proven in open court by the oaths of E. <strong>WARRINGTON<\/strong> and W. C.<strong> GAMBERL<\/strong> both subscribing witnesses thereto in which it appears the said <strong>HASSELL<\/strong> has appointed Jesse J. <strong>ROSS<\/strong> Executor to carry out said will and The said Jesse S.<strong> ROSS<\/strong> appeared in court and entered Into Bond the sum of Eight Thousand dollars with E. <strong>WARRINGTON<\/strong> and Jonathan<strong> MORRIS<\/strong> who was approved by the court as his securities and the said Jesse S.<strong> ROSS<\/strong> took the necessary oath for his qualification whereupon the court ordered that the following Letters Testamentary Isue to the said ROSS. State of Tennessee Wayne County Whereas it appears to the court here that Isaac.<\/li>\n<\/ul>\n<ul>\n<li><strong>HASSELL<\/strong> late of said county is dead and made his last will in writing in which he hath appointed Jesse S. <strong>ROSS<\/strong> Executor to the same which will has been exhibited in open court and proved as the law directs. it is therefore ordered that by the court that letters Testamentary of all and singular the goods and chattels rights and credits of the said Isaac <strong>HASSELL<\/strong> Deceased issue to the said Jesse S. <strong>ROSS<\/strong> having been qualified agreeable to law to enter into and upon all and singular the goods and chattels Rights and credits of the said Isaac <strong>HASSELL<\/strong> Deceased and the same unto your possessions take wheresoever the same may be found and a true and perfect Inventory thereof make and return to our Insuing County Court and all Just debts to the said Isaac <strong>HASSELL<\/strong> to pay and also well and truly to pay and deliver all the legacies contained and specified in the said Testament as the law charge you. Witness William<strong> JONES<\/strong>, clerk of our said Court at Office the<strong> 1st Monday in November 1848<\/strong>. William <strong>JONES<\/strong>, Clerk<\/li>\n<\/ul>\n<ul>\n<li>William <strong>SINCLEAR<\/strong> Jr. Ex&#8217;r and Resign <strong>SINCLEAR<\/strong> Ex&#8217;rx of the Last Will and testament of John <strong>SINCLIR<\/strong> Deceased this day returned into Court an Inventory and Account of sale which was received by the Court and ordered to be recorded.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>Ordered that Court adjourn until tomorrow morning 9 Oclock W. <strong>CARTER,<\/strong> Wm. M. J. <strong>JONES<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p><strong>Wednesday, Nov. 8th 1848<\/strong><br \/>\nCourt met according to adjournment present and presiding W. <strong>CARTER<\/strong>, Chairman, <strong>JONES &amp; ROBERTS<\/strong> his associates.<\/p>\n<ul>\n<li>It appearing to the court that Jacob A.<strong> KEATON<\/strong> late of said County is dead came Lucindy <strong>KEATON<\/strong> widow of the said Jacob A.<strong> KEATON<\/strong> &amp; requested that Wm. <strong>POLLARD<\/strong> administer and having made no last will and Testament in writing and application being made by William <strong>POLLARD<\/strong> to have letters of Administration granted him upon all and singular the goods &amp; Chattels rights &amp; Credits of the said Jacob A. KEATON where upon the said William <strong>POLLARD<\/strong> entered into bond of [crossed out] in the sum of three thousand dollars with D. J. <strong>JONES<\/strong> and Hiram <strong>ROBERTS<\/strong> his securities which was approved of by the court where upon the Court ordered that the following letters of administration isue to the said William <strong>POLLARD<\/strong>. State of Tennessee) County Court November Session.<\/li>\n<\/ul>\n<ul>\n<li>Wayne County ) Where as it appears to the court that Jacob A.<strong> KEATON<\/strong> is dead and having made no last will and testament in writing [crossed out] and application being made by William <strong>POLLARD<\/strong> to have letters of Administration granted him upon all and singular the goods and Chattels rights and Credits of the said deceased and having given bond and security as is by law in such cases required where upon the court ordered that he have letter accordingly. There are therefore to authorize you the said William <strong>POLLARD<\/strong> to enter into and upon all and singular the goods and Chattels rights and Credits of the said Jacob A. <strong>KEATON<\/strong> dec&#8217;d and the same in your possession take when and where to be found in this state and a true and perfect Inventory thereof take and return to our ensuing County court on oath and all the just debts of the intestate pay so far as the estate will amount or extend and the residue thereof deliver to those who have a right there to by law herein fail not. Witness William<strong> JONES<\/strong> Clerk of the County Court of the County of Wayne at office the first Wednesday after the <strong>first Monday in November 1848<\/strong>. Wm. <strong>JONES<\/strong>, Clk.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Where upon the said William <strong>POLLARD<\/strong> came into Court and took the necessary Oath for his qualification.<\/li>\n<\/ul>\n<ul>\n<li>Ordered by the Court that Wilson <strong>GRIMES<\/strong>, James <strong>ARNET<\/strong> and L. D. <strong>McMAHON<\/strong> be appointed commissioners to lay off and set apart to Lucinda <strong>KEATON<\/strong>, relect of Jacob A. <strong>KEATON<\/strong> dec&#8217;d who are free holders and unconnected with the parties either by affinity or consanguinity who being duly sworn for said purpose shall proceed and set apart to said Lucinda out of the estate of said Jacob an [this order is circled and incomplete, see below].<\/li>\n<\/ul>\n<ul>\n<li>Ordered by the Court that Wilson <strong>GRIME,<\/strong> L D. <strong>McMAHAN<\/strong> and James <strong>ARNET<\/strong>, [William <strong>BENHAM<\/strong> crossed out] free holders unconnected by the parties either by affinity or consanguinity be appoint commissioner who after having been duly sworn for said purpose shall proceed to allot and set apart to Lucinda<strong> KEATON<\/strong>, widow of Jacob A. <strong>KEATON<\/strong> dec&#8217;d so much of the provisions, stock, monies or other assets on hands belong to said estate as will be sufficient for the support and maintenance of said [said crossed out] Lucinda and her family for one year next after the decease of her said husband and report to the next term of this court.<\/li>\n<\/ul>\n<ul>\n<li>Ordered that Court adjourn till Court in Course W. <strong>CARTER<\/strong>, D.
