Will of Henry Beasley 1858

In the
name of God, Amen, I Henry Beasley being
of sound mind and disposing memory do this day make this my last will and
testament hereby revoking all others made by me heretofore.
1st It is
my will that all my just debts and funeral expenses be paid. After all of my
household and kitchen furniture, stock of every description, Corn and fodder,
farming utensils, ___ all of which my Executor shall sell upon a credit of
Twelve months. The purchaser giving
bond with good security and an alean on the land until the purchase money is
paid. The proceeds of which together
with my negroes and money shall be divided among my several heirs as follows
viz.
2nd. To
my grandson John P. Beasly (son of my son Shelby Beasley dec) i give my negro
boy Enoch and one Thousand dollars in money, being all I intend he shall have
of my estate as I think it is even more than my other grandchilden gets.
3rd I
give to my daughter Arriminta Duke the following negroes viz. my negro boy
Hall, Lucinda and Penelope and their increase.
4th I
give to my son Henry S. Beasley and his heirs the following negroes viz.
Stephen, Sophia, Andrew, and Mississippi valued at two hundred dollars more
than I intend he shall in negroes, which amount will be retained out of his and
in money.
5th I
give to my daughter Mary A. Beasley the following negroes viz. Polly,
Nathaniel, and Molsey and one hundred dollars to be paid to her to equalize her
negroes together with her increase.
6th I
give to my son Isham D. Beasley the following negroes viz. Catherine and
Benjamin and Archibald and their increase.
7th I
give to my daughter Adeline D. Kiterell the following negroes viz. Lewis, his
wife Burlina, Ned and Thomas.
8th I
give to my daughter Eveline H. Allen the following negroes viz. Warner, his
wife Elizabeth, Joshua and Rutha and their increase and one hundred dollars in
money.
9th I
give to my daughter Sally P. Bond the following negroes viz. Burd, Sally,
March, May and Lacy and their increase, one hundred dollars to be released as
her portion of money.
10th It
is my will that all of my money on hand and all that shall arise from the
sale __ stock and all other things that
may come into the hands of my Executors be equally divided among my several
heirs as before mentioned viz, Arriminta Duke, Suko in truct for Henry Beasley,
Mary A. Beasley, Isham D. Beasley, Adeline D. Kitrell, Evaline H. Allen and
Sally P. Bond also, also, I have still on hand a yellow negro girl named Eliza
which if I do not sell her before my
death, It is my request that she be sold and the amount be divided as before
mentioned. And I desire that some one
of my children purchase her at a fair price.
11th I
hereby nominate and appoint my beloved brother Gabriel D. Beasley and my Son in
Law Richard S. Duke as Executors of this my last will and testament without
giving any bond and security as I have full confidence in their honesty and
integrity in executing the same. This
2nd day of January Eighteen Hundred and Fifty Eight.

Beasley being this day of sound mind and disposing memory and having heretofore
made my last will and testament viz. In January last and having neglected to
state in that will what I wished to be done with the tract of land that I have
on Peyton's Creek containing about ninety acres, it being the tract whereon my
son Henry L. Beasley now lives, it is therefore my wish that this be made a
codicil to my said will and that said tract of land to be given to Richard S.
Duke as Trustee in Trust for the use and benefit of Henry L. Beasley and heirs
with the privilege of selling said land and purchasing another tract if that be
thought best and to the interest of said Henry L.Beasley and heirs by the said
Trustee Richard S. Duke. This 4th April
