Providence Baptist Church Petition (1833)

This petition was found by the late Earl Arnett of Columbus, Ohio in 1984 at the Tennessee State Archives and Library. He copies it and submitted a copy to the Wayne County Historical Society. Providence Baptist Church was the “mother church” of Memorial and Indian Creek Baptist Churches. Providence Baptist Church was active from before 1833 until 1909 when the church split; some of the members went to Memorial Church, while others started the Indian Creek Baptist Church at Three Churches. The petition and affixed names and signatures follow.


To the Honorable the State Legislature of the State of Tennessee

We your petitioners citizens of Wayne County and members of A Baptist Church caled [sic] providence Church on Indian Creek Would beg leave to have a piece of the vacant Land set apart for the purpose of Building a new meeting House and that a Law be passed allowing said Church to have Located any quantity of acres of land not Exceeding four and that sd Church be allowed to receive a grant from the State of Tennessee when it is entered and a plat and certificate Duly made out by the surveyor of the 7 Surveyors District and your Petitioners in duty bound will ever pray &c.

Petition To Free Slaves (1825)

with Will of John Akin appended


“To the honorable the General Assembly of the State of Tennessee, now in session. We your humble petitions, heirs and legal representatives of John Akin, Dec’d, beg leave to represent to your honorable body, that the said John Akin, de’d, in his will ordered, willed and appointed Lott, a negro man servant of the said Akins, to be set free after three years service after his death and Esanah, a negro Girl to be set at liberty and made free immediately after his death. We therefore being the heirs and being willing that the said intentions of the said will of said Akins, dec’d should be compled with, pray your honorable body to pass such a law as may be thought most effectual for the final liberation and setting free said negroes, Lott having served the time required in s’d will of the said Akins, etc. and your petitioners in duty bound, will and pray.

Will of John Akin

In the name of God, Amen. I, John Akin, of the County of Wayne and State of Tennessee, being weak of boddy but of sound mind; calling to mind my mortality, I do feel it my duty to distribute my property amongst my children. I do make and order this my last weill and testament.

First: I bequeath to my eldest sone Robert Akin one yong bay borse & fourth of the crop and third of the Waggons and farming utentials.

I bequeath to my beloved son William B. Akin one third of an hundred acres of land where I now dwell lying on the waters of Tennessee in Wayne County and the fourth part of the hoggs and the fourth of the crop.

I bequeath to my beloved son Samuel Akins the third of the land, fourth of the crop and third of the waggons and third of the farming utentials.

I bequeath to my beloved son John Akin the third of the land, fourth of the crop and third of the waggons and third of the farming utentials.

I bequeath to my beloved daughter Martha L. Grimes one brown made and towo cows, Luck and Pink, and calf one bed and furniture and half the casting and loom and fourth of the hoggs —

I bequeath to my beloved daughter Pemelia Smith, one bed and furniture, one cow and calf, one three year old steer and yong sorrel mare and fourth of the hoggs.

I bequeath to my beloved daughter Ellenor Biffel, the remainder of the cattle and clock and half of the casting and dresser furniture, a yong gray horse, apails[?] and chairs and fourth of the hoggs. The books to be distributed amongst all the heirs.

I have through the prudence of God, two Black people cast on my care, the eldest named Esanah, the other Lot. I hereby ordain and decree that Esanah shall be free at my decease, free from bondage and from all persons. Lot, a black boy, I do ordain and decree that he shall serve my son John Akin three years after my deseace, then he shall be free from bondage and all persons.

I hereby appoint my beloved sons, Robert and Samuel Akin to be my faithful executors of this my last will and testament. Given under my hand and seal this 19th day of July 1821. //s// John AKin {Seal}

Petition To Move County Seat (1822)

To the Honorable the Senate and house of Representatives of the State of Tennessee 

The petitions of the Subscribers, Citizens of the County of wayne Respectfully sheweth unto your Honorable body, that under the Existing Laws for the Organization of their County, they are placed in a Situation, disagreeable to them, and such as they Humbly Conceive calls loudly for Legislative interference. It is believed by your Petitions that the Prosperity of a County depends not Intirely upon a fertile Territory but also and in no small degree upon the Situation of its Seat of Justice. So as to Offer inducements to the settlement of men of Interprize and Capital, the County and its town mutually assist and support Each Other. Your Petitioners are Situated in a County including a Very large Proportion of sterile Land totally unfit for Cultivation, believe that they can Only hope to balance the Natural disadvantages of the County by selecting Some Spott within it as the site of a town and seat of Justice. which will Promp Individuals who possess the means and Inclination to carry on Extensive business of Various Kinds to settle themselves in the place. and thus Diffuse throughout the County the produce of their wealth, skill and industry. Restricted to a certain distance from the center, within those bounds to for their courthouse. It is utterly Impossible for them to injoy the Benefits Resulting from circumstances of the above description. Your Petitioners therefore humbly Pray your Honorably body that this county of wayne be arranged better to the advantage of the Citizens at large in the following manner (to wit) Beginning at a point on the South boundary line of Perry county so as to give bounds for a Constitutional County Including a certain Surplus lying between Hickman Lawrence Wayne & Perry and that so much be taken off from Each of the above named Counties as to Compleat a Constitutional County To … [the following line is illegible on copy] [second page] … of said County of wayne Extend Over Tennessee River So far as to Include a Certain bind which points South Eastwardly to the Site of Carrolsville and then to Run South and East &c for a Constitutional bounds and if there should be a Surplus let it be on the South boundary as being a large[?] bounds of Country intirely unfit for Cultivation. We further pray that the Premises considered the law Confining the Commissioners for wayne county to a certain distance from the Centre for the Location of their country Town may be Repealed. and that a law may be Passed authorizing the County Court or a Majority of them to Put in Nomination two or more Places (one on the River) that the Citizens of the County determine by a Majority of Votes amonge themselves which place shall be the [Place-marked through] the Seat of Justice or Such Other relief as to your honorable body may seem meet agreeable to the forgoing suggestions and your Petitioners as in duly bound shall Ever Pray &c. The Memoriel of Elkis Hand of Wayn County – To the Honorable the general Essembly of the State of Tennessee umbly sheweth that your Memorielest in the 1821 — Did make two small Entrys of land (to wit) of 20 acres Each founded on a Certificate Nov 1039 for 640 acres issued by the Commissionors of west Tennessee Dated the 2nd September 1817 in the 7th District in Harden County Range 11 and Section 2 on the head waters of Horse Creek, your Memorielest not being acquainted with the science of Mathematricks made a mistake in his locations and missed the land he Intended to take Run a contrary course in to the pine Hills where the land is not worth anything your Memorielest farther Represents that he has a large family of Children and is But in Moderate Circumstances, your Memorielest therefore prays that your Honorable Body would take his Case into consideration and grant him Relief By passing a Law to authorise him to withdraw or lift the two Entrys above Recited and Lay them on other vacant and unappropriated land and your Memorielest as in Duty Bound will Ever Pray &c. //s// Elkins Hand

Petition To Establish Wayne County (1819)

The following petition was submitted to the Tennessee State Legislature in 1819 by the people living in the area currently comprising Wayne and Hardin Counties. The original petition is on file at the Tennessee State Library and Archives and is available on microfilm roll number 6, Legislature Petitions. The petition is copied here in its entirety. There are 228 signatures appended to the petition. I have attempted to decipher them as best I could; some are completely unreadable and some have ink blots covering part of the signature. The copy of this petition has been placed in the Wayne County Room at the Wayne County Public Library for further research.


To the Honourable General Assembly of the State of Tennessee Gentlemen (Greetings) the undersigners, Inhabitants residing in part of the lands purchased of the Chickasaw Indians & within the bounds of your State beg leave to report to your honourable body that as citizens of [crossed out] we feel ourselves bound to Obey conform to & abide by the laws of our country & for the want of such, we labour under a considerable inconvenience. Therefore we pray the interference of your body to [this word may be realize or could also be release] the many greviences that may arise for the want of laws both civil and military by making a new county within the following bounds (viz) Beginning at the south west corner of Lawrence County, & to run with the west boundary of said County North Eighteen miles, then a due west course to Tennessee River, then up the meador of said river to the South boundary of the State of Tennessee, then with said boundary East to the beginning we beg leave to represent to your body that the above bounds contain land enough to make a consititional County, we will ever pray &c 1819.
