Probate of John McCann estate
To The Worshipful County Court of Sumner County } now Sitting

Your petitioner John J. Franklin Adm of John McCann Dec'd would began to represent unto your worship that his in testate departed this life on the 5th of October 1831 leaving as his legal representative and his nine children five of whom are lawful age the other four are minors - Your petitioner would further show unto your worship that the whole amount of said intestate estate will not be more than Eight hundred dollars including three Negroes (to Wit) A woman aged 38 years and two children one two years the other 9 months old said Negroes are worth 350 or 400 $ equal to half the value of the estate Your worships will therefore see it will be unpopular for your petitioner to make distribution of Said estate amongst the minors unless Your Worships will grant him an order authorizing him to sell said Negroes it would be unpopular to separate the Children from their Mother you the premises consider your petitioner pray your worships to grant him an order to sell said Negroes to the highest bidder at public sale on a _? of nine or twelve months it is the wish of them that said Negroes be sold and in duty your petitioner will ever pray &e.

FINAL JUDGEMENT of ESTATE PROBATE for JOHN McCANN, deceased ~~~~ 1834

Pursuant to an order of Court, the honorably James Kirby appointing commissioner to settle with John J. Franklin adm" of John McCann, deceased. We herein name as hereinafter Substitute Adm" for such time as required for assigns and all others from the estate charge all as appointed. The clerks certificate of the amount of sales of the sum of $951.87 «
The Adm" produced evidence thereof that
he is entitled to credit of $560.31
for clerks services- 42.00
making the sum of - 602.31
what takes from the above leaves sum
in the hand of the amount of $349.56 «
