I, Logan D. Key, being sick but in possession of a sound mind and disparing memory make and publish this my last will and testament hereby revoking all other wills by me at any time made.
First I desire that all my just debts and Funeral Expenses by paid as soon after my death as possible by my Executor whom I shall here after appoint out of any money that I may die and possessed of or may first come into his hands.
Secondly, I will and bequeath all of my lands including a tract which I have already given to my son Thomas Key to my six sons jointly riz(?), Thomas, Anthony, William, George, James and Henry Key provided however that said lands shall be valued at cash valuation to my said sons by my friends, Armistead Moore, B. T. Lipscomb and James Haynie whom I hereby appoint for that purpose and if all or either of them fail to act I request my Executor to fill such vacancy with suitable persons and provided also that my son Thomas Key shall have the privilege of taking his interest to himself or so much thereof as will cover the tracts that I have already given him and if said tract be more than his estable share he shall have no more of my Estate until all my children are made equal with him.
Thirdly, It is my desire that the above named commissioners valued my Negroes at cash valuation and that my daughters, viz, Saley Perry & Malvina Key have enough of said negroes to make them equal with my sons to whom I have given my lands and that my Grand children (the children of Mary Farley), jointly have an equal share of said Negroes with my other two daughters.
Fourthly, I desire that all the balance of my property be sold and that the proceeds be equally divided amongst all of my children provided that if in the valuation and distribution of the negroes there is Equality. All of children shall be made equal before the proceeds of said sale be divided and that Mary Farleys children in all cases have a childs with the balance of my children.
Fifthly and lastly, I appoint my son George Key my Executor to execute this my last will and that he be awarded one dollar per day for every Day he may be employed in settling my Estate this the 29th Day of October 1858.
