Hendersonville Tenn. Oct 6th 1875.
I John L. Doxey being in sound mind and of disposing memory on this the sixth day of October in
the year of our Lord one thousand eight hundred and seventy five, considing(sic) the uncertainty
of life and the certainty of death. Do hereby make this my last will and Testament revoking all
wills heretofore made.
First; I desire that my body be decently buried.
Secondly; That out of my Estate all my just debts be paid.
Thirdly; I give and bequeath to my brother William W. Doxey my farm adjoining the Town of
Hendersonville in Sumner Co., Tenn. containing thirty five acres more or less and bounded on the
North by the lands of Mrs. Mary Weisiger, on the South by the L & N R Road, on the W by the
lands of Hugh Joyner, & on the East by the lands of the L & N R Road Company, together with
all the appurtenances thereunto belonging or in any wise appertaining. He my said brother taking
and receiving the same subject to the charge of one thousand dollars which sd?? one thousand
dollars is to be applied and approfuated? to the education of his son John L. Doxey, This is my
bequeath to my brother William. The residue of my Estate of every description, I desire to be
divided equally between my two brothers Beverly M. Doxey and Samuel Roseline Doxey. In
order that the same may be carried out, I hereby constitute and appoint my brother William W.
Doxey my Executor and in case of his demise then my brother Beverly Doxey and in case of his
demise then my brother Samuel Roseline Doxey and I hereby direct no matter which of the three
may serve that neither of them shall be required to give security for the performance of the trust.
In testimony whereof I have hereunto set my hand and affixed my seal this day & date above
mentioned.

Sumner County Court July Term 1881
The Will of J. L. Doxey having been presented in Court heretofore to wit on the 4th day of July
1881 & the envelope containing said will being opened in open Court according to the directions
contained on said envelope, and it appearing the will that Guslford C. Talbot, J. M. Shute, & T.
E. Dyson were the subscribing witnesses thereto, & thereupon the formal witnesses might be
produced to prove the same, and on the 9th day of July 1881 said will was ordered for proof as
the last will & Testament of John L. Doxey & J. M. Shute one of the subscribing witnesses
thereto, was duly sworn & deposed that he attested the paper produced as the last Will and
Testament of said John L. Doxey as his last will & testament, at the request of said John L. Doxey
& in his presence, and it is therefore ordered & adjudged that the said paper writing produced as
aforesaid is the last will & testament of said John L. Doxey & that the same be probated & spread
upon the records of this Court as such, and provided by law. And it further appearing that by the
terms of said will &c William W. Doxey is nominated & constituted executor of the said will of
John L. Doxey & that in the event of his demise Beverly M. Doxey was nominated & appointed
to serve as executor & carry out the provisions of said will and in the event of his demise that
Samuel Roseline Doxey was appointed & nominated to serve as executor and that the will
provides that whatever one of said parties served as said? executor, no bond or security was to be
required, and it further appearing that Dr Wm. W. Doxey appeared in open Court and declined to
accept the trust as executor (pg 219) as provided in said Will, and renounces the same, and
request that Samuel Roseline Coxey be appointed and qualified as such under the terms of the will
and it further appearing from the evidence under oath of Dr Wm. W. Doxey & Samuel Roseline
Doxey, that Beverly M. Doxey declines to accept the trust of executor and to serve as such and
that he desires his brother Samuel Roseline Doxey to accept the trust and to be qualified as such
and the said Samuel R. Doxey appearing in open Court and offering to accept the trust of
Executor &c under said will. And appearing to the Court in view of the presnises? that said
Samuel R. Doxey is a proper person to appoint and qualify as said executor. It is ordered and
decreed by the Court that said Samuel R. Doxey be appointed and qualified as the executor of the
last will and testament of John L. Doxey dec'd, and letters testamenterary will be issued to him
without requiring him to give bond & security as executor, the terms of the will expressly &
dispensing with bond and directing that he act without bond, and there upon the said Samuel R.
Doxey appearing in open Court and was qualified as executor & took the oath prescribed by Law.
