Will of Joseph McElwrath (McLewrath)
In the name of God Amen: I, Joseph McLewrath Senr. of the County of Sumner and State of
Tennessee being in sound sence and disposing mind and memory do make and ordain this my last
will and testament in manner and form following (Viz) -------
Item: I lend to my beloved wife Elizabeth McLewrath the use of my plantation during her natural
life also the use of my three Negroes and their increase also my stock of Every Kind my
household and Kitchen furniture and plantation utensils after my just debts is paid should any
debts be owing at my deth my desire is that they should be made out of property what can be best
be spared.
Item: I give and bequeath unto my son William McLewrath the land and plantation whereon I
now live, to him and his heirs forever after the death of his mother also one horse to the value of
Seventy dollars, five head of cattle one bed of furniture also Five dollars Cash to him and his heirs
forever.
Item: I give and bequeath to my son John McLewrath Five dollars in cash to him and his heirs
forever.
Item: I give and bequeath unto my son Joseph McLewrath Five dollars in Cash to him and his
heirs forever.
Item: My Will and desire is that after the death of my wife that all my property not especially
given away shall be sold at publick Sale and the profits arising therefrom be equally divided
amongst my five daughters Nancy
Rogers, Gean Orr, Sally Barr, Mary Wilson, and Rebeckah Alexander and their heirs forever,
share and share alike.
I constitute and appoint my beloved Wife Elizabeth McLewrath and my son William McLewrath
my whole and Sole Executrix and Executor of this my last Will and Testament as Witness my
hand and seal.
This 23rd day of February 1816

State of Tennessee, Sumner County Court August Term 1825.
The last Will and Testament of Joseph McLewrath dec'd was Exhibited in Open Court for probate
and duly proved according to Law, by the Oath of Hudson Thompson a subscribing witness
thereto and ordered to be recorded, and thereupon William McLewrath one of the Executors
named in the said last will appeared in Court and agreed to take upon himself the Execution of
said Will and Testament and with John Cryer and Stephen Wilson his securities entered into and
acknowledged their bond to the Governor in the sum of Three Thousand dollars conditioned as
the law directs and took the oath of Executor prescribed by Law.
