{"id":2163,"date":"2014-08-16T17:22:25","date_gmt":"2014-08-16T22:22:25","guid":{"rendered":"https:\/\/tngenweb.org\/wayne2\/?p=2163"},"modified":"2014-08-16T17:33:23","modified_gmt":"2014-08-16T22:33:23","slug":"court-october-1848","status":"publish","type":"post","link":"https:\/\/tngenweb.org\/wayne\/court-october-1848\/","title":{"rendered":"Court October 1848"},"content":{"rendered":"<p>State of Tennessee Wayne County<br \/>\nBe it remembered that a quarterly [corum crossed out] County Court was begun and held for the County of Wayne at the Court House in the Town of Waynesboro on the <strong>2nd day of October [September crossed out], being the first Monday.<\/strong> The Justices present, Washington <strong>CARTER<\/strong>, Chairman, <strong>LAFFERTY<\/strong>, <strong>JOB<\/strong>, <strong>HAYNES<\/strong>, <strong>WALKER<\/strong>, <strong>WILSON<\/strong>,<strong> KERWIN<\/strong>,<strong> YOUNG<\/strong>, <strong>GANT<\/strong>, <strong>WATKINS<\/strong>, <strong>CYPERT<\/strong>,<strong> GRAY<\/strong>, <strong>HOPSON<\/strong>, <strong>DIXON, LEE, SHEPARD &amp; PHILLIPS<\/strong>.<\/p>\n<p><strong>Monday Oct 2nd, 1848<\/strong><\/p>\n<ul>\n<li>This day came into Court, M.H. <strong>BURKS<\/strong>, who was choses [sic] appointed a guardian at a former term of this Court of the minor heirs of David<strong> MOSELY<\/strong> dec&#8217;d and took the necessary oath for this qualification.<\/li>\n<\/ul>\n<ul>\n<li>Ordered by the Court that John A.<strong> KENNEDY<\/strong> be appointed overseer of 1st class road in place of J.N.<strong> FOREHAND<\/strong> and have the following hands, to wit: H.H. <strong>HUNTER<\/strong>, S. <strong>SUTTON<\/strong>, John <strong>BENHAM<\/strong>, D. <strong>HELTON<\/strong>. Wm.[?] <strong>KEA<\/strong>, A.<strong> BUIE<\/strong>, J.N. <strong>SHIELDS<\/strong>, E.D.<strong> BURNS<\/strong>, J. <strong>WETHERS<\/strong>, Mark <strong>WHITE<\/strong>, T. <strong>MORGAN<\/strong>, Robt.. <strong>MACK<\/strong>, Constantine <strong>MACK<\/strong> and all hands within said bounds.<\/li>\n<\/ul>\n<ul>\n<li>On motion to appropriate to James <strong>ANDERSON<\/strong> and Thomas M. <strong>EAST<\/strong>, the amount of ten dollars each for their services a s commissioners to settle with the county Trustee of said County. A Majority being present the Ayes and nayes were as follows Ayes: W. <strong>CARTER<\/strong>, Chairman, <strong>LAFFERTY, JOBE<\/strong>??, <strong>WILSON<\/strong>, <strong>WALKER<\/strong>, <strong>GANT<\/strong>, <strong>WATKINS<\/strong>, <strong>HOPSON<\/strong>, <strong>GRAY, PHILLIPS<\/strong>, <strong>SHEPARD<\/strong> &amp; John A.<strong> MACK<\/strong> so said appropriation was mad [sic] to be paid out of any monies in the hands of the Trustee of Wayne County not otherwise appropriated.<\/li>\n<li>[The following undoubtably applies to the above appropriation; it is circled completely by a line] the ayes and nayes being called for stood as follows, to wit: Ayes W.<strong> CARTER<\/strong>, Chairman, <strong>LAFFERTY<\/strong>,<strong> JOB, WILSON , WALKER, GANT, WATKINS<\/strong>, <strong>HOPSON<\/strong>, Thomas <strong>GRAY, PHILLIPS, SHEPARD<\/strong> and<strong> LEE<\/strong> 12, Nayes: none. So said appropriation was made to be paid out of any monies in the hands of the Trustee, not otherwise appropriated.<\/li>\n<\/ul>\n<ul>\n<li>Ordered by the Court that Johnson <strong>BIFFLE<\/strong> be overseer of the road of 2nd class and that he work from Alexander<strong> GULLICK<\/strong> to where it intersects the old road near Moses <strong>RAY<\/strong>&#8216;S and have the following hands to work under his directions to wit: jacob <strong>STOW<\/strong>, Lafayette <strong>STOW<\/strong>, Wm. C. <strong>McBRIDE<\/strong>, Lewis <strong>HENSLEY<\/strong>, Nathan <strong>BIFFLE<\/strong>, Davis<strong> HAM<\/strong> ??, John G.<strong> HILL<\/strong> and Alexander <strong>HILL<\/strong>.<\/li>\n<\/ul>\n<ul>\n<li>Ordered by the Court that A.T. <strong>PHILLIPS<\/strong> be appointed overseer of the road of 2nd class in place of John <strong>LYNNVILL<\/strong> and that he have the hands in the same bounds to work under his directions.<\/li>\n<\/ul>\n<ul>\n<li>Ordered by the court that C.W. <strong>THOMPSON<\/strong> be appointed overseer of the road of 2nd class in the place of Seth <strong>DABBS<\/strong> and that he have the hands in the same bounds to work under his direction.<\/li>\n<\/ul>\n<ul>\n<li>Ordered by the Court that John<strong> BRATCHER<\/strong> be appointed overseer of the Road of 2nd Class in place of Grant S. <strong>SIMMONS<\/strong> and that he have the hands in the same bounds to work under his directions.<\/li>\n<\/ul>\n<p><strong>Monday, Oct 2nd, 1848<\/strong><\/p>\n<ul>\n<li>Ordered by the Court that Alfred <strong>SIMMONS<\/strong> be appointed overseer of the Road in the place of Thomas<strong> SHEPPARD<\/strong> and that he have [the hands in the same bounds to work under his directions, crossed out] Mason <strong>WHITTEN<\/strong> and all the hands from there to the County line to work under his direction.<\/li>\n<\/ul>\n<ul>\n<li>Upon application it is ordered by the court that Josiah <strong>DARBY<\/strong>, Josiah<strong> FOWLER<\/strong>, George<strong> WHITTEN<\/strong>, Caleb <strong>HUGHES<\/strong> and Berry<strong> FOWLER<\/strong> be appointed a Jury of View and mark out a road commencing at the Florence &amp; Wayneboro road on the land of Josiah <strong>DARBY<\/strong> and runn so as to intersect the Waynesboro &amp; Florence road on the Land of Jonathan<strong> WHITTEN<\/strong> and runn the nearest and best rout and that they report the same to the next term of this Court.<\/li>\n<\/ul>\n<ul>\n<li>Ordered by the Court that James C. <strong>QUEEN<\/strong> be appointed overseer of the road of 2nd class in place of Isham <strong>TURNBOUGH<\/strong> and that he have the hands in the same bounds to work under his direction.<\/li>\n<\/ul>\n<ul>\n<li>Ordered by the Court that James B. <strong>DAVIS<\/strong> be appointed overseer of the road of 2nd class in place of Bazel<strong> PRATER<\/strong> and that he have the hands in the same bounds to work under his direction.<\/li>\n<\/ul>\n<ul>\n<li>Ordered by the Court that William <strong>BAKER<\/strong> be apponted overseer of the road in place of William <strong>SINCLAIR<\/strong> and that he have the hands in the same bounds to work under his directions.<\/li>\n<\/ul>\n<ul>\n<li>Ordered by the Court that John W.<strong> MONTAGUE<\/strong> be appointed overseer of the road in the place of James <strong>SUTHERLAND<\/strong> and that he have the hands in the same bounds to work under his direction.<\/li>\n<\/ul>\n<ul>\n<li>Ordered by the court that John <strong>FRANKS<\/strong> be appointed overseer of the road of 2nd class and that he work from the Methodist Campground to the Hardin County line and that he have the following hands to wit: James M.<strong> BISHOP<\/strong>, Samuel J. <strong>POLLAC<\/strong>, Benjamin <strong>MARTIN<\/strong> and all the hands in his settlement to work under his direction.<\/li>\n<\/ul>\n<ul>\n<li>Ordered by the court that Joseph <strong>DIAL<\/strong> be appointed overseer of the road in the place of James <strong>LEE<\/strong> and that he have the hands in the same bounds to work under his direction.<\/li>\n<\/ul>\n<ul>\n<li>Ordered by the Court that Samuel C.<strong> MITCHELL<\/strong> be appointed overseer of the opening of the road through Ashland from the ford of Buffalo to where it intersects the old road at the end of the lane below John <strong>SCOTT<\/strong>s and that he have following hands to wit: all the hands that work under Isaac SURRATT and all that live in Ashland to work under his direction.<\/li>\n<\/ul>\n<p><strong> Monday, October 2nd, 1848<\/strong><\/p>\n<ul>\n<li>Came into Court John G. <strong>HILL<\/strong> and others who was appointed at a former term of this court to view and mark out a 2nd class road so as to change the old road so as to runn through Ashland and report a road found as directed in the order.<\/li>\n<\/ul>\n<ul>\n<li>On application it is ordered by the court that Joseph <strong>PITTS<\/strong>, Charles <strong>PARKER<\/strong>, Gideon<strong> SMITH<\/strong>, Joseph <strong>ROBNETT<\/strong> and William<strong> EADS<\/strong> by appointed a jury to view and mark out so as to change the road leading down green River so as to leave the old road at the Baptist Meeting house on John S. <strong>BURNS&#8217;<\/strong>s land and intersecting the same at or near Joseph <strong>PITTS<\/strong> and that they report at the next term of this court.<\/li>\n<\/ul>\n<ul>\n<li>Ordered by the court that John L. <strong>COPELAND<\/strong> by appointed overseer of the road in the place of William<strong> DABBS<\/strong> and that he have the hands in the same bounds to work under his direction.<\/li>\n<\/ul>\n<ul>\n<li>Came John M. <strong>SCOTT<\/strong> and others who was appointed at a former term of this court a jury to view and mark out a road from Harrison Forge running up Poags Creek across and down Factorys Fork and intersect the West Point road near the Bethlehem Meeting House and report a road found as directed in the order.<\/li>\n<li>Ordered by the Court that Jacob<strong> SCOTT<\/strong> be appointed overseer of the Clearing out a 2nd class road from Harrison Forge so as to intersect the West Point Road near the Bethlehem meeting House as marked out by the Jury.<\/li>\n<\/ul>\n<ul>\n<li>A settlement between William Jones, Clerk of this Court and James <strong>ARNETT<\/strong>, Administrator of the estate of Guston <strong>KINDLE<\/strong>, decd, was this day submitted to the court and confirmed and ordered to be recorded.<\/li>\n<\/ul>\n<ul>\n<li>A settlement between William <strong>JONES<\/strong>, Clerk of this Court and Geo. W. <strong>BARKER<\/strong>, Guardian of Elvira<strong> COCKBURN<\/strong>, was this day submitted to the court and confirmed by the Court and ordered to be recorded.<\/li>\n<\/ul>\n<ul>\n<li>Came into Court James <strong>ARNETT<\/strong> who has this day been Chosen and appointed by the Court, Guardian of Alfred P., Minor heir of Gustan <strong>KINDLE<\/strong>, decd, and entered into bond of Three hundred and fifty dollars with John <strong>McDOUGAL<\/strong> and Samuel L. <strong>BURNS<\/strong> his securities Which was approved of by the court and ordered to be recorded and where upon the said James ARNETT took the necessary oath for his qualification.<\/li>\n<\/ul>\n<p><strong>Waynesboro October 2nd 1848<\/strong><\/p>\n<ul>\n<li>Ordered by the Court that Reuben<strong> EAST<\/strong> and John <strong>CARTER<\/strong> be attached to the hands that is now attached to Jackson<strong> ARNOLD<\/strong> to work on the road under his direction.<\/li>\n<\/ul>\n<p>A majority of the Justices being present<\/p>\n<ul>\n<li>Upon application of William <strong>JONES<\/strong>, Clerk of this Court for an appropriation of Twenty eight dollars and fifty cents the amount by him expended for blank book for his office the Ayes and nayes were as follows Ayes W. <strong>CARTER<\/strong>, Chairman, <strong>YOUNG<\/strong>, <strong>HAYNES<\/strong>,<strong> LAFFERTY, WILSON, GANT, WATKINS, CYPERT<\/strong>, Thos. <strong>GRAY<\/strong>, <strong>SHEPARD<\/strong> &amp; DIXON, Ayes 11, Noes none so said appropriation was made to be paid out of any monies in the hands of the Trustee of said County not otherwise appropriated. Issued<\/li>\n<\/ul>\n<p>A majority of the Justices being present<\/p>\n<ul>\n<li>On motion be appropriate to Wm.<strong> JONES<\/strong>, Clerk of this Court the sum of eight dollars the amount by him expended for furniture for his office, the Ayes and Nayes were as follows Ayes W. <strong>CARTER, <\/strong>Chairman<strong>, YOUNG, HAYNES, LAFFERTY, WILSON, GANT, WATKINS, CYPERT<\/strong>, Thos.<strong> GRAY<\/strong>, <strong>SHEPARD<\/strong> and <strong>DIXON<\/strong> 11 naes none so said appropriation was made to be paid out of any monies in the hands of the Trustee of Wayne County not otherwise appropriated. Issued.<\/li>\n<\/ul>\n<ul>\n<li>On motion to appropriate to Wm<strong> JONES<\/strong>, Clerk of this Court the amount of Seventy five cents the amount by him expended for a bland Book for his office the Ayes and nayes were as follows Ayes W. <strong>CARTER<\/strong>, Chairman, <strong>YOUNG, HAYNES, LAFFERTY, WILSON, GANT, WATKINS, CYPERT<\/strong>, Thos. <strong>GRAY, SHEPARD<\/strong> and <strong>DISON<\/strong> 11 noes none so said appropriation was made to be paid out of any monies in the hands of the County Trustee not otherwise appropriated.<\/li>\n<\/ul>\n<ul>\n<li>On motion to appropriate to Nathan <strong>BIFFLE<\/strong>, Joseph<strong> EAST<\/strong> and Lemuel D. <strong>MACK<\/strong> the sum of twenty five dollars each for their services as Commissioners in superintending the building of the Court house the Ayes and nayes were as follows Ayes W. <strong>CARTER<\/strong>, Chairman<strong>, YOUNG, HAYNES, LAFFERTY, WILSON, KERWIN, GANT, WATKINS, CYPERT<\/strong>, Thos. <strong>GRAY, SHEPARD &amp; DIXON<\/strong> Ayes 12, noes none so said appropriation was made to be paid out of any monies in the hands of the County Trustee not otherwise appropriated.<\/li>\n<\/ul>\n<ul>\n<li>On motion to release John M. <strong>SCOTT<\/strong> from the payment of a balance on an Old School Bond and satisfactory proof being made to the court a majority of the Justices being present the Ayes and nayes being taken stand as follows Ayes [this entire entry crossed out].<\/li>\n<\/ul>\n<ul>\n<li>On motion to release John M. <strong>SCOTT<\/strong> from the payment of a balance on an old School Bond A majority of the Justices present and satisfactory proof being made to the Court that said Bond has once been paid It was therefore ordered by the Court that the said SCOTT be released from the payment thereof.<\/li>\n<\/ul>\n<ul>\n<li>On application of L.S. <strong>MACK<\/strong> to be released from the payment of a balance on an old School Bond and satisfactory proof being made to the Court that the bond had once been paid And a majority of the Justices being present it is ordered by the Court that the said <strong>MACK<\/strong> be released from the payment there off.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>Waynesboro Oct. 2nd 1848<\/strong><\/p>\n<ul>\n<li>A majority of the Justices present came Grief L. <strong>MITCHELL<\/strong> and others who was appointed at a former term of this court a jury to view and mark out a 2nd class road leaving the turn pike road at or near John<strong> RICKETS<\/strong> on Eagle Creek and runn a cross the dividing ridge between Eagle and Hardins Creek by <strong>MITCHELLS<\/strong> mill and intersect the Waynesboro and Savannah road at or near Wm. J. GRIMES and report a road found as directed [crossed] follows leaving the Turnpike road below E.B. <strong>THROGMARTINS<\/strong> and runn up the hollow between THROGMORTENS and H.<strong> HAGGARD<\/strong>S and cross the ridge and intersect the Waynesboro and Savannah road at Wm. J.<strong> GRIMES<\/strong> where upon [crossed out] which was recd by the court.<\/li>\n<\/ul>\n<ul>\n<li>Ordered by the Court that E. B. <strong>THROGOMORTEN<\/strong> be appointed overseer of the clearing out a 2nd class road as viewed and marked out by Grief L.<strong> MITCHELL<\/strong> and other from the turnpike on Eagle Creek across and intersect the Waynesboro and Savannah road at Wm. J. <strong>GRIMES<\/strong> and have the hands on Eagle Creek above Wm. M. <strong>GALLAGLEY<\/strong>S and all the hands on the branch of Hardins Creek of Hardins Creek that said road runns down to work under his direction.<\/li>\n<\/ul>\n<ul>\n<li>Ordered by the Court that Joshua T. <strong>BREWER<\/strong> be appointed overseer of the Shannonville road from the ford of the creek near the widow <strong>ROBINSON<\/strong>&#8216;S old place to the Perry County line and have the following hands to wit Thomas <strong>MONTAGUE<\/strong>, Josiah ROBINSON, Casper <strong>HEDRICK<\/strong>, Peter <strong>HEDRICK<\/strong>, John <strong>HEDRICK<\/strong>, David<strong> POWEL<\/strong>, John R. <strong>BREWER<\/strong> and Samuel <strong>BREWER<\/strong> to work under his directions.<\/li>\n<\/ul>\n<ul>\n<li>Ordered by the Court that Jesse S.<strong> ROSS<\/strong> and hands work under Wm. <strong>BATTLES<\/strong> as overseer of the road in place of working under Sandy <strong>GUNTER<\/strong>.<\/li>\n<\/ul>\n<ul>\n<li>A majority of the Justices being present Came F. W. <strong>LOYD<\/strong> &amp; others who was appointed a jury to view and mark out a 2nd class road and reported in Court a road found as follows leaving the Lawrenceburg Road at Baker <strong>CYPERTS<\/strong> and intersecting the same at John <strong>McGLAMERY<\/strong>&#8216;S as directed in said order which was reced by the court.<\/li>\n<\/ul>\n<ul>\n<li>Ordered by the Court that William<strong> SHIPMAN<\/strong> be appointed overseer of the clearing out a 2nd class road as viewed and marked out by F. W. <strong>LOYD<\/strong> and others leaving the Lawrenceburg road at Baker <strong>CYPERT<\/strong>&#8216;s and intersecting the same at John <strong>McGLAMERY<\/strong>&#8216;s and have all the hands on the waters of Indian Creek from Samuel <strong>COOPERS<\/strong> to the head to work under his direction.<\/li>\n<\/ul>\n<ul>\n<li>Came into Court Joacum <strong>DUGGAR<\/strong> who was appointed Guardian of the minor heirs of George <strong>CROSSNO<\/strong> decd at the last term of this court and report that there has nothing come into his hands as such Guardian.<\/li>\n<\/ul>\n<p><strong>Monday Oct 2nd 1848<\/strong><\/p>\n<ul>\n<li>The last will and testament of John<strong> SINCLEAR<\/strong> was this day exhibited in open Court and the execution of the same duly proven by the oaths Benjamine <strong>WATKINS<\/strong> and James C [crossed out] <strong>COPELAND<\/strong> both subscribing witnesses there to and said will was ordered to be recorded Where upon William<strong> SINCLEAR<\/strong> and Resign<strong> SINCLEAR<\/strong> Executor and Executrix to said will appeared in Court and entered into bond in the sum of twelve thousand dollars with John N. <strong>GILLIS<\/strong>, David <strong>COOK<\/strong> and James <strong>COPELAND<\/strong> who was appointed by the Court as his[crossed out] their securities Where upon the said William <strong>SINCLEAR<\/strong> and Resign <strong>SINCLEAR<\/strong> took the necessary oaths for their qualification thereupon Court ordered that the following letters Isue to the said William and Resign <strong>SINCLEAR<\/strong> to wit) State of Tennessee Wayne County Where as it appears to the Court here that John <strong>SINCLEAR<\/strong> late of said County is dead and made his last will in writing in which he hath appointed William <strong>SINCLEAR<\/strong> and Resign <strong>SINCLEAR<\/strong> his executor and Executrix to the same which said will has been exhibited in open court and proves as the law directs it is therefore ordered the Court that letters testamentary of all and singular the goods and chattles rights and credits of the said John <strong>SINCLEAR<\/strong> decd Isue to the said Wm. and Resign <strong>SINCLEAR<\/strong> having been qualified agreeable to law to enter into and upon all and singular the goods and chattles rights and credits of the said John <strong>SINCLEAR<\/strong> decd and the same into your possession take wheresoever the same may be found and a true and perfect inventory there of mark and return to our ensuing county Court and all Just debts of the said John<strong> SINCLEAR<\/strong> to pay and also and truly pay and deliver all the legacies contained and specified in the said testament as far as the said Goods and Chattels rights and credits will there unto extend and the law charge you. Witness Wm. <strong>JONES<\/strong>, Clerk of said Court office on the 1st Monday in Oct. 1848. Wm.<strong> JONES<\/strong> Clk.<\/li>\n<\/ul>\n<ul>\n<li>Ordered that Court adjourn tell tomorrow. W. <strong>CARTER<\/strong>, Solomon<strong> JOBE<\/strong>, John W. <strong>LEE<\/strong>.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>Tuesday Oct 3rd 1848<\/strong><\/p>\n<ul>\n<li>Court met according to adjournment. The Following Justices present &amp; presiding W. <strong>CARTER<\/strong>, Chairman,<strong> JOBE &amp; LEE<\/strong> his associates.<\/li>\n<\/ul>\n<ul>\n<li>It Appearing to the Court that Samuel<strong> HAMM<\/strong> late of said County is dead and having made no last will in wrighting and application being made by E. S. <strong>HAMM<\/strong> to have letters of Administration granted him upon all and singular the goods and chattles rights &amp; credits of the said Samuel<strong> HAMM<\/strong> where upon the said E.S. <strong>HAMM<\/strong> Entered into bond in the sum of Five hundred dollars with Wm. <strong>THORNTON<\/strong> and Thomas<strong> LAWSON<\/strong> his securities which was approved of by the court where upon the court ordered that the following letters of Administration Isue to the said E.S. <strong>HAMM<\/strong><\/li>\n<\/ul>\n<ul>\n<li>State of Tennessee Wayne County\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Came into Court Joseph <strong>PITTS<\/strong> and made oath that he has lost or mislaid an order as overseer of the road and that he had kept said order to be (unreadable). Whereupon it was ordered that the said <strong>PITTS<\/strong> be released as such overseer and that Andrew <strong>WILLIAMS<\/strong> be appointed in his place and that the said <strong>WILLIAMS<\/strong> have the hands in the same bounds to work under his direction.<\/li>\n<\/ul>\n<ul>\n<li>A settlement between Wm. <strong>JONES<\/strong>, Clerk of this Court &amp; John H. <strong>GRAVES<\/strong> and Joseph<strong> PITTS<\/strong>, Ad&#8217;m of the Estate of Wm. <strong>WILLIAMS<\/strong>, dec&#8217;d was this day submitted to the court which was rec&#8217;d by the court and ordered to be recorded.<\/li>\n<\/ul>\n<p><strong>Tuesday Oct 3rd 1848<\/strong><\/p>\n<ul>\n<li>Ordered by the Court that John<strong> HARDIN<\/strong> be appointed overseer of the road in the place of James T.
