In the name of God Amen: I William Stuart of the State of Tennessee, Sumner County do solemnly declare and publish this my last Will and Testament and hereby revoke all others made to wit:

In the first place I bequeath the farm on which I now live with all the appurtenances to my wife Nancy Stuart to have and to hold the same during her natural life and after her decease to my son William Stuart Jun. (Junior) in fee simple forever.

Second, I bequeath my farming utensils to my son William.

Executed on this the eighteenth day of March in the year of our Lord one thousand eight hundred and thirty-three.

Know all men by these presents that we Susan Stewart, Agnes Stewart, Robert Stewart, James Stewart, James Phillips and Elizabeth Phillips his wife, Marcus B. Stewart and Nancy Stewart, the children and heirs of William Stewart Seign (Senior) deceased doth agree both for himself mutually and unanimously to make the following distribution of the herein after described perishable property of which the aforesaid William Stewart Seign (Senior) died, seised and possessed of, which property was not embraced by the Will of the aforesaid deceased, to wit; four head of horses, five head of cattle, fourteen head of sheep, thirty five head of hogs, and all the household and kitchen furniture do grant, deed and convey all the rights, title, claim and interest that we may have in or to the aforementioned described property to William Stewart Junior, son the said decedent and to his heirs forever and so by these presents severally and individually each for himself, ratify and confirm the same to him the said William Stewart Junior and his heirs from ourselves, our heirs and assigns forever. In testimony whereof we have each for himself written his name and affixed his seal this 10th day of December 1833.

Deed of agreement and sale from James Phillips, Marcus B. Stuart, Susan S. Stuart, Nancy S. Stuart, Agnes Stuart, Elizabeth Phillips, James Stuart and Robert Stuart to William Stuart Jr. for the personal property of William Stuart Senior, deed was proved in open court by the oath of John Parker and Minor B. Hanes, subscribing witnesses thereto and ordered to be certified for registration.
