Note: Wm. Edgar W. Perdue was my 2xgrgrandfather. He died intestate August 1866 in Sumner County. The following information comes from the settlement of his estate. I found  unreadable pages while others only backside of a document. I did not try to include these. Some pages are not in order and others obviously  missing beginnings and endings.

Harriet L. Perdue et als

Be it remembered that this cause came on for hearing on the 29 April 1867 before (???) judge of the county court. Upon the report of special commissioner which is in words and figures as follows viz:

Which being unexcepted to is in all thing and confirmed - it is therefore ordered and decreed by the court that all the interest and title of the defendents Harriet L., Mary and Wm Henry Perdue and the infant son of Harriet L. Perdue in and to one acres of land in Sumner County Dist No. 16 adjoining the lands of Adaline Chitwood and being the same one acre of land which was conveyed by Lee Perdue to W. E. W. Perdue be divested out of them and be vested in George Chitwood but a lien is retained until all of the purchase money is paid. And it is ordered and decreed that all the interest and titles of said defendants in and to a tract of land in Sumner County Dist No 17 adjoining the lands of D. W. Barber and containing 39 acres it being the land conveyed by D. W. Barber to W. E. W. Perdue be divest out of them and vested in Harriet L. Perdue a lien being retained until all the purchase money is paid. And is ordered and decreed by the court that the interest and title of said defendants in the

remainder estate to the 16 acres heretofore assigned to the widow Harriet L. Perdue as her dower be divested out of them and be vested in Harriet L. Perdue a lien is retained upon said land until all the purchase money is paid. It is ordered and decreed by the court that the clerk of this court will pay the cost of this cause and a fee of $15.00 (G. F. and B. F. Allen solicitors in this case) out of the $30 in cash paid into his office and if there be any remainder he is ordered to pay the same to the administrator. It is ordered by the court that the adm proceed to select the notes for the land sold by him as commissioner out of what he is ordered to pay the debts against the estate of W. E. W. Perdue and the remainder if any to those entitled by law to the same.

March 1867, next before the Judge of the County Court Sumner County at the Court House, Gallatin to answer the Bill and Petition of W. B. Cochran admin of W. E. W. Perdue dec'd filed in said Court  against (????) and have you then and there this writ.

vs.

Harriet L. Perdue, Mary & Wm Henry Perdue and infant son of W. E. W. Perdue and Harriet L. Perdue not named. all citizens of Sumner County.

Complainant would respectfully show that W. E. W. Perdue died in Sumner County about August 1866 and complainant qualified in August 1866 as his administrator, said Perdue was possesed of a very small estate the sales of his personal property amounted to 93.00(?) in addition to this there was a note for $25.00 owed D. W. Barber this is the entire personal estate that came into the hands of the administrator. Said Perdue died seized and possessed of two tracts of land in Sumner County Dist No 16 & 17. The one in No. 16 is one acre of land given to W. E. W. Perdue by his father Lee Perdue and joins the lands now owned by Mrs. Adaline Chitwood - the land in Dist 17 consist of Twenty nine acres adjoining the lands of D. W. Barber who conveyed the same to said Perdue and adjoining the said 29 acres is the widows dower consisting of 16 acres - this land is all poor and of little value. Complainant would show that by the decree of this court certain articles were allowed to the widow for years support which had to be furnished and were worth some $175 or $180 - Said

Perdue was also in debt to Dr. Lane in about $22.00 and Dr. J. Head in about (unreadable) and Dr. Millikin in about (unreadable) and to Lee Perdue in about $40.00 and to Height and Co. in about $4.50 and there maybe other debts which are not now known. Complainant has suggested the insolvency of the estate. The personal estate has already been exhausted in August and was not enough to furnish the widow with the articles given by the Court for her years support and there is nothing with which to pay the debts of the estate except the land. Complaintant would show that W. E. W. Perdue left a widow Harriet L. Perdue who has had dower assigned her out of said land and he left three children, viz: Mary - William Henry and an infant son, not yet named - these children are all minors without regular guardian. These premises considered Complainant prays that process issue and that said widow and children be made parties defendants to this bill - let guardian ad liten be appointed for the minors. Let a decree be rendered for the sale of the lands mentioned in this bill and the remainder interest in the widow's dower and the proceeds applied to the payment of W. E. W. Perdue debts and give such other & general relief as the nature of this cause may reward.

In accordance to a decree of the County Court, I proceeded to sell land belonging to the estate W. E. W. Perdue deceased  - one parcel land contained by estimation 45 acres to the widow with her dower for seventy five dollars for which I taken a note on Levina Perdue for forty two dollars and 50 cents the balance I got in greenbacks sold private in District No. 17 then public I sold one acre lying in District No. 16 and in the County of Sumner and state of Tennessee to one Mr. Chitwood for Sixty Seven Dollars due in six months from date improvements included.

In this cause it appearing that Mary Perdue, Wm Henry Perdue and an infant son not named of W. E. W. and H. L. Perdue are minors without regular guardian and have been served with (???) this case it is ordered by the court C. B. Guild be appointed guardian ad litern for said minors he appearing in open court and accepting said appointment and it is also appearing that Harried L. Perdue has failed to plead answer or decree to Complainant's bill within the time required by law it is ordered by the court that complainant be taken for confessed against said Harriet L. Perdue and set for hearing ex-parte as to her at the present term of the court.

The answer of G. B. Guild guardian ad litern of the minors Mary, William Henry Perdue and infant son of W. E. W. and Harriet L. Perdue not yet named to the Bill of W. B. Cochran Admin'd. Respondent for answer says that he knew but little of facts stated in the Bill but believes the same to held has truthfully set forth and that the land should be sold for the purposes stated. He herein refers all questions (???) the rights of the minors to you herein asking strict proof (??) the questions submitted  (??) such necessary orders & decrees and will fully protect them in all rights.

...which articles form the report of the admin cost $175. - this showing that the personal estate was not enough to pay for the widow's years support leaving $58 dollars due to the admin on the same there are the following debts on file in this office viz: Account to Height & Co. for $4.50 Rec'd an account of Dr. J. L. Lain for $22.50 there are other debts reportedly by the admin not yet filed. I therefore report that it is necessary to sell the land mentioned in the pleadings for payment of the debts of the estate.

Be it remembered that this cause came in for hearing on this 29 April 1867  upon the pleadings and the report of H. Clerk which is as follows:

which being unexcepted to is in all things confirmed and it appearing that the person estate of W. E. W. Perdue had been exhausted in paying the widows year support and that there were still debts against said estate unpaid and that it is necessary to sell the real estate of W. E. W. Perdue for the payment of debts and it appearing that said land sell the same without compensation - it is therefore ordered and decreed by the court that W. B. Cochran be appointed special commissioner to sell the lands of the late W. E. W. Perdue and the remainder in the dower  Said commissioners ordered to sell for at least $30 cash ordered to pay the costs of this cause and (???) and upon such other terms  as he may think best either public or privately he is ordered to report his sale to this court.

This cause coming to be heard before T. C. Douglas judge on this 29 April 1867 up the bill = answer of the guardian ad litern for confesses as to H. L. Perdue. It is ordered by the court that the cause be referred to the Clerk of this Court to take an account of the indebtedness of the estate of W. E. W. Perdue and the amount of personal property to show whether it is necessary to sell the land mentioned in the bill for the payment of debts - the clerk will report to the present term of this court practicable.

In this case I report that the action of the adm shows that the sale of the personal property of W. E. W. Perdue amounted to $92 and a note for $25 on D. W. Barber. Making whole personal estate $117. The evidence of D. W. Barber on J. P. shows this to be the entire estate - By the return of the commissioners appointed by this court which is of record - certain articles were set apart for the support of the widow one year.
