In the name of God amen.
I WILLIAM KIRK of the Co. of Sumner and state of Tennessee being weak in body but of sound mind and memory do make and ordain this my last will and testament in manner and form following viz., Item, I give and bequeath unto my 3 single daughters, Lucy KIRK, Marget KIRK and Sarah KIRK, 45 ac. of land of the west end of the tract I now live on to them and their heirs or assigns forever and it is my further will and desire that no person shall be permitted to live on the said land without the free consent of all 3 of my daughters above named and if either of them shall think proper to part from her share of the land it shall be laid off on the east end in such a manner as not to include any of the houses or to take too great a proportion of the timered land. Item, I give and bequeath unto my 4 youngest sons Benjamin KIRK, Hezikiah KIRK, Robert KIRK and Isaac KIRK, 60 ac. of land on the east end of the tract I now live on to them and their heirs assigns forever. My further will and desire is that my 4 sons above named have a horse apiece that is to say Benjamin is called Ball, Hezikiah's is called Sir Charles, Robert's is called the Panterloon filly and my son is to have the first colt that my mare shall have; also I give and bequeath unto my above named sons, two beds and furniture to them and their heirs forever. Item, I give and bequeath unto my above named daughters all my household and kitchen furniture that is not already given away also all my plantation tools and all my stock of every kind except the horses that I have given unto my 4 sons above named together with all the provisions that is on the place and the crop of every kind and also one negro man named Manuel to them and their heirs forever. Item, My will and desire is that all my just debts be paid in the following manner to wit that each of my children above named shall pay an equal share in proportion to what they received but one seventh part of all the debts my estate shall be owing. Item, I constitute and appoint my son Benjamin KIRK, my whole and sole executor of this my last will and testament as witness my hand and seal this 22nd day of November 1830.

The last will and testament of WILLIAM KIRK dec'd was exhibited in ct. and duly proved by the oath of Robt. LAWRENCE one of the subscribing witnesses thereto and ordered to be recorded and therefore Benjamin KIRK the ex'or therein named appeared in ct. with Malaki BARNES and Robt. LAWRENCE his securities entered into and ack. their bond to the Gov. in the sum of $300 conditioned as the law directs and took the oath of ex'or prescribed by law. A copy test. A. H.
