Know all men by these presents That whereas W. Bruce died in Sumner County, Tennessee on
or about July 21, 1883, seized and possessed of a tract of land of about 360 acres in the Sixth
Civil district of said Sumner County, Tennessee, made up of several tracts of land bounded as
follows: East by the lands of Widow Austin Wells and John Wells: North by the lands of James
May deceased. West by the lands of Hampton Raymer and South by the lands of J. M. Bruce,
and whereas a petition was filed in the County Court of said Sumner County on or about Jany
22,1885 on the case of J. M. Bruce et al vs Matilda Bruce et al to have the lands of said J. W.
Bruce partitioned among the heirs at law, and whereas it was found that said property could not
be partitioned in kind among the heirs of said J. W. Bruce as appears by an agreement among
his heirs and filed in said case on or about Dec 23, 1887, which partition was at that time signed
and acknowledged by the heirs of said J. W. Bruce, and whereas by the terms of said agreement J.
M. Bruce and W. D. Bruce purchased all the interests of the other heirs in said tract of land and
have paid to said heirs the full value of each share and whereas said J. M. Bruce and W. D. Bruce
have never by any formal transfer partitioned said tract of land between themselves but by
mutual agreement between themselves divided and went into possession of said land the said W.
D. Bruce taking the easterly part of said tract and J. M. Bruce the westerly part on 174 acres of
said tract, and whereas said W. D. Bruce died intestate, unmarried and without issue, about
fifteen years ago and whereas said W. D. Bruce by deed of record in Book 52, Page 146 of the
Registers office for said Sumner County, Tennessee, sold and conveyed to Morey Bruce the
westerly part of the tract of 360 acres more or less, owned by J. W. Bruce, which tract of land is
described as follows:
Situated and being in the Sixth Civil Dist. of said Sumner County, Tenn. containing 174
acres more or less and being that part of the land of J. W. Bruce, deceased, allotted to J. M.
Bruce
and beginning at a stake Alex Bruces corner; thence west 84 poles to a stake in a field; thence
South 29 poles to a stake; thence west 18 poles to the top of the ridge; thence South 2 (degrees)
E. 53 poles to a stake, Andersons corner; Thence East 180 poles to a hickory; thence South 42
poles to a rock; thence East 66 poles to a rock near two oaks, Raymers corner; thence North 52
poles to a stake in the Edge of a field; thence west 92 poles to two hickories; thence North 62
poles to a stake; thence N. 3 (degrees) W. 24 poles to a stake; thence with the ridge N. 67 deg.
W.
28 poles an oak; N. 28 (degrees) W. 31 poles to an oak, thence S. 83 (degrees) W. 24-1/2 poles
to
a stake; thence N. 32 (degrees) W. 18 poles to a hickory and thence N. 19 (degrees) E. 20 poles
to
the beginning, and Whereas by Deed of record in Book No. 57 page 452 R. O. S. C., Morey
Bruce and wife Lizzie Bruce conveyed said tract of land with other property to one M. M. Lewis,
and whereas M. M. Lewis and wife conveyed said tract of land by deed of record in Book 61,
page 29 R. O. S. C., to H. H. Ward Trustee for C. W. Waller and Whereas some question has
been raised as to the title of said tract of land of 174 acres by reason of irregulation in the
proceedings in the Case of J. M. Bruce et al against Matilda Bruce et al in the County Court of
Sumner County, Tennessee, and by reason of the fact that J. M. and W. D. Bruce never made
deeds of partition onto the other of the lands of J. W. Bruce, deceased and for the further reason
that by some in advertance or oversight J. A. Bruce one of the heirs of the heirs of J. M. Bruce,
deceased, did not acknowledge the agreement signed by all of the heirs of J. W. Bruce and filed in
said case relating to the partition of said J. W. Bruces land, and whereas the land of which W. D.
Bruce died seized and possessed have been divided among his heirs, and whereas we desire to
remove any cloud upon the title of said above described tract of land of 174 acres, more or less,
now owned by H. H. Ward, Trustee for C. W. Waller, Now therefore in consideration of the
premises and one Dollar in cash to us paid, the receipt of which is hereby acknowledged, We,
Mary W. Lassiter, a widow, R. Adaline Bruce, Mrs. M. J. Lewis and husband Pete Lewis, Mrs.
Florence Hughes and husband H. H. Hughes, J. A. Bruce, Jr., J. W. Bruce, W. B. Bruce and J. H.
Bruce children of J. A. Bruce Sr. deceased, all being of lawful age and being sole surviving heirs
of
J. W. Bruce, W. D. Bruce, and J. A. Bruce, Sr., have bargained and sold and do by these
presents hereby remise, relinquish, quit claim and convey unto said H. H. Ward, Trustee, and his
assigns, all our right, title, claim and interest in and to the above described tract or parcel of land
of 174 acres more or less in said Sixth Dist. of Sumner County, Tennessee, and bind ourselves our
heirs and representatives by these presents.
In testimony whereof we have hereunto subscribed our names, this the 9th day of July,1909.

personally acquainted, and who acknowledged that they executed the within quit claim deed
instrument for the purposes therein contained. And M. J. Lewis, Kate Bruce & Florence Hughes,
wives of the said P. Lewis, A. F. Bruce & H. H. Hughes respectively, having personally appeared
before me privately and apart from their husbands, the said M. J. Lewis, Kate Bruce, and Florence
Hughes acknowledged the execution of said quit claim to have been done by her freely,
voluntarily, and understandingly, without compulsion or constraint from their said husbands and
