I, M. A. Billings of the County of Sumner and State of Tennessee being of sound mind and disposing memory do make and publish this my last will and testament.

1st. As soon after my death as possible I desire all my funeral expenses and just debts paid by my Executor out of the first money that may come into his hands of my estate.

2nd. I will and bequeath to the Baptist Church in the town of Gallatin Tenn. of which I am now a member the sum of fifty dollars to be invested by the Treasurer of said Church in a silver Communion service, this clause my Executor will execute next after Clause first.

3rd. I will and bequeath to B. C. Barry my gold watch and chain, and my Executor will deliver the same to him at my death.

4th. All the residue of my property, after the payment of the legacies aforesaid I will and bequeath to David F. Barry.

5th. I nominate and appoint David F. Barry my Executor to this my will & he is by me excused from giving bond or filing an inventory of my estate.

In witness where of I do hereunto affix my name and Seal in the presence of my witnesses to this instrument.

The testatrix M. A. Billings signed the foregoing instrument as her will in our presence and we do hereunto assign our names as witnesses to the same at her request in her presence and the presence of each other.

Sumner County Court July Term July 13th 1896.
A paper writing purporting to be the last Will and Testament of Mrs. M. A. Billings, dec'd was this day produced in open Court for probate and duly proven by the oath of Mrs. M. C. House formerly Mrs. M. C. Elkin one of the witnesses, Viz M. S. Elkin being dead, comes J. J. Turner and J. K. Miller and being sworn state that they were well acquainted with the hand writing of M. S. Elkin & the same was well known among his neighbors and business associates, and that the [pg 122] signature of M. S. Elkin thereto is genuine, thereupon said will was ordered filed and recorded as said last will and testament of Mrs. M. A. Billings dec'd.
